Ini merupakan permohonan oleh Plaintif di dalam Lampiran 8 untuk kebenaran memasukkan Penghakiman Terus dalam tindakan ini terhadap Defendan bagi jumlah RM17,129,924.57, iaitu amaun yang diindorskan pada Writ Saman dan Pernyataan Tuntutan dengan faedah pada kadar 5% setahun dari tarikh penghakiman sehingga tarikh realisasi dan kos.

Namun demikian, untuk bertindak adil terhadap Defendan, Mahkamah telah meneliti serta mengambil kira hujahan yang dibangkitkan oleh Defendan dalam Afidavit Balasan Defendan bertarikh 13 Disember, 2024 (di dalam Lampiran 10) serta Hujahan Bertulis Defendan bersama Ikatan Autoriti Defendan (di dalam Lampiran 16 dan
Lampiran
Lampiran 17) sebelum memutuskan untuk membenarkan permohonan Plaintif dengan kos sebanyak RM3,000.00 [4] Tidak berpuas hati dengan keputusan tersebut, Defendan telah memfailkan rayuan ke Mahkamah Rayuan melalui Lampiran 19 terhadap keputusan Mahkamah ini yang membenarkan permohonan Plaintif untuk memasukkan penghakiman terus terhadapnya. [5] Berikut adalah alasan penghakiman Mahkamah ini untuk Lampiran 8. Isu Teras [6] Berbangkit dari 8 ialah persoalan sama ada ini merupakan kes yang sesuai untuk satu penghakiman terus dimasukkan terhadap Defendan. Alasan-Alasan oleh Plaintif [7] Alasan-alasan yang dikemukakan oleh Plaintif, pada dasarnya, berlandaskan kepada peruntukan-peruntukan di dalam Akta Cukai Pendapatan 1967. [8] Plaintif berhujah bahawa seksyen 103(1) Akta Cukai Pendapatan 1967 dengan jelas memperuntukkan bahawa cukai yang kena dibayar di bawah suatu taksiran adalah genap masanya dan kena dibayar atas penyampaian Notis Taksiran kepadanya tidak kira sama ada atau tidak orang itu merayu terhadap taksiran tersebut. [9] Tambahan, Plaintif turut merujuk kepada seksyen 103(5) dan 103(6) Akta Cukai Pendapatan 1967 yang dikatakan dengan jelas memperuntukkan bahawa kenaikan yang dikenakan di bawah peruntukan tersebut boleh didapatkan kembali sebagai suatu cukai yang genap masanya dan kena dibayar. [10] Plaintif juga merujuk dan bergantung kepada seksyen 145(2) Akta yang sama yang secara jelas memperuntukkan bahawa salinan Notis Taksiran yang telah diserahkan secara pos biasa ke alamat terakhir Defendan yang diketahui pada masa itu dalam simpanan Plaintif dan tidak pernah dikembalikan tanpa serah kepada Plaintif adalah disifatkan sebagai telah sempurnanya disampaikan kepada Defendan. [11] Seterusnya, Plaintif turut berhujah bahawa apabila suatu perakuan di bawah seksyen 142(1) Akta Cukai Pendapatan 1967 ditandatangani oleh Ketua Penolong Pengarah yang menyatakan nama dan alamat Defendan serta amaun cukai yang genap masanya untuk dibayar oleh Defendan, ia menjadi keterangan yang mencukupi kepada Mahkamah untuk memberi penghakiman bagi amaun cukai yang dinyatakan di dalam perakuan tersebut. [12] Turut dibangkitkan oleh Plaintif ialah seksyen 106(1) Akta yang sama yang dengan jelas memperuntukkan bahawa sebarang cukai yang genap masanya dan kena dibayar boleh didapatkan kembali melalui prosiding sivil sebagai suatu hutang yang genap masanya dan kena dibayar kepada Plaintif. [13] Akhir sekali, Plaintiff juga berhujah bahawa Defendan tiada pembelaan bermerit di dalam tindakan ini. Hujahan-Hujahan Balas oleh Defendan [14] Intipati perbalahan Defendant terhadap tuntutan Plaintif berpaksikan kepada prinsip res judicata dan alasan bahawa Defendan tidak menerima Notis bagi Tahun Taksiran 2020 daripada Plaintif. [15] Mengenai, prinsip res judicata, Defendan merujuk kepada dua tuntutan sebelum ini yang telah dimulakan oleh Plaintiff terhadapnya, yakni, Kes BA-21NCvC-109-09/2021 (“Kes 109”) dan Kes BA-21NCvC- 129-10/2021 (“Kes 129”). [16] Kes 109 merujuk kepada tuntutan oleh Plaintif untuk Anggaran Cukai Pendapatan bagi Tahun Taksiran 2019 sementara Kes 129 merujuk kepada tuntutan oleh Plaintif untuk Anggaran Cukai Pendapatan bagi Tahun Taksiran 2018 (Tambahan). [17] Defendan memaklumkan kepada Mahkamah bahawa Plaintif dan Defendan telah memasuki suatu Penghakiman Persetujuan untuk kedua Kes 109 dan Kes 129. [18] Memandangkan tuntutan Plaintif di dalam kes ini adalah juga untuk Notis bagi Tahun Taksiran 2018 (Tambahan), Defendan membuat hujahan bahawa yang dicabar bukanlah amaun notis taksiran tersebut tetapi sebaliknya, yang dicabar adalah kesahihan notis taksiran tersebut. Defendan berhujah bahawa: “Once the notice of assessment has been reduced to a consent judgment endorsed by the Court, the Plaintiff is barred from “double claiming” a similar claim from the previous suit”. Undang-Undang dan Prinsip-Prinsip Yang Terpakai [19] Untuk memudahkan rujukan, peruntukan-peruntukan dalam Akta Cukai Pendapatan 1967 yang terpakai adalah seperti berikut: Recovery by suit 106. (1) Tax due and payable may be recovered by the Government by civil proceedings as a debt due to the Government. Payment of tax 103. (1) Except as provided in subsection (2), tax payable under an assessment for a year of assessment shall be due and payable on the due date whether or not that person appeals against the assessment. (1A) Where an assessment or additional assessment has been made under section 91A, the tax or additional tax payable under the assessment shall be due and payable on the day the amended return is furnished whether or not that person appeals against the assessment or additional assessment. (2) Where an assessment is made under section 90(3), 91, 92 or 96A, or where an assessment is increased under section 101(2), the tax payable under the assessment or increased assessment shall, on the service of the notice of assessment or composite assessment or increased assessment, as the case may be, be due and payable on the person assessed at the place specified in that notice whether or not that person appeals against the assessment or increased assessment. (3) Where any tax due and payable under subsection (1) has not been paid by the due date, so much of the tax as is unpaid upon the expiration of that date shall without any further notice being served be increased by a sum equal to ten per cent of the tax so unpaid, and that sum shall be recoverable as if it were tax due and payable under this Act. … (5) Subject to subsection (7), where any tax due and payable under subsection (2) has not been paid within thirty days after the service of the notice, so much of the tax as is unpaid upon the expiration of that period shall without any further notice being served be increased by a sum equal to ten per cent of the tax so unpaid, and that sum shall be recoverable as if it were tax due and payable under this Act. Evidential provisions 142. (1) In a suit under section 106 the production of a certificate signed by the Director General giving the name and address of the defendant and the amount of tax due from him shall be sufficient evidence of the amount so due and sufficient authority for the court to give judgment for that amount. 145. Service of notices (1) Subject to any express provision of this Act, for the purposes of this Act notices may be served personally or by ordinary or registered post. (2) A notice relating to tax which is sent by ordinary or registered post shall be deemed to have been served on the person (including a partnership) to whom it is addressed on the day succeeding the day on which the notice would have been received in the ordinary course of post if it is addressed – (a) in the case of a company, partnership or body of persons having a registered office in Malaysia – (i) to that registered office; (ii) to its last known address; or (iii) to any person authorized by it to accept service of process; (b) in the case of a company, partnership or body of persons not having a registered office in Malaysia – (i) to any registered office of the company, partnership or body (wherever that office may be situated); (ii) to the principal place of business or other activity of the company, partnership or body (wherever that place may be situated); or (iii) to any individual authorized (by or under the law of any place where the company, partnership or body is incorporated, registered or established) to accept service of process; and (c) in the case of an individual, to his last known address. [20] Maksud serta pemakaian peruntukkan-peruntukkan di dalam Akta Cukai Pendapatan 1967 ini telah diulas dan diterima pakai dalam kes-kes yang telah diputuskan sebelum ini. Dapatan Mahkamah [21] Mengenai hujahan Defendan bahawa Plaintif telah gagal menghantar Notis bagi Tahun Taksiran 2020, Mahkamah ini berpuas hati bahawa Notis Taksiran tersebut telah diserah kepada Defendan ke alamat terakhir yang diketahui pada masa itu secara pos biasa, selaras dengan peruntukan seksyen 145(2)(c) Akta Cukai Pendapatan 1967, dan tidak pernah dikembalikan kepada Plaintif tanpa serah. [22] Mengenai tunggakan cukai pendapatan bagi Tahun-tahun Taksiran 2018 (Tambahan), dan 2020 pula, tidak dapat disangkalkan bahawa peruntukkan-peruntukkan seksyen 103(1) dan (3) Akta Cukai Pendapatan 1967, sepertimana yang diterima pakai dalam kes-kes seperti Sun Man Tobacco Co Ltd v Government of Malaysia [1937-1978] AMTC 492; [1973] 1 LNS 144; [1973] 2 MLJ 163; [1973] 1 MLRA 755, Government of Malaysia v Abdul Rahman [1937-1978] AMTC 693; [1975] 1 MLJ 276; [1974] 1 MLRH 504, Government of Malaysia v KPM Modal Sdn Bhd [2002] AMEJ 0086; [2002] 6 CLJ 221; [2002] MLJU 158; [2002] 2 MLRH 32, Government of Malaysia v Ong Kar Beau [2003] 3 AMR 565; [2003] CLJU 188; [2003] 6 MLJ 225; [2003] 5 MLRH 749, Government of Malaysia v Teoh Chai Siok [1979-1996] AMTC 1448; [1990] 2 CLJ Rep 76; [1990] 1 MLJ 183; [1989] 2 MLRH 762 dan Kerajaan Malaysia v Beyond Gateway Sdn Bhd [2003-2005] AMTC 59; [2003] 2 CLJ 527; [2003] MLJU 178; [2003] 1 MLRH 244, juga terpakai dalam kes ini. [23] Berikutan perkara di atas, Plaintif telah mengambil tindakan guaman sivil ke atas Defendan berdasarkan peruntukan seksyen 106 Akta Cukai Pendapatan 1967. [24] Di dalam kes Kerajaan Malaysia v Pembinaan Kota Laksamana (Melaka) Sdn Bhd & 2 Ors [2023] AMEJ 2337; [2023] AMTC 396; [2023] CLJU 2348; [2023] MLJU 2565, Mahkamah ini telah membuat huraian serta rumusan mengenai kedudukan undang-undang yang melibatkan aspek tuntutan sebegini. [20] As the plaintiff has invoked the summary procedure under Order 14 of the Rules of Court 2012, a question for determination is whether the conventional rule which requires a defendant resisting an application for summary judgment to raise “an issue or question in dispute which ought to be tried or that there ought for some other reason to be a trial” as provided in Order 14 r 3 of the Rules of Court 2012 has any application pursuant to a claim made under the Income Tax Act 1967. [21] In Mohd Najib Hj Abd Razak v Government of Malaysia [2023] AMTC 1; [2023] AMEJ 2078; [2023] MLJU 2283; [2023] 1 LNS 2063; [2024] 1 MLRA 69, the Federal Court had considered the following three questions of law: [18] … (c) Question 3 Whether, by reason of Sections 103 and 106(3) of the Income Tax Act 1967, this Court is wholly prevented from considering whether or not there are triable issues and/or some other reason warranting a trial (within the meaning of Order 14 Rule 1 and Order 14 Rule 3 of the Rules of Court 2012 ), before deciding whether or not to give judgment in favour of the Plaintiff, despite the fundamental liberties, rights and powers enshrined in, inter alia, Articles 5, 8 and 121 of the Federal Constitution. … (e) Question 5 Whether Order 14 Rule 3 of the Rules of Court 2012, which provides that a Summary Judgment application may be dismissed if a Defendant can show “some other reason” for a trial to be held, applies in civil recovery proceedings in tax matters. (f) Question 6 Whether in instances of manifest and obvious errors in calculation of a tax assessment, a court is entitled by virtue of its inherent and judicial powers to consider a Defendant‘s defence of merit to dismiss or set aside an application for Summary Judgment by a Plaintiff and order full trial on the matter. [22] As noted by the Federal Court, “Questions 3, 5 and 6 all of which deal with the workings of summary judgment in the context of section 106 ITA” (see paragraph [19]). [23] The workings of summary judgment in the context of section 106 of the Income Tax Act 1967 were adeptly articulated by Nallini Pathmanathan FCJ … [24] Based on the … exposition relating to the workings of summary judgment in the context of s 106 of the Income Tax Act 1967, the Federal Court affirmatively held that the “issue or question which ought to be tried or that there ought for some other reason to be a trial” rule as envisaged in Order 14 r 3 has no application. [25] Dakwaan tuntutan berganda dan res judicata oleh Defendan wajar dipertimbangkan secara serius. [26] Selepas diperhalusi Notis-Notis Tahun Taksiran yang telah dikeluarkan untuk tuntutan ini, Mahkamah ini mendapati bahawa dakwaan oleh Defendan merupakan suatu salah sangka. [27] Pada hakikatnya, sungguhpun tuntutan ini adalah juga untuk Notis Tahun Taksiran 2018 (Tambahan) (berserta Notis Tahun Taksiran 2020), Notis ini telah dikeluarkan pada 7 September, 2021, berikutan satu audit persetujuan yang telah ditandatangani oleh Defendan. Dengan kata lain, masih terdapat satu "shortfall" atau kekurangan yang kini dituntut menerusi Notis Tahun Taksiran 2018 (Tambahan) ini.
