The Respondent must prove that the Respondent has suffered damages following the breach of duty of care committed by the Appellant. *ALL three elements must be proved on the balance of probabilities by the Respondent to succeed in its negligence claim against the Appellant. [29] Sebagaimana fakta yang jelas dinyatakan bahawa Perayu/D1, Perayu/D1 ialah syarikat pengimport Kenderaan tersebut dan menjual Kenderaan tersebut kepada Responden/Plaintif. Pertikaian dalam kes ini bukanlah bertumpu kepada isu percukaian ke atas Kenderaan tersebut tetapi kepada penyerahan Kenderaan yang dibeli itu kepada Responden/Plaintif. [30] Penilaian kepada percukaian dibuat oleh Jabatan Kastam Diraja Malaysia (JKDM) dan surat pelepasan Kenderaan tersebut selepas bayaran cukai dibayar telah dan hendaklah dilaksanakan oleh Perayu/D1 sehingga Kenderaan tersebut dimiliki oleh Responden/Plaintif sepenuhnya dan berada dalam pegangan Responden/Plaintif. Namun obligasi Perayu/D1 belum disempurnakan sepenuhnya kerana Kenderaan tersebut telah disita oleh JKDM akibat daripada “a shortfall in the duty and/or tax for the Vehicle”. S/N 0qQAYZadGkeusmkRZkKrqg Bagaimana boleh berlakunya “a shortfall in the duty and/or tax for the Vehicle”? [31] Peguam cara terpelajar Perayu/D1 berhujah − “The problem here in this case is that the customs department has done the assessment based on the wrongful declaration done by a stranger to this suit named Muhammad Rizal Bin Abd Rahman. That is the crust of the issue in this case. Therefore, as far as duty of care is concerned, the issue to be determined by this Honorable Court is that whether the Appellant who is not the declarant is duty bound to make the correct declaration in K1 Form? The facts transpired in the trial are as follows (reference to be made to notes of proceeding only if facts as stated herein are disputed): a. The Appellant has lent its AP for the sale and purchase of the Vehicle by the Respondent who at all times liaised with the 9th Defendant. b. Be that as it may, on paper, the sale was still transacted between the Appellant and the Respondent. S/N 0qQAYZadGkeusmkRZkKrqg c. When the Vehicle was brought into Malaysia using the AP of the Appellant, K1 form was submitted to the Malaysian Royal Custom Department for assessment of payable duty. *Custom has adduced K1 form from their back-end system which can be found at page 693 of Enclosure 5. d. The K1 form adduced by custom proves that the K1 form was submitted by Star Warehousing Sdn Bhd through the manager named Muhammad Rizal Bin Abd Rahman. e. In the K1 form, it was declared that the Vehicle was a 2014 made car meanwhile, custom department had later on discovered that the Vehicle is actually a 2018 made car. So, Muhammad Rizal Bin Abd Rahman made the wrong declaration. However, after the Vehicle was delivered to the Respondent, custom department has discovered the wrong declaration and asserted claim of shortfall towards the Respondent. Following which, because the Respondent refused to pay therefore the Vehicle was detained by custom department. The question now is who made the declaration? The declarant as per the evidence is the manager of Star Warehousing Sdn Bhd named Muhammad Rizal Bin Abd Rahman. In this regard, it is the Appellant’s submission that it is the declarant that is duty bound to make the correct declaration in K1 form but not the AP holder. S/N 0qQAYZadGkeusmkRZkKrqg It is our submission that when the AP Holder is not the declarant, AP holder did not owe duty of care towards the Respondent to ensure that the declaration is correctly made. More importantly, the declarant here Muhammad Rizal Bin Abd Rahman is a manager from Star Warehousing Sdn Bhd. He is not even related to the Appellant. Premised on that, since the Appellant does not owe duty of care towards the Respondent to ensure that the declaration is correctly made, the Appellant has not committed any breach of duty care in this case The role of the Appellant here is passive. The Appellant charged the Respondent based on the assessment by the custom and has paid the figure accordingly upon receiving the money from the Respondent. The Appellant did not do the declaration and was not the party that should do the assessment. Hence, the Appellant was not under the duty of care to make the right declaration and do the correct assessment. The duty was on the declarant, the manager of Star Warehousing Sdn Bhd named Rizal Bin Abd Rahman and the custom department. Very unfortunately, the Respondent that is aware of the name and particulars of the declarant, obviously the wrongdoer, decided not to name the declarant as one of the defendants in the suit.”. S/N 0qQAYZadGkeusmkRZkKrqg [32] Dalam tindakan ini, Responden/Plaintif menuntut dan memplidkan kecuaian terhadap semua Defendan yang dinamakan. Walau bagaimana pun, daripada keterangan dan bukti yang dikemukakan di Mahkamah Sesyen, Mahkamah Sesyen membuat dapatan bahawa kecuaian adalah di pihak Defendan Pertama sepenuhnya. [33] Penilaian fakta semasa perbicaraan di hadapan Mahkamah Sesyen adalah − • pengalaman D1 yang terlibat dengan kereta lebih kurang 24 tahun. • D1 mengakui dan bersetuju bahawa D1 meminjamkan Approved Permit (AP) kepada Chua Beng Hong (D9) dan D9 membuat semua penjualan semua ini atas nama dan bagi pihak BHU. AP Defendan Pertama telah digunakan untuk membeli kenderaan import tersebut. • D1 gagal dalam tanggungjawabnya terhadap Plaintif bagi menyediakan dokumen yang teratur dan betul (proper documents) atau mengesahkan cukai yang sepatutnya dibayar. D1 gagal menyemak dokumen mengenai pengimportan Kenderaan tersebut yang menggunakan AP D1. • D1 mempunyai “Duty of Care” terhadap Plaintif sebagai ejen pengimport untuk memastikan cukai yang betul dibayar kepada Kerajaan (JKDM) dan D1 telah memungkiri “Duty of care” tersebut. S/N 0qQAYZadGkeusmkRZkKrqg • Plaintif telah berjaya membuktikan bahawa Plaintif adalah “bona fide purchaser” bagi Kenderaan tersebut. [34] Apabila Mahkamah Sesyen memutuskan atas dasar bahawa Plaintif telah membeli kenderaan tersebut melalui D1; membuat bayaran penuh sebagaimana diminta; Plaintif telah patuh kepada apa yang diarahkan oleh D1 dan setelah semua urusan selesai, Plaintif telah mendapat hak dan milikan kepada kenderaan tersebut. Kenderaan tersebut juga telah ada dalam milikan Plaintif dan isu yang timbul hanya selepas 9 bulan kenderaan diserah dan dimiliki oleh Plaintif, maka prinsip undang-undang yang dipakai oleh Pn HMS adalah berdasarkan keputusan Mahkamah Persekutuan dalam kes − • Malayan Banking Bhd v. Mohd Affandi Ahmad & Anor, Federal Court, Putrajaya [2024] 10 CLJ 501, apa yang dinyatakan oleh Mahkamah Atasan berhubung isu “bona fide purchaser” adalah melibatkan “good faith”, “made fullpayment”, “already the registered owner”, “sale and purchase transaction already completed”, “element of fraud, deceit or dishonesty” dan seterusnya. • Pekan Nenas Industries Sdn Bhd v. Chang Ching Chuen & Ors [1998] 1 CLJ 793; [1998] 1 MLJ 465. • T Sivam Tharamalingam v. Public Bank Bhd [2018] 6 CLJ 1; [2018] 5 MLJ 711. S/N 0qQAYZadGkeusmkRZkKrqg [35] Dalam fakta kes ini, Responden/Plaintif telah menyerahkan urusan pembelian kenderaan tersebut sepenuhnya kepada Perayu/D1 (dan/atau D9). Segala dokumentasi dan urusan berhubung jumlah harga kenderaan termasuk cukai dan kos-kos lain yang perlu Plaintif bayar, adalah diuruskan oleh Perayu/D1. Setelah menerima pengesahan daripada pihak Perayu/D1, Responden/Plaintif telah membuat bayaran penuh sewajarnya. Apa yang dinantikan dan dijangkakan dan perlu ditunaikan ialah Kenderaan tersebut diserahkan kepada Responden/Plaintif bagi kegunaannya. [36] Dalam tindakan ini, sepanjang perbicaraan dan saksi-saksi memberi keterangan, Mahkamah Sesyen mendapati − • tiada bukti menunjukkan wujudnya konspirasi atau penipuan (fraud) di pihak Responden/Plaintif. • alegasi D1 bahawa “Plaintif sendiri terdapat pengetahuan penuh bahawa Encik Chua telah terlibat dalam tindakan jenayah yang mengisytiharkan tahun pengeluaran kereta tersebut secara palsu untuk tujuan pengelakkan cukai dan wujud tindakan konspirasi antara Plaintif, Encik Chua dan pihak ketiga yang menyalahi undang-undang”, adalah tidak disokong oleh mana-mana keterangan dan bukti. S/N 0qQAYZadGkeusmkRZkKrqg [37] Keterangan Perayu/D1 melalui saksi tunggalnya iaitu SD-1 yang mengalihkan beban dan tanggungjawab kepada pihak lain khususnya pihak D9, Hasnarama, Star Warehouse, D2 hingga D8 dan pihak-pihak lain sepanjang dalam keterangannya di Mahkamah Sesyen gagal untuk membuktikan kecuaian tersebut dilakukan oleh pihak lain. Perayu/D1 sendiri dalam keterangan mengakui bahawa sepanjang proses permohonan AP hingga ke bayaran cukai, D9 tidak terlibat dan perkara ini adalah di bawah tanggungjawab Perayu/D1. [38] Dalam alasan penghakimannya, Pn HMS menyatakan − • Hujahan Defendan Pertama dalam
