Berdasarkan prinsip-prinsip di atas, saya telah menjadualkan item-item yang diplidkan di dalam penyata tuntutan eseperti berikut. Ringkasan sebagaimana pernyataan tuntutan dan hujahan Plaintif Defendan a. Kehilangan tanggungan di bawah seksyen 7 Akta Undang-Undang Sivil, 1956 RM400.00 Tidak dihujahkan secara spesifik Hujahan Plaintif – Melalui perenggan 10 pernyataan tuntutan, ianya telah diplidkan “Plaintif-Plaintif menuntut di bawah Seksyen 7 dan 8 Akta Undang-Undang Sivil 1956. Tetapi, plaintif tidak memplidkan butiran-butiran tuntutan tersebut. Melalui hujahan yang difailkan- 1 S.Santhana Dass, Personal Injury Claims, Alpha Sigma Sdn Bhd (2000), page 10 S/N wvJswtBHq0eHYcPpp7F9hw Hujahan Defendan S/N wvJswtBHq0eHYcPpp7F9hw Keputusan Mahkamah Mahkamah Agong dalam kes Chan Chin Ming v Lim Yok Eng [1994] 3 MLJ 233 telah menekankan, inter alia, (a) loss of support is for all practical purposes translated into financial loss sustained by a dependant dan (b) it should not be restricted to food or sustenance for the plaintiff but should equate with the pecuniary benefit the plaintiff received from her son so as to enable her to lead a certain life-style. Dalam kes Mahkamah Tinggi Soh Kim Chee (sebagai bapa yang sah dan penanggungan kepada Soh Yong Hau simati, untuk diri sendiri) & Anor v Nazri bin Yahya & Anor [2021] MLJU 2147 Evrol Mariette Peters, Pesuruhjaya Kehakiman (pada ketika itu) telah menyatakan seperti berikut- [33] There are several aspects to section 7(3) of the Civil Law Act that are crucial to note, namely, loss of earnings, loss of support and compensation. [34] Assessment of loss of earnings is dealt with in sub-para (d) of section 7(3)(iv) of the Civil Law Act. Loss of support, on the other hand, is not synonymous, but is based on the loss of earnings, and must be proved, as it is premised on the compensatory principle and not enrichment. As such, the Plaintiffs had to be compensated for the loss of support suffered as a result of the death of the provider of the support. This meant that the Plaintiffs had to prove the loss of support suffered, which for all practical purposes should be translated into financial loss sustained by a dependant. [35] With regard to the further deduction of 50% made by the learned SCJ, it was crucial to bring to the forefront that ‘support’ in the context of section 7 of the Civil Law Act means the pecuniary provision which furnished a livelihood, a source of means of living, subsistence, sustenance, maintenance or living, and that the “loss of support” meant the pecuniary benefit lost, a consequence of the death of the provider. Reference on this point was made to Muhamad Hashim (Bapa Noor Azlan Muhamad (Simati) Bertindak Bagi Pihak Tanggungan) v. Teow Teik Chai & Anor [1996] 1 CLJ 615. [36] It is apt, at this juncture, to bear in mind that ‘it is not enough to write down the particulars and throw them at the head of Court, saying, “This is what I have lost; I ask you to give me this damages’: per Lord Goddard in Bonham-Carter v. Hyde Park Hotel Ltd [1948] The 64 TLR 177 cited in Sum Kum v Devaki Nair & Anor [1964] 3 MLJ 74. S/N wvJswtBHq0eHYcPpp7F9hw [37] It is a well-established principle that special damages, in contrast to general damages, has to be specifically pleaded and strictly proved: Ong Ah Long v Dr S Underwood [1983] 2 MLJ 324. This was reiterated by Gunalan Muniandy JC (as he then was) in Manivannan Nalatamby & Anor v. Wong Siew Ling & Ors [2014] 1 LNS 292, where he had stated in the following passage: Even though this item of claim is under General Damages which is subject of assessment, it is a liquidated claim for a specified amount that has been quantified. As such, the quantum claimed must be strictly proved. Amongst others, it is essential to prove the deceased’s income at the time of his accidental death. The Appellants cited in support the Supreme Court case of Chan Chin Ming & Anor v. Lim Yok Eng [1994] 3 CLJ 792; [1994] 5 MLJ 233 where it was inter alia, held “... Further in our opinion, loss of support is for all practical purposes translated to financial loss sustained by the dependant.” [Emphasis added.] [38] The measure of damages is the pecuniary loss suffered by the Plaintiffs as a result of the death of their child. The pecuniary loss is the actual benefit of which the Plaintiffs have been deprived of: Chan Chin Ming & Anor v. Lim Yok Eng [1994] 3 CLJ 792; [1994] 5 MLJ 233 and Yap Ami & Anor v. Tan Hui Pang [1982] CLJ Rep 367. [39] The Plaintiffs submitted that as parents of the deceased, they had automatically qualified for the loss of support. As such, the Plaintiffs argued, there was no pre-condition to prove such loss. In my view, there was no doubt that the Plaintiffs had a right to claim for loss of support pursuant to section 7(3B) of the Civil Law Act, which reads: … …. [40] However, although they had qualified to claim for loss of support, it did not automatically mean that they were entitled to what they claimed without proving what they had actually suffered, as alluded to in the above-mentioned cases. In this case, the learned SCJ had justified his decision of a further deduction of 50% on the basis that the Plaintiffs had their own income. [41] This is consistent with the principle of unjust enrichment as propounded in Nam Ho Travel Service (S) Pte. Ltd. v. Progressive Insurance Sdn. Bhd. [1994] 1 CLJ 280 that ‘the principle of damages in tort is to compensate and not to enrich.’ The Plaintiffs, therefore, S/N wvJswtBHq0eHYcPpp7F9hw had to be put as near as possible to the position they were in before the accident, and not entitle them to profit from a misfortune. Setelah meneliti keterangan SP3 khususnya, saya berpuashati dan bersetuju dengan hujahan defendan bahawa pihak plaintif gagal membuktikan elemen-elemen penting sebagaimana yang ditekankan oleh Mahkamah-Mahkamah di atas. Apa yang dikemukakan kepada Mahkamah ini hanyalah keterangan bahawa simati ada bekerja dan menerima pendapatan sebanyak RM1,200 sebulan lebih kurang dan simati ada memberi beliau wang. Itu sahaja. Oleh itu, Mahkamah tidak membenarkan tuntutan item ini. Plaintif Defendan b. Kos Repot Polis, Rajah Kasar dan kunci dan gambar-gambar kemalangan dari Balai Polis Trafik Derah Kuantan RM150.00 Tidak dihujahkan Tiada dokumen Tiada resit Tidak dibuktikan Keputusan Mahkamah Mahkamah ini tidak membenarkan tuntutan bagi item ini. Plaintif Defendan c. Kos carian JPJ untuk MPV no. CDT 7169 RM10.00 Tidak dihujahkan Tiada dokumen Tiada resit Tidak dibuktikan Keputusan Mahkamah Mahkamah ini tidak membenarkan tuntutan bagi item ini. S/N wvJswtBHq0eHYcPpp7F9hw Plaintif Defendan d. Laporan Perubatan daripada HTAA (Ortopedik, Rehabilitasi dan Oral Maxillifacial) RM120.00 Tidak dihujahkan Tiada dokumen Tiada resit Tidak dibuktikan Keputusan Mahkamah Mahkamah ini tidak membenarkan tuntutan bagi item ini. Plaintif Defendan e. Kos perbelanjaan perjalanan pergi dan balik dari rumah serta perbelanjaan makanan dan penjagaan yang ditanggung oleh keluarga simati untuk melawat & menjaga simati di HTAA @ RM100.00 sehari pada 21.6.2020-RM15.8.2020 (56 hari) RM5,600.00 Tidak dihujahkan Tiada keterangan RM1,500.00 Cadangan defendan Keputusan Mahkamah Mahkamah membenarkan RM1,500.00 bagi item ini. Plaintif Defendan f. Kos perbelanjaan perjalanan pergi dan balik dari rumah serta perbelanjaan makanan dan penjagaan yang ditanggung oleh keluarga simati untuk melawat & menjaga simati di HTAA Tidak dihujahkan Tiada keterangan RM1,000.00 Cadangan defendan S/N wvJswtBHq0eHYcPpp7F9hw @ RM100.00 sehari pada 19.8.2020,
