1.1 Pada 19.3.2024, orang kena tuduh (“OKT”) di dalam kes ini telah dipertuduhkan dengan 1 pertuduhan di hadapan Mahkamah Sesyen Kuala Kubu Bharu bagi 1 kesalahan iaitu di bawah Seksyen 15 (1) (a) Akta Dadah Berbahaya 1952 (“ADB”) yang boleh dihukum dibawah seksyen 39C (1) (b) AKTA yang sama.

1.2 Pertuduhan serta hukuman telah dibacakan dan diterangkan kepada OKT dalam Bahasa Malaysia dan OKT telah mengaku salah atas pertuduhan tersebut serta faham sifat dan akibat pengakuannya. Pendakwaan dikendalikan oleh pegawai pendakwa Insp Firdaus manakala OKT tidak diwakili peguam.

1.3 Atas pengakuan salah OKT tersebut, Hakim Mahkamah Sesyen ini telah pada 19.3.2024 menerima pengakuan salah OKT, mensabitkan OKT atas pertuduhan tersebut dan seterusnya menjatuhkan hukuman penjara 6 tahun 6 bulan dari tarikh tangkap, 3 sebatan rotan serta perintah pengawasan selama 3 tahun.

1.4 OKT telah tidak berpuashati atas hukuman tersebut dan telah pada 21.3.2024 memfailkan satu notis rayuan yang merayu atas hukuman agar dapat diringankan.

2.1 OKT telah dipertuduhkan dengan pertuduhan seperti yang berikut: “Bahawa kamu pada 28/11/2023 jam lebih kurang 0047 hrs bertempat di tandas balai Bahagian Siasatan Jenayah Narkotik Daerah Hulu Selangor, di dalam Daerah Hulu Selangor, di dalam Negeri Selangor, telah memberikan kepada diri sendiri dadah berbahaya tanpa kebenaran yang sah dadah jenis amphetamine dan methamphetamine. Oleh itu, kamu telah melakukan kesalahan di bawah seksyen 15(1)(a) Akta Dadah Berbahaya 1952. Dan selanjutnya bahawa kamu, sebelum melakukan kesalahan tersebut, iaitu pada 15/10/2021, telah disabitkan oleh majistret, di Mahkamah Majistret Kuala Kubu Bharu dengan kesalahan di bawah seksyen 15(1)(a) Akta Dadah Berbahaya 1952 iaitu kesalahan memberikan kepada diri sendiri dadah berbahaya tanpa kebenaran yang sah dan dihukum di bawah seksyen yang sama iaitu denda RM1000.00 ingkar denda (1) bulan penjara. Selanjutnya, kamu juga pada 20/05/2022 telah disabitkan oleh majistret, di Mahkamah Majistret Kuala Kubu Bharu dengan kesalahan di bawah seksyen 15(1)(a) Akta Dadah Berbahaya 1952 iaitu kesalahan memberikan kepada diri sendiri dadah berbahaya tanpa kebenaran yang sah dan dihukum di bawah seksyen yang sama iaitu penjara (8) bulan dari tarikh tangkap dan (2) tahun pengawasan. Oleh yang demikian, kamu telah melakukan satu kesalahan di bawah seksyen 15 (1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah seksyen 39C (1) AKTA yang sama. Hukuman: penjara selama tempoh tidak kurang daripada (5) tahun tetapi tidak melebihi (7) tahun, dan hendaklah juga dikenakan dengan hukuman sebat tidak lebih daripada (3) sebat.

3.1 Seksyen 15 ADB - Self Administration “(1) Any person who:
a
consumes, administers to himself or suffers any person, contrary to s. 14 to administer to him any dangerous drug specified in Parts III and
b
is found in any premises kept or used for any purposes specified in s. 13 in order that such dangerous drug may be administered to or smoked or otherwise consumes by him; shall be guilty of an offence against this Act and shall be on conviction to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding two years.

For purpose of this section, "consumes" includes eat, chew, smoke, swallow, drink, inhale or introduce into the body in any manner or by any means whatsoever.”

3.2 Seksyen 38 Akta Dadah Berbahaya 1952 memperuntukkan seperti berikut: “(1) Where a person is found guilty of an offence under section 15, he shall, immediately after having undergone the punishment imposed upon him in respect thereof, undergo supervision by an officer as defined under section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 for a period of not less than two and not more than three years as may be determined by the court.

A person required to undergo supervision under subsection (1) shall be deemed to have been placed under such supervision under paragraph 6(1)(b) of the Drug Dependants (Treatment and Rehabilitation) Act 1983.”

3.3 Seksyen 39C (1) (b) Akta Dadah Berbahaya 1952 pula menyatakan berikut: “(1) Where a person who has not less than-
a
two previous admissions;
b
two previous convictions under paragraph 10(2)(b) or paragraph 15(1)(a) or any combination of the sections;
c
one previous admission and one previous conviction under paragraph 10(2)(b) or paragraph 15(1)(a);
d
one previous admission and two previous convictions under section 31A; or
e
one previous conviction under paragraph 10(2)(b) or paragraph 15(1)(a) and two previous convictions under section 31A, is found guilty of an offence under paragraph 10(2)(b), paragraph 15(1)(a) or section 31A, he shall, instead of being liable to the punishment provided for that offence under the section under which he has been found guilty, be punished with imprisonment for a term which shall not be less than five years but shall not exceed seven years, and he shall also be punished with whipping of not more than three strokes.”

3.4 Tafsiran peruntukkan dengan terma "shall be punished" seperti yang digunakan didalam Seksyen 39C (1) ADB ini adalah jelas tanpa apa-apa kekeliruan tentangnya dan Mahkamah ini tidak mempunyai apa jua budi bicara untuk menjatuhkan apa-apa hukuman lain selain dari apa yang telah diperuntukkan dan ini membawa tafsiran bahawa hukuman tersebut adalah mandatori melainkan bagi menentukan tempoh hukuman tersebut yang masih menjadi budibicara Mahkamah ini (rujuk kes Public Prosecutor v. Hew Yew [1971] CLJU 110; [1971] 1 LNS 110; [1972] 1 MLJ 164). Hukuman yang diputuskan oleh Mahkamah Sesyen ini adalah selaras dengan peruntukkan undang-undang setelah mempertimbangkan faktor-faktor yang akan dihuraikan selepas ini.

3.5 Selanjutnya, Mahkamah ini juga mengambil kira bahawa pengakuan salah OKT telah dibuat mengikut peruntukan seksyen 173 Kanun Tatacara Jenayah dan adalah teratur sebagaimana dinyatakan dalam kes Pham Van Thoung & Yang Lain lwn. PP (supra), Seah Ah Chiew v. PP [2006] 8 CLJ 585, Lee Weng Tuck & Anor v. PP [1989] 2 CLJ 120 dan Mohammad Hassan v. Public Prosecutor [1997] 1 CLJ SUPP 485, maka Mahkamah ini menerima pengakuan salah OKT dan seterusnya mensabitkan OKT atas pertuduhan terhadapnya.

FAKTA KES Secara ringkas fakta kes OKT seperti mana ditandakan sebagai Lampiran A dikemukakan oleh pihak pendakwaan dan diakui benar oleh OKT adalah seperti berikut;

4.1 Pada 28.11.2023 jam lebih kurang 0030hrs, bertempat di Bahagian Siasatan Jenayah Narkotik, IPD Hulu Selangor, Sjn Jabarulhatdan Bin Abu Bakar, no. polis: RF/124944 (selepas ini disebut pengadu) telah arahkan Kpl 148434 dan Kpl 173140 supaya mengiringi 1 orang lelaki warganegara Malaysia berketurunan India Muslim bernama Muhammad Iqbal bin Abdullah, no. kad pengenalan: 830624-10-5883 (selepas ini disebut sebagai OKT) ke tandas Bahagian Siasatan Jenayah Narkotik IPD Hulu Selangor untuk mengambil sampel air kencing milik OKT.

4.2 Sebelum memulakan ujian, OKT telah diminta memilih botol specimen air kencing dan OKT telah memilih botol specimen air kencing no. siri C0372609. OKT telah diiringi ke tandas oleh Kpl 148434 dan Kpl 173140. OKT telah mengisikan air kencingnya dalam botol specimen air kencing tersebut dan kemudiannya membawa botol specimen air kencing itu ke meja penguji. Pengadu seterusnya menjalankan ujian saringan awal ke atas specimen air kencing OKT.

4.3 Hasil daripada ujian saringan awal air kencing tersebut, OKT didapati positif dadah jenis “Meth”. Botol specimen air kencing tersebut juga telah dimeteraikan di hadapan OKT oleh pengadu. Keputusan ujian saringan awal air kencing tersebut juga telah dimaklumkan kepada OKT. Pengadu kemudiannya telah membuat tangkapan ke atas OKT seperti mana dalam no. report Kuala Kubu Bharu 2686/2023.

4.4 Botol sampel air kencing yang mengandungi specimen air kencing OKT telah dihantar ke makmal dadah, Jabatan Patologi Hospital Kuala Lumpur. Hasil analisa specimen air kencing OKT disahkan mengandungi dadah berbahaya jenis Amphetamine dan Methamphetamine. Amphetamine dan Methamphetamine adalah dadah berbahaya yang disenaraikan dalam jadual pertama Akta Dadah Berbahaya 1952.

4.5 OKT juga sebelum ini pernah dituduh dan dihukum bagi kesalahan di bawah sekysen 15 (1) (a) Akta Dadah Berbahaya 1952 seperti berikut:

4.6 Berdasarkan keterangan, kronologi kes dan sabitan lampau terhadap 2 pertuduhan di bawah seksyen 15 (1) (a) Akta Dadah Berbahaya 1952, OKT dituduh di bawah seksyen 15(1) (a) Akta Dadah berbahaya 1952 dan dihukum di bawah seksyen 39C (1) (b) Akta Dadah Berbahaya 1952 serta pengawasan di bawah seksyen 38B Akta Dadah Berbahaya 1952.

4.7 Pihak pendakwaan telah mengemukakan ekshibit-ekshibit seperti yang berikut:

4.8 Gambar botol urine dan rekod kesalahan lampau OKT telah ditunjukkan kepada OKT dan OKT akui benar kesemuanya.

5.1 OKT telah mengaku salah atas pertuduhan tersebut. OKT juga faham sifat dan akibat pengakuan salahnya. Prinsip asas pengakuan salah OKT wajar diberikan pengurangan atau diskaun atas hukuman yang bakal dikenakan kerana pengakuan salah OKT tersebut bukan sahaja menjimatkan masa pihak mahkamah malah pihak pendakwaan juga tidak perlu mengemukakan saksi-saksi pendakwaan dalam membuktikan pertuduhan ke atas OKT.

5.2 YA Augustine Paul, Hakim Mahkamah Rayuan di dalam Bachik bin Abdul Rahman V. Pendakwa Raya [2004] 2 MLJ 534, [2004] 2 CLJ 572, telah memutuskan berkenaan pengurangan hukuman atau diskaun tersebut bukanlah sesuatu yang automatik memandangkan hukuman bagi sesuatu kesalahan itu masih atas budibicara Hakim yang mendengar pertuduhannya setelah menilai keseriusan kesalahan yang dipertuduhkan serta faktor-faktor lain yang menjadi aras pertimbangannya sebagaimana dinyatakan seperti yang berikut: “One of the principles in sentencing is that a convicted person should be given a discount for pleading guilty. A reduction of about one third of the sentence that would otherwise have been imposed is normally given. This, however, is not a strict rule and the court may, in the exercise of its discretion, refuse to grant any discount. The severity of the offence or the existence of a previous conviction may outweigh the mitigating effect of the guilty plea; so, may the demands of public interest for a deterrent sentence as well as the absence of a good defence or of other mitigating factors. The guilty plea does not automatically entitle the convict to a lesser punishment.”

5.3 Selanjutnya Mahkamah ini merujuk kepasa prinsip yang digariskan di dalam kes Public Prosecutor V Kamaruzaman Bin Mahmud & Anor [2007] 1 MLJ 750 di mana mahkamah memutuskan seperti berikut: "[68] Ordinarily a plea of guilty has been treated as a mitigating factor since it saves judicial time in conducting a lengthy trial but it also saves time and inconvenience of many, particularly the witnesses (see Melvani v Public Prosecutor [1971] 1 MLJ 137, Sau Soo Kim v Public Prosecutor [1975] 2 MLJ 134, Loh Hock Seng & Anor v Public Prosecutor [1980] 2 MLJ 13, Public Prosecutor v Leo Say & 2 Ors [1985] 2 CLJ 155, Mohamed Abdullah Ang Swee Kang v Public Prosecutor [1988] 1 MLJ 167, Public Prosecutor v Ravindran a/l N Rethinam & 5 Ors [1992] 4 CLJ 2043, Tan Lay Chen v Public Prosecutor [2001] 1 MLJ 135). The court has recognized that a plea of guilty is ordinarily a consideration to be taken into account in mitigation of punishment but it must be made clear that it is not the law that a sentencing judge must exercise a discretion to provide a non-custodial sentence in every case of plea of guilty as each case is dealt with on its own individual merits and should not be assumed mechanically that it will be spared the custodial sentence. A plea advanced on counsel's advice late in the day because a conviction is almost inevitable, will be given less weight than one advanced from arrest or committal, on the first day he is charged in court to save witnesses from the trauma of a trial or to reduce court delays, (see R Lawrence [1980] 1 NSWLR 122,) Laurentiu [1992] 63 A Crim R 402)."

5.4 Mahkamah ini juga merujuk kepada dapatan Mahkamah Persekutuan di dalam kes lwan Bujang Dara & Anor v. Public Prosecutor [2017] CLJU 285; [2017] 1 LNS 285; [2017] 3 MLJ 630 yang menyatakan seperti berikut: “But the court is not only concerned with the plea in mitigation in passing sentence. No matter how strong the plea in mitigation is in favour of a lenient sentence, the court's overriding consideration has always been and will always be the public interest.”

5.5 Pertimbangan Mahkamah ini dalam memutuskan hukuman bukanlah hanya semata-mata untuk kepentingan OKT tetapi juga kepada faktor kepentingan awam serta keseriusan kesalahan yang dilakukan seperti mana pertuduhan. Mahkamah ini memandang serius atas kesalahan seperti mana pertuduhan. OKT dalam pertuduhan ini telah dituduh atas kesalahan memasukkan ke dalam badannya dadah berbahaya jenis Amphetamine dan Methamphetamine yang mana OKT juga telah mempunyai 2 sabitan lampau atas kesalahan yang sama. Kini OKT dituduh lagi atas kesalahan yang sama di bawah peruntukkan yang sama. Kesalahan jenayah melibatkan dadah berbahaya adalah suatu kesalahan jenayah yang serius dan sangat berleluasa sejak bertahun lama sehingga kini. Jenayah melibatkan dadah bukan sahaja merosakkan OKT secara peribadi tetapi juga merosakkan masyarakat dan negara secara amnya. OKT dilihat tidak insaf dan tidak menunjukkan inisiatif untuk berubah dengan hukuman yang pernah dijalani sebelum ini. Maka, atas pertuduhan ini mahkamah perlu memberikan suatu bentuk hukuman yang berbentuk pemenjaraan panjang selaras dengan undang-undang untuk mengasingkan OKT dari bebas terjerumus dalam gejala dadah dan berharap OKT akan berubah sepanjang menjalani hukuman pemenjaraan ini.

6.1 Mahkamah ini seterusnya perlu mengambil kira kepentingan awam melampaui kepentingan OKT sebelum sesuatu hukuman dijatuhkan selari dengan prinsip undang-undang sebagaimana yang telah digariskan di dalam kes R V Ball (Kenneth John) [1951] 35 CR APP R 164 seperti berikut: “In deciding the appropriate sentence, a court should always be guided by certain considerations. The first and foremost is the public interest. The criminal law is publicly enforced, not only with the object of punishing crime, but also in the hope of preventing it. A proper sentence, passed in public, serves the public interest in two ways. It may deter others who might be tempted to try crime as seeming to offer easy money on the supposition, that if the offender is caught and brought to justice, the punishment will be negligible. Such a sentence may also deter the particular criminal from committing a crime again, or induce him to turn from a criminal to an honest life. The public interest is indeed served, and best served, if the offender is induced to turn from criminal ways to honest living. Our law does not, therefore, fix the sentence for a particular crime, but fixes a maximum sentence and leaves it to the court to decide what is, within the maximum, the appropriate sentence for each criminal in the particular circumstances of each case. Not only in regard to each crime, but in regard to each criminal, the court has the right and the duty to decide whether to be lenient or severe.”

6.2 Selanjutnya, mahkamah ini juga merujuk kepada dapatan Yang Arif Hakim Augustine Paul di dalam Tan Lay Chen V Public Prosecutor [2001] 1 MLJ 135; [2000] 4 CLJ 492, yang menyatakan seperti berikut: “The phrase 'pass sentence according to law' in the subsection means that the sentence imposed must not only be within the ambit of the punishable section but it must also be assessed and passed in accordance with established judicial principles (see Re Chang Cheng Hoe & Ors [1966] 2 MLJ 252; Public Prosecutor v Jafa bin Daud [1981] 1 MLJ 315; Philip Lau Chee Heng v Public Prosecutor [1988] 3 MLJ 107). The assessment of a sentence in accordance with judicial principles clearly contemplates, inter alia, a consideration of the mitigating circumstances in favour of the person to be sentenced. It is generally accepted that an accused person should be given credit or discount for pleading guilty (see Sau Soo Kim v Public Prosecutor [1975] 2 MLJ 134; Public Prosecutor v Sulaiman bin Ahmad [1993] 1 MLJ 74; Public Prosecutor v Ravindran & Ors [1993] 1 MLJ 45). However, this is not a strict rule as the court may, in the exercise of its discretion, refuse to grant any discount in an appropriate case (see Zaidon bin Shariff v Public Prosecutor [1996] MLJU 159; [1996] 4 CLJ 441; Lee Say & Ors v Public Prosecutor [1985] 2 CLJ 155). The severity of the offence committed may outweigh the mitigating effect of a guilty plea (see Loh Hock Seng v Public Prosecutor [1980] 2 MLJ 13, Public Prosecutor v Oo Leng Swee & Ors [1981] 1 MLJ 247). Where public interest demands a deterrent sentence in the circumstances of a particular case, then the effect of a guilty plea must also give way (see Sim Gek Yong v Public Prosecutor [1995] 1 SLR 537; R v Costen [1989] 11 Cr App R (S) 182). Thus, there can be no automatic rule that a guilty plea on its own entitles an accused to a lesser punishment (see Public Prosecutor v Govindnan a/l Chinden Nair [1998] 2 MLJ 181)”

6.3 Hukuman yang diputuskan oleh Mahkamah ini adalah suatu hukuman yang munasabah sebagai pengajaran kepada OKT secara khusus supaya tidak diulanginya lagi di masa hadapan dan juga suatu mesej kepada masyarakat secara umumnya agar tidak sewenangnya melibatkan diri dengan sebarang aktiviti berkaitan dadah berbahaya. Masyarakat perlu dilindungi dan aktiviti penagihan dadah ini perlu dibanteras dalam negara ini. Hukuman ringan dilihat tidak lagi relevan kepada OKT yang tidak langsung menunjukkan keinginan untuk berubah dan masih terus hanyut dengan gejala seperti ini. Mahkamah ini berharap dengan hukuman berbentuk pemenjaraan panjang dan sebatan ini akan dapat membantu OKT bermuhasabah serta berubah ke arah yang lebih baik lantas menjadi manusia yang lebih berguna kepada keluarga, bangsa, agama dan negara.

6.4 Mahkamah ini mengambil pendekatan dengan mengikuti prinsip yang telah diputuskan oleh YA Mokhtar Sidin HMR di dalam kes Tia Ah Leng V. Public Prosecutor [2004] 4 CLJ 77 di mana menyatakan: “[1] Although it is an accepted rule of practice that an accused person - who pleads guilty to an offence with which he has been charged - should be given a discount on the sentence that would otherwise have been imposed on him had he been convicted after a trial, yet there are important exceptions to this general rule. Indeed, the offences under the Dangerous Drugs Act 1952 are exceptions to this rule.”

7.1 OKT tidak diwakili peguam semasa pengakuan salah direkodkan. Mitigasi OKT menyatakan bahawa OKT mengaku salah dan memohon agar hukuman diringankan.

7.2 Pihak pendakwaan dalam hujahannya memohon agar hukuman setimpal ke atas OKT dikenakan.

7.3 Mahkamah ini telah menimbangkan rayuan mitigasi yang dikemukakan OKT dan pengakuan salah OKT di peringkat awal sebagai faktor mitigasinya. Mahkamah ini mengambilkira hujahan pihak pendakwaan serta rekod kesalahan lampau OKT yang mana 2 rekod lampau atas kesalahan yang sama menunjukkan tiada keinsafan dan perubahan OKT untuk menjauhi penyalahgunaan dadah. Oleh yang demikian itu, mahkamah ini perlu memberikan suatu bentuk hukuman yang diharapkan dapat mencegah kegiatan dan penglibatan OKT dalam kesalahan ini serta menjadi bentuk pengajaran kepada OKT serta masyarakat supaya menjauhkan diri dari penglibatan dengan dadah berbahaya.

8.1 Berdasarkan P6 (rekod kesalahan lampau OKT), OKT mempunyai 2 rekod kesalahan lampau atas kesalahan yang sama bermula pada tahun 2021 dan 2022 di Mahkamah Kuala Kubu Bharu. Ekshibit P6 telah memenuhi kehendak Seksyen 400(1)(a) Kanun Prosedur Jenayah (selepas ini dirujuk sebagai “KPJ”) iaitu telah menyatakan dengan jelas maklumat berikut:
a
identiti Perayu;
b
seksyen-seksyen dan pertuduhan;
c
hukuman yang dijatuhkan;
d
tarikh hukuman; dan
e
perakuan dari Penolong Pendaftar Penjenayah (P6).

8.2 Peruntukkan Seksyen 400 KPJ menyatakan yang berikut: "Section 400. How previous conviction or acquittal may be proved.

In any inquiry, trial or other proceeding under this Code a previous conviction or acquittal or an order directing any person to be under the supervision of the police may be proved in addition to any other mode provided by any law for the time being in force -
a
by an extract certified under the hand of the officer having the custody of the records of the Court whether of Malaysia or the Republic of Singapore in which that conviction or acquittal was had to be a copy of the sentence or order; or
b
in case of a conviction either by a certificate signed by the officer in charge of the prison in Malaysia or the Republic of Singapore in which the punishment or any part of it was inflicted, or by production of the warrant of commitment under which the punishment was suffered, together with, in each of those cases, evidence as to the identity of the accused person with the person so convicted or acquitted."

8.3 Oleh itu, P6 adalah rekod kesalahan lampau OKT yang lengkap dan boleh diterima oleh Mahkamah ini selaras dengan seksyen 40 KPJ. Dari rekod lampau tersebut, OKT masih melakukan kesalahan yang sama dan tidak menunjukkan inisiatif untuk menghindari kegiatan dadah ini. P6 menunjukkan hukuman pemenjaraan ke atas OKT dalam tempoh singkat itu tidak memberikan kesan untuk OKT berubah ke arah yang lebih baik. Oleh itu, mahkamah ini berpandangan OKT ini sesuai dihukum dengan pemenjaraan yang panjang untuk mencegahnya dari terlibat lagi dengan kegiatan penagihan dadah ini. Rekod lampau dalam P6 bukan sahaja menunjukkan kesalahan di bawah seksyen 15(1)(a) ADB malah juga OKT telah disabitkan atas kesalahan memiliki dadah di bawah seksyen 12(2) ADB pada tahun 2013, 2021 dan 2022.

8.4 Mahkamah Rayuan di dalam Adam Atan v. Public Prosecutor [2009] 1 CLJ 93 memutuskan seperti berikut: “There is no gain say that drug offenders are a menace to society. They are nothing less than serpents on the front lawn of justice and should be dealt with accordingly. Every day we read in the newspapers about the efforts of the law enforcement agencies in seizing large quantities of dangerous drugs and of the deleterious nature of these drugs which is visited upon members of our society, in particular our youth. The courts will be failing in their duty if they do not take a serious view towards the offences of this nature. The sentence imposed must not only be commensurate with the offence in this case but must also stop would be offenders dead in their tracks from committing it."

8.5 Selanjutnya, Mahkamah ini merujuk kepada kes Sabri bin Jaafar V. Public Prosecutor [2017] MLJU 751 yang menyatakan seperti berikut: “The Appellant is a repeated offender at close intervals. He had served 8 months’ imprisonment in 2010 followed by another 5 months’ imprisonment in 2013 and followed by another 7 months’ imprisonment in 2015 in similar s. 12(3) offence as well as s. 15(1)(a) offence under the Dangerous Drugs Act 1952. He had also in 2009 served sentence for another offence under s. 15(1)(a) of the Dangerous Drugs Act 1952. The drugs involved were hard drugs comprising of heroin and morphine. The Appellant is therefore a habitual offender contrary to that of a remorseful and rehabilitated person as suggested by his counsel. In the circumstances, it is definitely desirable that the Appellant must be sentenced to imprisonment for such a term that commensurate with the gravity of the offence as well as repeated previous occurrences.”

9.1 Kesalahan berkaitan dengan dadah di bawah Akta Dadah Berbahaya adalah suatu kesalahan jenayah serius. Penyalahgunaan dadah bukan sekadar boleh mengancam keselamatan OKT dan keluarganya malah ianya juga boleh mengancam masayarakat di negara ini.

9.2 Kerajaan Malaysia telah beberapa kali meminda hukuman kesalahan berkaitan aktiviti penyalahgunaan dadah dengan meningkatkan hukuman kesalahan bagi tujuan membendung masalah penyalahgunaan dadah, namun permasalahan ini sehingga kini masih berleluasa dan sukar dibendung. Oleh itu, mahkamah ini berperanan untuk memberikan pengajaran yang munasabah kepada pesalah penyalahgunaan dadah ini. Mahkamah ini merujukan kepada nas undang-undang dari penghakiman Augustine Paul HMT (kemudiannya HMP) dalam kes PP V. Amir Hamzah Amir Mydin [2003] 1 LNS 736 yang mana diputuskan: "Keseriusan kesalahan berkenaan dadah perlulah dizahirkan dalam hukuman yang dijatuhkan supaya ianya menjadi satu petunjuk yang jelas kepada semua anggota masyarakat tentang betapa seriusnya kesalahan jenis ini di mata undang-undang. Hukuman yang bersifat pencegahan juga memenuhi hasrat penggubal undang-undang yang telah mengkaji semula dan menaikkan hukuman bagi kesalahan-kesalahan di bawah Akta tersebut beberapa kali dalam usaha mengekang merebaknya kesalahan yang melibatkan najis dadah.”

9.3 Mahkamah ini merujuk Pendakwa Raya V. Abdul Halim Ishak & Satu Lagi [2013] 9 CLJ 559, di mana Mahkamah Rayuan telah menekankan mengenai kesalahan berkaitan dadah berbahaya seperti berikut: “[21] Tidak dapat dipertikaikan bahawa kesalahan yang berkaitan dengan dadah adalah merupakan satu kesalahan yang serius yang boleh mengancam keselamatan dan ketenteraman negara serta kesihatan umum. Dadah telah diisytiharkan sebagai musuh nombor satu negara oleh Kerajaan pada tahun 1983. Justeru, jika Mahkamah menjatuhkan hukuman yang ringan kepada satu kesalahan yang ditetapkan melalui Parlimen sebagai serius, sudah tentu perlindungan sewajarnya tidak dapat diberikan kepada orang ramai. Dalam kes Yusmarin Samsudin v. PP (supra) mahkamah menegaskan: “The severity of sentence can only be to reflect Parliament's intention that conviction for being in possession of a large amount of any form of prohibited drugs must commensurate with the sentence to be passed on the peculiar facts of each case. [Penekanan ditambah]”

9.4 Mahkamah ini juga mengambil kira prinsip penghukuman dalam kes Letitia Bosman V Public Prosecutor & Other Appeals (No.1) [2020] 5 MLJ 277, [2020] 8 CLJ 147 yang menyatakan seperti berikut: "[124]... Generally, the law does not fix a mandatory sentence for a certain offence. A maximum sentence is prescribed for the offence and the court is left to decide the appropriate sentence within the ambit of the punishment provision. In such a case, the accused will then make a plea of mitigation, which is a submission to move the court to pass a lenient sentence. It bears noting that under the scheme of Chapter XX of the CPC that governs the procedure of criminal trials in the High Court, there is no statutory requirement for mitigating factors to be considered by the court before it passes sentence according to law. Although there is no provision in the CPC for a plea in mitigation in High Court trials, nevertheless as a matter of fact, in practice it is quite common to allow a plea in mitigation before the court imposes sentence. After the accused has submitted the mitigation plea, the prosecution will submit the aggravating factors for the purpose of pressing for a heavy sentence. [125] In passing sentence, the court takes into consideration the mitigating and aggravating factors in order to ensure that the sentence is in accordance with the law. Passing a sentence according to law means the sentence imposed must not only be within the ambit of the sentence period stipulated but also assessed and passed according to established judicial principles (see Jafa bin Daud at p 316 of the judgment of Mohamed Azmi J)."

9.5 Mahkamah Agung, di dalam kes Mohamed Abdullah Ang Swee Kang V PP [1988] 1 MLJ 167, telah memutuskan yang berikut: "In assessing the length of custodial sentence, the court must look at the overall picture in perspective by considering, firstly, the gravity of the type of offence committed; secondly, the facts in the commission of the offence; thirdly, the presence or absence of mitigating factors, and, fourthly, the sentences that have been imposed in the past for similar offences to determine the trend of sentencing policy, if any. The fact that a sentence of imprisonment is imposed as a deterrence does not justify the sentencer in passing a sentence of greater length than what the facts of the offence warrant. The gravity of the type of offence involved must be considered in the light of the particular facts of the offence.”

10.1 Mengambil kira faktor-faktor yang telah dinyatakan di atas, hukuman yang telah diputuskan oleh Mahkamah ini ke atas OKT adalah selari dengan peruntukkan undang-undang serta setimpal atas kesalahan yang telah dilakukannya. Hukuman tersebut adalah suatu bentuk pengajaran agar OKT tidak sewenangnya melakukan kesalahan yang sama pada masa akan datang. Disamping itu juga, bentuk hukuman seumpama ini memberikan gambaran bahawa Mahkamah ini memandang berat dan serius atas semua kesalahan jenayah yang patut dijauhi oleh masyarakat secara umum dan khasnya kepada OKT sendiri.

10.2 Mahkamah ini telah menimbangkan mitigasi OKT, hujahan ringkas pihak pendakwaan dan faktor kepentingan awam yang mahsyur yang perlu diambil kira Mahkamah dalam menjatuhkan hukuman bagi sesuatu kes. Walaubagaimanapun, ini tidak bermakna Mahkamah terus mengabaikan kepentingan OKT. Kaedah yang wajar digunakan Mahkamah adalah membuat imbangan di antara kepentingan awam dan kepentingan OKT dalam menentukan hukuman yang berpatutan. Rujukan selanjutnya di dalam PP v. Md Rashid Harun [2000] 3 CLJ 832 yang menggariskan seperti berikut: “Courts are duty bound to consider all these matters before deciding upon a suitable sentence” …The sentence must be one appropriate to the gravity of the offence… Accordingly, the sentence should reflect the seriousness of the offence… Mitigating factors are not to be disregarded, even if the offence calls for a deterrent sentence… That is not to say though, that “the circumstances of the individual offender are more important than the protection of innocent members of the community from injury to their persons, or from risk even to their lives”. Public interest must not be relegated to the background. “The correct approach is to strike a balance, so far as possible, between the interest of the public and the interest of the accused.”

10.3 Oleh itu, atas imbangan dan pertimbangan faktor-faktor yang dinyatakan di atas, keputusan Mahkamah ini yang memutuskan OKT dihukum penjara 6 tahun 6 bulan dari tarikh tangkap, 3 sebatan rotan dan perintah pengawasan selama 3 tahun adalah munasabah, setimpal, wajar dan selari dengan peruntukkan undang-undang. …………..
