JMB: 0016) DEFENDAN] GROUNDS OF JUDGMENT Introduction [1] This Court heard and allowed in part, an appeal against an order for summary judgment that the Sessions Court made on 30-5-2024 against the Appellant/Defendant. Referring to the parties as they were in the Court below, the Plaintiff had sued the Defendant for the recovery of property management fees and other charges for services rendered. Summary judgment was entered for the sum RM339,393.42 with judgment interest accruing at 10% p.a. from 30-5-2024 until full payment. Background facts [2] The Defendant is the Joint Management Body ( ) of Armanee Condominium. The Plaintiff had been appointed by the Defendant as the property manager of Armanee Condominium since 2011. Under the property management agreement between the parties ( ), the Defendant would be entitled to property management fees for services rendered. Such fees excluded service tax and all costs related to its services which were billed as reimbursables. A late payment fee may be levied at 10% p.a. for any late payment of management fees. [3] Towards the end of the relationship, the Plaintiff remained engaged on a month to month basis until 31-3-2023 when the termination of its services took effect. A statement of account adduced in evidence by the Plaintiff in support of its claim for the period 19-5-2022 until 31-3-2023 ( ) showed that the management fee and a fixed disbursement were billed every month at RM16,218.00. Other disbursements were billed separately and included, inter alia, the . [4] As of 3-10-2023, the Defendant has paid the Plaintiff the sum totalling RM136,699.14, leaving a balance outstanding on that Statement of Account in the sum of RM339,393.42.
