Jumary was clearly a material witness who could have shed light on the contemporaneous WhatsApp communications, including instances where the guards were questioned and reprimanded regarding their performance. Significantly, the Court notes that there was no contemporaneous rebuttal from the guards in response to those allegations in the WhatsApp messages. For example, see page 23 and 55 of the Notes of Proceeding: Page 23 My question is, so do you agree from the WhatsApp conversation, it shows that the guard wasn't in their patrolling station? Yes.
