KERAJAAN MALAYSIA ...DEFENDAN-DEFENDAN ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 4 ALASAN PENGHAKIMAN Pendahuluan [1] Di dalam kes ini Perayu-Perayu (Plaintif-Plaintif) telah memfailkan Notis Rayuan bertarikh 9/02/2024 (Lampiran - 60) terhadap keputusan yang telah diberikan oleh Mahkamah ini pada 22/1/2024 di mana Mahkamah ini telah memutuskan untuk menolak Saman Pemula Perayu-Perayu (Plaintif-Plaintif) di bawah Lampiran - 1 dengan kos. Selanjutnya, Mahkamah juga telah menetapkan bahawa kos Saman Pemula ini adalah sebanyak RM5,000.00 dan kos tersebut mesti dibayar oleh Perayu-Perayu (Plaintif-Plaintif) kepada Responden-Responden (Defendan-Defendan) dan ia tertakluk kepada bayaran fi alokatur. [2] Oleh itu Notis Rayuan yang difailkan oleh Perayu-Perayu (Plaintif-Plaintif) adalah terhadap keseluruhan keputusan yang telah diberikan oleh Mahkamah ini bertarikh pada 22/1/2024 tersebut. [3] Seterusnya, bagi tujuan penyediaan Alasan Penghakiman di dalam tindakan ini, maka selepas ini Mahkamah akan merujuk ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 5 Perayu-Perayu sebagai Plaintif-Plaintif. Manakala, Responden-Responden pula akan dirujuk sebagai Defendan-Defendan. Saman Pemula Pemohon-Pemohon (Lampiran - 1) [4] Di dalam Lampiran - 1, Plaintif-Plaintif memohon deklarasi kewarganegaraan melalui kuat kuasa undang-undang di bawah Perkara 14(1)(b) Perlembagaan Persekutuan bagi Ishaan Chandra Morgan (“Anak”). [5] Plaintif-Plaintif menuntut terhadap Defenden-Defenden dan memohon untuk mendapatkan perintah-perintah seperti berikut:-

Satu deklarasi bahawa Ishaan Chandra Morgan (Sijil Kelahiran No. Daftar: C0609/2021, No. Siri: 002975XA) bertarikh 26.8.2021 (“Anak”) adalah seorang warganegara Malaysia melalui kuat kuasa undang-undang berdasarkan kelahirannya di Persekutuan menurut Perkara 14(1)(b) dan Bahagian II Seksyen 1(e) dan

Jadual Kedua Perlembagaan Persekutuan; (b) Satu deklarasi bahawa Anak tersebut adalah seorang warganegara Malaysia melalui kuat kuasa undang- ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 6 undang berdasarkan kewarganegaraan ibu bapanya, Chandra Morgan a/l Velutham @ Velautham (No. K/P: 791209-01-6139) dan Sharene Kam Guat Mei (No. K/P: 790522-10-5002) menurut Perkara 14(1)(b) dan Bahagian II Seksyen 1(a) Jadual Kedua Perlembagaan Persekutuan; (c) Satu deklarasi bahawa Sijil Kelahiran Anak (No. Daftar: C0609/2021, No. Siri: 002975XA) bertarikh 26.8.2021 yang dikeluarkan oleh Defendan Pertama yang mendaftarkan Anak tersebut sebagai seorang “bukan warganegara” dan bukannya sebagai seorang warganegara Malaysia adalah satu perlanggaran hak asasi Anak tersebut sebagai seorang warganegara Malaysia; (d) Satu perintah bahawa Defendan-Defendan mengeluarkan semula sijil kelahiran Anak tersebut (No. Daftar: C0609/2021, No. Siri: 002975XA) bertarikh 26.8.2021 dan mendaftarkan Anak tersebut sebagai seorang warganegara Malaysia dalam tempoh 14 hari dari tarikh penyampaian perintah ini ke atas Defendan-Defendan; ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 7 (e) Satu perintah bahawa Defendan-Defendan mengeluarkan satu MyKID kepada Anak tersebut dalam tempoh 14 hari dari tarikh penyampaian perintah ini ke atas Defendan-Defendan; (f) Bahawa keperluan untuk penyampaian kediri untuk perintah ini dikecualikan dan penyampaian perintah ini dilaksanakan melalui penyampaian ke atas Jabatan Peguam Negara secara pos berdaftar; (g) Kos; dan (h) Perintah-perintah dan / atau arahan-arahan lain selanjutnya yang boleh diberi atau dibuat dan dianggap sesuai dan adil oleh Mahkamah yang Mulia ini. [6] Saman Pemula Plaintif-Plaintif ini (Lampiran - 1) telah disokong oleh Afidavit Sokongan yang diikrarkan oleh Plaintif Pertama iaitu Chandra Morgan a/l Velutham @ Velautham bagi pihak beliau dan Plaintif Kedua (Sharene Kam Guat Mei) bertarikh pada 12.11.2021 (“Afidavit Sokongan Plaintif-Plaintif”) (Lampiran - 2). ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 8 Latar Belakang Kes [7] Berdasarkan rekod Jabatan Pendaftaran Negara, ISHAAN CHANDRA MORGAN (“kanak-kanak tersebut”) telah dilahirkan pada 12.11.2020 di Sentul Medical Centre Kuala Lumpur. Kelahiran kanak-kanak tersebut di daftarkan di JPN Daerah Petaling dengan No. Daftar Kelahiran 153333XA. [8] Dalam Daftar Kelahiran kanak-kanak tersebut, maklumat ibu kandung tercatat sebagai bernama “Delicia” berstatus ‘BUKAN WARGANEGARA” yang berketurunan INDONESIA dan memegang PASPOT INDONESIA No. C4183232. Semasa kanak-kanak tersebut dilahirkan, ibu kandung kanak-kanak tersebut tidak berkahwin lagi. Manakala, maklumat bapa kandung kanak-kanak tersebut tercatat sebagai ‘MAKLUMAT TIDAK DIPEROLEHI’. Pemaklum kelahiran kanak-kanak ialah Plaintif Ke-2 sendiri. [9] Memandangkan, ibu kandung kanak-kanak tersebut seorang warga INDONESIA dan berstatus ‘BUKAN WARGANEGARA’ yang ‘BELUM BERKAHWIN’ dan tiada maklumat berkenaan ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 9 bapa kandung kanak-kanak tersebut, status kewarganegaraan kanak-kanak tersebut adalah mengikut kewarganegaraan ibu kandung, iaitu berstatus ‘BUKAN WARGANEGARA’. [10] Sesalinan Borang Daftar Kelahiran Asal ISHAAN CHANDRA MORGAN (kanak-kanak tersebut) ditenderkan sebagai Ekshibit “JPN-1” dalam Afidavit jawapan Defendan-Defendan (No. 2) (Lampiran - 26). Manakala, sesalinan Sijil Daftar Kelahiran Asal ISHAAN CHANDRA MORGAN (kanak-kanak tersebut) ditenderkan sebagai Ekshibit “JPN-2” dalam Afidavit jawapan Defendan-Defendan (No. 2) di bawah Lampiran - 26 tersebut. [11] Kanak-kanak tersebut telah kemudian dianakangkatkan oleh Plaintif-Plaintif melalui Akta Pengangkatan 1952 (Akta 257) di Mahkamah Sesyen Seremban pada 07.07.2021. Perintah pengangkatan telah direkodkan oleh JPN pada 30.08.2021 di JPN Putrajaya. Kedua-dua Plaintif bertaraf WARGANEGARA. Selepas pengangkatan, kanak-kanak tersebut telah dikeluarkan Sijil Kelahiran Baru dengan No. Daftar Kelahiran C0609/2021. ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 10 [12] Sesalinan Fail Pengangkatan ISHAAN CHANDRA MORGAN (kanak-kanak tersebut) ditenderkan sebagai Ekshibit “JPN-3” dalam Afidavit jawapan Defendan-Defendan (No. 2) (Lampiran - 26). Manakala, sesalinan Sijil Daftar Kelahiran Baru (No. Daftar Kelahiran C0609/2021) ISHAAN CHANDRA MORGAN (kanak-kanak tersebut) ditenderkan sebagai Ekshibit “JPN-4” dalam Afidavit Jawapan Defendan-Defendan (No. 2) (Lampiran - 26). [13] Oleh kerana taraf warganegara seseorang yang dilahirkan di Malaysia adalah ditentukan berdasarkan status warganegara dan status perkahwinan ibu bapa kandung semasa individu tersebut dilahirkan, dan proses pengangkatan tidak melayakkan seseorang mendapat kerakyatan secara kuat kuasa undang-undang (‘by operation of law’) di bawah Perkara 14(1)(b) Perlembagaan Persekutuan (PP), maka kanak-kanak tersebut masih bertaraf ‘BUKAN WARGANEGARA’ selepas proses pengangkatan. [14] Plaintif-Plaintif telah mendaftarkan perkahwinan mereka pada 22.01.2018 dengan No. Daftar Perkahwinan KC050454464 dan diupacarakan di Putrajaya. ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 11 [15] Berdasarkan rekod JPN, Plaintif Pertama melalui permohonan pertama bertarikh 24.09.2021 telah memohon untuk mendapatkan kewarganegaraan di bawah Perkara 15A Perlembagaan Persekutuan (PP) untuk kanak-kanak tersebut. Permohonan tersebut dibuat di Jabatan Pendaftaran Negara (JPN) Negeri Sembilan dengan nombor permohonan 05051011- 20210924-091421-45. Permohonan tersebut telah selesai diproses di peringkat JPN dan permohonan telah dikemukakan ke Kementerian Dalam Negeri pada 24.11.2021 untuk pertimbangan. Analisis Mahkamah Kedudukan Undang-Undang Kewarganegaraan di Malaysia [16] Di Malaysia, undang-undang berkenaan kewarganegaraan adalah seperti yang termaktub di bawah Perlembagaan Persekutuan. Di dalam kes CTEB & Anor v Ketua Pengarah Pendaftaran Negara, Malaysia & Ors (2021) 4 MLJ 236, Mahkamah Persekutuan di dalam kes tersebut telah memutuskan seperti berikut:- “[125] The concept of citizenship law predated the formation of the Federation of Malaysia. It was there even before independence. Laws ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 12 pertaining to citizenship in Malaysia then form part of the supreme law and no longer remain as ordinary law. These provisions too are entrenched in the FC in that, they are not easily amended as it requires the consent of the Conference of Rulers pursuant to art 159(5) of the FC. Even with the Proclamation of Emergency under art 150 as we are currently under, no emergency law may be passed which is inconsistent with provisions relating to citizenship (see art 150(6A)).” [17] Seterusnya, di dalam kes Pendaftar Besar Kelahiran dan Kematian, Malaysia v Pang Wee See & Anor (applying on behalf and as litigation representatives for Pang Cheng Chuen, a child) (2017) 3 MLJ 308, Mahkamah Rayuan di dalam kes tersebut telah memutuskan seperti berikut:- “[21] We must state here that the law on citizenship is contained, both procedurally and substantively in the Federal Constitution itself. There is no statute that was specially legislated to house the specific provision pertaining to citizenship. Rather, these provisions reside in the Federal Constitution. We noted too, that these provisions make no reference to other specific statutes, especially in aid of its interpretation. In fact, the Federal Constitution itself provides for the interpretation required in order to make clear what the words in the citizenship provisions are supposed to mean. In other words, the citizenship provisions in the Federal Constitution are exclusively housed in the Federal Constitution itself. The Federal Constitution, like most other written Constitutions, is ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 13 interpreted not in the like manner in which other statutes are normally interpreted. In relation to the Federal Constitution, all other statutes are subsidiary legislations. Thus the constitutionality of the Federal Constitution is considered from the perspective of the Constitution itself. It is not to be interpreted by reference to other statutes, albeit they were passed by Parliament.” Kewarganegaraan melalui kuat kuasa undang-undang [18] Menurut Perkara 14(1)(b) Perlembagaan Persekutuan ianya memperuntukkan seperti berikut:- “(1) Subject to the provisions of this Part, the following persons are citizens by operation of law, that is to say: (a) every person born before Malaysia Day who is a citizen of the Federation by virtue of the provisions contained in Part I of the Second Schedule; and (b) every person born on or after Malaysia Day, and having any of the qualifications specified in Part II of the Second Schedule.” [19] Seterusnya, di bawah Bahagian

Jadual Kedua Perlembagaan Persekutuan memperuntukkan seperti berikut:- “1. Subject to the provisions of Part III of this Constitution, the following persons born on or after Malaysia Day are citizens by operation of law, that is to say: ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 14 (a) every person born within the Federation of whose parents one at least is at the time of the birth either a citizen or permanently resident in the Federation; and (b) every person born outside the Federation whose father is at the time of the birth a citizen and either was born in the Federation or is at the time of the birth in the service of the Federation or of a State; and (c) every person born outside the Federation whose father is at the time of the birth a citizen and whose birth is, within one year of its occurrence or within such longer period as the Federal Government may in any particular case allow, registered at a consulate of the Federation or, if it occurs in Brunei or in a territory prescribed for this purpose by order of the Yang di-Pertuan Agong, registered with the Federal Government; and (d) every person born in Singapore of whose parents one at least is at the time of the birth a citizen and who is not born a citizen otherwise than by virtue of this paragraph; and (e) every person born within the Federation who is not born a citizen of any country otherwise than by virtue of this paragraph.” [20] Oleh itu, Perkara 14(1)(b) Perlembagaan Persekutuan tersebut jika dibaca bersama dengan Bahagian II, Jadual Kedua Perlembagaan Persekutuan ianya jelas memperuntukkan mengenai kewarganegaraan melalui kuat kuasa undang-undang bagi tiap-tiap orang yang lahir pada atau selepas Hari Malaysia. ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 15 [21] Dalam lain perkataan, bagi menjadikan seseorang warganegara melalui kuat kuasa undang-undang dibawah Perkara 14(1)(b) Perlembagaan Persekutuan dibaca bersama dengan Bahagian II,

Jadual Kedua Perlembagaan Persekutuan, seseorang itu hendaklah memenuhi kelayakan-kelayakan seperti yang telah diperuntukkan dan kelayakan tersebut hendaklah dipenuhi pada masa kelahiran seperti yang diputuskan dalam kes CTEB & Anor v Ketua Pengarah Pendaftaran Negara, Malaysia & Ors (2021) 4 MLJ 236, “[128] Of the four categories, the operation of law citizenship is almost automatic. One either fits the given criteria under the FC or one does not. The criteria are clearly stipulated in the FC and it does not require any exercise of discretion by the authority. [129] By operation of law, therefore entails a situation where at birth the person’s status of citizenship will be so determined. It is a matter of birthright. This legal position is also as stated by Emeritus Professor Datuk Dr Shad Saleem Faruqi, in his book Our Constitution (Sweet & Maxwell, Thomson Reuters 2019) at pp 178–179. In practical terms, a birth certificate will be issued right away upon registration of such birth. While the other three categories of citizenship by registration and naturalisation require an application to the authorities upon meeting the necessary conditions imposed under the FC (see Suffian An Introduction to the Constitution of Malaysia (3rd Ed, Pacifica Publications 2007) at pp ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 16 330–337). ... [132] Citizenship by operation of law is not peculiar only to Malaysia. Many countries in the world recognise this principle of citizenship, based on its own set of criteria as well as the jus soli and jus sanguinis rule. Hence, it is safe to conclude that whether one is qualified as a citizen by operation of law naturally must be discerned from the criteria as embedded in the FC itself, upon the true construction of the relevant provisions. ... [194] Concluding my view and discussions, I am clear in my mind and reinforced in my view, that the qualification of acquiring citizenship by operation of law, must be met at birth. And if the qualifications are not met, this court is not at liberty to add and subtract any other or qualifications which the FC states otherwise.” [22] Kelayakan-kelayakan untuk kewarganegaraan melalui kuat kuasa undang-undang dibawah Perkara 14(1)(b) Perlembagaan Persekutuan dibaca bersama Bahagian II, Jadual Kedua Perlembagaan Persekutuan adalah berdasarkan kepada dua (2) konsep iaitu pertamanya, konsep jus soli dan keduanya, konsep jus sanguinis. Konsep-konsep ini dijelaskan di dalam kes-kes berikut:- ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 17 (a) Pendaftar Besar Kelahiran dan Kematian, Malaysia v Pang Wee See & Anor (applying on behalf and as litigation representatives for Pang Cheng Chuen, a child) (2017) 3 MLJ 308 “[29] In determining citizenship of a person, two concepts are commonly applied, namely the concept of jus soli and the concept of jus sanguinis. Jus soli which means ‘right of the soil’, and commonly referred to as birth right citizenship, is the right of anyone born in the territory of a state to nationality or citizenship. The determining factor being the place or territory where a person was born. In the case of jus sanguinis, which in Latin means ‘right of blood’, is a principle of nationality law by which citizenship is not determined by place of birth but by having one or both parents who are citizens of the state… …Viewed from the context of these two concepts, we are of the considered opinion that art 14(1)(b) read with s 1(a), Part II, Second Schedule of the Federal Constitution is a provision which is anchored on the elements of both the concepts of jus sanguinis and of jus soli, whereby citizenship of a person is traceable to the place of birth namely, Malaysia, as well as Malaysian citizenship of one of the person’s parents (the right of blood) at the time of the person’s birth, in order to be a Malaysian citizen by operation of law, under art 14(1)(b) read with s 1(a), Part II, Second Schedule ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 18 of the Federal Constitution.” (b) Lim Jen Hsian & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2018] 6 MLJ 548 “[27] Article 14(1)(b) of the Federal Constitution encapsulates the requirement of citizenship by jus soli ie by the place of birth; while para 1(e) of Part II, Second Schedule of the Federal Constitution (not born a citizen of any country) encapsulates the requirement of citizenship by jus sanguinis ie by blood or lineage. [28] Thus, it would appear that the second appellant would need to satisfy both the requirements of jus soli and jus sanguinis in order to fulfil the requirements of art 14(1)(b) and s 1(e) of Part II, Second Schedule of the Federal Constitution (refer to Chin Kooi Nah (suing on behalf of himself and as litigation representative to Chin Jia Nee, child) v Pendaftar Besar Kelahiran dan Kematian, Malaysia [2016] 7 MLJ 717).” (c) Than Siew Beng & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors (2017)- 5 MLJ 662 “[23] Article 14(1)(b) of the Federal Constitution encapsulates the requirement of citizenship by jus soli ie place of birth; while para 1(e) of Part II of the Second Schedule of the Federal Constitution ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 19 (‘not born a citizen of any country’) encapsulates the requirement of citizenship by jus sanguinis ie by blood or lineage. [24] Thus, it would appear that the second appellant would need to satisfy both the requirements of jus soli and jus sanguinis in order to fulfil the requirements of art 14(1)(b) and para 1(e) of Part II, Second Schedule of the Federal Constitution (refer to Chin Kooi Nah (suing on behalf of himself and as litigation representative to Chin Jia Nee, child) v Pendaftar Besar Kelahiran dan Kematian, Malaysia [2016] 7 MLJ 717).” Sama ada ISHAAN CHANDRA MORGAN (“kanak-kanak tersebut”) adalah seorang warganegara Malaysia melalui kuat kuasa undang-undang [23] Di dalam kes ini, Mahkamah mendapati bahawa kanak-kanak tersebut adalah bukan seorang warganegara Malaysia melalui kuat kuasa undang-undang di bawah Perkara 14(1)(b) Perlembagaan Persekutuan oleh kerana kanak-kanak tersebut tidak memenuhi kelayakan-kelayakan yang diperuntukkan di bawah Perkara 14(1)(b) tersebut di atas. ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 20 [24] Berdasarkan akan fakta bahawa kanak-kanak tersebut telah dilahirkan pada 12.11.2020 di Sentul Medical Centre, Kuala Lumpur, maka bagi menentukan status kewarganegaraan kanak-kanak tersebut, peruntukan yang relevan untuk diteliti adalah Bahagian II, Jadual Kedua Perlembagaan Persekutuan dibaca bersama Perkara 14(1)(b) Perlembagaan Persekutuan seperti berikut:- (a) Seksyen 1(a), Bahagian II, Jadual Kedua Perlembagaan Persekutuan; dan (b) Seksyen 1(e), Bahagian II, Jadual Kedua Perlembagaan Persekutuan. Seksyen 1(a), Bahagian

Jadual Kedua Perlembagaan Persekutuan [25] Menurut Seksyen 1(a), Bahagian II, Jadual Kedua Perlembagaan Persekutuan ianya memperuntukkan seperti berikut:- “1. Subject to the provisions of Part III of this Constitution, the following persons born on or after Malaysia Day are citizens by operation of law, that is to say: (a) every person born within the Federation of whose parents one at least is at the time of the birth either a citizen or permanently resident in the Federation;” ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 21 [26] Berdasarkan Perkara 14(1)(b) Perlembagaan Persekutuan dibaca bersama Seksyen 1(a), Bahagian II, Jadual Kedua Perlembagaan Persekutuan, kelayakan-kelayakan untuk mendapatkan kewarganegaraan melalui kuat kuasa undang-undang adalah seperti berikut:- (a) Tiap-tiap orang yang lahir pada atau selepas Hari Malaysia; (b) Tiap-tiap orang yang lahir di Persekutuan; dan (c) Pada masa kelahiran, sekurang-kurangnya seorang daripada ibu bapanya adalah seorang warganegara atau bermastautin secara tetap di Persekutuan. [27] Perkataan ibu bapa dalam Seksyen 1(a), Bahagian II, Jadual Kedua Perlembagaan Persekutuan adalah merujuk kepada ibu bapa kandung dan bukannya ibu bapa angkat. Ini adalah seperti yang diputuskan dalam kes Pendaftar Besar Kelahiran dan Kematian, Malaysia v Pang Wee See & Anor (applying on behalf and as litigation representatives for Pang Cheng Chuen, a child) (2017) 3 MLJ 308 “[31] What had become clear to us had been that one of the key ingredients stipulated in art 14(1)(b) read together with s 1(a) of Part II of ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 22 the Second Schedule of the Federal Constitution, is that the person seeking to be a citizen of Malaysia via this specific constitutional provision must show proof that when he was born in this country, one of his parents must either be a citizen of Malaysia or was permanently resident in this country. The phrase that is employed under that provision reads, ‘is at the time of the birth’. To our minds, that phrase has categorically made a reference to the biological parent of the person, who must either be a Malaysian citizen or a person who is permanently resident in Malaysia. By virtue of this phrase, any person intending to claim citizenship by operation of law under the above stated constitutional provision, it is not sufficient that he or she was born in Malaysia. He must be a person, whose either parent was a Malaysian citizen or a Malaysian permanent resident, when he was born in Malaysia. That provision does not contain any reference to an adoptive parent, albeit a Malaysian adoptive parent.” [28] Taraf perkahwinan ibu bapa kandung semasa kelahiran juga hendaklah diambil kira. Sekiranya seseorang adalah anak luar nikah, perkataan ibu bapa hendaklah dibaca dan ditafsirkan sebagai ibu. Ini adalah berdasarkan Seksyen 17, Bahagian III,

Jadual Kedua Perlembagaan Persekutuan memperuntukkan seperti berikut:- “17. For the purposes of Part III of this Constitution references to a ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 23 person‘s father or to his parent, or to one of his parents, are in relation to a person who is illegitimate to be construed as references to his mother, and accordingly section 19 of this Schedule shall not apply to such a person.” [29] Merujuk kepada kes Lim Jen Hsian & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2018] 6 MLJ 548 “[38] The second appellant’s lineage would only be traceable to his Malaysian biological father provided that his parents was in a lawful marriage. In the case of an illegitimate child, the word ‘parent’ is construed to refer to his biological mother. Section 17 of Part III of the Federal Constitution states as follows: For the purposes of Part III of this Constitution references to a person’s father or to his parent, or to one of his parents, are in relation to a person who is illegitimate to be construed as references to his mother, and accordingly section 19 of this Schedule shall not apply to such person.” [30] Oleh yang demikian, bagi seseorang untuk memenuhi kelayakan ketiga iaitu pada masa kelahiran, sekurang-kurangnya seorang daripada ibu bapanya adalah seorang warganegara atau bermastautin secara tetap di Persekutuan, beliau haruslah membuktikan sekurang-kurangnya seorang daripada ibu ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 24 bapanya (jika anak sah) atau ibunya (jika anak luar nikah) adalah seorang warganegara atau bermastautin secara tetap di Persekutuan. [31] Di dalam kes di hadapan Mahkamah ini, ianya merupakan satu fakta yang tidak dipertikaikan bahawa Plaintif-Plaintif bukanlah merupakan ibu bapa kandung kepada kanak-kanak tersebut. Di dalam Salinan Sah Sijil Daftar Kelahiran kanak-kanak tersebut (Ekshibit “JPN-2”), maklumat ibu kandung tercatat sebagai bernama “Delicia” berstatus ‘BUKAN WARGANEGARA” yang berketurunan INDONESIA dan memegang PASPOT INDONESIA No. C4183232. Begitu juga, semasa kanak-kanak tersebut dilahirkan, ibu kandung kanak-kanak tersebut tidak berkahwin lagi. Manakala, maklumat bapa kandung kanak-kanak tersebut tercatat sebagai ‘MAKLUMAT TIDAK DIPEROLEHI’. Seterusnya, pemaklum kelahiran kanak-kanak tersebut adalah Plaintif Kedua sendiri di dalam kes ini (Sharene kam Guat Mei). ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 25 [32] Oleh itu, kanak-kanak tersebut hanya memenuhi kelayakan pertama dan kedua di mana kanak-kanak tersebut lahir selepas Hari Malaysia iaitu pada 12.11.2020 dan kanak-kanak tersebut lahir di Persekutuan iaitu di Sentul Medical Centre Kuala Lumpur. Walau bagaimanapun, kanak-kanak tersebut tidak memenuhi kelayakan ketiga kerana Plaintif-Plaintif telah gagal untuk membuktikan sekurang-kurangnya seorang daripada ibu bapanya (jika kanak-kanak tersebut adalah anak sah) atau ibunya (jika kanak-kanak tersebut adalah anak luar nikah) adalah seorang warganegara atau bermastautin secara tetap di Persekutuan. Menurut Borang Daftar Kelahiran Kanak-Kanak tersebut (Ekshibit “JPN-1”) adalah jelas dicatitkan bahawa status ibu kandung kanak-kanak tersebut adalah cuma sebagai Pemastautin Sementara (“Temporary Resident”) sahaja dan bukannya sebagai Pemastautin Tetap (“Permanent Resident”). [33] Malahan, adalah jelas terbukti di dalam kes ini melalui Salinan Sah Sijil Daftar Kelahiran kanak-kanak tersebut (“Ekshibit JPN- 2”) bahawa taraf kewarganegaraan ibu kandung kanak-kanak tersebut adalah dicatitkan sebagai bukan warganegara Malaysia. Sebaliknya, ibu kandung kanak-kanak tersebut adalah seorang ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 26 berketurunan Indonesia dan memiliki Pasport Indonesia No. C4183232. Begitu juga, pada Borang Daftar Kelahiran Kanak-Kanak tersebut (“Ekshibit “JPN-1”) pada bahagian / ruangan Taraf Perkahwinan (“Status of Marriage”) telah dicatitkan bahawa semasa kanak-kanak tersebut dilahirkan, ibu kandung kanak-kanak tersebut adalah Tidak Berkahwin atau pun “Not Married”. [34] Manakala, maklumat bapa kandung kanak-kanak tersebut tercatat sebagai ‘Maklumat Tidak Diperolehi’. Dalam lain perkataan, semasa kanak-kanak tersebut dilahirkan, ibu kandung kanak-kanak tersebut bukannya merupakan seorang warganegara Malaysia atau seorang yang bermastautin secara tetap di Persekutuan. Tetapi ibu kandung kanak-kanak tersebut adalah merupakan seorang berketurunan Indonesia dan beliau memiliki Pasport Indonesia dengan No: C4183232 di mana adalah jelas terbukti di sini bahawa ibu kandung kanak-kanak tersebut bukannya merupakan seorang warganegara Malaysia. [35] Justeru itu, adalah jelas di sini bahawa kanak-kanak tersebut bukanlah warganegara Malaysia melalui kuat kuasa undang-undang sebagaimana yang diperuntukkan di bawah Perkara ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 27 14(1)(b) Perlembagaan Persekutuan dibaca bersama Seksyen 1(a), Bahagian II, Jadual Kedua Perlembagaan Persekutuan. Seksyen 1(e), Bahagian

Jadual Kedua Perlembagaan Persekutuan [36] Menurut Seksyen 1(e), Bahagian II, Jadual Kedua Perlembagaan Persekutuan ianya memperuntukkan seperti berikut: “1. Subject to the provisions of Part III of this Constitution, the following persons born on or after Malaysia Day are citizens by operation of law, that is to say: (e) every person born within the Federation who is not born a citizen of any country otherwise than by virtue of this paragraph.” [37] Berdasarkan Perkara 14(1)(b) Perlembagaan Persekutuan dibaca bersama Seksyen 1(e), Bahagian II, Jadual Kedua Perlembagaan Persekutuan, kelayakan-kelayakan untuk mendapatkan kewarganegaraan melalui kuat kuasa undang-undang adalah seperti berikut:_ (a) Tiap-tiap orang yang lahir pada atau selepas Hari Malaysia; (b) Tiap-tiap orang yang lahir di Persekutuan; dan ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 28 (c) Pada masa kelahiran, tidak menjadi warganegara mana-mana negara. [38] Kelayakan ketiga iaitu tidak menjadi warganegara mana-mana negara adalah terkandung dalam konsep jus sanguinis iaitu penentuan keturunan (lineage) seseorang (perhubungan seseorang dengan ibu bapa kandung semasa dilahirkan). [39] Merujuk kepada kes-kes berikut:- (a) Than Siew Beng & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2017] 5 MLJ 662 “[27] The contentious issue is in respect of the requirement of jus sanguinis in para 1(e) of Part II of the Second Schedule of the Federal Constitution, as expressed by the phrase, ‘who is not born a citizen of any country’. For the purposes of this requirement the material time to determine the status of the second appellant’s lineage is at the time of his birth. ... [35] A plain reading of para 1(e) ‘was not born a citizen of any country’ refers to the relationship of the second appellant to his biological and lawful parents at the time of his birth. The only available documentary evidence, the second appellant’s birth ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 29 certificate (‘exh TSB6’) contained no information pertaining to the biological parents and the relevant particulars were endorsed with ‘Maklumat Tidak Di perolehi’.” (b) Lim Jen Hsian & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2018] 6 MLJ 548 “[36] Paragraph 1(e) of Part II, Second Schedule of the Federal Constitution confers citizenship to a person born by jus sanguinis, by reference to his blood or lineage. Thus when a child has not, at birth, acquired citizenship of any country, this would render him/her not born a citizen of any country.” [40] Oleh itu, beban bagi membuktikan kelayakan ketiga adalah terletak kepada Plaintif-Plaintif. Plaintif-Plaintif hendaklah membuktikan semasa kelahiran, berdasarkan keturunannya (lineage), kanak-kanak tidak menjadi warganegara mana-mana negara. [41] Merujuk kepada kes-kes berikut:- (a) Lim Jen Hsian & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2018] 6 MLJ 548 “[33] It is a well established principle of law that he who asserts ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 30 must prove. This is particularly so in respect of facts which are within the appellants’ knowledge. The burden of proof is on the appellants to establish on the balance of probabilities that the second appellant was not born a citizen of any country. Such rule of evidence is enunciated in s 103 of the Evidence Act 1950 which provides: The burden of proof as to any particular fact lies on that person who wishes the court to believe in its existence, unless it is provided by any law that proof of that fact shall lie on any particular person. [34] In the case of Ong Boon Hua @ Chin Peng & Anor v Menteri Hal Ehwal Dalam Negeri,Malaysia [2008] 3 MLJ 625; [2008] 5 CLJ 42, it was held that the burden is on the applicant to prove his citizenship status by the relevant documents, the absence of which would be fatal to prove his claim. [35] The burden of proof would only shift to the respondent to prove positively that the second appellant was born a citizen of a foreign country once the appellant has established a prima facie case (refer to Toh Whye Teck v The HappyWorld Ltd [1953] 1 MLJ 171).” ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 31 (b) Than Siew Beng & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2017] 5 MLJ 662 “[29] It is a well-established principle of law that ‘he who asserts must prove’. The burden of proof is on the appellants to establish a prima facie case on the balance of probabilities that the second appellant, ‘was not born a citizen of any country’. [30] Such rule of evidence is enunciated in s 103 of the Evidence Act 1950 which provides: The burden of proof as to any parlicular fact lies on that person who wishes the court to believe in its existence, unless it is provided by any law that proof of that fact shall lie on any parlicular person. [31] In the case of Ong Boon Hua @ Chin Peng & Anor v Menteri Hal Ehwal Dalam Negeri, Malaysia [2008] 3 MLJ 625; [2008] 5 CLJ 42, it was held that in order to ascertain the citizenship status of the applicant, the burden is on the applicant to furnish the necessary documents, and the absence of such documents would be fatal to the applicant’s claim.” [42] Bagi membuktikan keturunan (lineage), Plaintif-Plaintif hendaklah mengemukakan keterangan mengenai taraf kewarganegaraan dan taraf perkahwinan ibu bapa kandung. Kegagalan ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 32 membuktikan perkara ini terjumlah kepada kegagalan memenuhi kelayakan ketiga dibawah Seksyen 1(e), Bahagian II, Jadual Kedua Perlembagaan Persekutuan. Ini adalah seperti yang diputuskan dalam kes Than Siew Beng & Anor v Ketua Pengarah Jabatan Pendaftaran Negara & Ors [2017] 5 MLJ 662 “[35] A plain reading of para 1(e) ‘was not born a citizen of any country’ refers to the relationship of the second appellant to his biological and lawful parents at the time of his birth. The only available documentary evidence, the second appellant’s birth certificate (‘exh TSB6’) contained no information pertaining to the biological parents and the relevant particulars were endorsed with ‘Maklumat Tidak Di perolehi’. [36] Since the identity of the child’s lawful and biological parents are unknown, it is not possible to determine the lineage of the second appellant that would enable the second appellant to be conferred citizenship by lineage ie jus sanguinis. [37] Thus in our view, the second appellant has not fulfilled the requirement to be a citizen by operation of law within the meaning of para 1(e) of Part II of the Second Schedule of the Federal Constitution (refer to Chin KooiNah (suing on behalf of himself and as litigation representative to Chin Jia Nee, child) v Pendaftar Besar Kelahiran dan Kematian, Malaysia [2016] 7 MLJ 717). ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 33 [38] We cannot accept the contention of the appellants that the evidence that the second appellant was born in the Federation and had resided in the Federation all his life, as well as the absence of particulars on the second appellant’s birth certificate in respect of his lineage can be construed as sufficient proof that the second appellant ‘was not born a citizen of any country’. As was stated earlier, what is required is evidence of the second appellant’s lineage, which evidence is absent. [39] Thus, we agree with the finding of the learned High Court judge that the second appellant has failed to prove on the balance of probabilities that the requirement of para 1(e) of Part II of the Second Schedule of the Federal Constitution abovementioned has been satisfied.” [43] Di dalam kes di hadapan Mahkamah ini, adalah merupakan satu fakta yang tidak dipertikaikan bahawa Plaintif-Plaintif bukanlah merupakan ibu bapa kandung kanak-kanak tersebut dan tiada sebarang bukti atau apa-apa keterangan yang telah dikemukakan oleh Plaintif-Plaintif mengenai taraf kewarganegaraan dan taraf perkahwinan terhadap ibu bapa kandung kanak-kanak tersebut. [44] Mahkamah mendapati bahawa kanak-kanak tersebut hanya memenuhi kelayakan pertama dan kedua di mana kanak-kanak tersebut lahir selepas Hari Malaysia iaitu pada 12.11.2020 dan ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 34 kanak-kanak tersebut lahir di Persekutuan iaitu di Sentul Medical Centre Kuala Lumpur. Walaubagaimanapun, kanak-kanak tersebut tidak memenuhi kelayakan ketiga kerana Plaintif-Plaintif telah gagal untuk membuktikan keturunan (lineage) kanak-kanak tersebut bagi membuktikan kepada Mahkamah bahawa kanak-kanak tersebut tidak menjadi warganegara mana-mana negara. [45] Malahan, adalah jelas melalui Ekshibit “JPN-1” dan Ekshibit “JPN- 2” ibu kandung kanak tersebut adalah seorang berketurunan Indonesia dan memiliki pasport Indonesia No: C4183232 atau dalam erti kata yang lain ibu kandung kanak-kanak tersebut lebih mirip mempunyai kewarganegaraan Indonesia. Tambahan juga, adalah merupakan suatu fakta yang tidak dipertikaikan bahawa semasa kanak-kanak tersebut dilahirkan, ibu kandung kanak-kanak tersebut masih tidak berkahwin lagi. Di samping itu juga, melalui maklumat bapa kandung kanak-kanak tersebut sepertimana yang tercatat di dalam Ekshibit “JPN-1” dan Ekshibit “JPN-2” di mana dinyatakan sebagai ‘Maklumat Tidak Diperolehi’. ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 35 [46] Oleh itu, Mahkamah mendapati Plaintif-Plaintif telah gagal untuk membuktikan keturunan (lineage) kanak-kanak tersebut bagi membuktikan kanak-kanak tersebut bukan warganegara mana-mana negara. Plaintif-Plaintif tidak ada mengemukakan sebarang keterangan ataupun apa-apa bukti-bukti dokumentari bagi membuktikan kepada Mahkamah ini bahawa kanak-kanak tersebut adalah bukan warganegara untuk mana-mana negara. Sebaliknya, berdasarkan kepada bukti-bukti dan keterangan-keterangan yang ada di hadapan Mahkamah ini, adalah jelas terbukti bahawa ibu kandung kanak-kanak tersebut adalah merupakan seorang keturunan atau pun warganegara Indonesia. [47] Justeru itu, berdasarkan kepada alasan-alasan ini Mahkamah mendapati bahawa kanak-kanak tersebut bukanlah warganegara Malaysia melalui kuat kuasa undang-undang di bawah Perkara 14(1)(b) Perlembagaan Persekutuan dibaca bersama Seksyen 1(e), Bahagian II, Jadual Kedua Perlembagaan Persekutuan. KESIMPULAN Secara kesimpulannya, memandangkan kanak-kanak tersebut bukannya merupakan warganegara Malaysia melalui kuat kuasa ALASAN PENGHAKIMAN SAMAN PEMULA NA-24-3-11/2021 36 undang-undang, maka Plaintif-Plaintif tidak layak kepada permohonan-permohonan / perintah-perintah yang dipohon oleh Plaintif-Plaintif di dalam Saman Pemula di bawah Lampiran - 1 ini. Oleh yang demikian, Mahkamah dengan ini memutuskan untuk menolak Saman Pemula Plaintif-Plaintif (Lampiran- 1) dengan kos. Selanjutnya, Mahkamah juga telah menetapkan bahawa kos Saman Pemula ini adalah sebanyak RM5,000.00 dan mesti dibayar oleh Perayu-Perayu (Plaintif-Plaintif) kepada Responden-Responden dalam tindakan ini tertakluk kepada bayaran fi alokatur. Disediakan oleh: t.t (Mohamad Haldar bin Abdul Aziz) Pesuruhjaya Kehakiman Mahkamah Tinggi 2 Seremban Negeri Sembilan Darul Khusus. Bertarikh: 14 haribulan Mei 2024.
