DEFENDAN ALASAN PENGHAKIMAN Latarbelakang [1] Kes ini telah ditamatkan hayatnya atas kuatkuasa “unless order” yang dipohon oleh kedua-dua peguam Defendan 1 dan 2 semasa prosiding pada 14.1.2024. Pada tarikh tersebut, pihak-pihak berhujah berhubung lampiran 49 dan 61 yang difailkan masing-masing oleh Defendan 1 dan 2 untuk Plaintif memasukkan sejumlah wang bagi tujuan jaminan kos. 15/08/2024 14:14:20 JA-22NCvC-5-01/2020 Kand. 115 [2] Semasa prosiding tersebut, setelah mendengar hujahan kedua-dua pihak, Mahkamah telah membenarkan permohonan Defendan 1 di lampiran 49 dan turut membenarkan lampiran 61 yang difailkan oleh Defendan 2 dengan perintah untuk RM100,000.00 dibayar oleh Plaintif kepada peguam Defendan masing-masing dalam tempoh 21 hari iaitu pada atau sebelum 3.2.2024. [3] Turut dibenarkan ialah perintah “unless order” iaitu “sekiranya Plaintif gagal, cuai dan/atau enggan membayar jumlah sebanyak RM100,000.00 masing-masing dalam tempoh yang ditetapkan pada atau sebelum 3.2.2024, maka tindakan ini adalah dibatalkan dengan serta-merta terhadap Defendan 1 dan Defendan 2”. Peguam bagi pihak Plaintif tidak ada mengemukakan apa-apa bantahan atas permohonan Defendan ini. [4] Pada 4.2.2024 semasa tarikh pengurusan kes, peguam Plaintif telah memaklumkan Mahkamah bahawa telah berlaku kegagalan di pihak Plaintif mematuhi perintah bertarikh 14.1.2024 tersebut. Tiada apa-apa mitigasi dimajukan atas kegagalan ini. Peguam Defendan telah memohon Mahkamah untuk menguatkuasakan perintah “unless order” tersebut. Mahkamah membenarkan permohonan peguam Defendan dan memerintahkan kes dibatalkan dengan kos RM10,000.00 dibayar oleh Plaintif kepada kedua-dua Defendan. Bayaran kos ini perlu dibayar Plaintif sebelum apa-apa tindakan memfailkan semula dibuat oleh Plaintif. [5] Rayuan ini yang difailkan pada 1.3.2024 adalah atas perintah pembatalan tuntutan Plaintif terhadap Defendan berbangkit daripada “unless order” ini dan bukan atas perintah Mahkamah membenarkan jaminan kos pada lampiran 49 dan 61 Defendan. Kedudukan “Unless order” di bawah Kaedah Mahkamah 2012 [6] Mahkamah mempunyai kuasa budi bicara untuk membenarkan “unless order” dan ini diperuntukkan di bawah Aturan 23 Kaedah 3 dan Aturan 92 Kaedah 4 Kaedah Mahkamah 2012. Lampiran 49 dan lampiran 61 dibuat di bawah seksyen 580A Akta Syarikat dan Aturan 92 Kaedah 4 ini (meskipun lampiran 49 mempunyai kesilapan apabila merujuk kepada Aturan 94 Kaedah 4 dan bukan Aturan 92 Kaedah 4 kerana tiada Aturan 94 Kaedah 4 di dalam Kaedah Mahkamah 2012). [7] Aturan 92 Kaedah 4 memperuntukkan seperti berikut: “4. Inherent powers of the Court (O. 92 r. 4) For the removal of doubt it is hereby declared that nothing in these Rules shall be deemed to limit or affect the inherent powers of the Court to make any order as may be necessary to prevent injustice or to prevent an abuse of the process of the Court”. [8] Mahkamah dalam membenarkan “unless order” ini berpendapat bahawa berdasarkan fakta di dalam tuntutan ini, perintah ini adalah perlu kerana kes ini telahpun diremit semula oleh Mahkamah Rayuan ke Mahkamah ini setelah rayuan Plaintif untuk mengetepikan perintah membatalkan writ dan tuntutan Plaintif yang difailkan oleh Defendan 2 di bawah Aturan 18 Kaedah 19 atas alasan ia bersikap skandal, remeh, mengaibkan, menyusahkan selain suatu penyalahgunaan proses Mahkamah, dibenarkan oleh Mahkamah Rayuan. [9] Selain daripada itu, Plaintif juga telah digulung pada 19.8.2019 dan meskipun perintah penggulungan ini telah diketepikan, ia menunjukkan kedudukan Plaintif yang tidak kukuh kerana selain daripada perintah penggulungan ini, terdapat satu lagi permohonan penggulungan dalam JA-28NCC-15-02/2021 (eksibit “NMT-10” Lampiran 2) di mana Plaintif merupakan Defendan 1 dalam kes JA-22C-4-06/2019 dan penghakiman telah diperolehi pada 25.10.2020 terhadap Defendan 1 iaitu Cosmic Master Development Sdn Bhd untuk membayar Hong Xin Construction Sdn Bhd. Oleh itu, pematuhan kepada perintah Mahkamah ini bertarikh 14.1.2024 adalah penting. [10] Mahkamah ini memetik kes-kes yang dirujuk dalam penghakiman oleh Yusrin Faidz Yusoff JC dalam kes Ooi Swee King v Standard Chartered Saadiq Bhd [2024] 2 CLJ 476 yang merujuk kes Md Amin Md Yusof & Anor v. Cityvilla Sdn Bhd [2004] 3 CLJ 88, Mahkamah Rayuan yang memutuskan keperluan untuk Mahkamah yang berdepan dengan isu kepatuhan pada perintah Mahkamah untuk tidak membuat keputusan membatalkan kes tanpa apa-apa asas atau justifikasi dengan hanya bersandarkan kepada kegagalan mematuhi perintah mahkamah semata-mata dengan menyatakan seperti berikut: “[1] Although a party's action or counterclaim may be struck out for non-compliance with a peremptory order of the court, such an order (striking out) will not be made unless there has been a history of failures to comply with other orders of court. A peremptory order (unless order) is an order of the last resort. Such an order will not meet the "ends of justice" if it results in a miscarriage of justice. The judge must look into all the circumstances of the case, including whether the default was intentional and contumelious, before proceeding to penalise the party in default, (p 94 c-d).” (penekanan oleh Mahkamah ini) [11] Apa yang dimaksudkan dengan frasa “intentional and contumelious” dapat dilihat di dalam kes Folin & Brothers Sdn Bhd v. Wong Foh Ling & Ors (No 2) [2001] 5 CLJ 476, Abdul Malik Ishak J (ketika itu) yang memetik Ward LJ dalam Hytec Information Systems Ltd v. Coventry City Council [1997] 1 WLR 1666 (di muka surat 1674) dan Sir Nicholas Browne-Wilkinson VC dalam Re Jokai Tea Holdings Ltd (Note) [1992] 1 WLR 1196 (di muka surat 1203) petikan oleh penghakiman Sir Nicholas Browne-Wilkinson yang menyatakan seperti berikut: “In my judgment, in cases in which the court has to decide what are the consequences of a failure to comply with an 'unless' order, the relevant question is whether such failure is intentional and contumelious. The court should not be astute to find excuses for such failure since obedience to orders of the court is the foundation on which its authority is founded. But if a party can clearly demonstrate that there was no intention to ignore or flout the order and that the failure to obey was due to extraneous circumstances, such failure to obey is not to be treated as contumelious and therefore does not disentitle the litigant to rights which he would otherwise have enjoyed." Thus, in this case I must examine the reason given by the plaintiff for breaching the unless order”. [12] Di dalam kes Ooi Swee King, Mahkamah Sesyen membenarkan permohonan Defendan untuk membatalkan kes Plaintif kerana writ telahpun luput dan penyata tuntutan tidak bertarikh tetapi membenarkan pemfailan semula kerana merits belum didengar. Defendan merayu atas isu “kebenaran pemfailan semula”. Mahkamah Tinggi yang mendengar rayuan mengekalkan perintah kebenaran pemfailan semula dengan memutuskan perintah untuk writ dan penyata tuntutan diserahkan dalam masa 14 hari dari tarikh meterai perintah bukanlah suatu perintah “peremptory order” ataupun “unless order” kerana ia tidak membawa bersama perintah ini, akibat jika berlaku perlanggaran atau kegagalan mematuhinya. [13] Ini berbeza dengan kes di hadapan Mahkamah ini kerana peguam Defendan jelas memohon “unless order” dan menyatakan akibat kegagalan pematuhan perintah Mahkamah. Berdasarkan kepada kes Hup Soon Omnibus Co Sdn Bhd & Anor v Lim Chee @ Lam Kum Chee [2017] MLJU 1937 di mana Mahkamah Persekutuan memutuskan seperti berikut: “[6] On the factual matrix of the present case, it is quite plain to us that the appellants had willfully breached the 31.3.2016 Order requiring them to deposit RM50,000.00 within 14 days as security for the costs. [7] The appellants had offered no plausible explanation for the breach of the order. In our view, the non-compliance was a willful and blatant disregard of the order of the Court of Appeal for which sanctions would be justified. [8] The Court will pay particular regard to the paramount importance of securing compliance with its orders. In Stolzenberg and Others v CIBC Mellon Trust Co. Ltd. [2004] EWCA Civ 827, Arden L J said at paragraph 167:- “...Compliance with orders of the court is not a question of judicial amour propre. It goes to the essence of the rule of law that parties subject to the court’s jurisdiction...should comply with the court’s orders. The gravity of the matter of non-compliance is plainly increased where the non-compliance results from a conscious decision, as in this case. It follows, as Ward LJ said in Hytec Limited v Coventry City Council [1997] 1 WLR 1666 at 1674 to 1675, that, ‘If a party intentionally or deliberately... flouts the order, he can expect no mercy’. He has to persuade the court that in all the circumstances the injustice to him outweighs the interests of the administration of justice and the injury to the other party.’ [9] In this regard, it is pertinent to note that respondent had given 3 signed cheques to the 1st appellant’s director for the payment of the amount of security of costs, but to date it has not been paid as ordered by the Court of Appeal. This clearly demonstrates that the appellants’ breach has been conscious and deliberate. The appellants did not seek leave of the Court for extension of time for the furnishing of security for costs.” [14] Berlandaskan kepada prinsip yang diputuskan oleh Mahkamah Persekutuan ini dan di dalam ketiadaan apa-apa mitigasi untuk menjelaskan kenapa berlaku kegagalan ini yang ditafsirkan oleh Mahkamah ini sebagai sikap bersahaja dan tidak acuh dengan perintah Mahkamah (lihat: kes Md Amin Md Yusof (supra), Mahkamah ini memutuskan membenarkan permohonan Defendan untuk “unless order” ini digunapakai untuk dikuatkuasakan bagi membatalkan kes Plaintif. -Tandatangan- (NURULHUDA NUR’AINI BTE MOHAMAD NOR) HAKIM MAHKAMAH TINGGI MALAYA JOHOR BAHRU Tarikh: 15.8.2024 KAUNSEL Bagi pihak Plaintif: Manian K.
