KERAJAAN MALAYSIA ...RESPONDEN-RESPONDEN ALASAN PENGHAKIMAN PENGENALAN [1] Melalui Notis Usul, Pemohon, 47 tahun, telah memohon di Mahkamah ini agar satu Writ Habeas Corpus dikeluarkan bagi membebaskan Pemohon yang sedang menjalani tahanan selama 2 tahun di Pusat Pemulihan Akhlak Simpang Rengam, Johor. [2] Mahkamah telah menolak permohonan Pemohon dengan alasan-alasan yang akan dinyatakan di bawah. FAKTA KES [3] Pemohon telah ditangkap oleh polis pada 11-06-2024 jam lebih kurang 7.00 petang. Satu Perintah Tahanan bertarikh 05-08-2024 telah dikeluarkan terhadap Pemohon di bawah Seksyen 6(1) Akta Dadah Berbahaya (Langkah-Langkah Pencegahan Khas) 1985 ("Akta tersebut") oleh Timbalan Menteri Dalam Negeri Malaysia (TMDN) yang memerintahkan agar Pemohon ditahan selama 2 S/N LCSCgzkoEqWWV8lnoexqg tahun bermula 05-08-2024 di Pusat Pemulihan Akhlak Simpang Rengam, Johor ("PPA Simpang Rengam"). [4] Pemohon telah menimbulkan 3 isu yang mewajarkan Pemohon dilepaskan. PRINSIP-PRINSIP BERKENAAN UNDANG-UNDANG PENCEGAHAN [5] Permohonan semakan kehakiman bagi mencabar Perintah Tahanan yang dikeluarkan di bawah Akta tersebut hanya boleh dibuat atas alasan ketidakpatuhan prosedur mandatori semasa suatu tindakan atau keputusan itu dibuat. Ini bermakna Mahkamah ini tidak mempunyai bidang kuasa untuk menyemak tindakan dan keputusan yang dibuat berdasarkan budi bicara. Seksyen 11C Akta tersebut menyatakan dengan jelas: S/N LCSCgzkoEqWWV8lnoexqg [6] Justeru, Mahkamah ini harus memberikan kesan terhadap pindaan Akta tersebut apabila Parlimen telah memasukkan peruntukan seksyen 11C pada 24 Ogos 1989. Ia adalah sebagaimana yang diputuskan oleh Mahkamah Persekutuan di dalam kes Lee Kew Sang v. Timbalan Menteri Dalam Negeri, & Ors [2005] 3 CLJ 914 In our view, courts must give effect to the amendments. That being the law, it is the duty of the courts to apply them. So, in a habeas corpus application where the detention order of the Minister made under s. 4(1) of the Ordinance or, for that matter, the equivalent ss. in ISA 1960 and DD(SPM) Act 1985, the first thing that the courts should do is to see whether the ground forwarded is one that falls within the meaning of procedural non-compliance or not. To determine the question, the courts should look at the provisions of the law or the rules that lay down the procedural requirements. It is not for the courts to create procedural requirements because it is not the function of the courts to make laws or rules. If there is no such procedural requirement then there cannot be non-compliance thereof. Only if there is that there can be non-compliance S/N LCSCgzkoEqWWV8lnoexqg thereof and only then that the courts should consider whether, on the facts, there has been non-compliance. [7] Di samping itu, undang-undang juga telah menetapkan bahawa beban untuk membuktikan bahawa Pemohon telah ditahan menurut undang-undang dan segala prosedur mandatori telah dipatuhi adalah di atas bahu pihak berkuasa yang menahan iaitu Responden-responden sendiri. Ia adalah seperti yang diputuskan oleh Mahkamah Persekutuan di dalam kes SK Tangakaliswaran Krishnan v. Menteri Dalam Negeri, Malaysia & Ors [2009] 6 CLJ 705 yang menyatakan seperti berikut: It is for the respondents to prove that the constitutional and statutory safeguards embodied in art. 151 and s. 6(1) were strictly complied with. The liberty of an individual should not be infringed upon even to the slightest extent without proof that the impugned infringement is in accordance with the Constitution and statute. When considering whether a restraint upon liberty is in accordance with law it is based on the evidence furnished by the detaining authority that a court must turn in the usual way. And where that evidence is by way of affidavit, the court is not spared the task of subjecting its contents to the same tests as in any other case, if not to stricter scrutiny since the case concerns the violation of a S/N LCSCgzkoEqWWV8lnoexqg constitutionally guaranteed protection. One of the tests that a court applies to test allegations in affidavits is to see whether they are contradictory in nature. See, Eng Mee Yong & Ors v. Letchumanan [1979] CLJU 18; [1979] 1 LNS 18. Further, where a party upon whom the onus of proof lies adduces conflicting or contradictory evidence, a court assessing that evidence is in the usual way entitled to rule that the burden has not been discharged. And in a matter as important as individual liberty, where contradictory averments are made on oath, the detenu is entitled to rely on the version that is most favourable to him. [8] Dalam keadaan tersebut Pemohon atau orang yang ditahan di bawah undang-undang pencegahan, bebas untuk mengambil segala kesempatan yang ada apabila terdapat pelanggaran undang-undang, ketidakaturan atau ketidakpatuhan prosedur memandangkan perintah tahanan yang diberikan adalah tanpa bicara yang melanggar hak kebebasan seseorang. Apabila terdapat pelanggaran undang-undang, ketidakaturan dan ketidakpatuhan prosedur, perintah tahanan akan menjadi tidak sah dan writ habeas corpus dikeluarkan dan Pemohon dibebaskan. Saya merujuk kepada kes Mahkamah Agung Ng Hong Choon v Timbalan S/N LCSCgzkoEqWWV8lnoexqg Menteri Hal Ehwal Dalam Negeri & Lagi [1994] 4 CLJ 47, dimana Wan Yahya SCJ menyatakan:- In cases of this nature the appellant is nevertheless entitled to take advantage of any technical imperfection which has the effect of invalidating the restrictive order; or to use the precise words of Regby J in Ex Parte Johannes Choeldi & Ors [1960] CLJU 25; [1960] 1 LNS 25; [1960] 1 MLJ 184 at 186: The distinction, no doubt, is a highly artificial one. But this is an application for a writ of habeas corpus, and the applicants in matters which concern their personal liberty, are entitled to avail themselves of any technical defects which may invalidate the order which deprives them of that liberty." KEPUTUSAN DAN ALASAN MAHKAMAH TERHADAP ISU-ISU YANG DITIMBULKAN Isu Pertama Perintah tersebut adalah bercanggah dengan Perkara 149 Perlembagaan Persekutuan. [9] Pemohon menghujahkan, adalah penting untuk menentukan kewujudan dan/atau identiti kumpulan besar orang tersebut yang S/N LCSCgzkoEqWWV8lnoexqg dikaitkan dengan Pemohon sebelum Pemohon boleh ditahan dalam tahanan pencegahan di bawah Akta. Setelah meneliti "Alasan-Alasan Yang Atasnya Perintah Itu Dibuat" dan "Pengataan-Pengataan Fakta Yang Atasnya Perintah Itu Diasaskan". Pemohon mengatakan tidak ada fakta mahupun dakwaan kewujudan mana-mana kumpulan besar orang yang mengancam keselamatan negara dan tidak ada apa-apa yang menunjukkan bahawa Pemohon dikaitkan dengan mana-mana kumpulan orang besar itu. Dari pembacaan yang teliti terhadap Fakta Pengataan terhadap Pemohon, menunjukkan bahawa dia bertindak "sendirian" dan bukan secara bersindiket. [10] Responden-Responden menghujahkan bahawa ketiga-tiga (3) elemen yang diperuntukkan oleh undang-undang telah dipatuhi sebelum TMDN iaitu Datuk Seri Dr. Shamsul Anuar Bin Nasarah mengeluarkan Perintah Tahanan di bawah Seksyen 6(1) Akta tersebut. Hal ini dapat dilihat daripada keterangan TMDN di perenggan 8 Afidavit Jawapan beliau. Keputusan Mahkamah [11] Perkara 149 Perlembagaan Persekutuan menyatakan seperti berikut: - S/N LCSCgzkoEqWWV8lnoexqg Federation or any part thereof, any provision of that law designed to stop or prevent that action is valid notwithstanding that it is inconsistent with any of the provisions of Article 5, 9, 10 or 13, or would apart from this Article be outside the legislative power of Parliament; and Article 79 shall not apply to a Bill for such an Act or any amendment to such a Bill. [12] Manakala Mukaddimah kepada Akta tersebut menyatakan:-
