Lampiran 1 tersebut dan membenarkan pampasan gantirugi kepada Responden secara taksiran. [13] Oleh itu, Responden menuntut ganti rugi untuk dibayar oleh Pemohon-Pemohon secara bersesama dan berasingan, seperti berikut- (a) Ganti rugi khas sebanyak RM584,523.00; (b) Gantirugi am, teruk dan teladan untuk ditaksirkan oleh Mahkamah Yang Mulia; S/N Ly9j4zQ3mEG6aq2/DhdYvg (c) Faedah pada kadar 5% setahun ke atas jumlah penghakiman bermula daripada tarikh penghakiman sehingga ke tarikh penyelesaian penuh; (d) Kos taksiran ganti rugi ini; dan (e) Apa-apa relief tambahan yang pada hemat Mahkamah Yang Mulia ini adalah adil dan suai manfaat. Hujahan Pihak-Pihak [14] Pemohon-Pemohon berhujah bahawa tuntutan ganti rugi khas yang dituntut oleh Responden berjumlah RM584,523.00 merupakan suatu amaun yang tidak munasabah dan wajar dipertimbangkan semula. [15] Pemohon-Pemohon seterusnya menghujahkan bahawa walaupun undang-undang matan membenarkan Responden menuntut fi guaman dan kos berkaitan, Mahkamah tetap mempunyai budi bicara untuk menilai faktor-faktor lain; antaranya bahawa Pemohon-Pemohon merupakan orang awam dan bukannya suatu entiti korporat dan akan sangat terkesan dengan jumlah ganti rugi yang terlalu banyak. [16] Pemohon-Pemohon turut berhujah bahawa pihak Responden telah gagal untuk membuktikan secara spesifik berkenaan dengan butiran-butiran berkaitan dengan pihak-pihak bagi perkhidmatan oleh Tetuan Haaz (M) Sdn. Bhd., Tetuan CHY Architects Sdn. Bhd. dan Tetuan Unitech QS Consultancy (KL) Sdn. Bhd. seperti-S/N Ly9j4zQ3mEG6aq2/DhdYvg (a) Bukti lantikan dan/atau tempoh perkhidmatan yang dipersetujui oleh pihak-pihak bagi perkhidmatan yang dipersetujui; (b) Invois bagi kos sebanyak RM 2,835.00 oleh Tetuan CHU Architects berkenaan bayaran tidak dikemukakan dan tidak wujud sebarang terma-terma berkaitan kos ‘idling’ dalam Surat Tawaran (rujuk Ekshibit TSY-4 Afidavit Taksiran Ganti Rugi); dan (c) Kos dan perbelanjaan ‘idling’ tersebut dikenakan secara lump sum dan tiada butiran berkenaan dengan pengiraan secara harian dalam Surat Tawaran tersebut. [17] Dalam hal ini, Responden sebaliknya telah berhujah bahawa Responden adalah merupakan pemilik berdaftar Hartanah-Hartanah tersebut dan/atau tuanpunya yang tidak boleh disangkal. Pendudukan Pemohon-Pemohon adalah secara salah dan tanpa kebenaran Responden. Responden mempunyai kuasa yang sempurna untuk menikmati segala faedah kepentingan sebagai pemilik tanah yang sah menurut undang-undang (“proprietary right and interest”). Selain berhak melakukan apa-apa urusniaga ke atas Hartanah-Hartanah tersebut, termasuk meneruskan pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru tersebut. S/N Ly9j4zQ3mEG6aq2/DhdYvg [18] Responden turut berhujah semenjak 29 Ogos 2024 sehingga 5 September 2024, Responden telah terhalang dan diprejudis dari meneruskan keseluruhan kerja-kerja pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru tersebut akibat daripada Perintah Injunksi Interim tersebut. [19] Responden seterusnya berhujah bahawa kesan dan akibat Perintah Injunksi Interim tersebut bukan sahaja terhad kepada tiga (3) hartanah berkaitan Pemohon ke-3, ke-4 dan ke-5, sebaliknya Responden telah terhalang daripada meneruskan segala kerja pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru yang melibatkan keseluruhan Hartanah-Hartanah di Kampung Sungai Baru. Oleh itu, Responden telah terhalang daripada menikmati segala faedah kepentingan dan hak sebagai pemilik tanah yang sah menurut undang-undang (“proprietary right and interest”), termasuk untuk menjalankan segala urusniaga ke atas Hartanah-Hartanah tersebut. Inilah impak dan kesannya akibat Perintah Injunksi Interim tersebut. [20] Responden juga berhujah bahawa berdasarkan kesan dan impak yang dinyatakan, Perintah Injunksi Interim tersebut dengan jelas telah memprejudiskan Responden secara teruknya sehingga menyebabkan Responden mengalami kehilangan dan kerugian yang mewajarkan Responden dipampas dengan sewajarnya. Ganti Rugi Khas [21] Untuk tuntutan gantirugi khas, Responden menyatakan telah S/N Ly9j4zQ3mEG6aq2/DhdYvg melantik Tetuan Zulpadli & Edham pada 30 Ogos 2024, untuk memfailkan permohonan bagi menentang dan mempertikai Lampiran 1 termasuk untuk memfailkan permohonan pengenepian dan pembatalan Perintah Injunksi Interim tersebut, demi menjaga hak dan kepentingan Responden di mana fi guaman professional yang dikenakan dan perlu dibayar adalah sebanyak RM543,076.00 (Fi Guaman). [22] Responden menyatakan bahawa setakat pemfailan hujahan bertulis Responden, Dokumen dan kertas-kertas kausa yang telah difailkan oleh Tetuan Zulpadli & Edham, adalah sepertimana di Lampiran 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 27, 29, 30, 31, 36 dan 37 dalam tindakan ini. [23] Fi guaman profesional yang dikenakan adalah berdasarkan kerumitan dan kepentingan perkara subjek yang dipertikai di samping tempoh masa yang singkat dan segera untuk penyediaan dokumen dan kertas-kertas kausa yang berkenaan bagi tujuan pendengaran di mana jumlah sebanyak RM543,076.00 tersebut adalah merupakan suatu jumlah yang wajar dan munasabah sebagai fi guaman professional yang terpaksa dibelanjakan di dalam tindakan ini. [24] Di atas lantikan Tetuan Zulpadli & Edham tersebut, Lampiran 1 tersebut telah berjaya ditolak di mana hak dan kepentingan Responden terhadap Hartanah-Hartanah tersebut berjaya dikembalikan semula. S/N Ly9j4zQ3mEG6aq2/DhdYvg [25] Peguam Responden menghujahkan bahawa Fi Guaman tersebut adalah hak yang boleh dituntut oleh Responden sebagai ganti rugi atas dasar tanggung rugi penuh (“full indemnity”). [26] Selanjutnya, Responden melalui pekerja, ejen dan/atau wakil yang dilantik, telah terhalang daripada meneruskan kerja-kerja pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru tersebut kesan dan akibat daripada Perintah Injunksi Interim tersebut bermula 29 Ogos 2024 sehingga 5 september 2024 di mana pekerja, ejen dan/atau wakil yang dilantik tersebut telah mengenakan kos dan perbelanjaan tambahan untuk menggantikan tempoh yang mereka terhalang daripada melaksanakan kerja-kerja yang berkaitan seperti yang berikut:- (a) Tetuan Haaz (M) Sdn. Bhd., yang dilantik sebagai kontraktor untuk tujuan meroboh dan membina papan dendeng bagi lapan (8) Hakmilik Induk tersebut, telah mengenakan kos dan perbelanjaan tambahan kepada Responden sebanyak RM35,480.00 sebagai kos terbiar ‘idling cost’ untuk penggunaan jentera, mesin dan tenaga kerja bagi tempoh 30.8.2024 sehingga 5.9.2024. (b) Tetuan CHY Architects Sdn. Bhd., yang dilantik sebagai konsultan arkitek untuk tujuan meroboh dan membina papan dendeng bagi lapan (8) Hakmilik Induk tersebut, telah mengenakan kos dan perbelanjaan tambahan kepada Responden sebanyak RM2,835.00 sebagai kos dan perbelanjaan terbiar ‘idling cost’ untuk tenaga kerja S/N Ly9j4zQ3mEG6aq2/DhdYvg bagi tempoh 30.8.2024 sehingga 5.9.2024 butiran pengiraan adalah seperti yag berikut: - Kos dan Perbelanjaan Terbiar ‘Idling Cost’ Bil. Hari Kuantiti Kadar bulanan (RM) Jumlah (RM) CHY Architects Sdn. Bhd. Jumlah Fi Professional: - RM97,200.00 untuk 8 bulan Bayaran Bulanan: - RM12,150.00 7 hari 0.23333 12,150.00 2,835.00 (c) Tetuan Unitech QS Consultancy (KL) Sdn. Bhd., yang dilantik sebagai juruukur bahan untuk tujuan meroboh dan membina papan dendeng bagi lapan (8) Hakmilik Induk tersebut, telah mengenakan kos dan perbelanjaan tambahan kepada Responden sebanyak RM3,132.00 sebagai kos dan perbelanjaan terbiar ‘idling cost’ untuk tenaga kerja bagi tempoh 30.8.2024 sehingga 5.9.2024. [27] Berdasarkan perkara-perkara yang dinyatakan di atas, ringkasan tuntutan ganti rugi oleh Responden adalah seperti yang berikut: - No. Butiran Tuntutan Jumlah (RM) 1. Tetuan Zulpadli & Edham 543,076.00 2. Tetuan Haaz (M) Sdn. Bhd. 35,480.00 3. Tetuan CHY Architects Sdn. Bhd., 2,835.00 S/N Ly9j4zQ3mEG6aq2/DhdYvg 4. Tetuan Unitech QS Consultancy (KL) Sdn. Bhd. 3,132.00 JUMLAH KESELURUHAN 584,523.00 ANALISIS DAN DAPATAN [28] Pentaksiran ganti rugi diperuntukkan menurut Aturan 37, Kaedah (1) Kaedah-Kaedah Mahkamah 2012 (KKM 2012). [29] Dalam kes Voo Nyuk Fah & Anor v. Lam Yat Kheong & Anor [2012] 5 CLJ 229; [2012] MLJU 159; [2012] AMEJ 0030; [2012] 3 MLRA 164, Mahkamah Rayuan telah memutuskan- “[6] It is trite law that the task of taking of accounts and assessment of damages is an exercise of judicial discretion. Such discretion is a judicial one, as it is not to be exercised based on whims and fancies, but by reference, guidance and application of established judicial principles and of course having regard to all the facts and evidence adduced before the officer or the judge who undertakes the assessment. ... [7] In our view the basic governing principles may be stated as follows: ... 3. In awarding damages, be it for breach of contract or in the commission of tortuous act, the principle of "restitution in integrum" applies. In common parlance, it means that damages in terms of monetary compensation can be awarded to replace an injured party in the same or original position occupied (or enjoyed) by him before the occurrence of the injury or wrongful act. See Livingstone v. Rawyard Cool Co. [1990] 5 App. 25 which was referred to in Subramaniam Paramasivam & Ors v. Malaysian Airline System Bhd. [2002] 1 CLJ 230.”. (Juga rujuk kes Damansara Realty (Pahang) Sdn Bhd v. Om Cahaya Mineral Asia Bhd & Another Appeal [2020] MLRAU 374; [2021] 5 CLJ 283; [2021] 5 MLJ 1, Chong Nge Wei & Ors v. Kemajuan Masteron S/N Ly9j4zQ3mEG6aq2/DhdYvg Sdn Bhd & Ors [2019] 1 LNS 540; [2022] 4 CLJ 833; [2022] MLJU 529; [2022] 4 MLRA 296, dan Faradisse High Sdn Bhd v. Koperasi Polis Diraja Malaysia Berhad [2024] CLJU 821; [2024] MLRHU 837; ) [30] Mahkamah ini berpendapat bahawa dalam menilai jumlah gantirugi, ianya mestilah jumlah yang munasabah. Ini kerana telah menjadi prinsip perundangan bahawa tujuan gantirugi adalah untuk seboleh mungkin meletakkan pihak yang terlibat kepada kedudukan asal seolah-olah tidak berlaku sebarang kerugian atau keadaan yang menjejaskan kedudukan Plaintif atau Defendan, mengikut kes masing-masing. [31] Adalah jelas bahawa semenjak 29 Ogos 2024 sehingga 5 September 2024, Responden telah terhalang dari meneruskan keseluruhan kerja-kerja pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru akibat Perintah Injunksi Interim yang diperoleh Pemohon-Pemohon. [32] Ini mengakibatkan pekerja, ejen dan/atau wakil yang dilantik oleh Responden untuk melaksanakan kerja-kerja pelaksanaan Projek Pembangunan Semula Kampung Sungai Baru telah mengenakan kos dan perbelanjaan tambahan untuk menggantikan tempoh yang mereka terhalang daripada melaksanakan kerja-kerja yang berkaitan. [33] Dalam hal ini, Mahkamah Persekutuan dalam kes Takako Sakao v. Ng Pek Yuen & Anor (No 2) [2009] 3 MLRA 92; [2010] 1 CLJ 419; [2010] 2 AMR 814; [2010] 2 MLJ 181, telah memutuskan-S/N Ly9j4zQ3mEG6aq2/DhdYvg “[8] Some of the guidelines for an award of indemnity costs were discussed by Millett J (later Lord Millett) in Macmillan Inc. v. Bishopgate Investment Trust Ltd, 10 December 1993, (unreported): The power to order taxation on an indemnity basis is not confined to cases which have been brought with an ulterior motive or for an improper purpose. Litigants who conduct their cases in bad faith, or as a personal vendetta, or in an improper or oppressive manner, or who cause costs to be incurred irrationally or out of all proportion as to what is at stake, may also expect to be ordered to pay costs on an indemnity basis if they lose, and have part of their costs disallowed if they win. Nor are these necessarily the only situations where the jurisdiction may be exercised; the discretion is not to be fettered or circumscribed beyond the requirement that taxation on an indemnity basis must be 'appropriate'. [9] What appears clear is that the discretion to award costs on an indemnity basis is unfettered. All that is required is that it must be an appropriate case warranting an award on that basis. There is no doubt that in this case the second respondent conducted its case in bad faith. Its directing mind and will - indeed its alter ego - was the first respondent's common law husband. In essence he was the company. Both he and the first respondent set themselves upon a course to unlawfully deprive the appellant of her legitimate interest in the subject property. Having regard to his conduct - which is to be equated as the conduct of the second respondent company (see, Moore Stephens v. Stone Rolls Limited (in liquidation) [2009] UKHL 39, per Lord Phillips of Worth Matravers at para 51) - we consider this to be an appropriate case to award costs on an indemnity basis at all levels. We so ordered. The deposit in court was ordered to be refunded to the appellant.” [34] Dalam hal ini, Responden telah merujuk kes Ling Peek Hoe & Anor v. Ding Siew Ching & Ors [2022] 12 MLJ 658; [2022] MLRHU 771 yang telah membenarkan tuntutan fi guaman sebagai ganti rugi atas dasar tanggung rugi penuh (“full indemnity”). [35] Selanjutnya dalam kes Quill Construction Sdn Bhd v. Tan Hor Teng @ Tan Tien Chi & Anor [2003] 6 MLJ 279; [2003] 7 CLJ 24; [2003] S/N Ly9j4zQ3mEG6aq2/DhdYvg 2 MLRH 621 Mahkamah memutuskan- “Where civil process of the court or similar remedy is abused by improperly preventing the opponent from dealing with his property before his liability is established, English law does not afford a coherent remedy to the person who is injured by the improper use of such pre-judgment remedy. The common law gave no pre-judgment remedy and therefore there was no possibility of the defendants being injured. The admiralty court gives damages for wrongful arrest but not in the absence of malice. But in equity it is well established that where a plaintiff obtains an interlocutory injunction but fails to sustain it to a judgment in his favour, he will, except in special circumstances, be liable to the defendant in damages. It is not necessary to prove malice, vexation or lack of good faith. If, therefore, Lord Diplock’s analogy between an interlocutory injunction and a private caveat is taken to its logical end, a court setting aside a caveat, in principle should order an inquiry into damages as a necessary consequence of doing so.” [36] Seterusnya dalam kes Sambaga Valli a/p KR Ponnusamy v. Datuk Bandar Kuala Lumpur & Ors (and Another Appeal) [2017] CLJU 500; [2018] 4 AMR 745 [2018] 1 MLJ 784, Mahkamah Rayuan telah memutuskan- “[32] Now, aggravated damages are classified as a species of compensatory damages, which are awarded as additional compensation where there has been intangible injury to the interest of personality of the plaintiff, and where this injury has been caused or exacerbated by the exceptional conduct of the defendant. [33] The exemplary damages or punitive damages — the two terms now regarded as interchangeable — are additional damages awarded with reference to the conduct of the defendant, to signify disapproval, condemnation or denunciation of the defendant’s tortious act, and to punish the defendant. Exemplary damages may be awarded where the defendant has acted with vindictiveness or malice, or where he has acted with a ‘contumelious disregard’ for the right to the plaintiff. The primary purpose of an award of exemplary damages may be deterrent, or punitive S/N Ly9j4zQ3mEG6aq2/DhdYvg and retributory, and the award may also have an important function in vindicating the rights of the plaintiff (see Rookes v Barnard [1964] 1 All ER 367; AB and others v South West Water Services Ltd [1993] 1 All ER 609; Broome v Cassell & Co Ltd [1971] 2 QB 354, Laksmana Realty Sdn Bhd v Goh Eng Hwa and another appeal [2006] 1 MLJ 675).” [37] Merujuk kes Sambaga Valli a/p KR Ponnusamy (supra). Mahkamah ini mendapati bahawa Responden telah berjaya membuktikan tuntutannya berdasarkan dokumen-dokumen di ekshibit “TSY-3”, “TSY-4” dan “TSY-5” dalam Afidavit (Pentaksiran Ganti Rugi) tersebut. Dalam hal ini, rujukan juga dibuat dalam kes AEON Co (M) Bhd v. Asia Plywood Company Sdn Bhd & Another Appeal [2021] 5 CLJ 751; [2021] 1 MLRA 420; [2021] 2 MLJ 102 di mana Mahkamah Rayuan telah memutuskan bahawa pengemukaan dokumen invois adalah memadai bagi membuktian kerugian yang dialami oleh Responden bagi tujuan pentaksiran ganti rugi. [38] Seterusnya, dalam menentukan gantirugi teruk dan teladan, dalam kes M3 Technologies (Asia) Bhd & Anor v. Voon Sze Lin & Ors [2025] 4 CLJ 936; [2025] MLRHU 325; [2025] 10 MLJ 171 telah membenarkan jumlah sebanyak RM50,000.00 sebagai ganti rugi teruk di mana Mahkamah telah memutuskan- “[1] This judgment concerns encl. 377, which is the assessment of damages payable to the second defendant ("D2") pursuant to the plaintiffs' cross-undertaking as to damages. This obligation arose after the discharge of an Anton Piller order ("APO") obtained against D2. Initially granted ex parte by this court to preserve evidence linked to allegations of intellectual property infringement and breach of trust, the APO was later unseated by the Court of Appeal, which decreed that the order should never have been issued against D2. S/N Ly9j4zQ3mEG6aq2/DhdYvg Thus, the stage is now set for this court to grapple with the pivotal question: what loss has D2 suffered due to the wrongful execution of the APO, for which the plaintiffs, by their cross-undertaking, are bound to answer? ... [36] From the evidence led during the assessment hearing, I find that while the APO was discharged on procedural grounds, the plaintiffs' conduct in obtaining the order without a strong prima facie case and without full disclosure of material facts justifies an award of aggravated damages. The APO is a draconian order, and its misuse should be discouraged. ... [42] I am of the view that the plaintiffs' conduct of introducing the false statutory declaration by Mohamad Anif, its failure to give full and frank disclosure, coupled with the intrusive and distressing execution of the APO, justifies an award of aggravated damages to reflect the court's disapproval of the plaintiffs' actions. The harm inflicted on D2 was intensified by the manner in which the APO was used, seemingly to teach D2 a lesson despite the lack of credible evidence to substantiate a strong prima facie case against him. In light of these circumstances, I find it appropriate to award RM50,000 as aggravated damages to acknowledge the additional distress, humiliation, and sense of injustice experienced by D2 as a result of the plaintiffs' conduct.” KESIMPULAN [39] Mahkamah ini membenarkan Lampiran 36 menurut Aturan 37 Kaedah 1 KKM 2012 seperti berikut, iaitu gantirugi khas sebanyak RM 543,076.00 untuk fi guaman, idling cost sebanyak RM 35,480.00, RM 2,835.00 dan RM 3,132.00 kesemuanya berjumlah RM 584,523.00, gantirugi am, teruk dan teladan sebanyak RM 50,000.00 atas setiap Pemohon-Pemohon. Faedah 5% atas jumlah taksiran dari tarikh perintah ini hingga penyelesaian penuh. Tiada perintah atas kos. S/N Ly9j4zQ3mEG6aq2/DhdYvg *Nota Keputusan telah dibuat oleh Mahkamah ini mengenai taksiran gantirugi seperti di atas, namun begitu semasa alasan ini ditulis, Mahkamah ini mendapati terdapat kes di Mahkamah Persekutuan yang wajar diambilkira. Kes ini tidak langsung dirujuk oleh pihak-pihak semasa hujahan, untuk Mahkamah ini membuat keputusan. Dalam kes Golden Star & Ors v. Ling Peek Hoe & Anor & Another Appeal [2024] 4 MLJ 749; [2024] 6 CLJ 487; [2024] 4 AMR 477; [2024] 4 MLRA 345, Mahkamah Persekutuan telah memutuskan- “[32] The High Court had reasoned that because the respondents were liable for their fraudulent acts, following Doyle v. Olby (Ironmongers) Ltd [1969] 2 All ER 119, Smith New Court Securities v. Scrimgeour Vickers (Asset Management) Ltd [1999] 4 All ER 769, Yap Boon Hwa v. Kee Wah Soong [2019] MLRAU 289; [2020] 1 MLJ 37 and MD Biomedical Engineering (M) Sdn Bhd v. Goh Yong Khai [2022] 4 MLRA 44; [2021] 5 MLJ 408; [2021] 6 CLJ 30, the appellants were liable for all damages since the general rule of remoteness and foreseeability did not apply. Legal fees and other expenses in litigating the action between the parties were said to be a specie of special damages and thus recoverable. The Court of Appeal agreed. [33] We disagree. Damages are compensatory in nature awarded to compensate for loss sustained as a result of a civil wrong committed in breach of a duty of care. Whether such damages are recoverable or not is a matter of proof dependent on the evidence adduced at trial. …”.
