SUBRAMANIAM A/L DORAISAMY RAVISAMY A/L SINNASAMY … PENGADU-PENGADU Dan OFFIMO MARKETING SDN BHD … DEFENDAN) ALASAN PENGHAKIMAN Pengenalan [1] Ini adalah permohonan Perayu-Perayu untuk satu perlanjutan masa bagi kebenaran untuk memfailkan Rekod Rayuan di luar tempoh masa ekoran daripada keputusan yang dibuat oleh Ketua Pengarah Buruh. Pihak Perayu telah menjelaskan faktor-faktor kelewatan pemfailan Rekod Rayuan tersebut yang antara lainnya ialah kegagalan pihak Pejabat Buruh untuk mengemukakan dokumen-dokumen prosiding bagi mengemukakan Memorandum Rayuan dan juga Rekod Rayuan yang sepatutnya. [2] Sebaliknya pihak Responden membantah kepada permohonan ini dan menyatakan bahawa alasan yang diberikan oleh pihak Perayu adalah tidak mewajarkan untuk Mahkamah ini menggunakan budi bicara bagi melanjutkan tempoh masa bagi memfailkan dokumen-dokumen tersebut. Ini ditambah dengan fakta bahawa pihak Perayu telah melantik peguam walaupun pada asalnya seperti yang dikatakan oleh peguam Perayu semasa prosiding di Pejabat Tenaga Kerja didapati bahawa pihak Perayu tidak diwakili oleh peguam tetapi diwakili oleh pegawai daripada MTUC bagi mewakili pihak Perayu. Walau bagaimanapun semenjak daripada Notis Rayuan difailkan ke Mahkamah Tinggi adalah didapati bahawa pihak Perayu telah diwakili oleh peguam. [3] Dalam kes ini Mahkamah mendapati bahawa dua isu utama yang perlu diputuskan oleh Mahkamah iaitu adakah alasan yang digunakan oleh pihak Perayu mewajarkan Mahkamah ini untuk menggunakan budi bicara untuk melanjutkan tempoh masa pemfailan Rekod Rayuan dan adakah wajar untuk Mahkamah menggunakan Aturan 1A Kaedah-kaedah Mahkamah (KKM) 2012 dalam kes ini. Adakah Alasan Yang Digunakan Oleh Perayu-Perayu Mewajarkan Mahkamah Menggunakan Budi Bicara [4] Dalam hal ini Mahkamah merujuk kepada Aturan 55 kaedah 5 (3) KKM 2012 yang menyatakan seperti berikut: “55 Rayuan kepada mahkamah tinggi daripada mahkamah rendah

Dalam satu bulan selepas pemfailan notis rayuan di bawah kaedah ini, perayu hendaklah memfailkan rekod rayuan di Mahkamah Tinggi dan menyampaikan kepada setiap responden suatu salinan rekod rayuan itu, dan rekod itu hendaklah mengandungi salinan-
a
permohonan bagi keputusan;
b
semua pliding yang difailkan;
c
semua afidavit yang difailkan sebagai menyokong atau menentang permohonan itu; dan
d
perintah atau draf perintah keputusan yang dirayu: Dengan syarat bahawa rekod rayuan itu tidaklah termasuk nota keterangan, alasan penghakiman atau apa-apa memorandum rayuan.” [5] Bidang kuasa Mahkamah untuk melanjutkan suatu tempoh masa adalah satu budi bicara. Ini dinyatakan oleh Mahkamah Rayuan dalam kes Yeo Yoo Teik v Jemaah Pengadilan Sewa, Pulau Pinang & Anor [1996] 2 MLJ 54 seperti berikut: “The granting or dismissal of an application for extension of time is very much a discretionary matter, but in this instance we were loathe to exercise our discretion in favour of the applicant, particularly as no reasonable and acceptable explanation had been given for the four weeks delay. The omission on the part of a solicitor to be vigilant can hardly be described as an acceptable explanation.” [6] Pemakaian yang ketat berkenaan dengan budi bicara tersebut dapat dilihat dalam keputusan Mahkamah Rayuan dalam kes Alloy Automotive Sdn Bhd v Enkei Automotive Co Ltd & Anor [1997] 3 MLJ 205 yang menyatakan seperti berikut: “Before us, Raja Aziz informed the court that the appellant was initially represented by Darshan Singh & Co, Advocates and Solicitors. The appellant in appealing against the High Court's order of 5 October 1994, had not filed their memorandum of appeal and appeal record. He cited the reason for not having done so was the mistake of the solicitors. Raja Aziz asked the court to scrutinize a few circumstances. He stressed that the conduct of the solicitors had caused his client great hardship. A search of the court records was made and the appellant found so many things amiss and after a notice to show cause why this appeal should not be struck out was issued, it was revealed that the record of appeal had not been filed. This court viewed that there was a blatant disregard by the appellant's solicitors of the court's procedure. It is also the view of this court that to a certain extent, the appellant could not escape and was partly to blame for the delay in the filing of the appeal record. The appellant, we feel, should have been more vigilant and alert as to the state of its pending matter. We feel the appellant should have the attentiveness to check on the action of the solicitors it employed and paid for. If the case was delayed, the appellant should have pursued the matter as a diligent litigant and even to the extent of firing its solicitors and changing to a new solicitor who could do a better job. After all, it was paying and had the right to call the tune. The appellant was the master and the solicitors were only its agent. We could not subscribe and sympathize with the appellant's counsel's submission that his client presumed everything was in order until the letter from the Court of Appeal dated 29 June 1995.” [7] Sementara itu dalam kes Mohd Amin Mohd Yusof [2000] 4 MLJ 4, Mahkamah Persekutuan telah memberikan perlanjutan masa dan memberikan alasan mengapakah memberikan pelanjutan masa kerana melihat kepada faktor-faktor dalam kes tersebut. [8] Pematuhan prosedur dalam undang-undang adalah suatu yang penting bagi pihak-pihak. Ini bagi menjadikan peraturan tersebut dapat dilaksanakan dengan sewajarnya. Ini dinyatakan oleh Majlis Privy dalam kes Ratnam v Cumarasamy & Anor [1965] 1 MLJ 228 seperti berikut: “The Rules of Court must prima facie be obeyed, and in order to justify a court in extending the time during which some step in procedure requires to be taken there must be some material upon which the court can exercise its discretion. If the law were otherwise, a party in breach would have an unqualified right to an extension of time which would defeat the purpose of the rules which is to provide a time table for the conduct of litigation. “ [9] Apa yang jelas daripada autoriti-autoriti di atas adalah penentuan sama ada kebenaran diberikan untuk memfailkan Rekod Rayuan lebih daripada tempoh masa yang ditetapkan adalah bergantung kepada penjelasan yang diberikan ke atas kelewatan tersebut, fakta-fakta yang dinyatakan dalam affidavit sokongan permohonan tersebut dan ia juga bergantung kepada tempoh masa kelewatan tersebut. Mahkamah telah meneliti affidavit-affidavit yang telah dikemukakan dan juga alasan-alasan yang dikemukakan. Alasan Permohonan [10] Penelitian kepada Affidavit Sokongan permohonan ini menunjukkan bahawa alasan permohonan ini yang disediakan oleh Encik Jayabalan a/l Pichai menyatakan bahawa pada pengurusan kes pertama di hadapan Timbalan Pendaftar apada 19.09.2022 Pejabat Tenaga Kerja Bentong masih dalam proses penyediaan nota keterangan dan alasan penghakiman. Adalah didapati juga bahawa notris rayuan kes ini difailkan pada 15.08.2022. Pihak Perayu menyatakan mereka menunggu maklum balas daripada Pejabat Tenaga Kerja Bentong berkenaan pembekalan dokumen-dokumen berkaitan bagi menyediakan Rekod Rayuan. Encik Jayabalan a/l Pichai menyatakan bahawa sehingga 08.11.2022 iaitu pada pengurusan kes yang kedua tiada sebarang dokumen yang dibekalkan kepada peguam beliau. [11] Sebaliknya Responden dalam Affidavit Jawapan yang difailkan oleh Encik Go Pui Ju, Perayu-Perayu hanya memfailkan notis permohonan untuk perlanjutan masa selepas bantahan awal dikemukakan oleh peguam Responden semasa pengurusan kes di Mahkamah pada 08.11.2022. [12] Apa yang jelas daripada fakta di dalam kes ini ialah Rekod Rayuan tidak difailkan dalam tempoh masa seperti yang ditetapkan di bawah Aturan 55 kaedah 5 (3) KKM 2012. Apakah alasan yang diberikan oleh Pemohon dalam kes ini adalah wajar? Adakah Perayu-Perayu perlu menunggu sehingga mereka dibekalkan dengan Rekod Rayuan daripada Pejabat Tenaga Kerja Bentong? [13] Kelewatan Perayu-Perayu memfailkan Rekod Rayuan dalam tempoh masa yang ditetapkan adalah suatu yang tidak sepatutnya berlaku. Ini adalah apabila sesuatu rayuan telah difailkan pihak yang ingin memfailkan rayuan sepatutnya mengetahui bahawa mereka hendaklah memfailkan dokumen-dokumen yang dikehendaki termasuklah Rekod Rayuan dalam tempoh masa 30 hari seperti yang ditetapkan. Dalam kes ini ditambah pula Perayu-Perayu telah diwakili peguam. Oleh itu Rekod Rayuan sewajarnya difailkan dalam tempoh tersebut walaupun masih belum memperolehi nota keterangan dan alasan penghakiman. Ini adalah disebabkan Aturan 55 kaedah 4 KKM 2012 menyatakan bahawa ketiadaan nota keterangan dan alasan penghakiman tidak menghalang pemfailan Rekod Rayuan. Ia dinyatakan seperti berikut: “Dengan syarat bahawa rekod rayuan hendaklah difailkan walaupun nota keterangan dan/atau alasan penghakiman belum disediakan atau keputusan, perintah atau penghakiman yang telah dimeterai itu belum lagi diambil.” [14] Oleh itu Mahkamah berpendapat tiada alasan untuk Perayu-Perayu diberikan perlanjutan masa untuk memfailkan Rekod Rayuan melebihi tempoh 30 hari seperti yang dinyatakan di bawah KKM 2012 tersebut. Ini bermakna ketidakpatuhan tersebut tidak sewajarnya dibenarkan oleh Mahkamah. Sekiranya terdapat kekeliruan atau masalah bagi memfailkan Rekod Rayuan dalam tempoh yang ditetapkan Perayu-Perayu boleh memohon perlanjutan masa dengan alasan-alasan yang boleh dipertimbangkan oleh Mahkamah. Pemakaian Aturan 55 atau Aturan 55A KKM 2012 [15] Walau bagaimanapun dalam kes ini Mahkamah juga perlu mengambil perhatian ini adalah satu kes daripada Pejabat Tenaga Kerja yang mana ia melibatkan tuntutan yang berkaitan dengan tindakan pemberhentian ataupun melibatkan pekerjaan daripada Perayu-Perayu yang mana didapati bahawa Perayu-Perayu tidak berpuas hati dalam kes ini. Ini bermakna sekiranya tidak dibenarkan permohonan ini ia akan menjejaskan pihak Perayu untuk meneruskan pendengaran kes ini di hadapan Mahkamah ini. Adakah alasan sedemikian boleh mewajarkan Mahkamah ini mengenepikan ketidakpatuhan KKM 2012. [16] Malahan jika diteliti kepada KKM 2012 telah dipertuntukkan secara jelas prosedur untuk rayuan ke Mahkamah Tinggi daripada mana-mana undang-undang bertulis. Dalam konteks ini Akta Kerja 1955 yang terikat dengan Aturan 55A KKM 2012. Aturan 55A KKM 2012 menyatakan seperti berikut: “55A Rayuan kepada mahkamah tinggi di bawah undang-undang bertulis

Jika di bawah mana-mana undang-undang bertulis suatu rayuan dibuat daripada apa-apa keputusan mana-mana orang atau kumpulan orang kepada Mahkamah Tinggi rayuan itu hendaklah dibuat ke Mahkamah Tinggi di Negeri yang keputusan itu diberikan melalui saman pemula yang menyatakan alasan rayuan dan disokong dengan suatu afidavit, dan sekiranya Mahkamah mengarahkan sedemikian pada pendengaran rayuan itu, melalui keterangan lisan.

Perayu hendaklah melampirkan dokumen yang berikut sebagai ekshibit kepada afidavit yang difailkan bagi menyokong saman pemula atau apa-apa afidavit lanjut sebagaimana yang boleh difailkan dalam prosiding rayuan itu:
a
nota keterangan, sekiranya ada, yang direkodkan secara keseluruhannya atau sebahagiannya melalui cara mekanikal;
b
alasan penghakiman, sekiranya ada;
c
keputusan badan berkanun, sekiranya ada; dan
d
semua ekshibit dokumentar dan dokumen lain yang pihak-pihak hendaklah menimbangkan relevan bagi maksud rayuan: Dengan syarat bahawa saman pemula hendaklah difailkan walaupun alasan keputusan belum didapati atau belum disediakan. Sekiranya alasan keputusan sudah boleh didapati, maka ia hendaklah difailkan dengan cara afidavit lanjutan tanpa kebenaran Mahkamah Tinggi.

Melainkan jika diperuntukkan selainnya oleh mana-mana undang-undang bertulis, rayuan itu hendaklah difailkan dengan cara yang ditetapkan dalam perenggan (2) dalam satu bulan dari tarikh yang keputusan itu diberikan atau tarikh yang keputusan itu telah dimaklumkan kepada orang yang merayu, mengikut mana-mana tarikh yang terkemudian.

Melainkan jika diperuntukkan selainnya oleh mana-mana undang-undang bertulis, saman pemula itu hendaklah disampaikan dalam masa yang dihadkan untuk memfailkan rayuan kepada responden dalam rayuan itu atau jika responden merupakan suatu kumpulan orang, kepada setiausaha, pendaftar atau mana-mana pegawai lain kumpulan orang itu.” [17] Seksyen 77 Akta Kerja 1955 telah memperihalkan bagaimana rayuan boleh dikemukakan daripada keputusan Ketua Pengarah Buruh. Ia menyatakan seperti berikut: “77 Appeal against Director General’s order to High Court

Subject to any rules made under section 4 of the Subordinate Court Rules Act 1955, the procedure in an appeal to the High Court shall be the procedure in a civil appeal from a Sessions Court with such modifications as the circumstances may require.” [18] Pemakaian seksyen 77 Akta Kerja 1955 ini telah dinyatakan oleh Mahkamah Agong dalam kes Syarikat Maltaco Sdn. Bhd. v. Eow Teh Yu & Ors. [1985] CLJ Rep 307 seperti berikut: “For convenience the provisions of the law on procedure of appeal applicable on the date of the decision of the Assistant Director of Labour, Port Klang in this case are reproduced below: Section 77 of the Employment Act 1955 (Revised 1981) provides as follows: 77(1) If any person whose financial interests are affected is dissatisfied with the decision or order of the Director General under s. 69 or s. 73 such person may appeal to the High Court.

Subject to any rules made under s. 4 of the Subordinate Courts Rules Act 1955, the procedure in an appeal to the High Court shall be the procedure in a civil appeal from a Sessions Court with such modifications as the circumstances may require. Section 4 of the Subordinate Courts Rules Act 1955 (Revised 1971) provides as follows:

for regulating and prescribing the procedure in proceedings by way of appeal from a Subordinate Court to the High Court, the time within which any such appeal may be brought, and the procedure in connection with the transfer of proceedings from any Subordinate Court to the High Court or from the High Court to a Subordinate Court. On 1 April 1981 the Subordinate Courts Rules 1950 was repealed and replaced by the .Subordinate Courts Rules 1980 Order 49 r.

of the 1980 Rules like the 1950 Rules also provides that the notice of appeal shall be filed within 14 days from the date on which the decision was pronounced:

2.(3) The notice of appeal shall be filed within 14 days from the day on which the decision was pronounced. The Court appealed from shall thereupon supply to the appellant, upon payment of the fee therefor, a certified copy of the judgment, or in case no written judgment has been delivered, of the grounds of decision." Order 55 r. 13(1) and (2) of the High Court Rules 1980 provides as follows:

(1) Where under any written law an appeal lies from any decision of any person or body of persons to the High Court such appeal shall be made to the High Court in the State where the decision was given by motion setting out the grounds of appeal, supported by affidavit and, if the Court so directs at the hearing, by oral evidence.

Unless otherwise provided by any written law, such appeal shall be made within one month from the date on which the decision was given or the date on which such decision was notified to the person appealing, whichever is the later date.” Mahkamah Agong menyatakan seperti berikut: “We are therefore satisfied that it is clearly the intention of the Legislature that the procedure of appeal against the decision of the Director General under s. 69 of the Act shall be the procedure in a civil appeal from the Sessions Court as provided by O. 49 r. 2 of the Subordinate Courts Rules 1980 and not O. 55 r. 13 of the High Court Rules 1980.” [19] Sebelum daripada itu dalam kes Abaco Estate v. Selvarajah Thamboo [1985] CLJ Rep 362 dinyatakan seperti berikut: “The question is whether there is written law which provides otherwise. The answer is that there is such written law. It has been shown above that by virtue ofs. 77 (2) of the Employment Act the Subordinate Court Rules 1980 apply to the present case. Under O. 49 r. 2 (3) of those Rules notice of appeal must be filed within 14 days from the day on which the decision was pronounced. Thus the said O. 49 r. 2 (3) is a written law which is referred to in O. r. 13 (2) of the Rules of the High Court 1980 as written law which "otherwise provides".” [20] Apa yang menarik dalam kes Syarikat Maltaco Sdn. Bhd. v. Eow Teh Yu & Ors. (supra) dan Abaco Estate v. Selvarajah Thamboo (supra) dibuat dalam konteks Kaedah-kaedah Mahkamah Tinggi 1980 dan Kaedah-kaedah Mahkamah Rendah 1980 yang tidak lagi berkuatkuasa selepas daripada pengenalan KKM 2012. Jika diteliti kepada Kaedah-Kaedah Mahkamah Rendah 1980 terdapat peruntukan yang khusus berkenaan dengan rayuan iaitu di dalam Aturan 49, khususnya berkenaan dengan pemfailan notis rayuan. “49 APPEALS TO HIGH COURT Rule 1. Definitions. (O. 49 r. 1) In this Order "decision" includes "judgment", "order" and "decree" Rule 2. Notice of appeal. (O. 49 r. 2)

Appeals to the High Court shall be brought by giving notice of appeal in Form 140. A copy of such notice of appeal with the date filed endorsed thereon shall be sent by the Registrar to the Registrar of the High Court.

An appellant may appeal from the whole or any part of a decision and the notice of appeal shall state whether the whole or part only, and what part, of the decision is complained of.

The notice of appeal shall be filed within 14 days from the day on which the decision was pronounced. The Court appealed from shall thereupon supply to the appellant, upon payment of the fee therefor a certified copy of the notes of evidence, a certified copy of the judgment, or, in case no written judgment has been delivered, of the grounds of decision.

As soon as the certified copy is ready, the Court shall notify the appellant in Form 141.

Within 14 days from the receipt of the notification, the appellant shall, unless the Court for sufficient cause otherwise orders-
a
deposit in the Court appealed from a sum which in the opinion of the Registrar will cover the costs of preparing a sufficient number of copies of the appeal record for the use of the High Court and the parties to the appeal; and
b
lodge in the Court appealed from a sum of two hundred and fifty ringgit, or such lesser sum as the Court may in any case direct, by way of security for the costs of the appeal.

The notice of appeal shall be served by the appellant within the time limited for the filing of appeal on all parties directly affected by the appeal or their respective solicitors. It shall not be necessary to serve parties not so affected. Rule 3. Appeal record where the appellant is not represented or appeals as a poor person. (O. 49 r. 3)

When the appellant has complied with the requirements of rule 2 of the Order, and the appellant is not represented by a solicitor of the High Court has allowed the appellant to appeal as a poor person, the Court appealed from shall prepare the requisite number of copies of the appeal record and the record shall contain copies of-
a
the relevant pleadings;
b
the notes of evidence in proceedings recorded wholly or partly by mechanical means;
c
the grounds of judgment, provided that the absence of the grounds of judgment shall not prevent the appellant from proceeding with his appeal;
d
the decision;
e
the notice of appeal;
f
all such documentary exhibits and other documents the parties shall consider relevant for the purposes of appeal.

As soon as the appeal record is ready the Court appealed from shall serve the appellant with a notice in Form 141.

If the appellant shall consider that any documentary exhibit used need not be included in the record he shall obtain the consent in writing of all parties to the appeal to the omission of the document from the record. The written consent shall be produced to the Registrar.

Upon request by the appellant and, if the deposit mentioned in paragraph (5) of rule 2 of this Order is insufficient, upon payment by the appellant of a further sum sufficient to defray the cost of preparing the appeal record the Registrar shall-
a
supply the appellant with a copy of the appeal record and sufficient additional copies for service on the respondent or respondents; and
b
forward to the appropriate Registrar of the High Court the remaining copies of the record, having endorsed on one of the copies the date of service of the notice mentioned in paragraph (2) of this rule. Rule 3A. Appeal record where appellant is represented. (O. r. 3A)

the notice of appeal;
f
all such documentary exhibits and other documents the parties shall consider relevant for the purposes of appeal.

Two copies of the appeal record shall be filed in the High Court within six weeks of the receipt of the notification from the Court appealed from that the certified copies of the notes of evidence and the grounds of judgment are ready.

The appellant shall within the period limited for the filing of the record serve a copy thereof on each party who has been served with the notice of appeal. Rule 4. Stay of execution pending appeal. (O. 49 r. 4) The filing of a notice of appeal shall not operate as a stay of execution, but the Court may on application and on sufficient cause being shown stay execution on such terms as it may think fit. Rule 5. Execution of judgment on appeal. (O. 49 r. 5) When either party has extracted the order of the High Court on any appeal and has produced the order to the Subordinate Court appealed from, the Subordinate Court shall execute the order in accordance with the provisions of these Orders and Rules. Rule 6. Appeal to Judge in Chambers of the High Court. (O. r. 6)

Notwithstanding anything contained in this Order, an appeal from any decision other than a decision made after trial by the Court shall lie to a Judge in Chambers of the High Court.

The appeal shall be brought by filing a notice of appeal in Form 140 in the registry of the relevant subordinate court, with a copy extended to the registry of the High Court, within 14 days from the date on which the decision was pronounced and serving a copy of the notice on every other party to the proceedings.

Within three weeks after the filing of the notice of appeal, the appellant shall file the record of appeal in the High Court, and the record shall contain copies of-
a
the application for the decision;
b
all pleadings filed;
c
all affidavits filed in support of or in opposition to the application; and
d
the order or draft order of the decision appealed from: Provided that the record of appeal shall not include the notes of evidence, the grounds of judgment or any memorandum of appeal.

At the hearing of the appeal fresh evidence shall not be admitted unless the Judge is satisfied that-
a
at the hearing in the subordinate court the new evidence was not available to the party seeking to use it, or that reasonable diligence would not have made it so available; and
b
the fresh evidence, if true, would have had or would have been likely to have a determining influence upon the decision of the subordinate court.

Except so far as the Court may otherwise direct, an appeal under this rule shall not operate as a stay of the proceedings in the subordinate court.” [21] Oleh itu di dalam kes ini pada hemat mahkamah, rayuan daripada keputusan Pengarah Buruh yang diperuntukkan rayuannya di bawah seksyen 77 Akta Kerja 1955 hendaklah dibuat di bawah Aturan 55A KKM 2012. Ini adalah disebabkan Aturan 55 KKM 2012 secara jelas menunjukkan ia adalah prosedur rayuan daripada Mahkamah Rendah. Mahkamah Rendah telah ditakrifkan di bawah Aturan 1 kaedah 4 KKM 2012 seperti berikut: "Mahkamah Rendah" mempunyai erti yang sama sebagaimana yang diberikan kepadanya di bawah Akta Mahkamah Kehakiman 1964” [22] Penelitian kepada KKM 2012 berkaitan dengan rayuan adalah didapati terdapat tiga jenis prosedur rayuan iaitu rayuan kepada Mahkamah Tinggi daripada Mahkamah Rendah (Aturan 55), rayuan kepada Mahkamah Tinggi di bawah undang-undang bertulis (Aturan 55A) dan rayuan daripada Pendaftar Mahkamah Tinggi kepada Hakim Dalam Kamar (Aturan 56). Oleh yang demikian adalah sewajarnya rayuan dikemukakan mengikut peruntukan atau aturan-aturan tersebut. [23] Ini adalah disebabkan semasa Kaedah-kaedah Mahkamah 1980 dan Kaedah-kaedah Mahkamah Tinggi 1980 tiada peruntukkan seperti Aturan 55A pada masa itu. Kini, terdapat Aturan 55A KKM 2012 yang perlu dilaksanakan dan dipatuhi. [24] Aturan 55A KKM 2012 telah memperkenalkan satu bentuk rayuan yang boleh dikemukakan melalui saman pemula seperti yang dinyatakan di Aturan 55A KKM 2012 tersebut dan tempoh rayuan adalah satu bulan dari tarikh keputusan seperti yang diperuntukkan di bawah Aturan 55A kaedah 2 (3) KKM 2012. Ia adalah berbeza dengan tempoh masa yang diberikan di bawah Aturan 55 KKM 2012 yang memperuntukkan seperti berikut: “2. Rayuan melalui pendengaran semula dengan notis (A. k. 2) Semua rayuan ke Mahkamah Tinggi hendaklah dengan cara pendengaran semula dan hendaklah dibawa dengan memberikan suatu notis rayuan dalam empat belas hari dari tarikh keputusan itu dirayu.” [25] Sementara tempoh masa rayuan daripada Pendaftar Mahkamah Tinggi kepada Hakim Dalam Kamar menyatakan: “56 Rayuan daripada pendaftar mahkamah tinggi kepada hakim dalam kamar

Melainkan jika Mahkamah merintahkan selainnya, notis itu hendaklah difailkan dalam empat belas hari selepas penghakiman, perintah atau keputusan yang dirayukan itu diberikan atau dibuat, dan hendaklah disampaikan tidak kurang daripada lima hari sebelum tarikh yang ditetapkan untuk pendengaran rayuan itu.” [26] Apa yang jelas ialah apabila rayuan kepada Mahkamah Tinggi di bawah undang-undang bertulis pihak Perayu tidak terikat untuk memfailkan Rekod Rayuan dan memorandum rayuan seperti rayuan di bawah Aturan 55 KKM 2012. Ini adalah merupakan kebijaksanaan Jawatankuasa Kaedah-kaedah Mahkamah bagi memudahkan rayuan daripada keputusan di bawah undang-undang bertulis dengan memudahkan dan memendekkan proses rayuan jika dibandingkan dengan rayuan daripada keputusan Mahkamah Rendah. Kesimpulan [27] Pada hemat Mahkamah apabila sesuatu kaedah memperuntukkan tempoh masa untuk sesuatu tindakan dilakukan ia sewajarnya dipatuhi. Ketidakpatuhan kepada masa tersebut adalah suatu pengecualian jika alasan kepada ketidakpatuhan itu adalah jelas di Mahkamah. Hal ini adalah penting bagi mengelakkan kecuaian dan pengabaian sesuatu pihak kepada tempoh masa akan menjadikan penetapan tempoh masa itu tidak bermakna. Ia akan menyebabkan ketidakadilan kepada pihak-pihak. Adalah penting untuk Mahkamah mempertimbangkan kelonggaran tempoh masa yang ditetapkan sekiranya ia sejajar dengan prinsip undang-undang dan keadilan. [28] Dalam kes ini mahkamah berpendapat bahawa alasan permohonan untuk melanjutkan tempoh memfailkan Rekod Rayuan yang dikemukakan oleh Perayu-Perayu adalah tidak mewajarkan tempoh untuk pemfailan Rekod Rayuan dilanjutkan. [29] Adakah Mahkamah ini wajar menggunakan Aturan 1A KKM 2012 yang didapati bahawa walaupun di dalam kes ini telah terdapat kelewatan adakah Mahkamah boleh tidak mempedulikan kelewatan tersebut dan menggunakan Aturan 1A KKM 2012 tersebut. Mahkamah berpendapat bahawa dalam kes ini tiada alasan yang wajar untuk menggunakan Aturan 1A KKM 2012 tersebut. [30] Oleh yang demikian Mahkamah berpendapat permohonan Perayu-Perayu adalah ditolak.
