the dispute is finally decided by arbitration or the court.”. [69] If this Court allows the application by the GoM in the other OS, then SSB’s application by virtue of this OS must necessarily be dismissed. The converse applies (see, among others, paragraph 16 in the judgment in Tidalmarine Engineering Sdn Bhd v. Conlay Construction Sdn Bhd & Another Case [2018] 2 CLJ 376). 73 [70] There being no merits to the setting aside application by the GoM, the said Decision must be accorded its full force and effect by allowing it to be enforced as if it is an order or judgment of this Court pursuant to subsection 28(1) CIPAA. Conclusion [71] Based on all of the aforesaid considerations, the GoM’s contentions that there is a breach of natural justice and/or the learned Adjudicator had acted in excess of her jurisdiction are misconceived and unfounded.
