Defendan 3 JUDGMENT Introduction [1] This judgment concerns two originating summonses that arose from an adjudication decision dated 20.7.2020 made under the Construction Industry Payment and Adjudication Act 2012 (“CIPAA”). [2] The first originating summons was filed on 18.8.2020 by P&A Management Sdn Bhd (”the plaintiff”) under section 28 of CIPAA for an order to enforce the adjudication decision against WSH Development Sdn Bhd (”the defendant”) as if it is a judgment or order of the High Court (“application to enforce the adjudication decision”). [3] The second originating summons was filed on 19.12.2020 by the defendant under section 15(b) of CIPAA for an order to set aside the adjudication decision on the ground that there has been a denial of natural justice (“application to set aside the adjudication decision”). 4 [4] On 19.4.2021 I dismissed the defendant’s originating summons to set aside the adjudication decision and allowed the plaintiff’s application to enforce the adjudication decision as a judgment of the High Court. This judgment contains the reasons for my decision. Background [5] On 8.3.2017, the defendant appointed the plaintiff as its main contractor in respect of a construction project. The project was to construct 16 units of warehouses cum offices. On 25.10.2019, the plaintiff commenced adjudication proceedings for the failure to make certain payments pursuant to an interim payment certificate. After the pleadings were exhausted the parties filed their respective written submissions as directed by the adjudicator. On 20.7.2020 the adjudicator awarded a sum of RM3,093,610.84, (“adjudication sum”) interest and costs against the defendant. [6] The defendant did not pay the adjudication sum within the 21 days stipulated in the adjudication decision. The refusal to pay resulted in the plaintiff filing the first origination summons which was followed four months later with the defendant filing 5 the second originating summons. I decided that the defendant’s originating summons to set aside the adjudication decision be determined first. Analysis and decision The application to set aside [7] The application to set aside was anchored on section 15(b) of CIPAA which allows the setting aside of an adjudication decision on the ground that there has been a denial of natural justice.
