that it has been fully attested and executed if it purports to be so. The presumption relates to the execution of the documents, i.e. signature. attestation, etc. In other words, to its genuineness but not to the truth of its contents. The person presenting a document under s. 90 is relieved of the necessity of proving that it was executed by the person who is purported to be the executant but the Court will not presume the correctness of any statement in the document.” [22] Berdasarkan penilaian Mahkamah ke atas dokumen-dokumen tersebut, Mahkamah berpuashati bahawa dokumen-dokumen ini tergolong ke dalam perkara yang dinyatakan di dalam seksyen 90 Akta 56 dan oleh itu ianya boleh diterima oleh Mahkamah ini sebagai sebahagian dari keterangan. [23] Berkaitan hujahan peguam Plaintif bahawa dokumen-dokumen ini sewajarnya dikemukakan melalui SP4 yang merupakan saksi dari Pejabat Tanah dan Jajahan Machang, ia adalah pada pandangan Mahkamah sangat tersasar. Ini kerana SP4 sendiri mengakui bahawa dokumen-dokumen tersebut tidak lagi berada di dalam jagaan dan simpanan mereka. Ini dapat dilihat melalui keterangan SP4 seperti berikut: Peguam : Adakah Encik tahu apakah yang berlaku kepada rekod pentadbir tanah berhubung dengan dokumen-dokumen izinlalu seperti, example, one of the contoh adalah macam di muka surat 39 ini. Adakah Encik tahu?. : Tidak Yang Arif. Sebab surat ini tahun 1978 dan tiada lagi rekod, apa-apa rekod yang berkaitan. Surat ini di dalam simpanan Pejabat Tanah Jajahan Machang. Peguam : Jadi, bila, untuk tempoh masa bila pentadbir tanah akan mempunyai rekod tentang izin lalu?. Encik kata tadi 1978 memang tak ada. So, dari which point of time pentadbir tanah akan mempunyai rekod?. : Sejak bilalah?. Peguam : Sejak bila. : Sejak bila, saya kurang pasti. Peguam : Tapi, Encik pasti yang dokumen-dokumen di 1978 tidak ada dalam rekod. : Betul. Peguam : Yang Arif, if, if I may. Since the witness has confirmed that he has no knowledge of the way leave documents by LLN, and there’s no record of the same, I just want to inform Yang Arif that we will adduce the way leave documents in the Defendant’s case. [24] Selain itu, Mahkamah turut mendapati bahawa dokumen-dokumen tersebut dikeluarkan oleh jabatan Kerajaan yang ditandatangani oleh seorang penjawat awam iaitu seorang Pentadbir Tanah. Di bawah misalan (e) seksyen 114 Akta 56, Mahkamah boleh membuat andaian bahawa tindakan rasmi oleh Pentadbir Tanah telah dilaksanakan mengikut aturan. Ini seperti dinyatakan oleh Mahkamah Rayuan di dalam kes Mohd Isha Awang v. Mohamad Idris Seramal Baris [2020] 9 CLJ 760 yang telah menyatakan dengan jelas penggunaan misalan (e) ini seperti berikut: “In our view, had the learned JC applied his mind properly, he would have noticed that those documents issued by the relevant authorities are in fact, documents issued by a Government department. The documents show the judicial and official acts which have been performed. It is trite law tha the court may presume the existence of any fact which it thinks likely to have happened in relation to the facts of the particular case that judicial and official acts have been regularly perfomed (see s.114(e) of EA). The words “regularly performed” means correctly done (see Commissioners of the Municipality of Malcca v. Sinniah [1970] 1 LNS 22; [1974] 1 MLJ 77). The section also states that the court is required to have regard to the fact that ‘judicial act, the regularity of which is in question was performed under exceptional circumstances’. Once the presumption arises, the official act will be presumed to have been regularly done until the contrary is proved (see Evidence, Practise and Procedure, 4th edn., Augustine Paul at p. 908). Peh Swee Chin in Loo Keck Leong v. PP [1992] 3 CLJ 1332; [1992] 1 CLJ (Rep) 195; [1992] 2 MLJ 177, 182 (SC) held tha the presumption is of course a rebuttable and optional presumption, based upon the common experience of mankind.” [25] Sehubungan dengan itu, Mahkamah memutuskan untuk menerima dokumen-dokumen yang telah dikemukakan oleh Defendan bagi menentukan keabsahan tindakan Defendan memasuki tanah Plaintif. [26] Selanjutnya, Mahkamah telah meneliti dokumen-dokumen tersebut dan mendapati bahawa adalah jelas keberadaan Defendan adalah berdasarkan kepada seksyen 53 Akta 116 yang menyatakan seperti berikut; “(1) Subject as hereinafter provided, whenever it is necessary so to do for the purpose of installing any system of distribution of energy under this Act, the Board or a licensee may lay, place or carry on, under or over any land, other than State land, such supply lines and may erect in or upon any land, other than State land, such posts and other apparatus as may be necessary or proper for the purposes of the Board installation or licensed installation, as the case may be, and may take such other action as may be necessary to render the installation safe and efficient, paying full compensation in accordance with section 58 to all persons interested for any disturbance, damage or disability that may be caused thereby;...” [27] Namun peguam Plaintif menghujahkan bahawa pra syarat bagi seksyen 53 tersebut adalah Defendan perlu membuat permohonan kepada Pihak Berkuasa Negeri (State Authority). Apa yang dimaksudkan oleh Pihak Berkuasa Negeri adalah sepertimana yang ditafsirkan di bawah seksyen 2 Kanun Tanah Negara seperti berikut; “"State Authority" means the Ruler or Governor of the State, as the case may be…” [28] Peguam Plaintif turut menghujahkan bahawa keputusan perlu dibuat oleh Pihak Berkuasa Negeri dan Notis Niat untuk memasuki tanah tersebut perlu dinyatakan dengan jelas di dalam Borang 4 dan diserahkan kepada pemilik asal. Jika terdapat bantahan, maka satu siasatan perlu dijalankan oleh pegawai yang dilantik yang akan melaporkan kepada Pihak Berkuasa Negeri namun sebaliknya jika tiada bantahan, pihak LLN boleh terus memasuki tanah tersebut. [29] Berdasarkan kepada dokumen-dokumen yang dikemukakan, Plaintif menghujahkan bahawa Defendan gagal membuktikan bahawa terdapat permohonan yang dibuat oleh Defendan kepada Pihak Berkuasa Negeri. Defendan juga dikatakan gagal untuk mengemukakan Notis sebagaimana Jadual Keempat yang dihujahkan sebagai satu prasyarat. [30] Sehubungan dengan itu, peguam Plaintif menghujahkan bahawa apabila ini tidak dipatuhi maka tiada siasatan dilaksanakan, tiada perintah oleh Pihak Berkuasa Negeri, tiada bukti pembayaran dilakukan dan oleh itu, maka tiada persetujuan diberikan oleh pemilik terdahulu tanah tersebut. Dengan kata lain, keberadaan Defendan di atas tanah tersebut sejak 1978 adalah satu pencerobohan. [31] Di dalam menangani isu ini, Mahkamah ini perlu menjelaskan apa yang dimaksudkan sebagai satu pencerobohan. Hakim Wan Yahya HMT di dalam kes Tan Wee Choon v Ong PeckSeng & anor [1986] 1 MLJ 322 telah menjelaskannya seperti berikut; “Trespass to land unlike criminal trespass is completed once a person wrongfully, albeit peaceably, intrudes into the land in the possession of another, even where no damage is done. Trespass to land covers all unlawful entry and includes taking possession, pulling down or destroying anything permanently fixed to the land. The following passage on what constitutes trespass to land is found in Halsbury's Laws of England (3rd ed.), Vol. 38 at page 739: “Every unlawful entry by one person on land in the possession of another is a trespass for which an action lies, although no actual damage is done. A person trespasses upon land if he wrongfully sets foot on, or rides or drives over, it, or takes possession of it, or expels the person in possession, or pulls down or destroys anything permanently fixed to it, or wrongfully takes minerals from it, or places or fixes anything on it or in it, or, it seems, if he erects or suffers to continue on his own land anything which invades the airspace of another, or if he discharges water from another's land, or sends filth or any injurious substance which has been collected by him on his own land on to another's land.” [32] Apa yang dimaksudkan sebagai penceroboh telah diterangkan oleh Abdul Malik Ishak HMT di dalam kes Segar Restu (M) Sdn Bhd v Wong Kai Chuan [1994] 3 MLJ 530 seperti berikut; “…Who is a trespasser? In law, a trespasser is one who wrongfully enters on land in the possession of another, and has neither right nor permission to be on the land. Lord Dunedin in Robert Addie & sons (Collieries) Ltd v Dumbreck [1929] AC 358 at p 371 ” [33] Kedua-dua kes ini telah ditimbang oleh Mahkamah Rayuan di dalam kes Syarikat Air Negeri Sembilan Sdn Bhd lwn One Visa Sdn Bhd [2017] 1 MLJ 711 yang menyatakan; ““[27] Dapat diperhatikan dalam kes-kes tort pencerobohan ini, sama ada melalui nas-nas langsung (direct authority) atau sebaliknya, sifatsifat (traits) am yang ada dalam kesemua keadaan pencerobohan itu ialah adanya kemasukan (entry or intrusion) atau jika pada mulanya dibenarkan, telah berada atas hartanah berkenaan seterusnya, tanpa apa-apa kewajaran (unjustifiable). Dengan itu, kewajaran (justification) boleh menjadi dalihan kepada tort ini.” [34] Berdasarkan kepada otoriti-otoriti yang dibincangkan di atas, Mahkamah merumuskan sesuatu pencerobohan akan hanya berlaku apabila terdapat kemasukan atau keberadaan seseorang atau satu pihak ke atas sesuatu tanah tanpa sebarang hak ataupun kebenaran yang sah. [35] Di dalam kes ini, Defendan telah menegaskan bahawa kemasukan serta keberadaan mereka di atas tanah tersebut adalah bersandarkan kepada seksyen 53 Akta 116 yang telah dimansuhkan oleh Akta Bekalan Elektrik 1990 (Akta 447). Seksyen 53 Akta 116 mempunyai peruntukan yang sama dengan seksyen 11 Akta 447. [36] Seksyen 53 ini secara amnya memperuntukkan kuasa LLN untuk satu izin lalu sepertimana yang ditafsirkan oleh Hakim K.C Vohrah, HMT (pada ketika itu) di dalam kes Dolomite Industrial Park Sdn Bhd v Tenaga Nasional Berhad [1997] 1 LNS 38 seperti berikut; ““The word "wayleave" is not defined in Act 116 or Act 447 or regulations made under both of them. However, there is mention in s 53 of Act 116 of the right of the Electricity Board and in s 15 of Act 447 of the right of the licensee (here it is TNB) to enter into a "wayleave agreement" with the owner or occupier of land for the purpose of carrying a supply line across the land. In the New Shorter Oxford English Dictionary "wayleave" is defined as "(payment for) right of way granted by the owner of land to a particular body for a particular purpose, as for carrying telephone wires over or along buildings, or laying paths or pipes across land; a document conferring the right." In the context of both the Electricity Acts the word "wayleave" conveys the meaning of a right of way granted by the occupier or owner of land for the purpose of carrying a supply line across the land on payment for that right. Obviously a contractual relationship would have arisen between the parties for the wayleave.” [37] Bagi sesuatu hak izinlalu ini, pihak Defendan perlu memenuhi subseksyen 53(2) dan 53(3) Akta 116 seperti berikut:
