Oleh itu ini menjadi asas bahawa pengisytiharan tersebut tidak mematuhi seksyen 11 (d) KTN. S/N gl2wqvk9UqWhOZoQAtuHA [48] Pada masa yang sama Mahkamah juga perlu menimbangkan bahawa Warta Kerajaan No. 2501 tersebut telah diperbetulkan melalui Warta Kerajaan No. 1065 bertarikh 12.04.2020 seperti berikut: No. 1065 [Subseksyen 11(d)] PERISYTIHARAN KAWASAN BANDAR [Subsection 11(d)] DECLARATION OF TOWNSHIP PEMBETULAN CORRIGENDUM Dalam Pemberitahuan Warta No. 2501 yang disiarkan pada 21 November 2019, jadual adalah dipinda seperti berikut: “Daerah — Bentong. Daerah Kecil — Genting. Bandar Genting — Genting No. Pelan P.W. 5437. Luas — 6,669 (Hektar)” In Gezzette Notification No. 2501 publised on 21 November 2019, the Schedule is amended by as follows — “District — Bentong. Subdistrict — Genting. Township — Genting Plan No. P.W. 5437. Area — 6,669 (Hectares)” PT.Btg. 26/5(19)] [49] Apa yang perlu diteliti oleh Mahkamah ialah adakah dengan pengemukaan Warta Kerajaan No. 2501 yang telah diperbetulkan dengan Warta Kerajaan No. 1065 menyebabkan keputusan Pihak Berkuasa Negeri untuk mengisytiharkan Daerah Kecil Genting adalah tertakluk kepada semakan kehakiman? Mahkamah ini S/N gl2wqvk9UqWhOZoQAtuHA berpendapat tindakan Responden bagi mengisytiharkan Daerah Kecil Genting telah dilakukan dengan mengikut undang-undang. Responden mempunyai bidang kuasa untuk membuat pengisytiharan sedemikian. Apa yang menjadi isu dalam kes ini apakah tindakan Responden mengisytiharkan Daerah Kecil Genting sebelum mendapat perakuan daripada Pengarah JUPEM menyebabkan keputusan tersebut adalah tidak sah, tidak teratur dan tidak munasabah. Pada hemat Mahkamah ini tindakan Responden mengisytiharkan Daerah Kecil Genting terlebih dahulu yang dikatakan tidak mematuhi seksyen 11 (d) KTN adalah bukan merupakan tindakan ataupun ketidakpatuhan yang boleh menyebabkan keputusan Responden itu adalah tidak sah, tidak munasabah atau tidak setimpal. Ini adalah disebabkan Pengarah JUPEM telah membuat perakuan tersebut seperti yang dikehendaki di bawah seksyen 11 (d) KTN tersebut walaupun ia dibuat selepas daripada pengisytiharan. Ianya berbeza sekiranya tiada langsung perakuan dibuat oleh Pengarah JUPEM selepas daripada pengisytiharan yang dibuat oleh Responden. [50] Adalah tidak wajar untuk Mahkamah memutuskan bahawa ketidakpatuhan seperti dalam kes ini adalah tergolong kepada tindakan Responden yang mewajarkan kepada semakan kehakiman. Jika ini dilakukan ia akan menyebabkan keputusan-keputusan yang dibuat oleh badan awam akan diketepikan semata-mata disebabkan ketidakpatuhan ekoran daripada tidak melakukan sesuatu yang sewajarnya dalam tempoh yang telah ditetapkan di bawah undang-undang. Padahal ketidakpatuhan tersebut tidak menjejaskan kepentingan mana-mana pihak dan ianya telah dilakukan selepas daripada tindakan badan awam tersebut. Pada masa yang sama S/N gl2wqvk9UqWhOZoQAtuHA juga Mahkamah tidak akan membenarkan tindakan-tindakan yang dilakukan oleh Responden sekiranya ketidakpatuhan tersebut telah menjejaskan kepentingan awam. Ini tidak berlaku dalam kes ini. Ketidakpatuhan yang dikatakan telah dilakukan oleh Responden pada hemat Mahkamah tidak menjejaskan Pemohon-Pemohon dalam kes ini. [51] Dalam hal ini bagi tujuan melengkapkan perbincangan berkenaan dengan isu ini Mahkamah merujuk kepada pendekatan yang digunakan di United Kingdom ketika meneliti keputusan-keputusan yang dibuat oleh badan awam seperti yang dinyatakan dalam kes Pathan v Secretary of State for the Home Department [2020] 1 WLR 4506. Dalam kes tersebut isu yang timbul adalah tanggungjawab untuk memberikan notis berkenaan dengan keputusan di bawah Akta Imigresen 1971 di United Kingdom. Mahkamah Agong di United Kingdom telah menyatakan seperti berikut: “131 We are of the view that the duty to give notice of a decision to someone who will be adversely affected by it cannot be defined solely by the consideration that it is pointless for that person to make representations with a view to reversing or avoiding the effect of the decision. The duty to give notice is an accepted element of the duty to act fairly. Three months elapsed between Submania’s sponsor’s licence being revoked and the refusal of Mr Pathan’s application. It cannot be suggested that informing him promptly of the revocation of the licence when it had been cancelled would not have made a difference.” S/N gl2wqvk9UqWhOZoQAtuHA [52] Mahkamah juga menyatakan: “118 We should supplement what we have said already about the duty of procedural fairness by considering a particular question that arises in relation to it. When an administrative body is contemplating a decision which will adversely affect an individual, does the duty to act in a procedurally fair way require the body to inform the individual even though any representations that he or she might make will not affect the outcome? Or, to put it in other words, is the duty to act fairly by giving notice of an impending adverse decision dependent on the existence of the possibility of submissions by the person affected bringing about a change of mind by the decision-maker? 119 Before addressing that question, it should be pointed out that the scope of inquiry into the duty to act fairly cannot be confined, in every instance, to circumstances in which the affected person aspires to change the decision-maker’s mind on the precise decision made. Where notice of the decision might prompt a change of direction which would achieve the aim of the person, albeit by a different route, there is an active inquiry to be had as to whether the duty is activated. 120 There is ample authority on the issue of whether the duty to afford the opportunity to make representations arises where any such representations are bound to fail. Thus, as Lord Briggs JSC has pointed out, in Cinnamond v British Airports Authority [1980] 1 WLR 582, 593, it was said that no one could S/N gl2wqvk9UqWhOZoQAtuHA complain of not being given an opportunity to make representations if it would have achieved nothing. A somewhat similar view was expressed in Bank Mellat v HM Treasury (No 2) [2014] AC 700, para 179 in the passage from Lord Neuberger of Abbotsbury PSC’s judgment cited by Lord Briggs JSC at para 161 below. (It is noteworthy, however, that in that passage Lord Neuberger PSC was at pains to point out that any argument advanced in support of pointlessness “should be very closely examined, as a court will be slow to hold that there is no obligation to give the opportunity, when such an obligation is not dispensed with in the relevant statute”.) 121 Pointlessness can have two dimensions. The first is that there is no possibility of bringing about a change of mind on the part of the authority on the terms of the decision that has been made. So, for instance, in the present case, Mr Pathan’s application, so long as it was based on a CoS issued by a company which had ceased to have authority to issue such a certificate, could not succeed in any circumstances. The second dimension is different. It involves an examination of whether, on becoming aware of the decision, there was simply nothing that the affected person could do to achieve his aim. In other words, there was no other avenue which he or she could explore to avoid the impact of the adverse decision. 122 We are here concerned with the second dimension, and it will already be apparent that, in our view, it cannot be said that, even if notified promptly, Mr Pathan would still have been without avenues to pursue in an attempt to alter the outcome of S/N gl2wqvk9UqWhOZoQAtuHA the decision making process. We have outlined above the various options which we believe would have been open to Mr Pathan if he had been alerted earlier to the decision to cancel Submania’s sponsor licence. Before turning again to those options, it is necessary to say something of the nature of the duty to act fairly in the context of bringing to the attention of an individual at the earliest time reasonably possible a decision in relation to revocation of the sponsor licence which is likely to affect him or her adversely.” [53] Namun demikian adalah didapati bahawa terdapat juga keadaan di mana Mahkamah telah menjalankan peranan sebagai badan penyelia kepada tindakan badan awam. Ini dapat dilihat misalnya dalam kes R (on the application of Majera (formerly SM (Rwanda))) v Secretary of State for the Home Department [2022] 2 All ER 305 dan Regina (Palestine Solidarity Campaign Ltd and another) v Secretary of State for Housing, Communities and Local Government [2020] 1 WLR 1774. [54] Dalam hal ini juga adalah menarik untuk melihat pandangan yang dikemukakan dalam artikel bertajuk Has the UK Supreme Court Become More Restrained in Public Law Cases? oleh Lewis Graham, The Modern Law Review Volume 87, September 2024 No. 5 di halaman 1085 seperti berikut: “The numbers therefore confirm that the Court is generally quite favourable towards public bodies, and that it has become more favourable to public bodies over time. However, the extent of this change should not be exaggerated. Indeed, in two S/N gl2wqvk9UqWhOZoQAtuHA important judgments authored by Lord Reed, the Court underlined the constitutional expectation that even non-coercive judicial orders should be followed and respected, and chastised authorities for failing to do so in fairly trenchant terms. In another case, the majority of the Court limited the actions of a local authority through the application of an arguably expansive conception of the principle in Padfield. There is therefore no charge here of any wholesale abdication of the Court’s supervisory role or fealty to government. But the broader picture, taking into account the raw numbers as well as the substance of the case law, does suggest that the Court prefers something of athin conception of judicial review, and one which grants the executive significant leeway, at least in some respects. This is consistent with an overall restrained approach.” [55] Selain daripada itu dalam kes ini Pemohon juga menyatakan bahawa pihak Responden telah gagal untuk mengendorskan kawasan baharu Daerah Kecil Genting di dalam surat hakmilik Pemohon-Pemohon. Ini telah menyebabkan Pemohon-Pemohon tidak mempunyai pengetahuan bahawa tanah mereka telah dimasukkan atau diisytiharkan sebagai kawasan Daerah Kecil Genting. Ia menyebabkan Pemohon masih berpandangan bahawa mereka berada di dalam Daerah Bentong dan sewajarnya dikenakan kadar cukai tanah yang sama dan bukannya cukai baharu ekoran daripada pengisytiharan yang dibuat oleh pihak Responden. Pada hemat Mahkamah adalah tidak wajar untuk Responden dipertanggungjawabkan untuk memanggil kesemua pemilik-pemilik tanah di kawasan tersebut dan diendorskan di dalam hakmilik S/N gl2wqvk9UqWhOZoQAtuHA masing-masing kawasan Daerah Kecil Genting seperti yang diisytiharkan oleh Responden. Pada hemat Mahkamah adalah satu yang munasabah dan wajar untuk Responden memaklumkan pengisytiharan tersebut melalui Warta Kerajaan Negeri seperti yang telah dilakukan oleh pihak Responden. Ini bermakna tindakan pihak Responden tersebut adalah sesuatu yang munasabah dan tidak wajar dijadikan asas untuk semakan kehakiman dilakukan terhadap Responden. Kenaikan Cukai Tanah [56] Dalam kes ini juga pihak Pemohon menyatakan bahawa cukai tanah yang dinaikkan oleh pihak Responden adalah tidak sah, tidak munasabah dan tidak teratur. Penelitian kepada affidavit dan hujahan Pemohon dapatlah dinyatakan bahawa terdapat dua perkara-perkara utama yang ditimbulkan oleh Pemohon berkenaan kenaikan cukai tersebut iaitu: (a) keputusan untuk menaikkan cukai tersebut adalah bercanggah dengan Kanun Tanah Negara; dan (b) kadar cukai tersebut adalah lebih tinggi daripada sebelum ini dan tidak munasabah. [57] Berkenaan dengan isu (a) adalah didapati bahawa Pemohon menyatakan pihak Responden telah gagal untuk mendapatkan kebenaran daripada Majlis Tanah Negara bagi kenaikan cukai tanah tersebut. Sebaliknya pihak Responden menyatakan proses pemakluman kepada Majlis Tanah Negara telah dilakukan malahan S/N gl2wqvk9UqWhOZoQAtuHA Majlis Tanah Negara menggesa Kerajaan Negeri untuk menilai semula kadar cukai tanah di negeri-negeri memandangkan berlakunya perubahan ekonomi dan perubahan ekonomi yang memerlukan kajian semula kadar cukai tanah di negeri-negeri. Ekoran daripada syor tersebut maka Responden telah melalui Majlis Mesyuarat Kerajaan Negeri telah mempertimbangkan kenaikan cukai tanah yang terpakai ke seluruh negeri Pahang. Ini seperti yang disentuh di perenggan [39] di atas. [58] Penelitian kepada affidavit sokongan bagi permohonan semakan kehakiman ini berkaitan dengan kadar cukai tanah adalah dinyatakan bahawa Pemohon berpendapat kadar amaun cukai tanah di seluruh negeri Pahang tersebut adalah tidak teratur kerana ketiadaaan kelulusan Majlis Tanah Negara. Di samping itu peraturan tersebut juga di bawah Kaedah-kaedah Tanah Pahang telah diwartakan secara tidak sah kerana bertentangan dengan Kanun Tanah Negara. Begitu juga pindaan yang dibuat terhadap Kaedah-kaedah Tanah Pahang adalah salah dan Pihak Berkuasa Negeri tidak sewajarnya melakukan semakan ke atas cukai tanah sepertimana yang dinyatakan di bawah Kanun Tanah Negara. [59] Kaedah-kaedah Tanah Pahang tersebut adalah tidak terpakai kepada tanah Pemohon kerana Kaedah-kaedah Tanah Pahang 1992 (Disemak 2015) P.U. 27/2015 memperuntukkan bahawa kadar cukai tanah adalah terpakai kepada tanah baharu sahaja. Pemohon menyatakan bahawa tanah-tanah yang dimiliki oleh mereka adalah bukannya tanah baharu dan telahpun diberi hakmilik sebelum 01.01.2020. S/N gl2wqvk9UqWhOZoQAtuHA [60] Pada masa yang sama Mahkamah juga mendapati bahawa terdapat pindaan kepada Kaedah-kaedah Tanah Pahang (Pindaan) (No. 8) 2022 bertarikh 01.02.2023 yang menyatakan seperti berikut: Phg. P.U. 1. KANUN TANAH NEGARA Kaedah-Kaedah Tanah Pahang (Pindaan) (No. 8) 2022 Pada menjalankan kuasa yang diberikan oleh seksyen 14 Kanun Tanah Negara [Akta 828], Pihak Berkuasa Negeri membuat kaedah-kaedah yang berikut: Tajuk ringkas dan permulaan kuat kuasa 1. (1) Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Tanah Pahang (Pindaan) (No. 8) 2022. (2) Kaedah-Kaedah ini hendaklah disifatkan telah mula berkuat kuasa pada 1 Januari 2020. Pindaan kaedah 22 2. Kaedah 22(1) Kaedah-Kaedah Tanah Pahang 1992 [Phg. P.U. 27/2015], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dengan memotong perkataan “new”. Bertarikh 27 Januari 2023 [PTG.Phg.HASIL:B02/9/3; PTG.Phg.UP/10/REV/KTP09(01)SJ.4; PUN.Phg.A/100/06 Jld. 9/02] MOHD ZUKRI BIN SIDEK Setiausaha Majlis Mesyuarat Kerajaan Pahang S/N gl2wqvk9UqWhOZoQAtuHA [61] Adalah tidak dapat dinafikan bahawa Pihak Berkuasa Negeri tidak boleh dengan sewenang-wenangnya menaikkan kadar cukai tanah tanpa mematuhi Kanun Tanah Negara. Proses untuk mendapatkan ataupun mengenakan cukai tanah atau sebarang semakan cukai tanah adalah perlu dibuat dengan mengikut peruntukan di bawah seksyen 101 (5) KTN yang menyatakan seperti berikut: “101 Power of State Authority to revise rents periodically (1) Subject to the provisions of sub-section (5), the State Authority may from time to time revise in accordance with the following provisions of this section the rents payable in respect of alienated lands within the State. (2) Any revision under this section shall extend to all alienated lands within the State except land of any class or description which the State Authority may think fit to exempt therefrom. (3) On any revision under this section, the State Authority may- (a) increase or reduce by the same proportion the rents payable in respect of all lands to which the revision extends, or (b) make different provision for different classes or descriptions of such land, being, in the case of each such class or description, either-S/N gl2wqvk9UqWhOZoQAtuHA (i) provision for increasing or reducing rents by the same proportion, or (ii) provision imposing a new rate of rent thereon. (4) In the exercise of the powers conferred by this section the State Authority shall take no account of increases in land values attributable to improvements. (5) Revisions of rent under this section shall be made at such times as the State Authority may, with the approval of the National Land Council, determine, but- (a) in the case of the first such revision, not so as to have effect earlier than the beginning of the year 1970, and (b) in the case of any subsequent revision, not so as to have effect before the expiry of a period of ten years beginning with the most recent date as from which any rents in the State were revised under this section. (6) Where a revision of rent has been made under this section, the Registrar or Land Administrator shall, as soon as possible, amend the amount of rent endorsed on the document of title to, and payable in respect of, land affected by the revision by substituting the revised rent for that amount; and note the date of making the amendment and the authority therefor and authenticate the same under his hand and seal. S/N gl2wqvk9UqWhOZoQAtuHA (7) Notwithstanding the operation of Part IVA of the Strata Titles Act 1985, this section shall also apply to land with subdivided building in accordance to section 96A. (8) The rent of the land with subdivided building shall become payable only upon the termination of subdivision, in accordance with Part IVA of the Strata Titles Act 1985.” [62] Peruntukan tersebut dengan jelas dan nyata menunjukkan bahawa sebarang kenaikan atau semakan yang dibuat oleh Pihak Berkuasa Negeri terhadap cukai tanah hendaklah dengan persetujuan Majlis Tanah Negara. Kedudukan Majlis Tanah Negara telah dinyatakan di dalam Perkara 91 Perlembagaan Persekutuan seperti berikut: “91 National Land Council (1) There shall be a National Land Council consisting of a Minister as chairman, one representative from each of the States, who shall be appointed by the Ruler or Yang di-Pertua Negeri, and such number of representatives of the Federal Government as that Government may appoint but, subject to Clause (5) of Article 95E, the number of representatives of the Federal Government shall not exceed ten. (2) The chairman may vote on any question before the National Land Council but shall not have a casting vote. S/N gl2wqvk9UqWhOZoQAtuHA (3) The National Land Council shall be summoned to meet by the chairman as often as he considers necessary but there shall be at least one meeting in every year. (4) If the chairman or a representative of a State or of the Federal Government is unable to attend a meeting, the authority by whom he was appointed may appoint another person to take his place at that meeting. (5) It shall be the duty of the National Land Council to formulate from time to time in consultation with the Federal Government, the State Governments and the National Finance Council a national policy for the promotion and control of the utilization of land throughout the Federation for mining, agriculture, forestry or any other purpose, and for the administration of any laws relating there to; and the Federal and State Governments shall follow the policy so formulated. (6) The Federal Government or the Government of any State may consult the National Land Council in respect of any other matter relating to the utilization of land or in respect of any proposed legislation dealing with land or of the administration of any such law, and it shall be the duty of the National Land Council to advise that Government on any such matters.” [63] Mahkamah ini telah meneliti affidavit jawapan Responden bertarikh 16.01.2024 yang dideposkan oleh Hamadan @ Hamdan bin Hussin di perenggan 13 yang menyatakan bahawa semakan cukai tanah telah dibuat di bawah seksyen 101 KTN dan S/N gl2wqvk9UqWhOZoQAtuHA dibentangkan dalam Majlis Mesyuarat Kerajaan Bil 26/2019 dan telah diluluskan pada 11.09.2019. Apa yang menarik dalam keputusan Majlis Mesyuarat Kerajaan pada 11.09.2019 ialah seperti berikut: “ c. Berikutan daripada itu, semakan cukai tanah di bawah seksyen 101 KTN telah dibentangkan di Majlis Mesyuarat Kerajaan (selepas ini dirujuk sebagai "MMK") bilangan ke 26/2019 dan diluluskan melalui MMK bilangan ke 28/2019 pada 11/09/2019 di mana pada MMK tersebut turut bersetuju untuk-i. Perlaksanaan cukai tanah tahun 2020 berkuat kuasa pada 1 Januari 2020 terhadap kesemua hakmilik tanah di negeri Pahang; ii. Pelaksanaan semakan cukai tanah tahun 2020 adalah terhadap kesemua hakmilik di negeri Pahang. d. Semakan cukai tanah tahun 2020 ini adalah selaras bagi memastikan kadar cukai tanah yang dikenakan adalah bersesuaian dengan pembangunan semasa yang terdapat di negeri Pahang serta selaras dengan pengesyoran Majlis Tanah Negara dan juga Kelulusan MMK seperti yang dinyatakan pada para c di atas, suatu pewartaan Phg. P.U.54/2019 telah dibuat pada 31 Oktober 2019 dengan menggantikan Kaedah-Kaedah Tanah Pahang 1992. Pindaan tersebut dinamakan S/N gl2wqvk9UqWhOZoQAtuHA sebagai Kaedah-Kaedah Tanah Pahang Pindaan (No. 4) 2019 dan hanya berkuat kuasa mulai 1 Januari 2020. e. Seterusnya Responden menyatakan bahawa MMK 1/2023 bertarikh 1 Februari 2023 telah memutuskan untuk membuat pindaan terhadap Phg. P.U 54/2019 dengan memotong perkataan "new". Pada 1 Februari 2023 satu pewartaan Phg. P.U. 1/2023 telah di buat. Hal ini adalah selaras dengan keputusan MMK di para c di atas yang menyatakan bahawa semakan kadar cukai tanah terpakai untuk semua hak milik tanah di negeri Pahang.” [64] Ini mencadangkan bahawa pihak Responden telah mematuhi kehendak Kanun Tanah Negara sebelum membuat semakan kepada cukai tanah di negeri Pahang. Persoalannya ialah pihak Pemohon menyatakan bahawa tiada sebarang keterangan lain yang menunjukkan bahawa Responden telah mematuhi kehendak Kanun Tanah Negara berkenaan dengan kenaikan cukai tanah tersebut. Mahkamah juga mendapati bahawa tiada sebarang affidavit atau eksibit yang menunjukkan minit mesyuarat Majlis Mesyuarat Kerajaan yang memutuskan perkara seperti yang dinyatakan oleh Hamadan @ Hamdan bin Hussin seperti yang dinyatakan di atas. [65] Pada masa yang sama Pemohon juga menyatakan di dalam affidavit balasan Pemohon melalui Ahmed Ariff Meah bin Azlan Meah di perenggan 10.1 memohon pihak Responden mengemukakan minit mesyuarat keputusan Majlis Tanah Negara dan menyatakan sekiranya ada ia hanyalah merupakan suatu keputusan dasar dan S/N gl2wqvk9UqWhOZoQAtuHA bukannya kelulusan Majlis Tanah Negara seperti yang dikehendaki di bawah seksyen 101 (5) KTN. Dalam erti kata lain Pemohon menyatakan bahawa keputusan Majlis Tanah Negara sekiranya ada pada 14.12.2015 hanyalah merupakan keputusan dasar dan bagi menaikkan kadar cukai tanah dan Kerajaan Negeri Pahang hendaklah mendapatkan kelulusan daripada Majlis Tanah Negara setelah permohonan dikemukakan kepada Majlis Tanah Negara. [66] Pemohon juga menyatakan bahawa tindakan Responden membuat pindaan menjalankan semakan kepada cukai tanah di bawah seksyen 14 KTN adalah tidak wajar kerana kuasa untuk membuat semakan adalah di bawah seksyen 101 KTN. [67] Mahkamah ini meneliti affidavit-affidavit dan hujahan yang dikemukakan berkenaan perkara ini dan mendapati dalam menentukan kenaikan cukai perlu dilihat istilah yang digunakan di dalam seksyen 101 KTN ialah cukai atau rent yang telah ditakrifkan di bawah seksyen 5 KTN seperti berikut: "rent" includes- (a) any annual sum payable to the State Authority by way of rent; (b) any other annual payment due to the State Authority which by any written law is to be collected as if it were rent or land revenue; and S/N gl2wqvk9UqWhOZoQAtuHA (c) any fee due to the State Authority in respect of arrears of rent by virtue of rules under section 14; [68] Jika dilihat kepada seksyen 14 KTN pula memberikan kuasa kepada Pihak Berkuasa Negeri untuk membuat peraturan-peraturan yang salah satunya adalah berkenaan dengan rent iaitu seksyen 14 (1) (e) KTN seperti berikut: “14 Power of State Authority to make rules (1) Subject to sub-section (2), the State Authority may make rules generally for carrying out the objects and purposes of this Act within the State, and in particular, but without prejudice to the generality of the foregoing, may by such rules make provision with respect to- (a) the mode in which applications for State land are to be made; (aa) the exemption of any disposal of land, or any dealing or other act with regard to alienated land or any interest in land from the requirement in sub-section (1) of section 433B or sub-section (1) of section 433E, as the case may be; (ab) the exemption of any non-citizen or foreign company or class of non-citizen or foreign company from Part Thirty-Three (A) and the circumstances in which the exemption may be given; S/N gl2wqvk9UqWhOZoQAtuHA (b) the issue, under Chapters 2 and 3 respectively of Part Four, of temporary occupation licences and permits to extract and remove rock materials, and the issue for the purposes of section 427 of permits for the grazing of animals; (c) the control and management of reserved land, and the leasing thereof under section 63; (d) the sale by auction of land required by or under this Act to be so sold; (e) the rates (being rates per cubic metre or other lesser unit of volume) at which the rent to be reserved on, and the premium (if any) to be charged in respect of, the alienation under this Act of land of any class or description are, subject to the provisions of this Act, to be calculated; (f) the payments to be made under, and other incidents of, including matters relating to refund or forfeiture of any sum paid as deposit, licences and permits issued under this Act; (g) the fees or levy to be paid in connection with any matter arising under this Act; (ga) the remission in whole or in part of any levy to be paid under paragraph (g) or the exemption of any non-citizen or foreign company from the payment of such levy or any part thereof; S/N gl2wqvk9UqWhOZoQAtuHA (h) the scale of costs to be paid in relation to enquiries under this Act; (i) the places at which, and officers to whom, any item of land revenue is to be paid; (j) the collection, remission, rebate, payment by instalments or deferment of payment of any item of land revenue; (ja) the offences which may be compounded and the method and procedure for compounding such offences; (k) the powers and duties of any officers appointed under sub-section (1) of section 12; and (l) insofar as they do not fall within any of the preceding paragraphs, all procedural and other matters which by this Act are required or permitted to be prescribed, or which are necessary or convenient to be prescribed for carrying out or giving effect to the provisions of this Act. (1A) Notwithstanding paragraphs (1)(aa), (ab), (g) and (ga) of sub-section (1), the State Authority shall not make rules under paragraph (aa), or (ab), or under paragraph (g) with respect to any levy to be paid under this Act, or under paragraph (ga), except in accordance with the directions given by the National Land Council. S/N gl2wqvk9UqWhOZoQAtuHA (2) Nothing in sub-section (1) shall empower the State Authority to make rules with respect to the practice or procedure of the Survey and Mapping Department, or the powers or duties of Survey Officers, or with respect to any matter concerning payments in connection with surveys carried out by the Survey Department other than the collection of such payments.” [69] Peguam Pemohon yang bijaksana telah berhujah bahawa pihak Responden tidak mempunyai kuasa untuk menggunapakai seksyen 14 KTN bagi mengadakan kaedah-kaedah untuk meminda, menyemak atau mengubahsuai kadar sewa cukai tanah bagi tanah-tanah milik Pemohon-Pemohon. Peguam Pemohon bersandarkan kepada takrifan sewa di bawah seksyen 5 (c) KTN seperti yang dinyatakan di atas. Ia disokong pula dengan rujukan kepada Perkara 40 Bahagian V Undang-undang Tubuh Kerajaan Pahang yang memperuntukkan bagaimana suatu cukai boleh dikenakan. Perkara 40 Undang-undang Tubuh Kerajaan Pahang menyatakan seperti berikut: “40. Sebarang cukai atau bayaran tidak boleh dikenakan oleh Negeri ini atau bagi maksud-maksud Negeri ini kecuali dengan atau menurut kuasa undang-undang.” Adakah keputusan Responden adalah suatu ultra vires [70] Ringkasnya, ultra vires secara hurufiahnya membawa maksud melangkaui atau melebihi kuasa. Ia membawa maksud pihak yang membuat keputusan telah melebihi daripada kuasanya. Pihak yang diberikan kuasa itu mestilah melakukan tindakan di dalam ruang S/N gl2wqvk9UqWhOZoQAtuHA lingkup kuasa tersebut. Mahkamah perlu memastikan bahawa pihak yang diberikan kuasa itu melaksanakan kuasanya mengikut undang-undang. Ultra vires telah diputuskan terbahagi kepada dua jenis iaitu substantive ultra vires dan procedural ultra vires (Puraneswaran v. Menteri Hal Ehwal Dalam Negeri Malaysia [1991] 3 MLJ 65). [71] Dalam kes Penang Development Corporation v Teoh Eng Huat [1993] 1 AMR 23; [1993] 2 CLJ 283 Mahkamah telah menyatakan berkenaan dengan pelaksanaan doktrin ultra vires seperti berikut: “The development of the doctrine of ultra vires since has led some writers to classify the new concept of ultra vires as ultra vires in the broad sense. Thus, where official action while being within the scope of the authority of the law or a corporation if it becomes erroneous on some grounds such action would now be described asultra vires, being outside jurisdiction, under the broad concept of ultra vires. Examples of ultra vires used in this sense and the grounds therefore are succinctly illustrated by Lord Pearce in the Anisminic case at p. 195, Lord Reid in the same case at p. 171 and Lord Greene in Associated Provincial 223. Picture Houses Ltd. v. Wednesbury Corporation [1948] 1 KB For the sake of convenience, the remarks of Lord Reid at p. 171 of the Anisminic case is reproduced: It has sometimes been said that it is only where a tribunal acts without jurisdiction that its decision is a nullity. But in such cases the word 'jurisdiction' has been used in a very wide sense, and I have come to the conclusion that it is S/N gl2wqvk9UqWhOZoQAtuHA better not to use the term except in the narrow and original sense of the tribunal being entitled to enter on the inquiry in question. But there are many cases where, although the tribunal had jurisdiction to enter on the inquiry, it has done or failed to do something in the course of the inquiry which is of such a nature that its decision is a nullity. It may have given its decision in bad faith. It may have made a decision which it had no power to make. It may have failed in the course of the inquiry to comply with the requirements of natural justice. It may in perfect good faith have misconstrued the provisions giving it power to act so that it failed to deal with the question remitted to it and decided some question which was not remitted to it. It may have refused to take into account something which it was required to take into account. Or it may have based its decision on some matter which, under the provisions setting it up, it had no right to take into account. I do not intend this list to be exhaustive. But if it decides a question remitted to it for decision without committing any of these errors it is as much entitled to decide that question wrongly as it is to decide it rightly... Although Lord Reid was talking about a tribunal the same principle would apply in the case of an officer exercising his discretion or authority under the provisions of a statute.” S/N gl2wqvk9UqWhOZoQAtuHA [72] Ini adalah sejajar dengan hakikat semakan kehakiman seperti dinyatakan oleh Sir William Wade di dalam Administrative Law (Ninth Edition) Oxford University Press, di halaman 344 hingga 345 seperti berikut: “In requiring statutory powers to be exercised reasonably, in good faith, and on correct grounds, the courts are still working within the bounds of the familiar principle of ultra vires. The analysis involves no difficulty or mystique. Offending acts are condemned simply for the reason that they are unauthorised. The court assumes that Parliament cannot have intended to authorise unreasonable action, which is therefore ultra vires and void.” [73] Oleh yang demikian tindakan Responden adalah tidak dapat ditunjukkan oleh Pemohon telah menyalahi peruntukan undang-undang iaitu seksyen 101 (5) KTN atau mana-mana peruntukan di bawah Kanun Tanah Negara atau undang-undang bertulis lain. Oleh itu ia bukanlah satu tindakan ultra vires oleh pihak Responden. [74] Apakah seksyen 101 (5) KTN 1965 (Semakan 2020) itu hanya melibatkan kenaikan cukai tanah dan tidak berkaitan dengan semakan cukai? Apa yang jelas seksyen 101(5) KTN 1965 (Semakan 2020) dan dibaca bersama seksyen 14 KTN menunjukkan bahawa Pihak Berkuasa Negeri mempunyai kuasa di bawah seksyen 14 KTN untuk membuat peraturan bagi menjalankan apa-apa tindakan melaksanakan kuasa di bawah Kanun Tanah Negara tersebut. S/N gl2wqvk9UqWhOZoQAtuHA [75] Mahkamah ini berpendapat bahawa keputusan Responden untuk melakukan semakan cukai tanah yang membawa kepada peningkatan kadar cukai tanah yang melibatkan tanah-tanah milik Pemohon-Pemohon adalah sesuatu yang dilakukan mengikut bidang kuasa yang diberikan di bawah Kanun Tanah Negara. Setelah meneliti affidavit sokongan, eksibit-eksibit yang dikemukakan serta affidavit jawapan dan hujahan pihak-pihak Mahkamah tidak dapat menemui suatu petanda yang menunjukkan keputusan Responden adalah bercanggah dengan mana-mana undang-undang atau sesuatu yang tidak munasabah, tidak sah dan tidak setimpal bagi membolehkan Mahkamah ini menjalankan semakan kehakiman terhadap keputusan Responden tersebut. [76] Begitu juga berkenaan isu (b), setelah Mahkamah ini membuat dapatan bahawa semakan kehakiman tidak wajar dilakukan bagi keputusan Responden di dalam isu (a) maka secara pari passu atau kesan langsungnya isu (b) juga membawa natijah bahawa tiada keperluan untuk Mahkamah ini membuat semakan kehakiman. [77] Akhirnya Mahkamah berpendapat bahawa permohonan semakan kehakiman oleh pihak Pemohon-Pemohon bagi kes ini dan kes CB-25-1-04/2023, CB-25-3-04/2023, CB-25-4-04/2023 dan CB- 25-5-04/2023 adalah ditolak.
