(D) Ketiadaan Keterangan CCTV Di Tempat Kejadian Atau Kesan Cap Jari Tertuduh Pada Ekshibit P8 Tersebut. [119] Peguam tertuduh yang bijaksana menghujahkan bahawa ketiadaan CCTV di tempat kejadian atau kesan cap jari tertuduh pada ekshibit P8 tersebut menyokong versi pembelaan bahawa tertuduh tidak mempunyai pengetahuan bahawa terdapatnya dadah di dalam beg tersebut. Dengan itu, pergantungan oleh Hakim Mahkamah Tinggi yang bijaksana atas anggapan pengetahuan di bawah seksyen 37(d) Akta Dadah Berbahaya 1952 dan seterusnya pengedaran adalah tidak bersesuaian dan tidak bertepatan sama sekali. S/N wZzoZwhk8kYgX4dZk1VJg [120] Dengan hormatnya, kami tidak bersetuju dengan penghujahan tersebut. Tertuduh telah ditangkap ketika sedang membongkok untuk mengambil ekshibit P8 di dalam kereta tersebut. Maka dengan itu, keterangan forensik seperti CCTV atau kesan cap jari hanya mempunyai nilai sokongan yang kecil sahaja. Keterangan forensik seperti ini adalah relevan dan mempunyai kesan yang significant bila identiti seseorang menjadi isu pertikaian atau keterangan SP5 ditolak atau wholly discredited namun ini bukanlah situasi yang berlaku di hadapan kami ini. [121] Di dalam kes PP v. Mansor Md Rashid & Anor [1997] 1 CLJ 233, Mahkamah Persekutuan melalui penghakiman yang disampaikan oleh Chong Siew Fai CJSS (beliau pada ketika itu) menyatakan seperti yang berikut: “We also find ourselves in agreement with the learned Deputy Public Prosecutor that the learned trial Judge had erred in law when he faulted PW13 the investigating officer for not lifting the finger prints off the wrappings of the cannabis and for not taking photographs of the street light in front of the house No. 129. Where the identity of a culprit is in question or required to be proved, fingerprint evidence would be of great significance and immense value. In the present case under appeal, however, the charge alleged trafficking in the form of sale and there is evidence indicating the identities of the alleged offenders and the sale transaction. Fingerprint evidence on the newspaper wrapping, white plastic and the loytape, therefore, assumes little value or significance." [122] Di dalam kes PP v. Ebrahim Mirzaie Hj Ebrahim Deh Mokhtar [2017] 1 CLJ 575, Mahkamah Rayuan melalui penghakiman S/N wZzoZwhk8kYgX4dZk1VJg yang disampaikan oleh Ahmadi Asnawi HMR (beliau pada ketika itu) memutuskan seperti berikut: “[38] The evidential value of CCTV evidence. DNA profiles and fingerprint impressions as decided by high authority is only corroborative. The learned trial judge correctly appreciated the position. In PP v Mansor Md Rashid & Anor [1997] 1 CLJ 233, the Federal Court stated that: Where the identity of a culprit is in question or required to be proved, fingerprint evidence would be of great significance and immense value. In the present case under appeal, however, the charge alleged trafficking in the form of sale and there is evidence indicating the identities of the alleged offenders and the sale transaction. Fingerprint evidence on the newspaper wrapping, white plastic and the loytape, therefore, assumes little value or significance. [39] Now, having scrutinised the evidence, we were with the learned DPP that even without the CCTV evidence, DNA profiles and fingerprint impressions, there are sufficient evidence to prove the prosecution's case. [40] The evidence of both PW2 and PW3 (DSM Hairudin bin Abdullah) were uncontroverted that they saw the respondent pulling the bag, exh. P10, before and at the time they approached the respondent. The bag they saw and seized was a brown coloured bag carrying the “Sphere” brand name, exh. P10. It was the respondent himself who had put the said bag in the scanning machine and it was equally the respondent himself who had carried S/N wZzoZwhk8kYgX4dZk1VJg the said bag to the narcotics office. Both testified that the examination of the said bag was done in the presence of the respondent. These are uncontroverted direct evidence which needs no further support for its sustenance.” [123] Di dalam kes Public Prosecutor v. Badrulsham bin Baharom [1987] 1 LNS 72 [1987] CLJU 72, Lim Beng Choon J memutuskan seperti yang berikut: “In the present case, the prosecution had clearly established that the accused was in actual physical custody and control of P3 and its contents. From the totality of the evidence, the prosecution had also clearly established that the accused had the necessary knowledge of P6A-H and the nature of the dangerous drugs in question. In the circumstances, I cannot find fault with the police for failing to send the exhibits to the chemist in order to carry out finger print tests. The contention of the learned defence counsel, with due respect, amounts to nothing more than to ask this court to determine not whether there was sufficient evidence adduced before this court to warrant a conviction of the accused but to determine that the methodology of the police investigation must be 100% correct regardless of the fact that the police had gathered more than sufficient evidence to sustain a conviction of the accused. Besides, the learned defence counsel had failed to question any of the police witnesses as to why they did not send the exhibits for a finger print test. Had such a question been put to any one of them, a satisfactory explanation might have been given. I cannot therefore yield to the suggestion of the learned defence counsel particularly S/N wZzoZwhk8kYgX4dZk1VJg when I am fully satisfied from the totality of the evidence that the accused had knowledge of the dangerous drugs in question. Furthermore, as the bag, P3, and its contents were in his possession at the material time he had ample opportunity to dispose of the dangerous drugs in question when he chose to do so.” Kesimpulan [124] Berdasarkan kepada penilaian-penilaian diatas, kami mendapati bahawa keterangan tertuduh adalah tidak kredibel, suatu pemikiran terkemudian dan penafian semata-mata manakala keterangan SD3 pula tidak dapat menyokong pembelaan tertuduh serta tidak konsisten dengan keterangan tertuduh. [125] Menyentuh mengenai pembelaan bersifat simple denial, Mahkamah Persekutuan di dalam kes DA Duncan v. PP [1980] 2 MLJ 195, melalui penghakiman yang disampaikan oleh Raja Azlan Shah CJ (beliau pada ketika itu) telah memutuskan seperti yang berikut: “The defence was, in effect, a simple denial of the evidence connecting the appellant with the four boxes. We cannot see any plausible ground for saying that the four boxes were not his. In the circumstances of the prosecution evidence, the High Court came, in our view, to the correct conclusion that this denial did not cast a doubt on the prosecution case against the appellant.” [126] Di dalam kes Losali v. PP [2012] 2 CLJ 178, Mahkamah Rayuan melalui penghakiman yang disampaikan oleh Abdul Malik Ishak HMR (beliau pada ketika itu) memutuskan seperti yang berikut: S/N wZzoZwhk8kYgX4dZk1VJg “[54] The learned trial judge rightly held that the defence of the appellant was a bare denial. It is trite law that the defence of bare denial is no defence. What this amount to is this. That the appellant did not offer any explanation to the two charges and merely denied the evidence advanced by the prosecution. That was indeed a perilous course to undertake. [55] The bare denial cannot in law raise a reasonable doubt and the appellant must be convicted for both the charges. Raja Azlan Shah CJ (Malaya) (as His Majesty then was) in D.A. Duncan v. Public Prosecutor [1980] 2 MLJ 195, had this to say in regard to the defence of simple denial: The defence was, in effect, a simple denial of the evidence connecting the appellant with the four boxes. We cannot see any plausible ground for saying that the four boxes were not his. In the circumstances of the prosecution evidence, the High Court came, in our view, to the correct conclusion that this denial did not cast a doubt on the prosecution’s case against the appellant. [59] The defence of mere denial was also considered by the Federal Court in PP v. Abdul Manaf Muhamad Hassan [2006] 2 CLJ 129, FC, and their Lordships (with a coram of Abdul Malek Ahmad PCA, Steve Shim CJ (Sabah & Sarawak), Arifin Zakaria FCJ) did not place much emphasis on such a defence.” [127] Disebaliknya, keterangan SD2 pula adalah amat konsisten dan menyokong keterangan saksi-saksi pendakwaan khususnya keterangan S/N wZzoZwhk8kYgX4dZk1VJg SP5. Ini menambah lagi keyakinan kami akan kebenaran dan kekuatan keterangan kes pendakwaan. [128] Setelah meneliti keseluruhan keterangan yang dikemukakan di peringkat kes pendakwaan dan juga di peringkat kes pembelaan, kami mendapati bahawa pihak pembelaan telah gagal untuk menimbulkan apa-apa keraguan yang munasabah terhadap kes pendakwaan. Kami juga mendapati bahawa pihak pembelaan telah gagal untuk mematahkan anggapan pengetahuan di bawah seksyen 37(d) Akta Dadah Berbahaya
