that a man who is in possession of stolen goods soon after the theft is either the thief or has received the goods knowing them to be stolen, unless he can account for his possession; Wills on Circumstantial Evidence, 7th Edition, p. 104 has the following passage: The possession of stolen goods recently after the loss of them, may be indicative not merely of the offence of larceny, or of receiving with guilty knowledge, but of any other more aggravated crime which has been connected with theft. Upon an indictment for arson, proof that property which was in the house at the time it was burnt, was soon afterwards found in the possession of the prisoner, was held to raise a presumption that he was present at, and concerned in, the offence; R v. Rockman [1789] 2 East PC p 1035, and see R v. Fuller [1816] R & R 308. This particular fact of presumption commonly forms also a material element of evidence in cases of murder; which special application of it has often been emphatically recognised. It is upon the same principle that a sudden and otherwise inexplicable transition from a state of indigence and a consequent change of habits or a profuse or unwanted expenditure inconsistent with the position in life of the party, is sometimes a circumstance extremely unfavourable to the supposition of innocence (R. v. Burdock) (murder by poison) Bristol Assn. Ap.1835, Cor: Sir Charles Wetherell, Recorder. But the rule must be applied with discrimination, for the bare possession of stolen property, though recent, uncorroborated by other evidence, is sometimes fallacious and dangerous as a criterion of guilt. In the present case, the only evidence to connect the appellant with the killing is the possession of two pieces of jewellery, the property of the deceased, and it is not certain that they were on the deceased's person on the day of his death. In our view, this did not supply sufficient evidence on which to found a conviction for murder, and we accordingly allowed the appeal and directed that the appellant should be discharged." In the present case, the only evidence to connect the appellant with the killing is the possession of two pieces of jewellery, the property of the deceased, and it is not certain that they were on the deceased's person on the day of his death. In our view, this did not supply sufficient evidence on which to found a conviction for murder, and we accordingly allowed the appeal and directed that the appellant should be discharged. In this case the deceased was wearing the gold chain at the time of her death. This is a material element to connect the appellant to the murder of the deceased. This is further supported by other evidence such as, the acid injury on the appellant's lips and arm when the deceased also had acid injuries and the presence of the Yamaha motorcycle at the deceased's shop at about 7.05 am on the material date. Thus, the evidence is sufficient to convict the appellant for the murder of the deceased." [53] Mahkamah ini menilai bahawa keterangan barang-barang peribadi si mati yang berada di tangan Perayu telah disokong oleh keterangan bahawa terdapatnya DNA Perayu di rumah si mati iaitu pada puntung rokok dan rambut. Keterangan-keterangan ini jelas menunjukkan Perayu sememangnya ada di rumah si mati, dan adalah signifikan serta melimpah-limpah bahawa Perayu ada bersama si mati sejurus sebelum itu. Perayu tiada jalan keluar untuk menafikan perkara ini, kecuali mengakui bahawa sememangnya dia ada di rumah si mati bersama si mati. [54] Merujuk kembali kepada keterangan pakar forensik iaitu SP9, SP9 mengesahkan si mati telah meninggal dunia tiga puluh enam (36) jam sebelum autopsy dilakukan, di mana pada 18.01.2018 hingga pagi 19.01.2018 adalah masa kematian si mati. Pada keesokannya 19.01.2018 jam 5.00 pagi, Perayu telah sampai di rumah kakaknya di Johor Bahru sebagaimana keterangan kakak perayu, SP8. Pada hari yang sama jam 2.04 petang, Perayu telah menggunakan kad debit si mati di Johor Bahru, suatu tempat yang jauh dari rumah si mati. [55] Mahkamah ini mendapati, gabungan keterangan ikut keadaan ini, bersama-sama dengan keterangan saksi-saksi, menjurus kepada tiada yang lain kecuali Perayu adalah orang terakhir yang bersama dengan si mati sebelum si mati meninggal dunia. Penyelia si mati telah mencari si mati yang telah tidak datang kerja pada 19.01.2018 (Jumaat) dan 22.01.2018 (Isnin). Pengesahan kematian oleh SP9, si mati telah meninggal pada tiga (3) hari sebelum si mati dijumpai. Mahkamah ini memutuskan bahawa keterangan-keterangan ikut keadaan termasuk keterangan-keterangan daripada saksi-saksi sekeliling kes ini, sesungguhnya adalah nyata bahawa keterangan-keterangan ini telah membentuk keterangan ikut keadaan yang kuat yang boleh mewujudkan keterangan prima facie, dan hanya boleh dipatahkan oleh keterangan sahaja. Ianya seperti cahaya dari berbagai sudut menyuluh kepada suatu objek dan telah dapat mengesahkan identiti objek itu. Objek itu adalah bahawa Perayu adalah orang yang terakhir bersama si mati dan orang yang telah membunuh si mati. Mahkamah ini yakin dengan keterangan-keterangan yang dikemukakan, menunjukkan secara muktamad bahawa Perayu adalah orang yang membunuh si mati, dan bukannya orang lain. Mahkamah ini merujuk kepada panduan yang disampaikan oleh Hill Ag. C.J. di dalam kes Idris v. Public Prosecutor [1960] CLJU 40; [1960] 26 MLJ 296 sebagaimana berikut: "With regard to the definition of circumstancial evidence I can give you no better definition than quote to you the words of Lord Cairns in the case of Belhaven & StentonPeerage reported in 1875-6 Appeal Cases, page 297: My Lords, in dealing with circumstantial evidence we have to consider the weight which is to be given to the united force of all the circumstances put together. You may have a ray of light so feeble that by itself it will do little to elucidate a dark corner. But on the other hand you may have a number of rays, each of them insufficient, but all converging and brought to bear upon the same point, and when united, producing a body of illumination which will clear away the darkness which you are endeavouring to dispel. In other words circumstantial evidence consists of this: that when you look at all the surrounding circumstances, you find such a series of undersigned, unexpected coincidences that, as a reasonable person, you find your judgment is compelled to one conclusion. If the circumstantial evidence is such as to fall short of that standard, if it does not satisfy that test, if it leaves gaps then it is of no use at all." [56] Dalam kes ini juga, keterangan pakar forensik, SP9 jelas menyatakan bahawa punca kematian si mati adalah kecederaan di bahagian kepala akibat kudrat kuat objek tumpul dan SP9 juga telah mengesahkan secara positif bahawa kecederaan-kecederaan tersebut dialami oleh si mati sehingga menyebabkan kematian. Pada pandangan Mahkamah ini, pukulan yang dihasratkan sedemikian pastinya telah mendatangkan kecederaan kepada si mati yang akhirnya membawa kepada kematiannya. [57] Oleh yang demikian, pada hemat kami, keterangan-keterangan tersebut telah menyokong dapatan bahawa Perayu telah melakukan kesalahan di bawah Seksyen 300(c) Kanun Keseksaan, yang mana Perayu didapati bersalah atas kesalahan membunuh apabila perbuatannya memukul si mati tersebut dilakukan dengan niat hendak menyebabkan kematian. Kesalahan yang dilakukan oleh Perayu ini bukanlah sekadar kesalahan mematikan orang dengan salah di bawah Seksyen 299 Kanun Keseksaan. Keterangan-keterangan ikut keadaan yang dikemukakan oleh pihak Pendakwaan dalam kes ini sesungguhnya pada hemat kami, mencukupi untuk menunjukkan bahawa Perayu mempunyai niat untuk menyebabkan kematian si mati. [58] Selanjutnya, Mahkamah ini akan merujuk kepada beberapa keputusan Mahkamah Persekutuan yang memutuskan bahawa kecederaan si mati terjumlah kepada kesalahan menurut Seksyen 302, Seksyen 304(a) dan Seksyen 304(b) Kanun Keseksaan. Mahkamah ini terlebih dahulu ingin mengulas lebih lanjut berhubung pembuktian Seksyen 300(c) Kanun Keseksaan, yakni sama ada kecederaan yang dialami oleh mangsa dalam kes ini mencukupi pada lazimnya untuk untuk menyebabkan kematian. [59] Mahkamah Persekutuan dalam kes Zulkiple Mohammad v. PP [2022] 1 CLJ 673 menyatakan bahawa dalam menentukan sama ada kecederaan yang dialami oleh si mati mencukupi pada lazimnya untuk untuk menyebabkan kematian, ianya merupakan suatu persoalan fakta yang perlu diteliti oleh Mahkamah. Dalam hal ini, pendapat pakar perubatan, pakar patologi, pakar forensik dan seumpanya adalah diperlukan dalam membantu Mahkamah membuat dapatan fakta sama ada kecederaan yang dialami mencukupi pada lazimnya untuk menyebabkan kematian. Dalam penghakimannya, Abdul Rahman Sebli HMP (pada masa tersebut) menyatakan seperti berikut: [15] Whether the injury is sufficient in the ordinary course of nature to cause death is essentially a question of fact for the court to determine. Since however, this is a matter that is in the realm of medical science, medical evidence is needed to assist the court in arriving at a decision. Obviously, it is not for any layperson without the proper medical training and background to determine as a matter of scientific fact whether a particular injury is sufficient in the ordinary course of nature to cause death." [60] Prinsip berhubung frasa "lazimnya untuk menyebabkan kematian" (in the ordinary course of nature to cause death) telah dibincangkan secara panjang lebar oleh Mahkamah Persekutuan dalam kes Muhammad Akmal Zuhairi Azmal & Yang Lain Iwn. PP [2025] 4 CLJ 837. Dalam kes tersebut, isu yang dibincangkan adalah sama ada luka-luka bakar yang dialami oleh si mati, seorang penuntut Universiti Pertahanan Nasional Malaysia (UPNM) adalah mencukupi pada lazimnya untuk menyebabkan kematian. Mahkamah Persekutuan mendapati bahawa keterangan saksi pakar (SP6) yang menggunakan frasa "boleh menyebabkan kematian" atau "peluang hidup si mati adalah tipis" tidaklah terjumlah kepada mencukupi pada lazimnya untuk untuk menyebabkan kematian. Penggunaan perkataan "boleh" hanya merupakan suatu kemungkinan sahaja dan ianya tidak semestinya terjadi. Justeru, salah satu elemen penting Seksyen 300(c) Kanun Keseksaan telah gagal dibuktikan oleh pihak Pendakwaan dalam kes tersebut. [61] Dalam kes Muhammad Akmal Zuhairi Azmal (supra) tersebut, Nordin Hassan HMP dalam penghakiman beliau menyatakan sebagaimana berikut: "Sama Ada Kecederaan Terhadap Si Mati Tersebut Mencukupi Pada Lazimnya Untuk Menyebabkan Kematian [85] Seterusnya, salah satu elemen yang penting dalam pembuktian s. 300(c) ialah kecederaan luka-luka bakar yang dialami oleh si mati adalah mencukupi pada lazimnya untuk menyebabkan kematian. Penekanan di sini adalah pada frasa "lazimnya untuk menyebabkan kematian". (In the ordinary course of nature to cause death). [86] Kamus Dewan Perdana oleh Dewan Bahasa dan Pustaka di ms. 1269, mentafsirkan makna perkataan "lazim" sebagai "biasa" atau "selalu". Di sini, perkataan lazimnya untuk menyebabkan kematian membawa maksud kebiasaannya atau selalunya membawa kematian. Sehubungan itu, pihak pendakwaan mesti membuktikan melampaui keraguan yang munasabah bahawa kecederaan luka-luka bakar yang dialami oleh si mati adalah mencukupi pada kebiasaannya atau selalunya untuk menyebabkan kematian. [87] Maksud frasa 'mencukupi pada lazimnya menyebabkan kematian' atau dalam Bahasa Inggerisnya, 'sufficient in ordinary course of nature to cause death' ada dijelaskan dalam kes State Of AP v. Rayavarapu Punnayya & Anor [1977] AIR 45 seperti yang berikut: "16. In Clause 3 of Section 300, instead of the words likely to cause death occurring in the corresponding clause (b) of section 299, the words "sufficient in the ordinary course of nature" have been used. Obviously, the distinction lies between a bodily injury likely to cause death and a bodily injury sufficient in the ordinary course of nature to cause death. The distinction is fine but real and if overlooked, may result in miscarriage of justice. The difference between Clause (b) of section 299 and Clause (3) of section 300 is one of the degree of probability of death resulting from the intended bodily injury. To put it more broadly, it is the degree of probability of death which determines whether a culpable homicide is of the gravest, medium or the lowest degree. The word "likely" in clause (b) of section 299 conveys the sense of probable as distinguished from a mere possibility. The words "bodily injury...sufficient in the ordinary course of nature to cause death" mean that death will be "most probable" result of the injury, having regard to the ordinary course of nature." (penekanan ditambah) [88] Selanjutnya, maksud "sufficient" di bawah s. 300(c) yang dinyatakan di atas telah juga disentuh dalam kes Zulkiple Mohamad di mana dinyatakan: [34] In another Singapore Court of Appeal decision, it was held in Wang Wenfeng v. PP [2012] SGCA 47 that if the bodily injury intentionally inflicted was sufficient in the ordinary course of nature to cause death, s. 300(c) murder would have been committed "as a matter of course". Chan Sek Keong CJ speaking for the court also touched on the issue of "sufficiency" at p. 602:
