Offences are of the same kind when they are punishable with the same amount of punishment under the same section of the Penal Code, or of any other law for the time being in force: Provided that, for the purpose of this section, an offence punishable under section 379, 380, 382, 392, 393, 394, 395, 396 or 397 of the Penal Code shall be deemed to be an offence of the same kind as an offence punishable under any other of the said sections, and that an offence punishable under any section of the Penal Code or of any other law for the time being in force shall be deemed to be an offence of the same kind as an attempt to commit such an offence, when such an attempt is an offence. Peguambela telah merujuk kepada kes Bunya Anak Jalong v PP [2015] 5 CLJ 893, ms 912, Mahkamah Rayuan dimana diputuskan seperti berikut: “44. ... Though the alleged incidents in this case, regardless the incidents were in different months, involve the same accused, same victim, same offence and same place, they involve separate offences of rape. That the charges involve the same witnesses and evidence, and time and expense would be saved by a trial of the four charges together, find no merit in the light of the specific provisions of s 164 that only three offences of the same kind committed within the space of 12 months may be charged and tried together, and s 165 that an accused may be charged and tried together for offences that arose from one series of acts committed by one person so connected together as to form the same transaction. We failed to see how four rapes, and over four separate months, can be seen as one transaction even if by the same accused upon the same victim and in the same place. Peguambela telah berhujah bahawa berdasarkan keterangan yang ada, s.164 dan s.165 Kanun Prosedur Jenayah tidak dapat memberi remedi kerana peruntukan kedua-dua seksyen ini juga telah dilanggar dan seperti yang diputuskan di dalam kes Bunya Anak Jalong (supra), kecacatan seperti ini tidak dapat diselamatkan oleh Sek. 422 Kanun Prosedur Jenayah. Mahkamah setuju dengan hujah pihak Pendakwaan bahawa isu di dalam kes Bunya Anak Jalong (supra) adalah merujuk kepada empat (4) pertuduhan yang berbeza yang dibicarakan bersama. Oleh itu Mahkamah memutuskan bahawa setiap pertuduhan perlu dibicarakan berasingan. Mahkamah berpendapat bahawa walaupun keterangan SP2 ialah bahawa beliau dirogol lebih daripada sepuluh (10) kali oleh OKT, namum, pihak Pendakwaan telah hanya mengemukakan satu pertuduhan terhadap OKT iaitu bagi kejadian pertama OKT dikatakan merogol SP2 iaitu diantara tahun 2019 hingga tahun 2020. SP2 juga telah memberi keterangan bahawa kejadian pertama tersebut berlaku pada tahun 2019. Mahkamah berpendapat bahawa pertuduhan tidak cacat dan tidak melanggar peruntukkan Sek. 163 dan 164 Kanun Tatacara Jenayah [30] Mahkamah merujuk kepada kes PP lwn. Muhammad Shan Abdullah [2020] CLJU 2067; [2020] 1 LNS 2067; [2020] MLJU 2260 di mana, Mahkamah Tinggi memutuskan seperti berikut: "[29] In Mohd Hanif Kassim v. Public Prosecutor & Anor Appeal [2015] 3 CLJ 984, Choo Kah Sing JC in a charge for rape held that in cases where the time, date or place does not constitute an essential ingredient of the offence, mere non-compliance with s. 153 of the CPC on the time, date or place will not vitiate the validity of the charge. As long as the general particulars of the time, date or place are stated in the charge and the exercise of an accused's fundamental right to defend his case is not prejudiced or derogated, the charge remains a valid charge. His Lordship Choo Kah Sing JC cited the Federal Court case of Law Kiat Liang v. PP [1965] CLJU 81; [1965] 1 LNS 81 which in turn referred to and adopted the following statement of Atkin J in the case of R v. Severo Dossi [1918] 13 Cr App R 158: "From time immemorial a date specified in an indictment has never been a material matter unless it is actually an essential part of the offence." [30] See also the provisions of sections 156 CPC reproduced below: "That no error in stating either the offence or the particulars required to be stated in the charge and no omission to state the offence or those particulars shall be regarded, at any stage of the case, as material unless the accused was in fact misled by that error or omission" and see also the Federal Court authority of Ho Ming Siang v. Public Prosecutor [1966] CLJU 68; [1966] 1 LNS 68. [31] That the Respondent was charged with a sexual offence is clear and in Mohd. Rusziani Mislan v. Public Prosecutor [2018] CLJU 119; [2018] 1 LNS 119 at paragraph [22], SM Komathy JC (now Judge) held and with which the Court agrees: "The appellant was not prejudiced by the failure of the prosecution to specify the date of the incident in the charge. The charge provided sufficient particulars for him to prepare his defence. In sexual offences the essential ingredients are the identity of the offender and the sexual act itself" [32] It is indisputable that the Respondent is facing a charge on a sexual offence against a child and, therefore, as pointed out by the prosecution, any defect in the Charge on date and time of the incident would not make it defective." Merujuk kepada kes di atas, adalah jelas bahawa tarikh, masa dan tempat kejadian tidak membentuk intipati pertuduhan dan oleh yang demikian, pertuduhan di dalam kes ini tidak cacat/ defektif. [31] Pihak Pembelaan telah membangkitkan isu bahawa pihak Pendakwaan tidak memanggil kakak ipar SP1 yang bernama Beh Yi Ming sebagai saksi. Mahkamah tidak setuju dengan pendapat pihak Pembelaan mengenai isu ini kerana penama bukan saksi mata dan beliau sebagai makcik kepada SP2 telah tanya SP2 mengenai kejadian yang telah berlaku. Samada beliau memberi keterangan atau tidak, tidak menjejaskan kes pihak Pendakwaan. [32] SP2 telah ditemubual oleh pihak polis melalui rakaman video dan transkrip dari rakaman tersebut juga telah disediakan. Peguambela juga telah membangkitkan isu bahawa transkrip rakaman temubual SP2 tidak ditender di Mahkamah. Peguambelah telah berhujah bahawa anggapan dibawah seksyen 114(g) Akta Keterangan 1950 terpakai. Pihak pendakwaan telah berhujah bahawa mereka tidak berhasrat untuk menggunakan transkrip tersebut kerana SP2 sendiri boleh memberi keterangan di Mahkamah secara jelas dan terperinci. Kes Mahkamah Tinggi Shah Alam, Ahmad Hafizal bin Darusalam lwn Pendakwa Raya [2019] MLJU 830 dirujuk dimana dinyatakan: [82] Mengenai rakaman CIC yang tidak dikemukakan oleh pihak pendakwaan, mahkamah ini bersetuju dengan dapatan hakim bicara yang memutuskan: “[107] Peguambela tertuduh membangkitkan isu bahawa pihak pendakwaan telah menyembunyikan rakaman CIC dengan tidak mengemukakan rakaman CIC kepada pihak pembelaan. [108] Mahkamah berpendapat walaupun rakaman CIC tidak diserahkan kepada pihak pembelaan, ianya tidak menjadikan kes pendakwaan menjadi fatal kerana pihak pembelaan tidak diprejudiskan di atas kegagalan pihak pendakwaan menyerahkan rakaman CIC kepada pihak pembelaan kerana mangsa dalam kes di hadapan mahkamah ini telah dipanggil untuk memberi keterangan secara lisan di mahkamah dan pihak pembelaan juga telah diberi peluang untuk menyoal balas mangsa”. Di dalam kes ini, rakaman CIC telah diserahkan kepada peguambela. Selain daripada itu, seperti yang diputuskan di dalam kes Ahmad Hafizal bin Darusalam (supra), kes pendakwaan tidak menjadi fatal kerana SP2 telah dipanggil ke Mahkamah untuk memberi keterangan. [33] Pihak pembelaan telah berhujah bahawa pihak Pendakwaan telah membangkitkan isu ‘previous bad character’ OKT apabila keterangan saksi-saksi pihak Pendakwaan menyatakan bahawa OKT telah merogol SP2 lebih daripada sepuluh (10) kali, merogol empat (4) kali seminggu dan menunjukkan gambar dan video lucah kepada SP2. Peguambela telah merujuk kepada seksyen 54 Akta Keterangan 1950 Sek.54 Akta Keterangan 1950 menyatakan:
