Lampiran 2), KPI memaklumkan JC bahawa KPI menolak bantahan yang dikemukakan JC. Alasan-alasan penolakan KPI adalah:- (a) Kes telah ditadbir selama 15 tahun; (b) Tiada aduan dari JC mengenai apa-apa kesalahan yang dilakukan oleh JD; (c) JD tidak memiliki apa-apa aset yang boleh dihasilkan bagi faedah pihak pemiutang; (d) Pentadbiran kes tidak akan mendatangkan sebarang faedah kepada estet kebankrapan serta membazirkan wang awam. S/N w6o3ePrEWkaj41CostQj0A 4. Peguam JC kemudiannya menulis surat bertarikh 20.7.2022 kepada KPI memaklumkan bahawa peguam baharu mendapat arahan anakguam untuk membantah pelepasan JD dan JC berhasrat untuk memohon lanjutan masa selama 21 hari dari tarikh suratcara untuk membolehkan JC memfailkan kertas-kertas kausa di Mahkamah. 5. Seterusnya, pada 25.7.2022, Peguam JC telah memfailkan Saman Dalam Kamar dalam lampiran 1 untuk antara lain memohon lanjutan masa menurut Aturan 3 Kaedah 5 Kaedah-kaedah Mahkamah 2012 untuk memfailkan permohonan bagi menghalang KPI dari mengeluarkan sijil pelepasan di bawah seksyen 33A sebagaimana diperuntukkan di bawah seksyen 33B(4) Akta Tersebut. 6. Mahkamah dalam hal ini merujuk kepada Kaedah 284 Kaedah-kaedah Insolvensi 2017 (selepas ini dirujuk sebagai Kaedah Tersebut) yang memperuntukkan bahawa:- “Dalam ketiadaan mana-mana kaedah yang mengawal selia mana-mana prosiding di bawah Akta atau Kaedah-Kaedah ini, Kaedah-Kaedah Mahkamah 2012 hendaklah terpakai, mutatis mutandis.” 7. Mahkamah seterusnya merujuk kepada seksyen 93(4) Akta Tersebut yang secara spesifik memperuntukkan bahawa:- “(4) Where by this Act or by general rules the time for doing any act or thing is limited, the court may extend the time, either before or after the expiration thereof, upon such terms, if any, as to the court seems fit.” S/N w6o3ePrEWkaj41CostQj0A 8. Memandangkan terdapat peruntukan khusus untuk lanjutan masa dalam Akta Tersebut, Mahkamah berpendapat bahawa adalah salah bagi pihak JC memfailkan permohonan menurut Aturan 3 Kaedah-kaedah Mahkamah 2012. Maka, atas saranan Mahkamah, pihak JC telah memohon pindaan kepada lampiran 1 dan permohonan tersebut telah dibenarkan oleh Mahkamah ini pada 14.9.2022, memandangkan KPI tiada bantahan terhadap permohonan tersebut. 9. Selaras dengan kebenaran Mahkamah tersebut, pihak JC telah memfailkan Saman Dalam Kamar Terpinda dalam Lampiran 12 yang menjadi pertikaian di hadapan Mahkamah ini. Analisis dan keputusan 10. Sebagaimana dinyatakan dalam tajuk kepada seksyen 93 Akta Tersebut, peruntukan tersebut adalah peruntukan am berkaitan kuasa budi bicara Mahkamah. Mahkamah boleh menggunakan kuasa budi bicara am dalam seksyen 93(4) Akta Tersebut untuk melanjutkan tempoh masa yang dihadkan dalam peruntukan spesifik dalam Akta Tersebut atau Kaedah Tersebut, sekiranya peruntukan spesifik tersebut memberi ruang kepada Mahkamah untuk berbuat demikian. 11. Ada beberapa peruntukan spesifik yang memberi kuasa spesifik kepada Mahkamah untuk melanjutkan masa dan dengan demikian, Mahkamah pada kebiasaan tiada masalah dalam menggunakan budi bicara am di bawah seksyen 93(4) Akta Tersebut untuk melanjutkan tempoh masa yang dihadkan. Umpamanya, Kaedah 94 Kaedah Tersebut memperuntukkan bahawa:- S/N w6o3ePrEWkaj41CostQj0A “Subject to the power of the court to extend the time, a bankruptcy notice shall be served within three months from the issue of the bankruptcy notice.” 12. Dalam mentaksirkan peruntukan ini, Mahkamah pada kebiasaan tiada masalah dalam menggunakan budi bicara di bawah seksyen 93(4) Akta Tersebut untuk melanjutkan tempoh masa yang diperuntukkan dalam Kaedah 94 tersebut. Perkara ini dapat dilihat dalam kes Re Aris Massod Ex P UOL Factoring Sdn Bhd [1999] 3 MLJ 358; [1998] 4 CLJ SUPP 446; [1998] 1 MLRH 843. Dalam kes tersebut, JC memfailkan Notis Kebankrapan terhadap JD pada 31.10.1997. Pada 9.12.1997, JC telah memperolehi perintah Mahkamah untuk melanjutkan Notis Kebankrapan bagi tempoh 12 bulan mulai 30.1.1998 dan perintah untuk menyampaikan Notis Kebankrapan tersebut secara penyampaian ganti. JD memfailkan permohonan untuk mengetepikan kedua-dua perintah tersebut dan Penolong Kanan Pendaftar telah menolak permohonan tersebut. Dalam Rayuan kepada Hakim Dalam Kamar, salah satu isu yang ditimbulkan JD dalam rayuan tersebut adalah Permohonan untuk lanjutan Notis Kebankrapan adalah tidak teratur. Dalam memutuskan isu ini, Mahkamah memutuskan bahawa:- “In my view, the wordings in r. 96 (kini kaedah 94) are sufficiently clear. They relate specifically to the service of the BN within three months from issue thereof subject to the power of the court to extend such time for service. They do not provide for the extension of the BN itself. However, such an application can be dealt with under the discretionary powers of the court provided in s. 93(4) of the Bankruptcy Act 1967 which states…: Thus, having regard to the provisions of s. 93(4) and r. 96 aforesaid, I am of the view that the application taken out by the JC in this case is not irregular or defective. In the circumstances, the first point or proposition raised by the JD has no merit and must fail.” S/N w6o3ePrEWkaj41CostQj0A 13. Namun, terdapat juga peruntukan-peruntukan khusus yang menetapkan had masa untuk dipatuhi oleh pihak-pihak dan peruntukan-peruntukan tersebut adalah senyap berkenaan kuasa Mahkamah untuk melanjutkan masa. Dalam keadaan-keadaan tersebut, Mahkamah pada kebiasaannya akan menilai bahasa yang digunakan dalam peruntukan khusus tersebut untuk menentukan niat parlimen dalam menggubal peruntukan tersebut dan sama ada terdapat ruang kepada Mahkamah untuk menggunakan kuasa am di bawah seksyen 93(4) Akta Tersebut untuk melanjutkan masa. Dalam hal ini, Mahkamah merujuk kepada kes Mahkamah Persekutuan Metramac Corporation Sdn Bhd v Fawziah Holdings Sdn Bhd [2006] 4 MLJ 113; [2006] 3 CLJ 177; [2006] 1 MLRA 1; [2006] 3 AMR 725 di mana Mahkamah Persekutuan memutuskan bahawa:- “Thus when the language used in a statute is clear effect must be given to it. As Higgins J said in Amalgamated Society of Engineers v. Adelaide Steamship Co Ltd 28 CLR 129 at pp 161-162: The fundamental rule of interpretation, to which all others are subordinate, is that a statute is to be expounded according to the intent of the Parliament that made it, and that intention has to be found by an examination of the language used in the statute as a whole. The question is, what does the language mean; and when we find what the language means in its ordinary and natural sense it is our duty to obey that meaning even if we think the result to be inconvenient, impolite or improbable.” 14. Sebagai contohnya, Mahkamah merujuk kepada seksyen 3(1)(i) Akta Tersebut yang antara lain memperuntukkan bahawa melainkan seseorang JD, dalam tempoh 7 hari, telah memenuhi Notis Kebankrapan yang dikeluarkan oleh JC berkenaan sesuatu penghakiman yang telah diperolehi terhadap JD dan masih belum digantung, atau memuaskan hati Mahkamah bahawa ia mempunyai S/N w6o3ePrEWkaj41CostQj0A tuntutan balas, tuntutan silang atau “set off”, maka perbuatan kebankrapan berlaku. Peruntukan tersebut tidak memberi sebarang bidang kuasa kepada Mahkamah untuk melanjutkan tempoh masa yang ditetapkan dalam peruntukan tersebut. Dalam hal ini, Mahkamah-mahkamah memutuskan bahawa Mahkamah tidak mempunyai bidang kuasa untuk melanjutkan tempoh masa tersebut menurut seksyen 93(4) Akta Tersebut. Umpamanya, dalam kes Low Mun v Chung Khiaw Bank Ltd [1988] 1 MLJ 263; [1987] 2 CLJ 400; [1987] 1 MLRA 29, Mahkamah Agung memutuskan bahawa :- “It should be observed that once the seven days have expired without the debtor having satisfied the debt or having satisfied the Court that he has a valid counter claim, an act of bankruptcy occurs by operation of law, and the Court has no jurisdiction under s. 93(4) to extend the period prescribed (see Re A Debtor v. Slater Walker Ltd. [1981] 2 All ER 987).” 15. Perkara yang sama diputuskan oleh Mahkamah Tinggi dalam kes Re Lee Peak Sing; Ex P Malayan Banking Bhd [2012] 3 CLJ 338; [2011] 6 MLRH 798; [2011] AMEJ 0386 di mana Mahkamah memutuskan bahawa:- “(a) The appellant/judgment debtor contended that the seven days' mandatory statutory requirement can be condoned by the provisions of s. 93(4) and s. 131 of the Bankruptcy Act 1967 ("the said Act") and r. 274 of the Bankruptcy Rules 1969 ("the said Rules"). The respondent/judgment creditor however contended that since the word "must" was adopted under r. 94(1) of the said Rules, the appellant/judgment debtor's non-compliance with the seven days mandatory statutory requirement is fatal. (b) I find that since the word "must" is employed in r. 94(1) of the Bankruptcy Rules, this means that compliance is mandatory… (e) I find that s. 93(4) of the Bankruptcy Act deals with non-compliance with normal procedures, while s. 131 of the same Act deals with formal defects. These provisions do not apply to non-compliance with a mandatory statutory requirement. S/N w6o3ePrEWkaj41CostQj0A (f) The appellant/judgment debtor's attempt to rely on his ignorance of the law and/or failure/oversight on his part to instruct his solicitors to file encl. as a ground to justify his non-compliance with the seven days' mandatory statutory requirement and relied on r. 274 of the said Rules to exonerate him from non-compliance with a mandatory statutory requirement. I find that the appellant/judgment debtor's non-compliance with the seven days' mandatory statutory requirement is not a mere procedural irregularity and that this court is also bound by the decision of the Supreme Court in Sovereign General Insurance Sdn Bhd v. Koh Tian Bee (supra). (g) Further, I find that r. 274 is only applicable in circumstances involving mere non-compliance with procedural rules and not non-compliance with a mandatory statutory requirement and must again be read in light of the decision of the Supreme Court in Sovereign General Insurance Sdn Bhd v. Koh Tian Bee (supra) and the myriad of cases thereafter…” 16. Seterusnya Mahkamah merujuk kepada seksyen 5 Akta Tersebut yang antara lain memperuntukkan bahawa Petisyen Pemiutang hendaklah difailkan dalam tempoh 6 bulan dari tarikh Perbuatan Kebankrapan berlaku. Tempoh tersebut adalah tempoh mandatori dan tiada sebarang lanjutan masa yang dibenarkan dalam peruntukan tersebut. Dalam memutuskan permohonan JC untuk lanjutan masa untuk memfailkan Petisyen Pemiutang, Mahkamah dalam kes Perbadanan Nasional Bhd V Jeffrey Bin Munap [2022] MLJU 2063 telah memutuskan bahawa:- “[12] In particular, pursuant to s5(1)(c) of the IA, one of the mandatory express conditions for the JC to comply with for the filing of CP is that the act of bankruptcy on which the petition is grounded has to occur within six months before the presentation of the CP. This is in line with the passage in para. 2 of the Federal Court’s judgment of Westech Sdn Bhd v Thong Weng Lock [2017] 8 CLJ 257– [2] Under s. 3(1)(i) of the Bankruptcy Act 1967 (BA), an act of bankruptcy is committed upon the expiry of seven days from the date of service of the BN. In this case, on the premise that no legal impediment exists, the act of bankruptcy begins from 1 November 2011. Any creditor’s petition (CP) to be filed, must be done within six months of the latter date (s. 5(1)(c) of the BA). S/N w6o3ePrEWkaj41CostQj0A [13] The Federal Court in Westech Sdn Bhd (ibid) further referred to the case of Ng Yen Kok v AmFinance Berhad [2013] 1 LNS 366 and held that Ng Yen Kok’s case endorses the English decision of Re A Debtor (No. 10 of 1953) and it is settled law that a judgment creditor must present the CP within the period stated in the statutory provision… [16] Further to that, the words ‘shall not be entitled to present a bankruptcy petition’ are very clear and unambiguous. And also, the word ‘shall’ as stipulated in s5(1) IA connotes that the JC is required to comply with the said provision mandatorily. In addition, by reading s5(1) IA together with s5(7) IA, it is also clear that if the JC fails to comply with any of the requirements in s5 IA, this Court shall dismiss the CP even if the CP is filed later… [18] On the basis thereof, this Court opines that this Court ought not to exercise its discretionary powers under s93(4) IA and r283 IR to extend and/or abridge the time for filing of the CP after the six months statutory time limit as prescribed in s5(1)(c) IA has lapsed and/or after 23.3.2022.” 17. Selain itu, Mahkamah merujuk kepada kes Re Endon Tamseran; Ex P 200. Parkash Singh Wasawa Singh [2009] 8 CLJ 379; [2009] 2 MLRH Menurut fakta kes tersebut, Perintah Penerimaan dan Perintah Penghukuman telah direkodkan terhadap JD dan KPI telah dilantik sebagai pentadbir estet JD. Kemudiannya, KPI telah mengeluarkan notis niat kepada pemiutang-pemiutang berkenaan niat KPI untuk mengeluarkan sijil pelepasan di bawah seksyen 33A Akta Tersebut. JC membantah notis niat tersebut dan telah memfailkan notis bantahan JC. KPI menolak bantahan JC. JC memfailkan permohonan untuk menghalang KPI dari mengeluarkan Sijil Pelepasan dan Penolong Kanan Pendaftar menolak permohonan tersebut. Namun, permohonan tersebut kemudiannya dibenarkan dalam Rayuan kepada Hakim Dalam Kamar dan KPI dihalang dari mengeluarkan sijil pelepasan KPI selama 2 tahun dari tarikh perintah. S/N w6o3ePrEWkaj41CostQj0A 18. Seterusnya, JC memfailkan permohonan lanjut untuk melanjutkan lagi tempoh untuk menghalang KPI dari mengeluarkan sijil pelepasan melebihi 2 tahun yang dibenarkan dalam seksyen 33B Akta Tersebut, antara lain menurut seksyen 93(4) Akta Tersebut dan Aturan 92 Kaedah 4 Kaedah-kaedah Mahkamah Tinggi 1980. Dalam menolak permohonan JC tersebut, Mahkamah Tinggi memutuskan bahawa:- “[10] The words in s. 33B(6)(b) are clear and unambiguous, carrying a plain ordinary meaning. The words therein reflected the intention of the legislature. In such event it warrants the adoption of the literal approach to the interpretation of the section (see Kumpulan Kemuning Sdn Bhd v. Rajoo and 200 Ors [1983] CLJ 207; [1983] 2 CLJ 242; [1983] 2 MLJ 400 and Tan Kim Chuan & Anor v. Chandu Nair Krishna Nair [1991] 1 CLJ 682; [1991] 1 CLJ (Rep) 441 SC). The function of the court is to give effect to the said legislative intent and not taking over the role of the legislature by stretching it further and further beyond the expression intended by the legislature or assigning a different meaning of the clear terms of the statute… [11] Coming back to the matter presently before me, in my view it is very plain that the said prohibitory order (encl. 41) is incapable of being extended beyond the period of two years as provided by the said subsection 6(b) of s. 33B. It is the court's duty to obey and give effect to the meaning of the said words of the statute as the said words are clear, unambiguous and explicit enough…” 19. Berdasarkan kajian nas-nas di atas, apabila sesuatu peruntukan khusus adalah senyap berkenaan lanjutan masa dan penilaian bahasa yang digunakan seperti “hendaklah” (shall) atau “mestilah” (must) yang menunjukkan niat parlimen untuk tidak membenarkan sebarang lanjutan masa, Mahkamah akan memberi kesan yang ketat kepada peruntukan yang bersifat mandatori tersebut kerana prosiding kebankrapan adalah quasi-jenayah dan mempunyai kesan yang parah kepada si bankrap. S/N w6o3ePrEWkaj41CostQj0A Dalam hal ini, Mahkamah merujuk kepada kes Mahkamah Rayuan Dato’ Ramesh Rajaratnam v Datin Zaleha Abd Rahman & Ors [2014] 5 CLJ 669 di mana Mahkamah memutuskan bahawa:- “It is trite that bankruptcy proceedings are quasi-penal in nature. Judgment creditors are obliged to strictly follow the provisions of the Act and/or rules unless the non-compliance is condonable pursuant to the Act and/or rules or fiat of case laws. (see Wee Chow Yang t/a Vienna Music Centre v. Public Finance Bhd [1989] 3 MLJ 508). In Sobri Arshad v. Associated Tractors Sdn Bhd [1991] CLJ 798; [1991] 3 CLJ (Rep) 756; [1991] 3 MLJ 32, Edgar Joseph Jr observed: On a concluding note, bearing in mind that bankruptcy proceedings, if successful, would have harsh and penal consequence meticulous compliance with the law is often necessary. The case of In re North ex-parte Hasluck is the authority for the proposition that the statute relating to bankruptcy should be construed in a manner most favourable to the person affected. Failure to comply may attract art. 5(1) of the Federal Constitution which reads as follows: No person shall be deprived of his life or personal liberty save in accordance with law.” 20. Namun, sekiranya peruntukan tersebut menggunakan perkataan yang bersifat direktori seperti “boleh” (may), maka Mahkamah masih boleh menggunakan budi bicara untuk melanjutkan masa dengan menggunakan kuasa di bawah seksyen 93(4) Akta Tersebut. Berdasarkan pemerhatian ini, Mahkamah akan menilai peruntukan seksyen 33B Akta Tersebut untuk mengkaji sama ada Mahkamah mempunyai budi bicara bagi melanjutkan tempoh masa yang dinyatakan dalam peruntukan tersebut. Seksyen 33B(2) Akta Tersebut memperuntukkan bahawa:- “(2) A creditor who has been served with a notice under subsection (1) and who wishes to object to the issuance of a certificate discharging the bankrupt shall, within twenty-one days from the date of service of the notice, furnish a notice of the objection stating the grounds of his objection.” S/N w6o3ePrEWkaj41CostQj0A 21. Manakala seksyen 33B(4) Akta Tersebut memperuntukkan bahawa:- “(4) A creditor who has furnished a notice of his objection and the grounds of his objection in accordance with subsection (2) may, within twenty-one days of being informed by the Director General of Insolvency that his objection has been rejected, make an application to the court for an order prohibiting the Director General of Insolvency from issuing a certificate of discharge.” 22. Perbandingan kedua-dua peruntukan tersebut dengan jelas menunjukkan bahawa apabila KPI mengeluarkan notis niat untuk mengeluarkan sijil pelepasan di bawah seksyen 33A Akta Tersebut, pemiutang-pemiutang yang ingin membantah niat KPI tersebut adalah diwajibkan untuk mengemukakan bantahan kepada KPI dalam tempoh 21 hari dan tiada sebarang lanjutan masa yang boleh dipohon kerana perkataan yang digunakan adalah “shall”. Maka, berdasarkan nas-nas di atas, peruntukan tersebut adalah mandatori dan Mahkamah tidak boleh bergantung kepada seksyen 93(4) Akta Tersebut untuk sebarang perlanjutan masa. 23. Namun, apabila KPI menolak bantahan pemiutang tersebut, pemiutang wajar memfailkan permohonan kepada Mahkamah untuk menghalang KPI dari mengeluarkan sijil pelepasan dalam tempoh 21 hari dari tarikh penolakan bantahan tersebut. Namun, sekiranya berlaku kelewatan, Mahkamah masih mempunyai budi bicara untuk melanjutkan tempoh masa yang dinyatakan kerana perkataan yang digunakan adalah “may”. Dalam hal ini, Mahkamah merujuk kepada kes Perbadanan Nasional Insurans Sdn Bhd v Pua Lai Ong [1996] 3 MLJ 85; [1996] 3 CLJ 321; [1996] 1 MLRA 308; [1996] 3 AMR 2869 di mana Mahkamah memutuskan bahawa:- S/N w6o3ePrEWkaj41CostQj0A “The word 'must' as opposed to 'may' is used in the rule, and we interpret that to mean as implying a peremptory mandate as opposed to a mere direction or discretion as the word "may" implies. We equate the meaning of the word "must" as that given to the word "shall" and for that reason the choice of the word "must" in the rule does not create the existence of any discretion or empowers the Court to exercise such a discretion.” 24. Maka, Mahkamah boleh menggunakan budi bicara di bawah seksyen 93(4) Akta Tersebut. Mahkamah dapati had masa 21 hari yang diperuntukkan di bawah seksyen 33B(4) Akta Tersebut turut dinyatakan dalam Kaedah 196 dibaca bersama borang 98 Kaedah Tersebut. Maka, pemohon perlu menunjukkan bahawa terdapat keadaan khas dan sebab yang baik untuk melanjutkan masa sebagaimana diperutukkan di bawah Kaedah 283 Kaedah Tersebut:- “The court may under special circumstances and for good cause shown extend or abridge the time appointed by these Rules or fixed by any order of the court for doing any act or taking any proceedings.” 25. Mahkamah juga merujuk kepada kes Nazlan Hashim & Anor v Mohamad Akmal Mohd Rashid [2015] 1 LNS 1211 di mana Mahkamah memutuskan bahawa:- “[24] The Rules Committee must have taken into consideration the fact that litigants may require more time to decide, whether to appeal against the decision of the High Court to the Court of Appeal. That must have been the reason that a period of thirty days is given for the litigant. The thirty days period is more than ample time. [25] In my opinion, where the period given is substantial, such as thirty days, an applicant seeking for an extension of time has an onerous burden to justify the delay, as opposed to a shorter period of time, such as fourteen days…” S/N w6o3ePrEWkaj41CostQj0A 26. Berdasarkan nas-nas di atas, Mahkamah akan menilai alasan-alasan yang dikemukakan JC untuk memohon lanjutan masa. Berdasarkan surat JC bertarikh 20.7.2022, peguam JC memaklumkan bahawa peguam JC baharu sahaja mendapat arahan anakguam untuk membantah pelepasan JD. Mahkamah juga dapati tiada sebarang penjelasan lanjut dalam surat tersebut mahupun afidavit-afidavit JC berkenaan alasan mengapa berlaku kelewatan dalam JC memberi arahan kepada peguamnya. Mahkamah berpendapat bahawa kelewatan dalam mendapat arahan anakguam tidak boleh dijadikan alasan atau sebab yang baik untuk melanjutkan tempoh masa. Perkara ini ada diputuskan dalam kes Singapore Flour Mills Pte Ltd v Thong Yik Animal Feed Sdn Bhd & Ors [2000] 8 CLJ 559; [2000] 3 MLRH 393 di mana Mahkamah memutuskan bahawa:- “Delay in instructing counsel and solicitor can hardly be a reason to ground for application for extension of time.” 27. Mahkamah juga merujuk kepada kes Global Payments Sdn Bhd & Anor v Bank Negara Malaysia & Anor [2016] 1 LNS 1013; [2016] MLRHU 1128; [2016] AMEJ 1906 di mana Mahkamah memutuskan bahawa:- “Instruction To The Solicitor [20] The Applicants averred in the affidavit in support that they had instructed their solicitors to negotiate with the First Respondent also in my view does not amount to a reasonable ground for extension of time. [21] In the case of Mohd Ismail Abd Ghani v. Ketua Pengarah Pendaftaran Negara & Anor [2011] 5 CLJ 660, Aziah Ali J (now FCJ) held that the explanation by the applicant that he needed time to find a lawyer and his lawyer needed time to check his matter are not satisfactory ground to account for the delay.” S/N w6o3ePrEWkaj41CostQj0A 28. Mengeruhkan lagi keadaan, Mahkamah dapati peguam JC yang sama yang telah mengemukakan bantahan kepada Notis Niat untuk Pelepasan oleh KPI dan surat penolakan bantahan oleh KPI tutut ditujukan kepada peguam JC tersebut (rujuk eksibit WDH-1 Lampiran 2). Pada hakikatnya, KPI tidak perlu memberi alasan-alasan untuk keputusannya sebagaimana diputuskan dalam kes Re Endon Tamseran (supra) seperti berikut:- “[14] In the exercise of its powers under s. 33A(1) of the Act, the KP JIM is under no obligation to give reasons for so doing. However, in this case the KP gave all his reasons for wanting to discharge the bankrupt of her bankruptcy. It is perfectly within his discretion to do so and he is equally entitled to exercise his discretion to issue the certificate of discharge on those grounds.” 29. Namun dalam kes ini, KPI telahpun memberi alasan untuk keputusan beliau sebagaimana dihuraikan dalam perenggan 3 alasan ini. Maka, berdasarkan asas untuk bantahan yang dikemukakan oleh peguam JC dan alasan penolakan bantahan tersebut oleh KPI, Mahkamah berpendapat bahawa JC sememangnya boleh memfailkan permohonan di Mahkamah dalam jangka masa 21 hari yang ditetapkan dan merizabkan hak untuk mengemukakan alasan tambahan (sekiranya perlu) kelak memandangkan semasa mengutus surat bertarikh 20.7.2022, ia masih dalam tempoh 21 hari dari tarikh penerimaan keputusan dari KPI pada 4.7.2022. 30. Mahkamah tidak terlepas pandang bahawa JC ada mengusulkan emel bertarikh 22.7.2022 (Eks.WDH-4 Lampiran 2) meminta KPI menyediakan dokumen-dokumen berikut bagi tujuan semakan peguam JC dan JC sendiri. Perenggan 2 emel tersebut berbunyi:- S/N w6o3ePrEWkaj41CostQj0A “2. Oleh demikian, memandangkan arahan anak guam kami adalah untuk membantah “Pelepasan Melalui Sijil Pelepasan Ketua Pengarah Insolvensi”, pihak kami memohon jasa baik serta kerjasama awal dari pihak Tuan/Puan untuk menyediakan kepada pihak kami dokumen berikut bagi tujuan semakan pihak kami dan anak guam:- (a) Laporan Pelepasan Ketua Pengarah Insolvensi seperti yang diperuntukkan di bawah seksyen 33(3) Akta Insolvensi 1967 bagi si bankrap yang bernama Murugaveloo A/L Narayanan…; dan (b) Apa-apa dokumen, rekod dan laporan-laporan lain berkaitan dengan hal ehwal si Bankrap” 31. Sebagai permulaan, Mahkamah berpendapat bahawa peguam JC telah tersalah arah apabila memohon laporan KPI di bawah seksyen 33(3) Akta Tersebut (perenggan 2(a) emel tersebut) bagi keputusan KPI untuk mengeluarkan sijil pelepasan di bawah seksyen 33A Akta Tersebut. Laporan KPI hanya relevan bagi permohonan pelepasan oleh Si Bankrap di bawah seksyen 33 Akta Tersebut yang perlu diputuskan Mahkamah setelah meneliti laporan KPI menurut seksyen 33(3) Akta yang sama. Memandangkan keputusan KPI untuk mengeluarkan Sijil Pelepasan di bawah seksyen 33A Akta Tersebut adalah keputusan beliau sendiri setelah meneliti kandungan dokumen-dokumen dalam fail si bankrap, maka tiada keperluan untuk penyediaan laporan tersebut. Dalam menjelaskan isu ini, Mahkamah dalam kes Asia Commercial Finance (M) Bhd v Bassanio Teo Yang [2009] MLJU 313; [2009] 9 CLJ 413; [2009] 2 MLRH 668; [2009] AMEJ 0407 memutuskan bahawa:- S/N w6o3ePrEWkaj41CostQj0A "To my mind, the court could certainly delay the issuance of the certificate by two years as this is clearly provided in s. 33B. However, the court should not be strictly guided by s. 33 because that is a provision where the court is vested with the power to discharge a bankrupt. Counsel for creditor's main complaint is that the DGI did not prepare an updated report on the respondent. In my opinion the DGI cannot be faulted for not preparing a report that is required under s. 33. This is because the "report" in s. 33 is prepared by the DGI for the attention of the court for the purpose of providing sufficient information to assist the decision making process. That is the reason why the report is deemed to be prima facie evidence under s. 33(8). It goes without saying that if the report contains any adverse information that is within the contemplation of s. 33(6), the court is empowered to refuse a discharge. However, under s. 33A, the decision maker is the DGI himself and therefore it is common sense that he need not "report" to himself about the status of the bankrupt. It must be assumed all the relevant information that is in the file of the bankrupt has been considered by the proper officer of the DGI before the Notice of Intention to discharge is issued. Therefore, I cannot agree with counsel for the creditor that it is fatal for the DGI not to have prepared an updated report." 32. Seterusnya, perenggan (b) kepada emel tersebut merujuk kepada dokumen-dokumen secara am tanpa menjelaskan secara spesifik apakah dokumen yang dimaksudkan JC. Sebagaimana diakui sendiri oleh JC dalam perenggan 6 Afidavit Balasan JC (Lamp.8), tiada keperluan di bawah seksyen 33B Akta Tersebut yang memerlukan KPI untuk menyediakan sebarang dokumen mahupun mengemukakan sebarang alasan (Re Endon Tamseran supra) bagi keputusan beliau dalam menolak bantahan-bantahan yang dikemukakan oleh JC. Maka, adalah salah untuk Mahkamah mengubah, meminda atau menambah perkataan bagi peruntukan undang-undang yang jelas dan tidak kabur. Dalam hal ini, Mahkamah merujuk kepada kes Sharguna Simadary v Pengerusi Lembaga & Ors [2021] MLJU 431; [2021] 1 LNS 335; [2021] AMEJ 0336 di mana Mahkamah memutuskan bahawa:- “The wording of section 4A of the Act is plain and unambiguous. In such a case, it is not the duty of the court to add, vary or restrict the meaning of the provision. Where the words of a statute are unambiguous, plain and clear, they must be given their natural and ordinary meaning (see Kumaran Suppiah v. Dato' Noh Hj Omar & Anor [2006] 4 CLJ 675 and Master Mulia Sdn Bhd v. Sigur Rus Sdn Bhd [2020] 9 CLJ 213). Therefore, it is not for the court to read words into section 4A of the Act.” S/N w6o3ePrEWkaj41CostQj0A 33. Peguam JC merujuk kepada kes Mahkamah Agung Savrimuthu Sinnapan v PP [1987] 2 MLJ 173; [1987] 1 CLJ 368; [1986] 1 MLRA 327 di mana Mahkamah memutuskan bahawa “public interest, reason and justice demand that any statutory power must be exercised reasonably and with due consideration." Berdasarkan keputusan ini, Peguam JC berhujah bahawa pengemukaan dokumen-dokumen yang dipohon oleh JC akan memelihara keadilan bagi kedua-dua pihak dalam kes ini. 34. Setelah meneliti nas di atas, Mahkamah gagal menemui sebarang prinsip yang menegaskan bahawa apabila sesuatu pihak berkuasa membuat keputusan, pihak tersebut wajar mengemukakan dokumen-dokumen yang menyokong keputusan yang dibuatnya itu. Malah, Mahkamah dalam kes tersebut menyatakan bahawa Mahkamah bukannya forum untuk merektifikasi sebarang kekurangan dalam sesuatu peruntukan dan perkara tersebut adalah fungsi Parlimen. Dalam hal ini, Mahkamah dalam kes tersebut memutuskan bahawa:- “Here we are not in the position to assess and review the manner in which the Public Prosecutor exercises his discretion, as the law clearly leaves matters concerning the conduct of the prosecution to him as the guardian of public interest. Any complaint on this matter should be addressed to Parliament or to the appropriate Minister under whom he serves or to him personally and not to the Court unless it involves a constitutional issue.” 35. Dalam hujahan balas JC, JC merujuk kepada seksyen 135(2) Akta Tersebut yang memperuntukkan seperti berikut:- S/N w6o3ePrEWkaj41CostQj0A (2) Any creditor of the bankrupt may, subject to the control of the court, inspect at all reasonable times, personally or by agent, any such books, papers or documents in the possession of the Director General of Insolvency. 36. Peguam JC berhujah bahawa berdasarkan peruntukan tersebut di atas, JC berhak untuk memeriksa segala dokumen, kertas dan buku berkaitan hal ehwal JD yang berada dalam kawalan KPI. Mahkamah berpendapat bahawa peruntukan tersebut dengan jelas memperuntukkan bahawa semakan yang dimaksudkan tersebut adalah “tertakluk kepada kawalan Mahkamah”. Dalam hal ini, setakat tarikh keputusan, JC tidak pernah memohon kepada Mahkamah untuk menyemak dokumen-dokumen tersebut yang berada dalam kawalan KPI. 37. Dalam apa jua keadaan, Mahkamah berpendapat bahawa adalah salah untuk JC mengalihkan beban terhadap KPI berkenaan kelewatan JC memfailkan permohonan di Mahkamah, apabila JC sendiri gagal memberi sebarang penjelasan atau alasan yang munasabah mengapa berlaku kelewatan dalam JC memberi arahan kepada peguamnya, walhal arahan untuk membantah Notis Niat kepada KPI menurut seksyen 33B(2) Akta Tersebut telah diberi kepada peguam yang sama dan bantahan telahpun difailkan dalam tempoh masa yang dibenarkan. Dalam hal ini, surat keputusan KPI yang diterima JC pada 4.7.22 dengan jelas menyatakan dalam perenggan 3 seperti berikut:- S/N w6o3ePrEWkaj41CostQj0A “Mengikut seksyen 33B(4)Akta Insolvensi 1967, tuan boleh mengemukakan permohonan ke Mahkamah dalam tempoh dua puluh satu (21) hari dari tarikh tuan dimaklumkan tentang penolakan ini untuk menghalang Ketua Pengarah Insolvensi daripada mengeluarkan Sijil Pelepasan kepada bankrap.” 38. JC hanya mengemukakan isu berkaitan dokumen-dokumen yang diperlukan melalui emel pada 22.7.22 iaitu hanya 3 hari sebelum had masa yang ditetapkan untuk memfailkan permohonan di Mahkamah, iaitu pada 25.7.22. Setakat tarikh keputusan, tiada penjelasan diberikan dalam kertas-kertas kausa berkenaan kelewatan JC dalam memberi arahan kepada peguamnya untuk mengambil tindakan lanjut dalam kes ini walhal had masa 21 hari ada diperjelaskan dengan jelas dalam perenggan 3 dalam surat KPI. 39. Perintah Kebankrapan terhadap seseorang JD meninggalkan kesan yang mendalam kepada JD. Dalam menjelaskan kekangan yang dihadapi JD, Mahkamah dalam kes Re Rosli Abdul Kadir; Ex P Bank Kerjasama Rakyat Malaysia Bhd [2008] MLJU 1096; [2008] 5 CLJ 691; [2008] 1 MLRH 819 memutuskan bahawa:- “[16] It must be understood that the effect of an adjudication order and receiving order in a bankruptcy petition is distinct from the other form of execution. In other form of execution, if the judgment is for property or money, only the property or money is taken from the judgment debtor to satisfy the judgment. The effect, or the "punishment", if the judgment debtor becomes a bankrupt, is greater. Other than all his property shall vest in the Director General of Insolvency, he will be disqualified from holding the office of a member of Parliament, public office, certain positions in statutory bodies, practicing in certain professions, carrying on business alone or in partnership or by way of a company, maintaining any action without the previous sanction of the Director General of Insolvency, leaving Malaysia without permission of the Director General of Insolvency, receiving pension or other gratuity and enforcing his rights under certain legislation.” S/N w6o3ePrEWkaj41CostQj0A 40. Dengan demikian, Mahkamah berpendapat bahawa Mahkamah perlu menilai dengan ketat alasan-alasan yang diberikan oleh JC untuk memohon lanjutan masa. Dalam kes ini, tiada sebarang penjelasan yang munasabah yang telah diberikan oleh JC dan sikap sambil lewa JC ini tidak seharusnya diambil ringan oleh Mahkamah. Dalam hal ini, Mahkamah merujuk kepada kes Rohani @ Hamidah bt Nor v Sincere Leasing Sdn Bhd [1992] 4 MLRH 440; [1993] 1 AMR 225 di mana Mahkamah memutuskan bahawa:- “As observed by the action of the bank aforesaid, bankruptcy proceedings can have serious consequences for a debtor and I feel obliged to adopt the same attitude unless it can manifestly be shown that the irregularity or the defects were immaterial and in no way affected the rights of the debtor...” 41. Maka, atas alasan ini, Mahkamah berpendapat bahawa JC telah gagal menunjukkan keadaan khas dan sebab yang baik di bawah kaedah 283 Kaedah Tersebut untuk Mahkamah menggunakan budi bicara menurut seksyen 93(4) Akta Tersebut untuk melanjutkan masa bagi membolehkan JC memfailkan permohonan di Mahkamah menurut seksyen 33B(4) Akta Tersebut. Sekiranya Mahkamah membenarkan permohonan JC untuk lanjutan masa sewenang-wenangnya tanpa sebarang alasan yang munasabah, maka perkara ini akan mebuka “flood gate” untuk kesemua pihak memperlekehkan had masa yang ditetapkan menurut seksyen 33B(4) Akta Tersebut dan memohon lanjutan masa di Mahkamah. Perkara ini bertentangan dengan polisi awam kerana akan menggagalkan niat parlimen dalam menetapkan had masa untuk seseorang JC membuat permohonan di Mahkamah. S/N w6o3ePrEWkaj41CostQj0A 42. Dalam hal ini, Mahkamah merujuk kepada kes Pastpresentfuture Sdn Bhd v MFI Money Sdn Bhd [2021] 1 LNS 2961 di mana Mahkamah memutuskan bahawa:- “The Defendant had failed to provide any further explanation towards their argument. The reason to the delay is that the staff who received the writ and the statement of claim has failed to forward the same to the attention of the legal executive. If this was a reason to extend time, then it will open a floodgate as the time would have to be extended as matter of course. I find no merits in the Defendant's submission.” KESIMPULAN 43. Berdasarkan alasan-alasan yang dinyatakan di atas, Mahkamah dapati JC gagal menunjukkan keadaan khas dan sebab yang baik untuk memohon lanjutan masa dan dengan demikian, permohonan JC dalam Lampiran 12 adalah ditolak.
