SP5 turut menjumpai di ruang tamu rumah tersebut, alat penimbang digital, satu bungkusan plastik biru yang berisi plastik-plastik kosong dan sehelai bil elektrik tertera alamat No. 9, Rumah Estate AVB, Bt. 1 ¼, Jalan Semeling, 08100 Bedong, Kedah. Beban pembuktian di akhir kes pendakwaan [3] Beban pembuktian di akhir kes pendakwaan adalah sepertimana yang telah dinyatakan di bawah seksyen 180 Kanun Tatacara Jenayah (“KTJ”) iaitu untuk menentukan berdasarkan kepada keterangan-keterangan yang kredibel wujudnya satu kes prima facie. [4] Mahkamah berpandukan kepada dua kes utama berkaitan prima facie iaitu kes kes Balachandran v PP [2005] 1 CLJ 85 dan kes PP v Mohd Radzi Abu Bakar [2006] 1 CLJ 457. Mahkamah dengan ini merumuskan bahawa di akhir kes pendakwaan bermakna Mahkamah ini hendaklah membuat penilaian maksimum ke atas keterangan-keterangan yang dikemukakan oleh pihak pendakwaan termasuk menilai kredibiliti keterangan- keterangan oleh saksi-saksi pendakwaan. Mahkamah sedar jika terdapat lebih dari satu inferens yang boleh dibuat, maka Mahkamah perlu memberi kelebihan kepada inferens yang memihak kepada OKT. [5] Berpandukan kepada kes Muhammad Lukman Mohamad v PP [2021] 7 CLJ 524 elemen yang perlu dipenuhi bagi satu kesalahan pengedaran dadah berbahaya di bawah seksyen 39B Akta 234 adalah seperti berikut; “In our view, there is force in the submission. The requisites that must be satisfied to sustain conviction for the offence of trafficking in dangerous drugs under s. 39B(1)(a) of DDA 1952 are well-settled. The following elements must be established: a) The impugned drugs are dangerous drugs as listed in the First Schedule of DDA 1952; b) The impugned drugs are under the custody, control and possession of the appellant; and c) The appellant trafficked in the said impugned drugs.” Analisis dan dapatan Mahkamah Sama ada dadah yang dirampas adalah dadah berbahaya dan rantaian keterangan barang kes [6] Bagi elemen yang pertama, Mahkamah mendapati bahawa tiada sebarang pertikaian berbangkit berkenaan jenis dadah yang telah dirampas serta dianalisis. [7] Mahkamah telah meneliti keterangan oleh SP1, SP2, SP5 dan SP9 dan mendapati bahawa keterangan yang diberikan adalah kukuh di dalam membuktikan rantaian keterangan barang kes. Ianya tidak terputus dan Mahkamah berpuashati bahawa ia adalah merupakan barang kes yang sama yang ditemui oleh SP5 serta dikemukakan kepada SP1 untuk dianalisis dan seterusnya dikemukakan di Mahkamah ini. Kesemua saksi telah membuat pengecaman ke atas fizikal barang-barang kes tersebut dan ianya turut disokong oleh keterangan-keterangan dokumen. [8] Ia sepertimana keputusan Mahkamah Rayuan di dalam kes Gunalan Ramachandran v. PP [2004] 4 CLJ 551 di mana Hakim Abdul Hamid Mohammad, HMR (pada ketika itu) yang menyatakan; “This is because, as far as I am aware, there is no law that the exhibit recovered must be produced in court failing which the prosecution's case must necessarily fall. It may or it may not, again depending on the facts and the circumstances of each case. Sunny Ang v. PP [1965] 1 LNS 171; [1966] 2 MLJ 195 (FC) (fold). In a drug trafficking case, the drug may be lost or destroyed subsequent to it having been analysed by the chemist. So long as there is no doubt that the drug analysed by the chemist is the same one that was recovered in the case and it is in respect of that drug that the accused is charged, and there is a reasonable explanation as to how it was lost or destroyed or the reason for the gap, there is no reason why the prosecution's case should fall. In the instant case, there was no break in the chain of evidence whatsoever, from the day it was seized until the date of trial. The missing exhibits did not contain any drugs. They were empty plastic packets and a weighing machine. Their existence could be seen from the photographs, not to mention oral evidence.” [9] Mahkamah turut tidak mendapati sebarang perkara di mana keterangan Ahli Kimia iaitu SP1 boleh diputuskan sebagai secara nyata adalah luar biasa (“inherently incredible”). Mahkamah di peringkat ini berhak untuk menerima keterangan SP1 sepertimana yang dinyatakan di dalam kes Munusamy Vengadasalam v. PP [1987] CLJ (Rep) 221 seperti berikut; “We are therefore of the view, that in this type of cases where the opinion of the chemist is confined only to the elementary nature and identity of the substance, the Court is entitled to accept the opinion of the expert of its face value, unless it is inherently incredible or the defence calls evidence in rebuttal by another expert to contradict the opinion. So long as some credible evidence is given by the chemist to support his opinion, there is no necessity for him to go into the details of what he did in the laboratory, step by step.” [10] Sehubungan dengan itu, Mahkamah merumuskan bahawa dadah yang dipersoalkan adalah dadah berbahaya sepertimana yang disenaraikan di bawah Jadual Pertama 234 dan ia adalah dadah yang sama dirampas oleh SP5 serta yang dianalisis oleh SP1. Sama ada dadah berbahaya tersebut berada di dalam milikan OKT [11] Elemen kedua yang perlu dibuktikan adalah sama ada dadah yang dipersoalkan adalah di dalam milikan OKT. Bagi perkara ini terdapat dua perkara utama iaitu berkaitan jagaan serta kawalan dan selanjutnya berkaitan elemen pengetahuan. Ini bersandarkan kepada kes-kes duluan seperti Chan Pean Leon v PP [1956] MLJ 237, Ibrahim Mohamad & Anor v PP [2011] 4 CLJ 113 dan Romi Amora Amir v PP [2011] 1 CLJ 870. [12] Teras kepada keterangan pihak PR adalah bersandarkan kepada keterangan yang telah diberikan oleh SP5. Puan TPR menghujahkan bahawa keterangan SP5 ini telah berjaya membuktikan bahawa dadah-dadah tersebut berada di dalam pemilikan OKT. [13] Ia bersandarkan kepada keterangan-keterangan yang boleh dirumuskan seperti berikut: a) OKT telah memberikan maklumat kepada SP5. Maklumat yang diberikan oleh OKT telah dicatit oleh SP6 di atas P41; b) OKT telah mengambil satu anak kunci mangga yang tergantung dalam bilik nombor satu dan menyerahkan kepada SP5. OKT telah memandu arah SP5 dan anggota pergi ke rumah No. 10 yang pada masa itu di dalam keadaan berkunci. SP6 telah menggunakan kunci yang diserahkan oleh OKT untuk membuka pintu rumah No. 10.; c) OKT telah tunjukkan dengan tangannya ke arah satu beg pakaian berzip warna hitam putih “Reebox” dan satu kotak speaker warna hitam atas lantai ruang tamu rumah. Dadah-dadah berbahaya telah ditemui dalam beg dan speaker tersebut; dan d) perlakuan OKT yang telah menunjukkan dengan tangannya di mana barang kes dadah adalah relevan bawah seksyen 8 Akta Keterangan 1950. [14] Peguam OKT sebaliknya menghujahkan sebaliknya iaitu keterangan SP5 ini dipenuhi dengan percanggahan dan perlu di pertimbangkan dengan berhati-hati oleh Mahkamah. Apalagi di dalam kes ini, serbuan oleh pihak polis adalah dibuat berdasarkan maklumat yang di terima. [15] Peguam OKT menghujahkan bahawa keterangan SP5 perlu dinilai dengan mengambilkira keterangan SP7 yang merupakan adik kepada OKT yang menyatakan bahawa pada malam tersebut, adik OKT bernama Krishnan telah datang ke rumah nombor 9 tersebut dan OKT sebenarnya tidur di ruang tamu. Krishnan datang dengan sebuah motosikal yang kemudiannya ditinggalkan di rumah nombor 10 kerana Krishnan hendak pergi ke tempat lain. [16] Keterangan SP7 berkaitan perkara ini disokong oleh keterangan SP6 iaitu ibu OKT yang mengesahkan bahawa Krishnan juga tinggal di rumah nombor 9 bersama mereka. Malahan Pegawai Penyiasat iaitu SP9 telah mengakui di dalam keterangannya bahawa SP6 telah memaklumkan kepadanya semasa rakaman percakapan diambil bahawa Krishnan telah datang ke rumah nombor 9 tersebut sebelum serbuan oleh pihak polis. [17] Puan TPR di dalam hujahnya menegaskan bahawa keterangan SP6 dan SP7 ini perlu dipertimbangkan dengan berhati-hati memandangkan bahawa mereka adalah merupakan saksi yang berkepentingan. Perhatian Mahkamah dibawa kepada keputusan di dalam kes Ibrahim Bakri v PP [2014] 1 LNS 1943. [18] Mahkamah menegaskan bahawa SP6 dan SP7 adalah merupakan saksi-saksi yang dipanggil oleh PR dan bukannya saksi pembelaan sepertimana di dalam kes Ibrahim Bakri (supra). Di samping itu, pihak PR juga tidak di dalam mana-mana keadaan membuat permohonan sama ada di bawah seksyen 145 maupun seksyan 154 Akta Keterangan 1950 sama ada bagi maksud mengakaskan kredibiliti keterangan saksi mereka atau menyoal balas saksi-saksi mereka. [19] Di atas kegagalan tersebut, maka Mahkamah berpandangan bahawa Mahkamah tiada pilihan selain merumuskan bahawa keterangan berkaitan Krishnan ada datang ke rumah tersebut di rumah nombor 10 adalah suatu fakta yang tidak dipertikaikan oleh pihak PR. [20] Selain itu, Mahkamah mendapati keterangan SP5 juga adalah bercanggah dengan SP7 berkaitan motosikal yang dikatakan ditemui semasa serbuan di rumah nombor 10. Semasa pemeriksaan balas, SP5 menafikan sekeras-kerasnya bahawa SP5 ada menemui sebuah motosikal di rumah nombor 10. Ini bercanggah sama sekali dengan keterangan SP7 yang mengesahkan baahwa Krishnan ada meletakkan motosikalnya di rumah nombor 10. Keterangan SP5 turut bercanggah dengan keterangan SP8 yang turut serta di dalam serbuan pihak polis dan SP9 yang telah mengesahkan bahawa terdapat rampasan motosikal dari rumah nombor 10 tersebut. [21] Percanggahan ini bagi Mahkamah ini adalah sangat material kerana ia menyentuh menyentuh secara lanngsung kepada teras kes ini iaitu sama ada terdapat orang lain yang mempunyai akses ke atas dadah-dadah yang ditemui di dalam kes ini iaitu sama ada di dalam rumah nombor 9 mahupun rumah nombor 10. Apabila ia melibatkan satu percanggahan yang material, maka ia melibatkan kebolehpercayaan serta kewibawaan seseorang saksi itu. [22] Di dalam kes State of Jammu & Kashmir v Ferohmad Najar & Anor [CRAA No 9/2018] telah dinyatakan; “…It is true that even if defence is successful in contradicting a witness, it would not always mean that the contradiction in her two statements would result in totally discrediting this witness but when the contradiction relates to vital aspects of the case and the version of occurrence given in previous statement by a witness is entirely different from the version of occurrence given witness during the trial of the case, it does definitely make the statement of such witness unreliable and untrustworthy.” [penekanan ditegaskan] [23] Manakala di dalam kes Goh Ming han v PP [2016] 5 MLRA 634, Mahkamah Rayuan ada menyatakan; “[14] The contradiction is serious and cuts deep into the prosecution case as it involves the crucial question of whether the drugs were in the appellants’custody or control at the time of the raid. It is trite law that where is a doubt on any essential element of the charge the doubt must be resolved in favour of the accused especially where as in this case the doubt arose from the prosecution’s own evidence. [15] The learned Judicial Commissioner however dismissed the contradiction as a minor discrepancy and concluded that the drugs were brought into the room by the appellant who placed it next to the mattress near the door. It was of course for the learned Judicial Commissioner to make such finding of fact but before doing so he had a duty to evaluate the entire evidence and the probabilities of the case. [16] The rule that the prosecution’s evidence must be subjected to a maximum evaluation at the close of its caserequires that the trial court directs its mind properly and adequately to every material aspect of the evidence both for and against the prosecution in order to determine whether the strict requirement of proof has been met by prosecution.” [penekanan ditegaskan] [24] Terbaru, Mahkamah Rayuan di dalam kes Mohamad Alraziq Ramli lwn PR [2023] 5 MLRA 459 telah memutuskan; “[39] Dengan memberikan keterangan yang bercanggah dengan P11 dalam perkara-perkara yang material, kami mendapati SP2 dan SP3 bukanlah saksi yang bercakap benar dan tidak boleh dipercayai. Mereka sanggup menokok tambah dan mereka keterangan semata-mata untuk mendapatkan sabitan terhadap perayu. Perbuatan SP2 dan SP3 menunjukkan mereka tidak berintegriti. Oleh itu, kami mendapati HMT untuk sekalian kalinya terkhilaf apabila memutuskan SP2 dan SP3 adalah saksi-saksi yang berintegriti. Dapatan fakta HMT ini adalah bertentangan dengan keterangan. [40] Bila keterangan SP2 dan SP3 mengenai fakta-fakta material ditolak, kami berpendapat sabitan perayu yang berasaskan kepada keterangan SP2 dan SP3 adalah tidak selamat. Atas alasan ini sahaja, rayuan perayu harus dibenarkan.” [penekanan ditegaskan] [25] Sehubungan dengan itu, Mahkamah merumuskan bahawa SP5 bukanlah seorang saksi yang berkredibel dan bercakap benar. Oleh itu, keterangan SP5 perlu dipertimbangkan dengan berhati-hati dan tidak wajar diterima sebegitu sahaja. [26] Selain dari isu kewujudan Krishnan dan motosikalnya yang ditemui di rumah nombor 10, seperkara lagi yang menjadi perhatian serta pertimbangan Mahkamah ini adalah berkaitan dengan anak kunci bagi rumah nombor 10. Ini adalah merupakan keterangan yang penting bagi mengaitkan OKT dengan dadah di rumah nombor 10 tersebut. Ini kerana SP5 dan SP8 menyatakan bahawa kunci tersebut telah diserahkan oleh OKT kepada SP5. [27] Keterangan ini bagaimanapun adalah bercanggah dengan keterangan SP6 dan SP7 yang menyatakan bahawa anak kunci bagi rumah nombor 10 tersebut adalah dipegang oleh pejabat estet memandangkan rumah tersebut adalah tidak berpenghuni. SP7 bersetuju dengan cadangan peguambela bahawa kunci rumah tersebut telah diambil oleh Krishnan dari pejabat estet untuk menyimpan motosikalnya. [28] Pihak PR bagaimanapun menegaskan bahawa SP9 telah menyiasat berkaitan kunci tersebut dengan menunjukkan kunci tersebut kepada Penyelia serta Mandur di estet tersebut yang menyatakan bahawa kunci yang digunakan oleh pihak polis tersebut adalah berlainan dengan kunci yang disimpan oleh pihak estet. Pihak PR hanya bersandarkan kepada keterangan ini yang bagi pandangan Mahkamah ini hanyalah keterangan dengar cakap. [29] Pihak PR sebaliknya hanya menawarkan saksi-saksi ini iaitu Velayutham a/l Subramaniam dan Davidason a/l Thangaveloo kepada pihak OKT. [30] Persoalannya adakah ini mencukupi memandangkan telah wujud 2 versi yang berbeza dari kalangan saksi-saksi pihak PR. Walaupun pihak PR mempunyai hak untuk memanggil saksi-saksi yang difikirkan perlu dan wajar, namun tanggungjawab tersebut hendaklah dipenuhi dengan memanggil saksi-saksi yang dapat merungkaikan naratif sebenar pihak PR. [31] Apabila pihak PR berpeluang untuk mengenepikan segala keraguan ini dan tidak menggunakan peluang ini dan sebaliknya hanya menawarkan kepada pihak pembelaan, maka Mahkamah berpandangan bahawa faedah daripada keraguan ini wajar diberikan kepada pihak OKT. Mahkamah Rayuan di dalam kes Vinod Raj a/l Uthayakumar v PR [2023] MLRAU 6 ada menyatakan seperti berikut; “[32] Beralih pula kepada satu isu yang lain, undang-undang berhubung dengan beban pembuktian yang adalah jelas. Pihak pendakwaan bertanggungan untuk membuktikan tuduhan terhadap perayu tanpa sebarang keraguan yang munasabah pada setiap peringkat iaitu di peringkat pendakwaan ataupun di peringkat pembelaan. Lihat keputusan Mahkamah ini dalam kes Mohan Singh A/L Lachman Singh v Public Prosecutor [2002] 3 MLJ 291. Dengan itu, pihak pendakwaan perlulah mengambil segala langkah untuk mengetepikan sebarang kemungkinan lain berkait dengan pemilikan Cannabis tersebut, terutamanya kemungkinan bahawa Cannabis tersebut bukanlah milik perayu. …. [35] Daripada keterangan, pihak pembelaan telah pun mengemukakan versi pembelaan iaitu Cannabis tersebut dijumpai di atas lantai dalam lif dan bukannya di tangan perayu, semasa SP3 memberi keterangan lagi. Semasa dipanggil membela diri, perayu dalam keterangan secara bersumpah dari kendang saksi telah secara jelas menyatakan bahawa dia tidak memegang beg plastik berwarna merah mengandungi Cannabis dan pihak polis menjumpainya di atas lantai dalam lif. Keterangan perayu juga tidak tergugat semasa disoal balas oleh pihak pendakwaan. Jelasnya, pembelaan yang dikemukakan perayu bukanlah suatu pembelaan yang difikirkan kemudian. [36] Dalam situasi tersebut, wujud dua versi yang sama sekali berbeza berhubung dengan penemuan Cannabis tersebut. Dengan kata lain wujud situasi satu lawan satu. Timbul persoalan atau keraguan, versi mana yang perlu dipercayai? Kami dapati, dokumen kontemporari iaitu Borang Senarai Geledah eksibit P10 yang dikemukakan pihak pendakwaan melalui SP3 tidak dapat membantu. Ini kerana di dalam kandungan eksibit P10 tidak dinyatakan secra jelas bahawa beg plastik berwarna merah yang mengandungi Cannabis tersebut dirampas daripada tangan perayu sama ada diruangan ‘BARANG TANG DIJUMPAI/DIRAMPAS’ ataupun di ruangan ‘TEMPAT DIJUMPAI’. [37] Ironinya, pihak pendakwaan berpeluang untuk mengetepikan segala keraguan atau sebarang kemungkinan yang telah dibangkitkan pihak pembelaan dengan mengemukakan keterangan sokongan iaitu melalui keterangan forensik yang dapat menunjukkan perayu sememangnya memegang beg plastik berwarna merah tersebut ataupun sekurang-kurangnya memanggil salah seorang daripada anggota serbuan yang turut sama melihat perayu memegang beg plastik berwarna merah yang mengandungi Cannabis tersebut. [38] Malangnya, pihak pendakwaan gagal merebut peluang tersebut. Dengan itu, sudah tentulah akan timbul keraguan atau kemungkinan lain dalam situasi keterangan satu lawan satu. Faedah daripada keraguan atau kemungkinan tersebut sudah tentulah akan memihak kepada perayu. Dalam isu ini, kami bersetuju dengan hujahan Peguam perayu yang menegaskan bahawa HMT gagal memberikan pertimbangan sewajarnya ke atas keterangan pembelaan perayu yang dibina sejak daripada kes pihak pendakwaan lagi. Kami mendapati bahawa berlaku satu salah arahan serius di pihak HMT apabila gagal mengambil kira keraguan atau kemungkinan yang memihak kepada perayu tersebut.” [penekanan ditegaskan] [32] Malahan Mahkamah Rayuan di dalam kes Ti Chuee Hiang v PP [1995] 3 CLJ 1 pernah menegaskan bahawa pihak PR mempunyai tanggungjawab untuk memanggil saksi-saksi yang perlu bagi membuktikan satu kes melampaui keraguan ke atas mana-mana OKT dan jika budi bicara tersebut gagal dilaksanakan, maka seseorang OKT sewajarnya dilepaskan. [33] Di dalam keterangannya, SP5 turut telah mengemukakan keterangan berdasarkan kepada seksyen 27 Akta Keterangan 1950 di mana Puan TPR telah menghujahkan secara panjang lebar di dalam hujahan-hujahannya berkenaan pemakaian seksyen 27 tersebut. Adalah menjadi pegangan pihak PR bahawa keterangan tersebut boleh diterima masuk kerana ia merupakan maklumat yang diperolehi oleh SP5 daripada OKT yang membawa kepada penemuan barang kes di rumah nombor 10. [34] Perhatian Mahkamah ini dibawa kepada keputusan Mahkamah Persekutuan di dalam kes Pathmanabhan Nalliannen v PP & other appeals [2017] 4 CLJ 137 seperti berikut; “[109] Section 27 of the EA reads as follows: When any fact is deposed to as discovered in consequence of information received from a person accused of any offence in the custody of a police officer, so much of that information, whether the information amounts to a confession or not, as relates distinctly to the fact thereby discovered may be proved. [110] In Siew Yoke Keong v. PP [2013] 4 CLJ 149, Ahmad Maarop FCJ at p. 167, speaking for this court said: [28] In the light of the authorities referred to, we hold that information admissible under s. 27 of the Evidence Act includes accused's statement, or his act or conduct such as pointing out which leads distinctly to the discovery of a fact. For such information to be admissible in evidence, there is no duty on the prosecution to prove the voluntariness of the information. Hence it is not necessary to conduct a trial within a trial to determine the voluntariness of the information. [111] We have no reason to depart from the above principle of law. The act of the learned trial judge in undertaking the TWT exercise was unnecessary and a waste of judicial time. [112] Further, as to the approach in dealing with the evidence under s. 27 of the EA, we are of the considered view that the correct test was applied in Public Prosecutor v. Krishna Rao a/l Gurumurthi & Ors (supra), and adopted in PP v. Azilah Hadri & Anor (supra), as propounded in Chong Soon Koy v. Public Prosecutor [1977] CLJU 20; [1977] 1 LNS 20; [1977] 2 MLJ 78. Suffian LP had formulated the twin tests which read as follows: ... What was the fact discovered? The fact discovered embraces the place from which the pistol and ammunition were produced and the knowledge of the accused as to this. What was the information supplied by the accused relating distinctly to the facts thereby discovered? It was "information with regard to a firearm and some ammunition which he had hidden in the Berapit Hills in Bukit Mertajam" in the words of Mr. Ong. All that evidence is admissible... [113] In the present case, the fact discovered embraces the area near the farm where the items were discovered by the police. The information given by the second and fourth accused persons indicates their knowledge of the place and the items.” [35] Bagi Puan TPR, pihak PR telah berjaya membuktikan bahawa OKT semasa itu adalah berada di dalam tahanan pihak polis dan telah memberikan maklumat di mana dadah tersebut telah disimpan. Dadah tersebut juga berada di dalam ciri-ciri yang disorokkan apabila diletakkan di dalam sebuah beg yang diletakkan di dalam rumah yang tidak berpenghuni dan akhirnya ianya tidak mungkin akan ditemui oleh SP5 tanpa maklumat tersebut. [36] Puan TPR turut menghujahkan bahawa apabila pihak PR bergantung kepada seksyen 27 Akta Keterangan 1950 maka ia membuktikan bukan sahaja pengetahuan OKT tetapi juga ke atas jagaan serta milikan OKT. Ia berpaksikan kepada kes Faisal Abd Aziz v PP [2011] 9 CLJ 285 di mana Mahkamah Rayuan menyatakan; “A quick look at the grounds of judgment, will indicate that the trial judge had in fact made an affirmative finding of possession of the drugs by the appellant. In his judgment, the judge (at p. 55 of the record of appeal) wrote: It is also pertinent to stress that the manner of the packaging in small packets and the circumstances relating to the accused conduct of handing the two packets P8A and P8B and the act of pointing and picking the Old Spice bag P9 and handing it to SP3 to my mind not only established custody and control over P8A and P8B and P9 but also knowledge as to the contents of the cannabis in P8A and P8B and the cannabis content of P9. The manner and the place where P9 was found namely concealed in the bushes clearly establishes that it was only the accused who knew of its placement and concealment. It cannot have been found without the accused conduct of pointing to P9 and the plastic packets P8A and P8B was taken from the same place where P9 was found. Based on the available evidence, we find that the learned trial judge has not erred in law or on facts in making such a finding.” [37] Semasa SP5 memberikan keterangan, pihak PR telah mengemukakan keterangan bahawa OKT dikatakan telah memberikan maklumat berhubung dadah-dadah yang disimpan di dalam beg pakaian dan tong speaker dalam rumah nombor 10 di mana OKT dikatakan telah mengambil anak kunci manga rumah nombor 10 dan telah serahkan kepada SP5 untuk membuka kunci manga pintu rumah nombor 10. SP5 menyatakan telah mencatitkan maklumat yang diberikan dalam kertas kalendar (P41) yang mengandungi kenyataan seperti berikut: “Adalah menjadi kewajipan saya untuk memberi amaran kepada kamu bahawa kamu tidak diwajibkan menyatakan sesuatu atau menjawab apa-apa soalan, tetapi apa-apa kamu nyatakan sama ada sebagai menjawab sesuatu soalan atau tidak, boleh diberikan keterangan-S : Adakah kamu faham kata-kata amaran yang saya katakan? J : Saya faham S : Adakah apa-apa lagi dadah yang kamu simpan? J : Saya ada simpan rumah kosong tepi rumah saya. S : Boleh kamu tunjuk pada saya tempat kamu simpan dadah itu? J : Tuan buka pintu, ada dalam beg sama speaker itu dadah. [38] Walaupun secara amnya kebolehterimaan maklumat yang diberikan oleh OKT kepada SP5 tidak perlu melalui ujian kesukarelaan namun Mahkamah perlu berhati-hati berkaitan maklumat yang diterima tersebut. Ini kerana seksyen 27 Akta Keterangan 1950 adalah berkaitan dengan penerimaan maklumat yang membawa kepada penemuan barang salah. Ia tidak sepatutnya membenarkan pengakuan salah OKT diterima masuk [39] Kedudukan prinsip perundangan berkaitan perkara ini adalah jelas dan ini pernah dibincangkan oleh Mahkamah Rayuan di dalam kes Roslan Abdullah v PP [2009] 3 MLRA 174 seperti berikut; “[26] There is no duty on the prosecution to establish the voluntariness of the information” (Amathevelli R Ramasamy v. PP [2008] 1 MLRA 372; [2008] 3 MLJ; [2008] 4 CLJ 413 CA, per Raus Sharif JCA). But that is not to say that information could be extracted from an accused. Information must be properly and fairly obtained, and not compelled from an accused (Lam Chi Ming & Ors v. R [1991] 3 All ER 172). Indeed, in Goi Ching Ang, the Federal Court opined that voluntariness is desirable (see 524), that the court should ensure that the standards of propriety in obtaining s. information are scrupulously followed, and that the court has a discretion to exclude “evidence obtained in an oppressive manner by force or against the wishes of an accused person or by trick or by conduct of which the police ought not to take advantage” (see 527). The same was also held by the Federal Court in Francis Antonysamy v. PP 1 MLRA 230; [2005] 3 MLJ 389; [2005] 2 CLJ 481; [2003] 2 AMR 455 FC. Recently, in Krishna Rao Gurumurthi v. PP & Anor Appeal [2009] 2 CLJ 603 FC, the Federal Court per Richard Malanjum CJ (Sabah and Sarawak) held that the admission of information evidence does not demand voluntariness or the absence of any form of oppression, inducement, threat or promise to the maker, but that the court has the discretion to exclude it on the ground that its prejudicial effect outweighs its probative value. [27] Yet for s. 27 to apply, the information must be such as has caused the discovery of a fact. In other words, the fact must be the consequence and the information the cause of its discovery … the information must relate distinctly to the fact discovered” (Wai Chan Leong).” … in order for the section to apply there must be evidence of the information upon which the fact was discovered” (Evidence, Practice & Procedure, 2nd edn by Augustine Paul, at p. 258).” … the first step which must be taken before s. 27 can be invoked at all must be proof of some fact discovered as a result of the information given by the accused” (Hamiron Mat Udin & 2 Ors v. PP [1947] 1 MLRH 441; [1948] 1 MLJ 50 HC per Murray-Aynsley; see also Pang Chee Meng v. PP [1992] 2 SCR 1, where it was held that emphasis is placed on the fact discovered and not on the information, for the fact discovered confirms the truth of the information). “[28] Section 27 is not intended to let in a confession generally and not one word more of the information which the accused supplied should be given in evidence that is strictly necessary to show how the fact which was discovered is connected with accused so as in itself to be a relevant fact against him” (Krishnan Ramar v. PP [1987] 1 MLRA 239; [1987] CLJ (Rep) 145; [1987] 1 CLJ 28 SC per Wan Sulaiman SCJ). Consequently, courts must guard against the danger of the abuse of s. 27. [29] In Hasamuddin Talena v. PP [2002] 1 MLRA 113; [2002] 2 MLJ 408; [2002] 2 CLJ 504; [2002] 2 AMR 1885 CA, Gopal Sri Ram JCA, as he then was, said as follows: Approximations are not permitted. In other words, the exact words spoken by an accused have to be proved. An illustration of that proposition may be found in Pang Chee Meng v. PP [1991] 1 MLRA 608; [1992] 1 MLJ 137; [1992] 1 CLJ 265 (Rep); [1992] 1 CLJ 39, where Abdul Hamid Omar LP reminded us of the need for vigilance, ‘to ensure the credibility of evidence by the police personnel in respect of this section, (that is, s. 27) which is so vulnerable to abuse. The rationale for the rule adverted to a moment ago appears in the judgment of Syed Agil Barakbah J (as he then was) in Birch v. PP [1977] 1 MLRH 56; [1978] 1 MLJ 72. This is what he said: Information leading to the discovery must relate distinctly to the object so recovered and nothing more. Only so much of such information is admissible. Where such information is held to be admissible, the action of the accused which directly leads to such discovery, in this case the act of the appellant in approaching the green bag and opening it, is of little value and ought to be treated with caution as it is prejudicial to the accused. Further, there was no indication one way or the other what had caused the appellant to lead the police there. Whether her intention was to confess her guilt or to indicate Mohd Desa’s guilt still remain uncertain. To my mind, since more than one inference has arisen, the inference in favour of the defence ought to be accepted.’ Since nothing more than the information given by an accused is admissible, it follows that the information must be exact and recorded in the language or words used by the accused. The strictness of the rule in the application appears sufficiently from the following passage in Sarkar on Evidence (14th Ed) at p 492: Statements made by accused to police officers which are or may be provable under s. 27 should be clearly and carefully recorded. They should be recorded in the first person, that is to say, as far as possible in the actual words of the accused. They should not be paraphrased (In Re Athappa Goundan AIR [1937] Mad 618; Re Ramamurthy AIR [1941] M 290; Naresh v. R 46 CWN 180; Public Prosecutor v. Pasala AIR [1945] Mad 2021; Public Prosecutor v. Venkoba [1937] MWN 73; Chenna v. King Emperor AIR [1940] Mad 710; Gaya v. State AIR [1957] All 459; Nathuv State AIR [1958] All 46). No judge should allow one word more to be deposed to by the police than it is absolutely necessary to show how the fact discovered is connected with the accused. [30] The alleged information evidence could not have passed the stringent conditions for admission. In the first place, there was uncertainty as to the actual words that were spoken by the appellant. The alleged information that SP2 (Inspector Jong Lak Kho) recorded hours after it had been given and hours after the raid (see 61AR) was “suspek telah mendedahkan bahawa beliau ada menyimpan dadah ganja di rumahnya di alamat no. Lot 2132, Jambu Rias, 28600, Karak” (see exh. P22). But the alleged information that SP2 related in court was quite different, for it was the testimony of SP2 that the information from the appellant was “saya ada simpan dekat rumah” (see 45 – 46AR), or “dia ada simpan ganja di rumah, dia setuju untuk bawa ke tempat itu … dia ada beritahu saya rumahnya iaitu di Jambu Rias” (see 46AR), or “saya ada simpan ganja, dekat rumah di Jambu Rias” (see 46AR). The proscribed drugs were found in a bag in one of the bedrooms of Lot 2132 Jambu Rias, Karak. It was not found near Lot 2132 Jambu Rias, Karak. But given that the actual words of the appellant were not unambiguously proved, in that there were at least 2 different accounts of the alleged information, then it could not be said that the fact discovered must be the consequence and the alleged information must be the cause of its discovery. Exhibit P22 should have been rejected on that ground alone. In any event, the confessional content “saya ada simpan ganja” in the alleged information, which was eminently prejudicial, should not have been admitted. Indeed, the entire exh. P22 could have been rejected on the ground that it was not a contemporaneous record of the alleged statements of the appellant. In fact, exh. P22 was not even a record of the alleged statements of the appellant. More than anything else, exh. P22 was SP2’s record of the events that had transpired hours before “berdasarkan kepada ingatan saya” (see 67AR). Really, nothing spoke for admission of exh. P22. [31] Without exh. P22, the prosecution had simply no case. The appellant was arrested probably miles from the said house, while the proscribed drugs were found inside a bag (P12) in a bedroom of the said house. Indisputably, the appellant was not in actual physical custody or control of the proscribed drugs. In those circumstances, so as to prove possession of the proscribed drugs, the prosecution had to prove that the appellant had exclusive possession of the bedroom to begin with. But exclusive possession of that bedroom was not proved, for that bedroom was the bedroom of SP4 and appellant (see 79AR and 85AR). Worse still, the evidence was that the bedroom had no door (see 85AR) and was accessible to neighbours and friends (see 86AR). Admittedly, there was the evidence from SP4 that the Appellant was the owner of the bag (P12). But that evidence from SP4 was obtained, or was it extracted or coerced, from SP4 in the course of the impeachment proceedings taken by the prosecution against her (see 80AR). At the end of the day, all that was proved against the appellant was that in the bedroom that he shared with SP4 was arguably his bag (P12). But exclusive possession of that bedroom was not proved, and hence it could not be inferred that the appellant had possession of the drugs inside his bag. Perhaps the appellant had knowledge of the drugs, but “mere knowledge … is not sufficient to establish possession (see Gooi Loo Seng v. PP [1993]1 MLRA 227; [1993] 2 MLJ 137; [1993] 3 CLJ 1; [1993] 2 AMR 1135). A prima facie had not been made out. At any rate, the whole thing was a complete mistrial. [32] It was for those reasons that we had allowed the appeal, set aside the conviction and sentence, and acquitted the appellant when we heard the appeal on 25 May 2009.” [40] Di dalam kes ini, ternyata maklumat yang diberikan kepada SP5
