menafikan bahawa dia cuba melarikan diri ketika serbuan dibuat. [33] Hakim Bicara telah menganalisis pembelaan yang dikemukakan oleh Perayu di muka surat 32 – 33 Rekod Rayuan Jilid I, seperti berikut:- “Begitu juga di dalam kes ini, penafian oleh pihak Tertuduh di sini mengenai dadah tersebut tidak berjaya membangkitkan sebarang keraguan munasabah terhadap kes pihak pendakwaan. Keterangan-keterangan yang dikemukakan di peringkat pembelaan ini bukan sahaja gagal menimbulkan suatu keraguan yang munasabah terhadap kes pendakwaan malah, jika dinilai secara keseluruhannya keterangan (keterangan di peringkat pendakwaan dan pembelaan) (in totality) jelas dilihat yang satu kes di luar keraguan munasabah telah berjaya dibuktikan oleh pihak Pendakwaan terhadap Tertuduh. Malah keterangan yang ada adalah begitu “over whelming” untuk mengaitkan Tertuduh dengan kesalahan ini. Ini diperkukuhkan lagi dengan perbuatan serta tingkah laku Tertuduh sewaktu dia ditahan iaitu cuba melarikan diri dari polis. Ini jelas memperlihatkan akan mens rea sebenar Tertuduh. Apa yang dinyatakan oleh SP8 di dalam keterangannya jelas tidak sangkal oleh Tertuduh. Meneliti serta menimbangkan keterangan yang dikemukakan, didapati tiada sebab untuk SP5 dan SP8 mereka-reka cerita tentang insiden pertemuan oleh SP8 dengan Tertuduh Pertama di Restoran WDS pada 27.2.2013, 28.2.013 dan 26.3.2013 pada jam 11.00 pagi serta insiden pertemuan pada jam 3.00 petang tarikh yang sama. Tertuduh Pertama tidak pernah mengenali SP8 dan SP5 dan lain-lain saksi polis yang menahannya pada petang tarikh tersebut dan begitu juga di sebaliknya. Jadi, isu penganiayaan terhadap Tertuduh oleh pihak-pihak polis tidak timbul di sini. (PP v Mohd. [1962] 1 MLJ)”. [34] Kami bersetuju dengan analisis yang dibuat oleh Hakim Bicara. Pembelaan yang dikemukakan oleh Perayu secara nyata bertentangan dengan keterangan saksi-saksi pendakwaan yang didapati kredible oleh Hakim Bicara. Dalam kes Saminathan & Ors v Public Prosecutor [1955] 1 LNS, Hakim Buhagiar berkata:- “The fundamental principle in criminal cases is that there is a burden on the prosecution, which never shifts, to prove its case; it is not upon the accused to prove his innocence and in that sense the burden on the defence is not as high as that of the prosecution; to entitle the accused to an acquittal it is sufficient if he raises a doubt in the prosecution case and this he may do by “disproving” a material fact on which the prosecution relies or by proving facts from which it may be inferred that a material fact on which the prosecution relies is not so probable that a prudent man ought to act upon the supposition that that fact exists. The facts on which the defence rely must however be “proved”and they are proved not by showing merely a possibility that such facts exist but by showing a probability of their existence, the degree of probability being a matter of prudence in the circumstances of the case.”. [35] Perlu diambil perhatian bahawa Perayu telah memilih untuk memberikan keterangan atas sumpah tanpa diuji oleh pemeriksaan balasan. Walaupun keterangan demikian ialah keterangan yang boleh diterima dari segi undang-undang, namun keberatannya perlu dipertimbangkan dengan cermat oleh Hakim Bicara. Dalam kes Udayar Alagan v Public Prosecutor [1962] 1 MLJ 35, Mahkamah membincangkan tentang keberatan (“weight”) yang boleh diberi kepada keterangan demikian:- “There was evidence which made out that charge, if it was believed. There was evidence by the appellants to the contrary, though here it must be observed that two of them took the dangerous course of making a statement from the dock instead of going into the witness-box and giving evidence. An accused person is, of course, entirely within his legal rights when he elects to take that course, but in a case which must in the event depend on credibility he takes it at his own peril. The rule was stated in Shimmin's case 15 Cox CC 122 124 in 1882 by Mr. Justice Cave in a passage which, so far as I am aware (and I am quite prepared to be told I am wrong), has never been criticised:- “A prisoner, though defended by counsel, may, if he chooses, himself make his statement to the jury. He ought to be heard in his defence, and have the opportunity of making his explanation of the circumstances proved against him. True, his statement was not made on oath, and that he was not liable to be cross-examined by the prosecuting counsel, and what he said was therefore not entitled to the same weight as sworn testimony.”. (Penekanan ditambah). [36] Dalam kes Dato’ Seri Anwar bin Ibrahim v Pendakwa Raya and another criminal appeal Federal Court (Putrajaya) [2015] 1 MLJU 34, telah diputuskan seperti berikut:- “In law, a trial judge will not give much weight to what an accused has said in his unsworn statement as he is not subject to cross-examination by the prosecution nor can he be questioned by the trial judge. … The Court of Appeal after discussing the law on a statement from the dock, agreed with the trial judge that the appellant's statement from the dock was a mere denial. The Court of Appeal observed as follows: For the respondent to succeed in his defence, it is incumbent upon him to adduce evidence which can answer the allegations in the charge. In this case, the respondent did not even deny that he was at the scene of the crime at the material time and date as stated in the charge. He never disputed that his car was seen entering and leaving the condominium at the material time. He also did not dispute that he was seen entering the lift to the 5th floor of the condominium and later leaving the place. He also did not dispute that he had directed his chief of staff, PW24 to arrange for an envelope to be handed over to him at the said condominium and that PW24 had instructed PW1 to bring the envelope to him. The respondent also did not dispute the fact that PW1 had brought the envelope to him at the place of the incident. The learned judge found that the respondent's statement from the dock is a mere denial with which we fully agree. The bare denial by the respondent does not amount to any doubt whatsoever. A credible defence is one that answers the evidence thrown at it by the prosecution. It is also imperative that the respondent explain his case.”. (Penekanan ditambah). [37] Alasan (b) yang dikemukakan oleh Perayu adalah tidak bermerit dan ditolak. Kesimpulan [38] Berdasarkan alasan-alasan di atas, kami sebulat suara berpendapat bahawa alasan-alasan yang dikemukakan oleh Perayu berjaya menunjukkan bahawa Hakim Bicara telah melakukan “kekhilafan boleh dirayu” (“appeable error”) yang memerlukan campur tangan Mahkamah ini. Keputusan Hakim Bicara disokong oleh keterangan dan berdasarkan prinsip undang-undang yang betul. Pada pandangan kami, sabitan terhadap Perayu adalah selamat. Dengan itu, kami mengekalkan dan mengesahkan keputusan Hakim Bicara. Bertarikh: 9 Mac 2018 sgd.
