7 CLJ 584, Mahkamah Persekutuan menyatakan bahawa: 154 155 “At law there are only two standards of proof, namely beyond 156 reasonable doubt for criminal cases while it is on balance of probabilities 157 for civil cases.” 158 159 [24] Mahkamah juga merujuk kepada kes International Times & Ors v. Leong 160 Ho Yuen [1980] 1 LNS 31, mengenai beban pembuktian di mana 161 Mahkamah Persekutuan telah menyatakan seperti berikut (dengan izin); 162 163 “For the purpose of this appeal it is necessary to bear in mind the 164 distinction between the two senses in which the expressions burden of 165 proof and onus of proof are used (Nanji & Co. v. Jatashankar Dossa & Ors. 166 AIR 1961 SC 1474, 1478 and Raghavamma v. Chenchamma AIR 1964 SC 167 136, 143). The first sense, signified by the expression burden of proof 168 such as referred to in s.101 of the Evidence Act is the burden of 169 establishing a case and this rests throughout the trial on the party who 170 asserts the affirmative of the issue. The appellants in the present appeal 171 relied on justification and fair comment. Therefore, the burden of proving 172 these defences rests entirely upon them (Gatley on Libel and Slander, 173 7th Edn. Paras. 351 and 354). The second sense referred to as onus of 174 proof, on the other hand, relates to the responsibility of adducing 175 evidence in order to discharge the burden of proof. The onus as opposed 176 to burden is not stableand constantly shifts during the trial from one side 177 to the other according to the scale of evidence and other preponderates. 178 Such shifting is one continuous process in the evaluation of evidence. 179 According to ss. 102 and 103 of the Evidence Act, if the party with 180 whom this onus lies whether initially or subsequently as a result of its 181 shifting does not give any or further evidence or gives evidence which is 182 not sufficient, such party must fail. It is this onus that we are concerned 183 with in the present appeal. 184 185 [25] Mahkamah juga merujuk kes Tam Kim Khuan v. Tan Kee Kiat (M) SB 186 [1998] 1 MLJ 697, di mana diputuskan bahawa (dengan izin); 187 188 “It is settled law that the burden of proof rests throughout the trial on 189 the party on whom the burden lies. Where a party on whom the burden 190 of proof lies has discharged it, then the evidential burden shifts to the 191 other party…what shifts is the responsibility of adducing evidence to 192 discharged by cross-examination of witnesses of the party on whom the 193 burden of proof lies or by calling witness or by giving evidence himself or 194 a combination of the different methods. No adverse inference can be 195 drawn against that party for failure to give evidence himself. If he does 196 not adduce any evidence when the burden has shifted to him, he will fail. 197 If the party whom the burden lies fails to discharge it, the other party 198 need not call any evidence. In that event, it will not avail to him to turn 199 around and say that the respondent has not established his.” 200 201 [26] Selanjutnya prinsip undang-undang ini juga telah dijelaskan melalui 202 kes Mohd Ridzwan bin Abdul Razak v. Asmah bt Hj Mohd Nor [2016] 4 203 MLJ 282 di mana Mahkamah Persekutuan memutuskan di perenggan 66 204 yang berikut: 205 206 "[66]...We start by stating the obvious i.e. the standard of proof in civil 207 cases has traditionally been on a balance of probability, a standard that 208 is certainly lower than that of criminal cases; nowhere near that of 209 proving a case beyond reasonable doubt". 210 9 211 [27] Mahkamah merujuk kepada kes Mahkamah Persekutuan, Hong Yik 212 Trading v Liziz Plantation Sdn Bhd [2017] 5 MLJ 398 yang telah 213 memutuskan seperti berikut: 214 215 “[12] It is settled law that the burden of proof rests throughout the trial 216 on the party who asserts that the facts exist (s101 of the Evidence Act 217 1950). Where a party on whom the burden of proof lies has discharged 218 that burden, then the evidential burden shifts to the other party. 219 However, if the party whom the burden of proof lies fails to discharge it, 220 the other party need not call any evidence.” 221 222 [28] Mahkamah juga merujuk kepada kes Lim Jen Hsian & Anor v Ketua 223 Pengarah Jabatan Pendaftaran Negara [2017] 8 CLJ 412 oleh 224 Mahkamah Rayuan yang memutuskan bahawa: 225 226 “[33] It is a well-established principle of law that he who asserts must 227 prove. This is particularly so in respect of facts which are within the 228 appellants’ knowledge. The burden of proof is on the appellants to 229 established on the balance of probabilities that the second appellant 230 “was not born a citizen of any country”. Such rule of evidence is 231 enunciated in s, 103 of the Evidence Act 1950 which provides: 232 233 The burden of proof as to any particular facts lies on that person who 234 wishes the court to believe in its existence, unless it is provided by any 235 law that the proof of that fact shall lie in any particular person. 236 [34] In the case of Ong Boon Hua & Anor v. Menteri Hal Ehwal Dalam 237 Negeri, Malaysia& Ors [2008] 5 CLJ 42, it was held that the burden is on 238 the applicant to prove his citizenship stats by the relevant documents, 239 the absence of which would be fatal to prove his claim. 240 [35] The burden of proof would only shift to the respondent to prove 241 positively that the second appellant was born a citizen of a foreign 242 country once the appellant has established a prima facie case. (Refer to 243 Toh Whye Teck v. The Happy World Ltd [1953] 1 LNS 115; ; [1953] 19 244 MLJ 171). Mother who is a Thai national. The second appellant’s 245 biological mother named Rai-Putta Thippawan (“Rai Putta”) is a citizen 246 of Thailand. (exh. A of encl. . 10) (Refer to Foo Toon Aik v. Ketua 247 Pendaftar Kelahiran dan Kematian, Malaysia [2012] 4 CLJ 613; ; [2012] 248 9 MLJ 573.” 249 250 [29] Berdasarkan faktor-faktor tersebut, Plaintif di dalam kes ini adalah pihak 251 yang perlu membuktikan tuntutan yang dibuat. Beban pembuktian tidak 252 teralih kepada pihak Defendan untuk membuktikan sebaliknya sekiranya 253 pihak Plaintif gagal membuktikan kesnya. Oleh itu, Mahkamah ini 254 mempertimbangkan satu persatu setiap isu-isu yang dibangkitkan dalam 255 menentukan tuntutan pihak Plaintif. 256 257 [30] Pihak yang menuntut di dalam kes ini adalah Plaintif, maka beban 258 pembuktian adalah diletakkan di atas bahu mereka. Lanjutan daripada 259 itu, Plaintif juga perlu mencapai standard pembuktian iaitu di atas 260 imbangan kebarangkalian untuk membuktikan tuntutannya. 261 262 [31] Beban pembuktian Plaintif untuk membuktikan tuntutan tidak 263 berpindah kepada Defendan berdasarkan kes Selvaduray v Chinniah 264 [1939] MLJ 253 CA: 265 266 “[12] It is settled law that the burden of proof rests throughout the trial 267 on the party who asserts that the facts exist (s.101 of the Evidence Act). 268 Where a party on whom the burden of proof lies has discharged that 269 burden, then the evidential burden shifts to the other party. However, if 270 the party on whom the burden of proof lies fails to discharge it, the other 271 party need not call any evidence.This is highlighted in the case of 272 Selvaduray v. Chinniah [1939] 1 LNS 107; ; [1939] 1 MLJ where Terrell, 273 Ag CJ stated: 274 275 ... it is clear that the onus is on the plaintiff to prove his case. After the 276 conclusion of the whole case, there must be some preponderance in his 277 favour. It may be true that the plaintiff established a prima facie case, 278 but at the conclusion of the trial, the learned Judge has found that the 279 position was exactly even, i.e. that any preponderance in the plaintiff’s 280 favour had disappeared. That being the case, the plaintiff must 281 necessarily fail, as he has not discharged the onus which is upon him. No 282 doubt the defendant would equally have failed if he had been the 283 claimant and had tried to establish, as a substantive part of his case, the 284 alternative version which he tried to prove in answer to that of the 285 plaintiff.” 286 287 DAPATAN MAHKAMAH 288 289 [32] Dalam kes ini, tuntutan Plaintif adalah berkenaan tuntutan kerugian 290 kerosakan rumah yang disewakan kepada Defendan. Oleh itu, Plaintif 291 adalah perlu membuktikan kerosakan adalah dilakukan oleh Defendan 292 dan Plaintif juga perlu membuktikan tuntutan sebanyak RM 3,142.20 293 tersebut bagi ganti rugi yang dituntut tersebut. 294 295 [33] Keterangan saksi Plaintif iaitu SP1 dalam keterangan bersumpahnya 296 telah memberikan keterangan berkenaan pemeriksaan rumah, 297 kerosakan, telah mengambil gambar dan telah menghantar kepada 298 Plaintif. Secara amnya, keterangan SP1 adalah berkisar berkenaan 299 kerosakan rumah tersebut. 300 301 [34] Plaintif dalam kes ini menuntut sebanyak RM3,142.20 daripada 302 Defendan yang mana dikatakan Plaintif telah mengalami kerugian akibat 303 kerosakan rumah yang disewakan kepada Defendan. 304 305 [35] Mahkamah ini berpandangan Plaintif sewajarnya membuktikan tuntutan 306 atau bagaimana kiraan dibuat sehingga mendapatkan jumlah RM 307 3,142.20 tersebut. 308 309 [36] Keterangan SP1 tidak sama sekali menjelaskan bagaimana jumlah 310 tuntutan Plaintif RM 3,142.20 tersebut diperolehi. Tiada juga dokumen 311 yang ditandakan sebagai ekshibit. Tiada juga keterangan daripada pihak 312 kontraktor atau mana-mana orang lain yang dapat membuktikan jumlah 313 kerugian RM 3,142.20 tersebut diperolehi sebagai kerugian yang dialami 314 oleh Plaintif dalam kes ini. 315 316 [37] Walaupun berdasarkan semakan Mahkamah ini, terdapat satu quatation 317 pembaikan kerosakan rumah bertarikh 27 Februari 2025 daripada AS KT 318 Alarm and Renovation Sdn Bhd yang difailkan dalam Ikatan C, namun 319 dokumen ini tidak dirujuk dan tidak dikemukakan sebagai ekshibit. Tiada 320 juga keterangan berkenaan dokumen ini. Jumlah di dalam dokumen ini 321 adalah RM 3,540 yang mana ianya adalah berbeza dengan jumlah 322 tuntutan Plaintif, iaitu RM 3,142.20. 323 324 [38] Sekiranya terdapat keterangan berkenaan dokumen ini sekalipun, ianya 325 hanyalah quatation sahaja yang mana tidak dapat membuktikan Plaintif 326 telah membuat bayaran sebanyak jumlah yang dinyatakan, yang ianya 327 membolehkan Plaintif untuk membuktikan kerugian yang dialami oleh 328 pihak Plaintif dalam kes ini. 329 330 [39] Dokumen ini tidak dapat membuktikan Plaintif telah membuat bayaran 331 sebagaimana yang dituntut oleh Plaintif kepada Defendan. 332 333 [40] Mahkamah ini semasa menjalankan perbicaraan telah memberikan 334 ruang dan peluang serta telah menanyakan beberapa kali kepada Plaintif 335 samada terdapat dokumen yang hendak ditandakan sebagai ekshibit 336 atau terdapat saksi lain yang akan dipanggil. 337 [41] Namun, Plaintif maklum tiada dokumen lain dan tiada saksi lain yang 338 akan dipanggil. Oleh itu, Plaintif menutup kes dengan keterangan SP1 339 sahaja. 340 341 [42] Plaintif dalam kes ini memplidkan tuntutan terhadap Defendan adalah 342 sebanyak RM 3,142.20 tanpa mengemukakan apa-apa keterangan saksi 343 atau dokumen yang dapat membuktikan bahawa Plaintif telah 344 mengalami kerugian sebanyak jumlah yang dinyatakan dalam 345 tuntutannya. 346 347 [43] Dalam menilai keseluruhan tuntutan Plaintif ini, Mahkamah ini merujuk 348 kepada kes Ban Chuan Trading Co Sdn Bhd v. Ng Bak Guan [2004] 1 MLJ 349 411 di mana Mahkamah Rayuan telah memetik dapatan yang diputuskan 350 di dalam kes Bonham-Carter v. Hyde Park Hotel [1948] 64 TLR 177 di 351 mana diputuskan bahawa: 352 353 “The plaintiffs must understand that if they bring an action for damages, 354 it is for them to prove their damages; it is not enough to write down the 355 particulars and, so to speak, throw them at the head of the court saying, 356 ‘This is what I have lost, I ask you to give me these damages’. They have 357 to prove it”. 358 359 [44] Berdasarkan keterangan dan dokumen yang dikemukakan di Mahkamah 360 ini, tiada keterangan dan dokumen yang membolehkan untuk 361 Mahkamah membenarkan gantirugi yang dituntut oleh Plaintif dalam 362 kes ini. 363 364 [45] Dalam mengukuhkan lagi pertimbangan dan dapatan tersebut, 365 Mahkamah ini juga merujuk kepada kes Popular Industries Ltd v. The 366 Eastern Garment Manufacturing Co Sdn Bhd [1990] 1 CLJ 133 di mana 367 Lord Edgar Joseph Jr J memutuskan bahawa: 368 369 “In all circumstances, reason and justice point to the inevitable 370 conclusion that although the plaintiffs had shown the fact of damage, 371 no evidence or no sufficient evidence has been adduced as to its amount 372 with the perhaps unfortunate result that it is virtually impossible to 373 assess damage”. 374 375 [46] Mahkamah ini mendapati sepanjang perbicaraan dan keterangan saksi 376 Plaintif tiada perincian dibuat dan tiada bukti dokumentasi yang lengkap 377 telah dikemukakan oleh pihak Plaintif bagi membuktikan setiap tuntutan 378 yang dibuat. 379 380 [47] Sekiranya Mahkamah ini merujuk kepada quatation pembaikan 381 kerosakan rumah bertarikh 27 Februari 2025 daripada AS KT Alarm and 382 Renovation Sdn Bhd yang difailkan dalam Ikatan C (dokumen ini tidak 383 dirujuk dan tidak dikemukakan sebagai ekshibit) terdapat dua (2) amaun 384 tuntutan yang berbeza sekaligus menimbulkan keraguan berkenaan 385 jumlah sebenar yang perlu ditanggung Defendan sekiranya ada. 386 387 [48] Di dalam quatation yang difailkan tersebut, jumlah yang dinyatakan 388 adalah RM 3,540 mankala tuntutan Plaintif terhadap Defendan dalam 389 kes ini adalah RM 3,142.20. Tiada keterangan berkenaan dokumen 390 tersebut yang mana ianya menjadi lompang dan/atau tanda tanya 391 kepada Mahkamah ini. 392 393 [49] Oleh itu, Mahkamah ini berpendapat bahawa pengiraan tuntutan juga 394 adalah tidak terperinci dan tuntutan tersebut juga gagal dibuktikan 395 oleh pihak Plaintif ekoran daripada tiada bukti yang dapat mengaitkan 396 pembayaran yang telah ditanggung oleh pihak Plaintif. 397 398 [50] Mahkamah juga mendapati tiada sebarang keterangan ataupun 399 dokumen yang dikemukakan di Mahkamah ini untuk menunjukkan 400 lantikan kontraktor baru telah dibuat dengan kos sepertimana yang 401 dituntut. 402 403 [51] Di dalam hal ini Mahkamah merujuk kepada kes Sum Kum v. Devaki Nair 404 & anor [1963] 1 LNS 131 di mana Mahkamah Persekutuan telah 405 memutuskan: 406 407 “I would, however, add one observation of a general nature. This is by 408 no means the first appeal this Court and its predecessor have had to 409 deal with in which somewhat insufficient attention has been given at the 410 trial to the question of giving adequate evidence on the question of 411 quantum of damages. It is for Counsel in such cases to devote a little 412 more attention to that aspect of the matter in future. As Lord Goddard 413 said in the case of Bonham-Carter v. Hyde Park Hotel, Ltd [1948], 64 414 TLR 177, 178: 415 416 “Plaintiffs must understand that if they bring actions for damages 417 it is for then to prove their damage; it is not enough to write 418 down the particulars, and, so to speak, throw them at the head 419 of the Court, saying: ‘This is what I have lost; I ask you to give me 420 these damages’. They have to prove it.” 421 422 [52] Dalam kes ini, Defendan dalam pembelaannya ada membangkitkan 423 bahawa deposit dua (2) bulan sewa berjumlah RM 4,000 dan deposit api 424 dan air sebanyak RM 1,000 tidak dikembalikan oleh Plaintif. Namun, 425 dalam kes ini Defendan tidak membuat sebarang tuntutan balas kepada 426 Plaintif. 427 428 [53] Mahkamah ini mengambilkira juga akan kerugian yang dialami oleh 429 pihak Defendan dalam mempertimbangkan kes ini demi keadilan pihak- 430 pihak. Plaintif tidak dapat membuktikan secara terperinci kos yang telah 431 dikeluarkan disebabkan kerosakan yang dikatakan telah dilakukan oleh 432 pihak Defendan. 433 434 [54] Dalam mengukuhkan lagi pertimbangan dan dapatan dalam menolak 435 tuntutan Plaintif, Mahkamah juga merujuk kepada kes Popular 436 Industries Ltd v. The Eastern Garment Manufacturing Co Sdn Bhd [1990] 437 1 CLJ 133 di mana Lordship Edgar Joseph Jr J memutuskan bahawa 438 (dengan izin); 439 440 “In all circumstances, reason and justice point to the inevitable 441 conclusion that although the plaintiffs had shown the fact of damage, no 442 evidence or no suffient evidence has been adduced as to its amount with 443 the perhaps unfortunate result that it is virtually impossible to assess 444 damage”. 445 446 E. KESIMPULAN 447 448 [55] Setelah meneliti semua faktor di atas dan setelah Mahkamah 449 mempertimbangkan fakta-fakta, keterangan saksi-saksi dan keterangan 450 dokumen serta eksibit-eksibit yang dikemukakan, juga hujahan yang 451 difailkan oleh kedua-dua pihak, dan juga setelah Mahkamah menilai dan 452 mempertimbangkan kes di atas imbangan kebarangkalian Plaintif telah 453 gagal untuk membuktikan kes di atas imbangan kebarangkalian. 454 455 [56] Oleh yang demikian, Mahkamah ini telah menolak tuntutan Plaintif 456 terhadap Defendan dengan kos sebanyak RM 100 sebagaimana 457 diperuntukkan di bawah Aturan 93 Kaedah-Kaedah Mahkamah 2012. 458 459 (SITI NOR HASLIZA BINTI MD ALI) 460 Majistret 461 Mahkamah Majistret Alor Setar 462 Kedah 463 464 Pihak-pihak: 465 466 Bagi Plaintif : Encik Mohamad Ezzat bin Mohamad Ismail 467 468 Bagi Defendan : Encik Kamarul Zaman bin Kader Maidin 469 470
