1 IN THE HIGH COURT OF MALAYA IN JOHOR BAHRU IN THE STATE OF JOHOR DARUL TAKZIM CRIMINAL TRIAL NO.: JA-45B-6-09/2020 BETWEEN PUBLIC PROSECUTOR AND AUNG ZAW WIN GROUNDS OF JUDGEMENT Introduction [1] The accused was tried for the murder of Myat Zaw Lwin (the deceased), and the charge read as follows: “Bahawa kamu pada 20/10/2019 jam lebih kurang 2.10 petang di alamat No 31, Jalan Nipah 5, Taman Daya di dalam daerah Johor Bahru di dalam Negeri Johor telah membunuh seorang lelaki bernama Myat Zaw Lwin No Passport MC 818339, dan dengan itu kamu telah melakukan suatu kesalahan yang boleh dihukum di bawah seksyen 302 Kanun Keseksaan.” [2] Having considered the evidence presented by the prosecution at the close of the prosecution case on a maximum evaluation, I found that the prosecution had established a prima facie case of murder under section 302 against the accused, and thus, defence was called. 24/03/2024 12:40:52 Kand. 119 S/N DyocAOsegkipklmZZkBmQg 19/05/2026 13:41:58 Kand. 130 [3] The accused testified under oath and stated that he had no intention to kill the deceased because he had reacted to the provocation of the deceased, who had thrown a small iron table at him after an argument over a microphone. The accused also stated that he stabbed the deceased in self-defence. [4] At the end of the defence case, I found that the accused failed to establish the defence of grave and sudden provocation, sudden fight or self-defence on the balance of probabilities and thus failed to raise a reasonable doubt to the prosecution case. He was then convicted and sentenced to 30 years of imprisonment and 12 strokes of the rattan. [5] The prosecution has now appealed to the Court of Appeal against the sentence imposed. Below are my reasons for exercising my discretion to sentence the accused to a term of imprisonment rather than death. The Case [6] Myat Zaw Lwin, the deceased, was a Myanmar national who was also a work colleague of the accused. A group of Myanmar nationals lived in some houses rented by their employers in the vicinity of Taman Daya. Both the deceased and the accused were housemates. [7] On the fated day, it was a public holiday, and these Myanmar workers were at their respective homes enjoying their time off. [8] Zaw Thoo, PW4, was doing karaoke with the accused at his house opposite the deceased's house. They had a problem with the microphone, and the accused asked PW4 to go to his house and borrow the deceased's microphone. PW4 went to the deceased's house, but the deceased refused to lend him his microphone, so PW4 went back and informed the accused. The accused then tried to ask the deceased again S/N DyocAOsegkipklmZZkBmQg to lend him his microphone. Unfortunately, the circumstances became exasperating, and they got into a heated argument. [9] The deceased was seen throwing an iron table towards the accused, which hit him lightly on the forehead. This was when the accused was allegedly provoked, and they quarrelled. [10] In the course of the fight between the two, the accused grabbed a knife from the kitchen and started stabbing the deceased. The accused said he was not sure where he stabbed the deceased because he was angry and upset because the deceased had thrown the iron table, which hit him on the forehead. The deceased then was seen falling on the floor covered in blood. [11] From the testimony of the pathologist, Dr. Rohayu binti Shahar Adnan, PW14, it appeared that the cause of death was consistent with that of a "multiple stab wound to the chest". There were a total of twelve
