This finding of clinical competence is further fortified by SP1’s own devastating admissions under cross-examination, which completely hollowed out the Plaintiff's factual narrative of a haphazard, unsterile, and negligent procedure. In his witness statement (specifically at paragraph 9), SP1 had boldly asserted that the Defendants failed to inspect the minor Plaintiff’s anatomy prior to injecting the anaesthetic. However, when confronted under cross-examination at Page 17 of the Notes of Proceedings (Enclosure 27), specifically paragraphs 404 to 417, SP1 conceded that the Defendants did indeed hold and thoroughly clean the minor’s genitals, and carried out proper clinical preparations before administering the injection. Furthermore, despite now alleging that the clinic was unsafe and the tools were unsterile, SP1 admitted at Page 18 of the Notes of Proceedings (Enclosure 27), specifically paragraphs 418 to 422, that he stood by and observed the entire procedure without once instructing the Defendants to stop or expressing any contemporaneous objection. It is a settled principle of evidence that a party's post-facto allegations of negligence cannot stand when contradicted by their own contemporaneous conduct and admissions on the stand.
