PW 1 said he was justified and vindicated when the learned Judge 21 gave a thorough and systematic analysis of the facts and evidence in his 22 GOJ and found in favour of all the Plaintiffs. In his testimony PW1 attested 23 to the following :- 24 25 Q19: What do you mean by abuse of process? 26 A19: I understand it in the way it was explained in the Grounds. 27 28 Q20: Can you explain further? 29 A20: Yes, I can. I refer to the finding of abuse of process in three 1 paragraphs of the Grounds, being paragraph 49, paragraph 52.3 and 2 paragraph 79. 3 4 Q21: What about paragraph 49? 5 A21: Paragraph 49 reads, inter alia, “And so, it is relevant to ask why 6 PINS did not make the present claim as part of its counter-claim in suit 7 1041? It was therefore strongly argued for the defendants that based on 8 the facts and circumstances alluded to above, res judicata in the “wider 9 sense” applied and that the instant suit was an obvious manifestation of 10 an abuse of process. It is of course trite that whether res judicata in the 11 wider sense should be permitted to bar a claim is a matter that is to be 12 determined on the facts of each case, always having regard to where 13 the justice of the individual and particular case lies. I will return to this 14 topic in due course. I now move on to the topic of the plaintiffs’ pleaded 15 case.” I want to draw attention to the words, “the instant suit was an 16 obvious manifestation of an abuse of process”. I also want to draw 17 attention to the words, “where the justice of the individual and particular 18 case lies”. My own words are 22 “injustice”, “harassment”, “worry”, “anxiety ”, “trouble”, “inconvenience”, 23 “time consumed “, “effort consumed “, “punishment”, “revenge” and “dark 24 cloud over my head” 25 26 Evidence of PW 2 27
