On the merits of the application for extension of time, the respondent submits that no satisfactory explanation has been furnished for the delay of 35 days. Counsel relies upon the well-established principle that the Rules of Court are to be complied with, and that mere inadvertence, oversight, or financial constraint does not ordinarily constitute a sufficient reason. In this regard, reliance is placed upon Ratnam v Cumarasamy & Anor [1965] 1 MLJ 228 and Pearson v Chen Chien Wen Edwin [1991] 3 MLJ 208. Further, it is contended that the intended appeal lacks any reasonable prospect of success. The learned Magistrate, it is argued, correctly applied the principle articulated in Ng Han Seng v Scotch Leasing Sdn Bhd [2003] 4 CLJ 533, namely that where a party fails to provide a credible explanation for delay in seeking to set aside a judgment, the court is under no obligation to proceed to examine the substantive merits.
