bahawa pemohon itu tidak berupaya kerana apa-apa sebab jua untuk membayar wang itu, [7] JD berhujah bahawa penggantungan ini wajar diberikan atas alasan kononnya wujud terdapat hal keadaan khas yang menjadikan tidak suai manfaat untuk menguatkuasakan penghakiman atau perintah. JD menghujahkan bahawa rayuan mereka mempunyai merit yang nyata dan sekiranya pelaksanaan diteruskan, ia berpotensi menyebabkan kerugian dan prejudis kewangan yang tidak dapat diperbetulkan sekiranya rayuan JD di Mahkamah Tinggi berjaya kelak dan keputusan rayuan akan menjadi “nugatory” atau sia-sia. DAPATAN MAHKAMAH [8] Adalah menjadi undang-undang mantap bahawa pihak yang berjaya tidak seharusnya dinafikan hasil penghakiman, kecuali keadaan khas dibuktikan. Hal ini nampaknya dipersetujui oleh kedua-dua pihak di dalam hujahan mereka. JD merujuk kepada penghakiman Serangoon Garden Estate Ltd v. Ang Keng [1953] 1 LNS 98[1953] MLJ 116 yang dipetik di dalam kes Titanwood Industries Sdn Bhd & Anor V NCS Wood Products Sdn Bhd [2021] MLRHU 2440. Manakala JC memetik kes Lim Jen Lin @ Lim Jen Ling V. Petronas Refinery And Petrochemical [2026] MLRHU 73. [9] JD hendaklah membuktikan keadaan khas atau “existence of special circumstances” sebelum mahkamah dapat berpuas hati untuk memberikan suatu penggantungan pelaksanaan. Hal ini sebagaimana ditegaskan Mahkamah Rayuan di dalam kes Rowstead Systems Sdn Bhd V Bumicrystal Technology (M) Sdn Bhd [2005] 3 MLJ 132 yang menyatakan sepertimana berikut :- [12] It is now a well established principle that in an application for a stay of proceedings the applicant must show the existence of special circumstances. This principle was originally adopted in the case of Serangoon Garden Estate Ltd v Ang Keng [1953] MLJ 116. The Court of Appeal in the case of See Teow Guan & Ors v Kian Joo Holdings Sdn Bhd & Ors [1995] 3 MLJ 598 ruled that there is no need for the applicant to demonstrate special circumstances to warrant a stay of proceedings or of execution. However the recent Federal Court ruling in the case of Kosma Palm Oil Mill Sdn Bhd & Ors v Koperasi Serbausaha Makmur Bhd [2004] 1 MLJ 257 appears to have overruled the decision of See Teow Guan and reinstate the principle that was established in Serangoon Garden Estate whereby the applicant still requires to show special circumstances in an application for stay of proceedings of execution. We are therefore bound by the ruling of the Federal Court (see also the Court of Appeal decision in Ming Ann Holdings Sdn Bhd v Danaharta Urus Sdn Bhd [2002] 3 MLJ 49). [10] JD berhujah bahawa rayuannya ke Mahkamah Tinggi akan menjadi sia-sia sekiranya pelaksanaan ini tidak digantung dan ini merupakan satu keadaan khas yang mewajarkan penggantungan. Mahkamah ini akui prinsip sia-sia atau “nugatory” ini juga diterimapakai oleh Mahkamah Persekutuan sebagai salah satu keadaan khas atau “special circumstances”. Misalnya di dalam kes Kosma Palm Oil Mill Sdn Bhd & Ors (supra) di atas, penghakiman berikut dirujuk :- 18 … It is therefore clear beyond doubt that there are many factors that may constitute special circumstances and the fact that an appeal would be rendered nugatory if stay was refused is the most common one. It is an example of special circumstances. In other words, special circumstances is the genus of which nugatoriness is a species. If it has been shown that an appeal would be rendered nugatory if stay was refused what it means is that a special circumstance has been established. Thus, they cannot be treated as separate heads and one cannot be an alternative to the other. Neither can one be accepted or rejected in favour of the other as they are inter-related. See Teow Guan & Ors v Kian Joo Holdings Sdn Bhd & Ors could have withstood scrutiny if it had merely referred to nugatoriness without rejecting special circumstances. As nugatoriness is a species of special circumstances, a mere reference to it is sufficient to convey the correct legal impression. Any attempt to restrict the grant of a stay to nugatoriness, quite apart from its impropriety, will severely restrict the grounds on which an applicant may rely. Learned counsel for the applicants is therefore wrong in submitting that the nugatory approach is not a matter for consideration in this case as what is relevant is only the special circumstances. He would have been correct if he had said that he was not relying on nugatoriness but on some other species of special circumstances. [11] Namun, hujahan yang dimajukan JC juga ada asasnya. JC berhujah bahawa JD tidak boleh bergantung kepada hujahan bahawa rayuan akan menjadi “nugatory” sedangkan kebenaran merayu masih belum diperoleh. Saya bersetuju bahawa tiada rayuan yang sedang berjalan di Mahkamah Tinggi kerana Notis Rayuan yang difailkan adalah di luar masa dan belum dibenarkan untuk lanjutan masa oleh Mahkamah. Apatah lagi, semakan terkini saya semasa menyediakan alasan penghakiman ini mendapati permohonan JD tersebut telahpun dibatalkan oleh YA Hakim Mahkamah Tinggi pada 17 Julai 2026. [12] Dalam keadaan wujudnya rayuan ke mahkamah yang lebih tinggi sekalipun, rayuan tersebut tidak secara automatik menggantung pelaksanaan sesuatu penghakiman. Apatah lagi dalam tindakan ini, tiada rayuan yang sah sedang berjalan kerana Notis Rayuan telah difailkan di luar tempoh masa yang ditetapkan. Prinsip bahawa kewujudan rayuan semata-mata bukan alasan untuk menggantung pelaksanaan jelas diperuntukkan di bawah seksyen 73 Akta Mahkamah Kehakiman 1964.
