If any complainant or witness refuses to execute the bond, that officer shall report the same to the Magistrate’s Court which may then in its discretion issue a warrant or summons to secure the attendance of the complainant or witness before itself to give evidence in the matter of the charge against the accused. [36] Berdasarkan kepada manfaat yang diusulkan di atas, Mahkamah merujuk kepada PP v Resty Agpalo & Ors [2011] 2 CLJ 441 (MR) yang diputuskan oleh Suriyadi Halim Omar JCA - [11] To overcome its shortcoming the prosecution attempted to tender the statements (ID127 and ID128) 17 / 22 of Razbean recorded under s. 112 of the Criminal Procedure Code, as he was nowhere to be found. The attempt to have it tendered was rejected by the learned judge on several grounds. He found amongst others, that the prosecution failed to fulfil the prerequisites stipulated in s. 32(1)(i) of the Evidence Act 1950, failed to take reasonable steps to ensure Razbean’s attendance to give his evidence in court, failed to track down the material witness or at least put him under bond as per s. 118(1) of the Criminal Procedure Code, and the signatures of Razbean in ID127 were not the same with his signatures in ID128 A-D. ID 128 A-D is the supplement of ID 127. It was obvious to us that without ID127 and ID 128 the prosecution’s position was untenable as without them there would be no evidence to support the prosecution’s case against R3. [37] Seterusnya di dalam kes PP v Ang Kian Chai [2012] 1 LNS 389 di Mahkamah Rayuan oleh Abdul Malik Ishak JCA - [24] At the very least the prosecution should have tendered the s. 112 statement of Chen Jing to bridge the gap in the prosecution’s case. It cannot be denied that Chen Jing was put on a bond to appear as a witness. That bond was executed pursuant to s. 118 of the Criminal Procedure Code (“CPC”) and the bond was marked as exh. “P77” and it was worded in this way (see p. 202 of the appeal record at jilid 2): 18 / 22 [38] … [39] Nah, siapa sangka, peruntukan ini telah lama ada tetapi jarang-jarang digunakan. Berdasarkan kepada kes-kes yang dirujuk di atas, Mahkamah berpandangan remedi/alternative ini berperanan sebagai ‘wild card’ kepada pihak penguatkuasaan. [40] Seterusnya, satu lagi alternatif yang dicadangkan ialah peruntukan s. 388 KTJ. Pemakaian seksyen ini tertumpu kepada pengawalan terhadap pergerakan OYDS-OYDS setelah reman tamat, bahasa pasarnya, ‘jamin polis.’ [41] Di dalam kes Mahkamah Persekutuan, Inspector Yusof Hj Othman & Ors v. Kwan Hung Cheong yang telah membincangkan dengan jelas peruntukan s. 388 ini dan saling kaitannya dengan peranan polis : [26] It usually occurs that investigations could not be completed within the detention period granted by the magistrate under s 117 of the CPC. Section 388 of the CPC is there to assist the police. It empowers the police to release the accused person on police bail, while the investigations are still in progress. Thus, it is my respectful view that the trial judge had erred in deciding that the power of the police officer to release any person accused of a non-bailable offence under s 388 of the CPC is only exercisable before the accused person is produced before a magistrate under s 117 of the CPC. 19 / 22 Section 388 of the CPC makes no such provision. Neither does such a provision under s 117 of the CPC exsist. Thus, to uphold the decision of the trial judge on this issue will have the effect of defeating the intent and purpose of s 388 of the CPC. [27] Based on the above reasoning, it is my view that question 1 should be answered in the positive. It means that it is lawful for the police to issue police bail under s 388(1) of the CPC against the accused person who has been released by a magistrate after a detention under s 177 of the CPC.” [42] … [43] Oleh yang demikian, Mahkamah berpandangan jaminan di bawah s. 388 KTJ boleh dibuat terhadap OYDS-OYDS ini sebagai alternatif dengan syarat seperti mana dibenarkan di bawah s. 390 KTJ. Walaubagaimana pun, peruntukan ini masih boleh dipohon memandangkan tidak wujud sebarang peruntukan yang menghalang pihak penguatkuasaan daripada berbuat demikian.
