194... [33] The definition of possession itself was expressed to be when a person is so situated with respect to a thing that he has the power to deal with it as owner to the exclusion of all other persons, and when the circumstances are such that he may be presumed to intend to do so in case of need. This definition necessarily means that the possessor or possessors have the power to exclude other persons from enjoyment of the property... [51] All the above cases drive home the point that the element of exclusivity and the need to exclude others from access to the place where the drugs were found is of paramount importance if the prosecution are to successfully prove custody, control or possession. [52] As a matter of common sense, whether one has exclusive possession is directly related to whether one also had exclusive access to the place or area where the drugs were discovered. [53] Even in cases where the prosecution intends to place reliance upon the statutory presumption under section 37(d) DDA, by proving custody and control first, it is incumbent for them to exclude accessibility of others to the place where the drugs were found as well as to show knowledge on the part of the accused as to the existence of the thing said to be incriminating... [62] The cases above clearly state that in order for custody and control to be proven, it must first be established that others were excluded from access to the place where the impugned drugs were found, as well as knowledge on the part of the accused as to the thing said to be incriminatory. [63] The prosecution's failure to prove these basic or primary facts results in them not being able to rely upon the statutory presumption of possession under section 37(d) DDA." [19] Di dalam kes ini berdasarkan keterangan SP3, sewaktu serbuan pintu bilik tidak bertutup, SP5 pula mengesahkan bilik tempat serbuan tersebut merupakan bengkel yang digunakan tertuduh pertama bersama rakan-rakannya, SP3 juga semasa serbuan tidak ada merampas sebarang kunci bagi bilik tempat serbuan tersebut. SP6 yang melawat tempat kejadian pula memberitahu pintu bilik tersebut berkunci dan dibuka oleh SP6. Persoalannya berdasarkan fakta ini, siapa sebenarnya yang mempunyai akses keatas bilik tempat serbuan tersebut. Melihat pula kepada keadaan barang kes yang ditemui, barang kes ini bukanlah berada dalam keadaan terbuka, ianya diletakkan di dalam sebuah beg dan di dalam kotak yang tidak dapat dilihat dengan mata kasar isi dalamnya. Walaupun kedua-kedua tertuduh berada berhampiran dengan barang kes, tidak menjadikan tertuduh mempunyai milikan dan pengetahuan keatas barang kes tersebut kerana rakan-rakan mereka juga ada hadir dan mengunakan bengkel tersebut. [20] Mahkamah ini merujuk kepada nas undang-undang berikut; Lee Chee Meng V PP [1992] 1 MLJ 322 “…The doubt as to exclusive use of room B by the appellant alone could be sufficient ground to allow the appeal..” PP v Thilageswaran A/L Ramasamy [2002] MLJU 493 “..Andaian pengetahuan tersebut tidak mencukupi untuk membuktikan OKT memiliki dadah berkenaan, lebih-lebih lagi seperti yang telah dinyatakan sebelum ini terdapat kemungkinan besar yang orang lain juga ada akses ke bilik mandi dan premis berkenaan selain daripada OKT. Keadaan itu sudah mencukupi untuk mengenepikan andaian tersebut.” [21] Makanya, di dalam kes yang dibicarakan ini, bilik bengkel tempat dadah ditemui itu, bukan sahaja boleh diakses oleh tertuduh, malah ada keterangan yang mengatakan ada kemungkinan rakan-rakan tertuduh turut hadir ke situ pada masa-masa tertentu memandangkan ianya satu bengkel untuk membuat kerja. Malah SP5 di dalam keterangan bersumpahnya di mahkamah, memberitahu, selepas tangkapan, SP5 telah kunci bilik tersebut kerana bimbang barang-barang akan hilang. Maka ada kemungkinan pada masa-masa lain bilik tersebut dibuka sahaja untuk rakan-rakan tertuduh datang dan membuat kerja. [22] Selanjutnya pada pada 20.9.2023, tertuduh kedua telah membuat pengakuan salah keatas semua pertuduhan dan telah disabitkan dan dijatuhkan hukuman. Pada peringkat inu pihak pendakwaan telah berhujah mengenai peruntukan seksyen 34 Kanun Keseksaan dan juga seksyen 30 Akta Keterangan 1950. Namun, di dalam kes ini, apabila keterangan saksi-saksi lain adalah kurang jelas untuk mahkamah ini menentukan milikan dan pengetahuan tertuduh pertama, mahkamah ini perlu untuk mendengar keterangan dari tertuduh kedua yang telah mengaku salah, sebelum menimbangkan pengakuan rakan orang kena tuduh untuk mensabitkan tertuduh yang satu lagi dan menentukan pengunaan peruntukkan seksyen 34 kanun keseksaan, namun pihak pendakwaan telah tidak memanggil tertuduh kedua untuk memberi keterangan untuk mahkamah ini membuat penilaian. [23] Mahkamah ini merujuk kepada undang-undang yang mengawal selia kebergantungan keterangan rakan sejenayah yang telah dirumuskan dalam kes Ahmad Majmi Idris & Anor v PP [2014] 1 LNS 148 di mana Mahkamah Rayuan memutuskan bahawa:- “[12] The law on the evidence of an accomplice is contained in section 133 and section 114(b) of the Evidence Act 1950 (‘the EA’). Section 133 of the EA declares that an accomplice shall be a competent witness against an accused person; and a conviction is not illegal merely because it proceeds upon the uncorroborated testimony of an accomplice. This provision must be read with section 114(b) of the EA which stipulates that the court may presume that an accomplice is unworthy of credit unless he is corroborated in material particulars. However, the presumption under section 114 (b) should not be applied automatically. The trial judge has a discretion whether to apply or not the presumption…” [24] Malah, adalah salah untuk mahkamah ini mengaplikasi anggapan di bawah sek.114 (b) untuk menolak keterangan tertuduh kedua secara automatik hanya kerana beliau adalah rakan sejenayah. Dalam hal ini, Mahkamah merujuk kepada kes Abdul Karim Kula v PP [2009] 10 CLJ 1 di mana Mahkamah memutuskan bahawa:- “[26] Learned counsel also drew the court’s attention to s. 114(b) of the Evidence Act 1950 which provides that the court may presume that an accomplice is unworthy of credit unless he is corroborated in material particulars. This provision was the subject of an appeal in PP v. Haji Ismail & Anor [1939] 1 LNS 68;; [1940] 9 MLJ 76 where the Magistrate in acquitting the accused who was charged under s. 161 of the Penal Code automatically applied the presumption. In ruling that the learned Magistrate was in error Cussen J said at p. 79: There is no question of the mechanical application of any general rule of presumption. When it is a question of this particular presumption, the credibility of the witness who is in the position of an accomplice must be individually judged as any other witness, the same considerations being applied, with the added one that he is an accomplice. The court must consider who and what he is, his demeanour, hearing, the manner and quality and substance of his evidence in itself and in relation to all the circumstances of the case. The nature, quality and degree of his complicity must be examined. Then finally the Court must form its opinion whether he is to be given credit and his evidence accepted without corroboration or not. He is a competent witness and as such is entitled to have his credibility judged in itself; his evidence must be weighed and examined and not put aside unjudged and unconsidered because he is an accomplice. [27] It is therefore wrong to apply the presumption under s. 114(b) of the Evidence Act without giving due consideration to the evidence of the accomplice.” [25] Memandangkan dalam kes bicara, pihak pendakwaan adalah tidak memanggil tertuduh kedua yang telah mengaku salah untuk memberi keterangan di mahkamah, maka mahkamah ini tidak berpeluang untuk menilai keterangan tertuduh kedua dan juga tidak boleh mengaplikasikan penggunan s.114 (b) Akta Keterangan secara terus. Selanjutnya sebagaimana kes yang diputuskan diatas adalah jelas turut menyatakan; “..Section 133 of the EA declares that an accomplice shall be a competent witness against an accused person; and a conviction is not illegal merely because it proceeds upon the uncorroborated testimony of an accomplice..” [26] Walaupun tertuduh pertama dan kedua ditangkap bersama-sama, keadaan tersebut sahaja tidak dapat membuktikan kedua-dua mereka mempunyai niat bersama. Malah apabila dilihat dari fakta dan keterangan yang mana bilik stor tempat serbuan adalah juga dirumah tertuduh pertama dan tertuduh kedua hadir ke situ. Pengetahuan tertuduh pertama terhadap barang kes yang tertuduh kedua mengaku miliknya adalah tidak dapat juga dibuktikan. [27] Oleh yang demikian, secara keseluruhannya pihak pendakwaan gagal untuk membuktikan tertuduh pertama mempunyai milikan, kawalan dan pengetahuan keatas dadah yang ditemui dan justeru itu andaian di bawah seksyen 37 (d) Akta Dadah Berbahaya 1952 juga tidak terpakai. Keputusan Di akhir kes Pendakwaan. [24] Memandangkan elemen pertama gagal dibuktikan pihak pendakwaan dan berdasarkan kepada alasan-alasan diatas, mahkamah ini mendapati pihak pendakwaan telah gagal untuk membuktikan satu kes Prima Facie terhadap tertuduh. Berdasarkan keterangan yang ada di hadapan mahkamah, adalah tidak selamat untuk memanggil tertuduh pertama untuk membela diri terhadap pertuduhan tersebut dan mahkamah ini tidak bersedia untuk mensabitkan tertuduh jika pembelaan dipanggil dan tertuduh memilih untuk berdiam diri. [25] Maka tertuduh adalah dengan ini, dilepaskan dan dibebaskan dari kesemua pertuduhan, tanpa dipanggil membela diri. Berdasarkan keputusan ini, mahkamah juga memerintahkan supaya wang jaminan yang telah didepositkan di Mahkamah dikembalikan kepada tertuduh pertama.
