OKT dituduh dengan pertuduhan seperti berikut: PERTUDUHAN S/N dTCP0pXytUK07Disgv8dg **Note : Serial number will be used to verify the originality of this document via eFILING portal 2 Bahawa kamu pada 09.09.2025 jam lebih 0200 hrs di Sebuah Rumah Sewa yang beralamat B-Lot 3113, Kampung Pak Elong dalam Daerah Bachok dalam dalam Negeri Kelantan, telah tinggal di negara ini setelah tamat tempoh pas yang telah dikeluarkan kepada kamu yang sah laku sehingga 04 September 2025 iaitu 05 hari tanpa sebab yang munasabah dengan itu kamu telah didapati melanggar peruntukan Seksyen 15(1) (c) Akta Imigresen 1959/ 63 (Akta 155) dan dengan itu kamu telah melakukan kesalahan yang boleh dihukum di bawah Seksyen 15(4) Akta yang sama. HUKUMAN SEK. 15(4) AKTA IMIGRESEN 1959/63 (AKTA 155) Mana-mana orang yang tanpa sebab-sebab munasabah melanggar Seksyen ini adalah melakukan suatu kesalahan dan hendaklah apabila sabit kesalahan bertanggungan kepada suatu denda tidak kurang daripada sepuluh ribu ringgit atau penjara bagi tempoh tidak lebih lima tahun atau kedua-duanya.

OKT dengan dibantu oleh jurubahasa Mahkamah telah memohon untuk dikenakan hukuman penjara. Mahkamah telah bertanya beberapa kali berkenaan hukuman penjara ini tetapi OKT memaklumkan untuk dikenakan hukuman penjara kerana ketiadaan duit untuk membayar denda. Beliau hanya memohon untuk diringankan hukuman penjara yang dikenakan.

Pihak Pendakwaan memohon hukuman yang setimpal sebagai pengajaran kepada OKT supaya OKT tidak ulangi lagi kesalahan.

Mahkamah telah menimbangkan rayuan OKT dan juga hujahan pihak Pendakwaan.

Walaupun OKT telah mengaku salah di dalam kes ini tetapi kesalahan yang dilakukan oleh OKT ini adalah serius kerana ia melibatkan “isu negara”. Kesalahan yang serius ini menjadikan pengakuan salah OKT ini tidak menjadikan ia satu faktor yang patut dipertimbangkan oleh Mahkamah yang mulia ini.

Dalam kes Bachik Abdul Rahman v. PP [2004] 2 CLJ 572 di mana Hakim Augustine Paul telah menyatakan, antara lain: - " The circumstances in which a guilty plea will not have mitigating effect of a guilty plea (see Loh Hock Seng & Anor v. PP [1979] 1 LNS 48; [1980] 2 MLJ 13; PP v. Oo Leng Swee & Ors [1981] 1 LNS 109; [1981] 1 MLJ 247). Where public interest demands a deterrent sentence in the circumstances of a particular case, then the effect of a guilty plea must also give way (see Sim Gek S/N Yong v. PP [1995] 1 SLR 537; PP v. Govindnan a/l Chinden Nair [1998] 2 CLJ 370). A guilty plea cannot also be a powerful mitigating factor when effectively no defence to the charge is available to the accused (see PP v. Low Kok Wai [1988] 2 CLJ 105; [1988] 2 CLJ (Rep) 268). If a plea of guilty is made too late in the trial it may also cease to have mitigating effect (see PP v. Dato Nallakaruppan Solaimalai[1999] 2 CLJ 596). The absence of mitigating factors in favour of the accused like, for instance, the existence of previous convictions may also deprive the guilty plea of its effect. There can therefore be no automatic rule that a guilty plea on its own entitles an accused to a lesser punishment (see PP v. Tia Ah Leng [2000] 5 CLJ 614). Be that as it may, where there is a departure from the general rule the reason for not treating the guilty plea as a S/N dTCP0pXytUK07Disgv8dg **Note : Serial number will be used to verify the originality of this document via eFILING portal 5 mitigating factor must be reflected in the grounds of judgment (see Tan Lay Chen v. PP [2000] 4 CLJ 492). In the light of the law that we have adverted to what requires consideration is whether in the circumstances of this case the guilty plea of accused ought to have been treated as a mitigating factor in his favour and, if it is not to be so, whether the Sessions Court was aware of it. The relevant part of the judgment of the learned Sessions Court Judge that we have reproduced earlier makes it patently clear that in imposing sentence he had taken into consideration the seriousness of the offence against the background of the physical weakness and age of the victim; the element of public interest to be served; the effect of the crime on the victim; the previous sentence being served by the accused; and the need to protect society from persons like him. We interpolate to add that the sentence that the accused was then serving in respect of a conviction for an offence committed subsequent to the current offence and convicted earlier will rank as a previous conviction. In this regard we refer to Sim Yeow Seng v. PP [1995] 3 SLR 44 where Yong Pung How CJ sitting in the High Court said at p 47: - The rationale of PP v. Boon Kiah Kin [1993] 3 SLR 639 and, indeed, Lowe J's judgment in R v. Wilson [1965] VLR 199 is that a sentencing court should have regard to all of the accused's antecedents up to the moment of sentencing because these antecedents reveal his character, his attitudes and the likelihood of rehabilitation. So long as previous convictions are shown to exist, therefore, it does not matter whether they were in respect of offences committed before or subsequent to the offence for which the court is considering sentence.".

Dalam kebanyakkan kes saya menjatuhkan hukuman selama antara lima (5) atau (6) enam bulan penjara kepada OKT yang mengaku salah atas kesalahan sebegini. Hanya di dalam kes ini mahkamah S/N dTCP0pXytUK07Disgv8dg **Note : Serial number will be used to verify the originality of this document via eFILING portal 6 mengambil pendekatan untuk memberikan sedikit pengurangan kepada OKT. Sepatutnya OKT perlu bersyukur atas pengurangan ini.

Mahkamah juga mengambil kira kes ini sebagai kes “public interest” kerana ia melibatkan masalah negara. Kedaulatan negara ini perlu dijaga dengan memberikan hukuman yang setimpal kepada pesalah.

Dalam kes Kenneth John Ball [1951] 35 Cr. App. R 164, mahkamah menyatakan antara lain: “In deciding the appropriate sentence, a Court should always be guided by certain considerations. The first and foremost is the public interest. The criminal law is publicly enforced, not only with the object of punishing crime, but also in the hope of preventing it. A proper sentence, passed in public, serves the public interest in two ways. It may deter others who might be tempted to try crime as seeming to offer easy money on the sup-position, that if the offender is caught and brought to justice, the punishment will be negligible.

Mahkamah ini juga percaya bahawa tempoh 4 bulan yang dijatuhkan itu boleh dijadikan pengajaran kepada OKT ini. Jika penjara yang terlampau singkat ia tidak dapat dijadikan pengajaran dan iktibar oleh OKT itu sendiri. Ia tidak menjadi “deterrent” kepada OKT. Mahkamah ini percaya hukuman penjara selama 4 bulan dari tarikh tangkap ini merupakan satu hukuman wajar, berpatutan dan munasabah.
