Tertuduh di dalam kes ini telah dituduh dengan kesalahan mengedar dadah berbahaya iaitu Methamphetamine seberat 1,521.9gram dan Heroin dan Monoacetylmorphine seberat 36.5gram seperti berikut: Pertuduhan Pertama Bahawa kamu pada 22 April 2020, lebih kurang jam 4.30 petang, bertempat di hadapan Lorong Unta, Taman Berkeley, di dalam daerah Klang, di dalam Negeri Selangor Darul Ehsan telah didapati mengedar dadah berbahaya iaitu seberat bersih 1521.9gram Methamphetamine dan dengan 2 itu kamu telah melakukan suatu kesalahan di bawah Seksyen 39B(1) Akta Dadah Berbahaya 1952 yang boleh dihukum di bawah Seksyen 39B(2) Akta yang sama. Pertuduhan Kedua Bahawa kamu pada 22 April 2020, lebih kurang jam 4.30 petang, bertempat di hadapan Lorong Unta, Taman Berkeley, di dalam daerah Klang, di dalam Negeri Selangor Darul Ehsan telah didapati mengedar dadah berbahaya iaitu seberat bersih 36.5 gram Heroin dan Monoacetylmorphine (13.3 Heroin dan 23.2 Monoacetylmorphines) dan dengan itu kamu telah melakukan suatu kesalahan di bawah Seksyen 39B(1) Akta Dadah Berbahaya 1952 yang boleh dihukum di bawah Seksyen 39B(2) Akta yang sama.

Pertuduhan-pertuduhan tersebut dibacakan kepada tertuduh dan tertuduh faham pertuduhan-pertuduhan dan telah minta dibicarakan. Pihak Pendakwaan telah memanggil seramai 4 orang saksi untuk membuktikan kes mereka. SP1 – Konst RF208432 Amirul Asyraf bin Mohd Fisol – Jurustor SP2 – Encik Rahman bin Mamat – Ahli Kimia SP3 – Insp Mohd Rashshidy bin Ab Rahman – Pegawai Serbuan SP4 – Insp Shahril bin Salehuddin – Pegawai Penyiasat

Di akhir kes pendakwaan, Mahkamah memutuskan bahawa pihak Pendakwaan telah berjaya membuktikan satu kes prima facie bagi kedua-dua pertuduhan dan tertuduh dipanggil membela diri. Di akhir kes Pembelaan, Mahkamah memutuskan bahawa tertuduh gagal untuk menimbulkan keraguan yang munasabah terhadap 3 kes pendakwaan dan tertuduh disabitkan ke atas pertuduhan-pertuduhan yang dihadapi.

Tidak berpuas hati dengan keputusan tersebut, tertuduh telah memfailkan Rayuan terhadap sabitan dan hukuman tertuduh.

Ini merupakan alasan-alasan terhadap keputusan tersebut.

Pada 22 April 2020, jam lebih kurang 4.15 petang, Insp Mohd Rashshidy bin Ab Rahman (SP3) telah mengetuai sepasukan polis telah pergi ke Lorong Unta, Taman Berkeley, Klang, Selangor.

Lebih kurang 15 minit kemudian, SP3 nampak satu kereta jenis Honda Accord warna putih bernombor WB7202Y telah sampai di kawasan tersebut.

Kemudian, SP3 bersama pasukan serbuan telah menghampiri kereta tersebut dan SP3 telah memperkenalkan diri sebagai polis dengan menunjukkan kad kuasa kepada pemandu kereta tersebut. SP3 telah mengarahkan pemandu kereta tersebut iaitu tertuduh supaya keluar daripada kereta.

SP3 telah menjalankan pemeriksaan tubuh badan terhadap tertuduh, namun SP3 tidak menjumpai apa-apa barang yang menyalahi undang-undang. Kemudian SP3 telah membuat pemeriksaan di dalam kereta tersebut dan telah menjumpai satu beg kertas warna coklat bertulisan LEVI’S (P25) dan didalam beg 4 kertas tersebut terdapat satu bungkusan plastik pos laju (P26) yang mengandungi dua bungkusan tulisan cina bertulisan GUANYINWANG (P9) dan (P11) di mana setiap bungkusan mengandungi satu bungkusan plastik lutsinar (P10) dan (P12) yang berisi bahan disyaki dadah jenis syabu anggaran berat 2100 gram dan dua peket plastik lutsinar berisi bahan yang disyaki dadah jenis Heroin anggaran berat 726 gram. SP3 telah menjumpai beg kertas warna coklat tersebut di tempat letak kaki bahagian penumpang hadapan kereta tersebut.

SP3 telah merampas daripada tertuduh beg warna coklat (P25) tersebut bersama sebuah telefon bimbit jenama iPhone (P27) dan sebuah telefon bimbit jenama OPPO (P28) daripada tertuduh semasa kejadian. SP3 telah membawa tertuduh bersama barang-barang kes balik ke IPD Klang Utara, Pejabat Jabatan Siasatan Jenayah Narkotik.

Setelah SP3 sampai di pejabat JSJN, IPD Klang Utara bersama tertuduh dan barang-barang kes, SP3 telah membuat penimbangan dan membuat penandaan beliau sebelum menyerahkan tertuduh dan barang-barang kes kepada pegawai penyiasat (SP4) untuk tindakan lanjut.

Kemudian SP4 telah membuat penimbangan semula dan membuat penandaan beliau pada barang-barang kes. SP4 telah menyimpan barang-barang ke dalam almari besi di pejabatnya di mana kunci hanya dipegang oleh dirinya sahaja. Pada 13 Mei 2020, SP4 telah menghantar barang kes ke Jabatan Kimia untuk dianalisa. Hasil analisa dijalankan oleh Ahli Kimia (SP2) mendapati 5 bahawa barang kes yang dirampas disyaki dadah tersebut adalah dadah berbahaya jenis Methamphetamine seberat 1521.9gram dan dadah berbahaya jenis Heroin dan Monoacetylmorphine seberat 36.5gram.

Adalah menjadi undang-undang yang mantap beban pembuktian di akhir kes Pendakwaan adalah “prima facie” sepertimana diperuntukkan di bawah Seksyen 180(1) KTJ: “When the case for the prosecution is concluded, the Court shall consider whether the prosecution has made out a prima facie case against the Accused.”

Tahap prima facie telah diterangkan di dalam kes Mahkamah Persekutuan iaitu Balachandran v PP (2005) 1 CLJ 85 bahawa: “The test at the close of the prosecution would therefore be: is the evidence sufficient to convict the accused if he elects to remain silent? If the answer is in the affirmative then a prima facie case has been made out. This must, as of necessity, require a consideration of the existence of any reasonable doubt in the case for the prosecution. If there is any of such doubt there can be no prima facie. As the accused can be convicted on the prima facie evidence it must have reached a standard which is capable of supporting a conviction beyond reasonable doubt.”

Mahkamah ini juga merujuk kepada kes Mahkamah Persekutuan iaitu PP v Mohd Radzi bin Abu Bakar [2006] 1 CLJ 457 yang memutuskan seperti berikut: “(i) At the close of the prosecution’s case, subject the evidence led by the prosecution in its totality to a maximum evaluation. Carefully scrutinize the credibility of each of the prosecution’s witnesses. Take into account all reasonable inferences that may be drawn from that evidence. If the evidence admits of two or more inferences, then draw the inference that is most favourable to the accused;

(ii) ask yourself the question: If I now call upon the accused to make his defence and he elects to remain silent am I prepared to convict him on the evidence now before me? If the anwer to that question is “Yes”, then a prima facie case has been made out and the defence should be called. If the answer is “No” then, a prima facie case has not been made out and the accused should be acquitted;

(iii) after the defence is called, if the accused elects to remain silent, then convict;
IV
(iv) after defence is called, the accused elects to give evidence, then go through the steps laid out in Mat v. Public Prosecutor [1963] 1 LNS 82; [1963] MLJ 263.” [16] Berdasarkan kepada nas-nas undang-undang adalah menjadi tanggungjawab Hakim perbicaraan untuk menganalisa, menilai dan memberikan pertimbangan secara penilaian maksima terhadap kes pendakwaan dengan mengambilkira keterangan saksi-saksi pendakwaan, ekshibit-ekshibit yang dikemukakan dan soal balas yang diajukan oleh pihak pembelaan bersekali dengan hujahan kedua-dua pihak. Secara ringkasnya saya memperingati diri saya sendiri bahawa langkah-langkah yang telah diperincikan dalam kes PP v. Mohd Radzi Abu Bakar (supra) perlulah dipatuhi dengan ketat. Elemen Pertuduhan [17] Menurut Seksyen 39B(1)(a) Akta Dadah Berbahaya 1952; ‘No person shall, on his own behalf or on behalf of any other person, whether or not such person is in Malaysia, traffic in a dangerous drugs’ [18] Bagi membuktikan pertuduhan pengedaran dadah berbahaya di bawah Seksyen 39B(1) Akta Dadah Berbahaya (ADB) 1952, pihak Pendakwaan perlu membuktikan kesemua elemen/intipati seperti berikut: I. Dadah tersebut tersenarai di bawah ADB 1952 dan dengan berat seperti yang dinyatakan dalam pertuduhan; II. Dadah yang dirampas ada di dalam milikan tertuduh, iaitu tertuduh mempunyai jagaan dan kawalan ke atas dadah tersebut serta tertuduh mempunyai pengetahuan bahawa dadah tersebut adalah dadah berbahaya; dan III. Tertuduh telah mengedar dadah berbahaya tersebut.

Dadah tersebut tersenarai di bawah Akta Dadah Berbahaya 1952 dan dengan berat seperti yang dinyatakan di dalam pertuduhan [19] SP3 telah menjumpai dadah jenis Methamphetamine seberat 2100 gram dan dadah jenis Morphine dan Monoacetylmorphine seberat 726 gram di dalam beg kertas warna coklat bertulisan LEVIS dan beg kertas tersebut dijumpai di bahagian tempat letak kaki penumpang hadapan di mana kereta dipandu oleh tertuduh seorang sahaja. [20] Kesemua barang kes yang telah dirampas oleh SP3 telah dibuat tandaan secara tandatangan dan tarikh oleh SP3. Pegawai penyiasat (SP4) juga membuat tandaannya secara tandatangan ke atas barang kes yang diterima daripada SP3. Ahli kmia (SP2), SP3 dan SP4 telah camkan kesemua barang kes ini dengan tandaan masing-masing semasa perbicaraan. [21] Mahkamah mendapati bahawa dalam keadaan ini menunjukkan bahawa tidak terputusnya rantaian keterangan mengenai barang kes sebelum dihantar kepada SP2 malahan sehingga dikemukakan ke Mahkamah ini semasa perbicaraan. Mahkamah merujuk kepada kes Shahrizal Abdul Ghani v. PP [2014] 1 CLJ 70; [2014] 1 MLJ 70 yang menyatakan sedemikian: “The exhibit recovered or seized by the police was the same exhibit sent to and examined by the chemist and subsequently produced in the court as evidence. The prosecution had adduced sufficient evidence in respect of every link in the chain of custody, from the moment the exhibit was recovered by the police up to the time it was produced in the court. The witnesses had described how and from whom it was received, where it was and what happened to it while in the witnesses' custody, the condition in which it was received and the condition in which it was handed over to the next link in the chain of custody. (para 44)" [22] SP2 merupakan seorang ahli kimia yang masih di dalam perkhidmatan. Oleh itu, keterangan pakar kimia ini harus diterima oleh Mahkamah kerana ianya sempurna dan tiada kecacatan. SP2 merupakan seorang ahli kimia yang bertauliah dan menjelaskan secara terperinci analisa yang telah dijalankan olehnya. Rujukan adalah dibuat kepada kes Munusamy Vengadasalam v. PP [1987] CLJ Rep 221; [1987] 1 CLJ 250: “As a rule, a chemist in drug cases does not give any opinion as to ownership, control or possession of the substance sent for analysis, but he merely reports the result of the chemical examination of the substance. The only reason for sending the exhibits to the chemist is to determine its identity and to confirm what other witnesses have suspected. This type of opinion must in our view be distinguished from opinions which are of very technical or complicated nature, such as those given by handwriting, trade mark, copyright or ballistic experts. Without being derogatory it is common knowledge that even animals, such as snuff dogs when sufficiently trained, are able to detect certain dangerous drugs. We are therefore of the view, that in this type of cases where the opinion of the chemist is confined only to the elementary nature and identity of substance, the Court is entitled to accept the opinion of the expert at its face value, unless it is inherently incredible or the defence calls evidence in rebuttal by another expert to contradict the opinion". [23] Oleh itu, Mahkamah mendapati bahawa elemen pertama telah berjaya dibuktikan oleh pihak pendakwaan dan dadah-dadah yang dirampas oleh SP3 sebagaimana pertuduhan-pertuduhan adalah dadah-dadah sepertimana yang disenaraikan di dalam Seksyen 2 Akta Dadah Berbahaya 1952.

(ii) Dadah yang dirampas adalah berada di dalam milikan tertuduh, iaitu tertuduh mempunyai jagaan dan kawalan ke atas dadah tersebut serta tertuduh mempunyai pengetahuan bahawa dadah tersebut adalah dadah berbahaya. [24] Fakta kes menunjukkan elemen pemilikan ke atas dadah-dadah yang dijumpai telah dibuktikan oleh pihak pendakwaan ke atas tertuduh berdasarkan keterangan-keterangan berikut:
a
SP3 dan pasukannya telah sampai ke tempat kejadian sebelum ketibaan tertuduh.
b
SP3 nampak secara jelas kereta jenis Honda Accord bernombor pendaftaran WB7202Y sampai ke tempat kejadian.
c
SP3 telah meminta pemandu kereta Honda Accord tersebut keluar daripada kereta dan memperkenalkan diri sebagai pegawai polis.
d
SP3 telah mengesahkan identiti tertuduh adalah pemandu yang keluar daripada kenderaan tersebut.
e
SP3 mengesahkan bahawa pada waktu kejadian hanya tertuduh seorang sahaja yang berada dalam kereta Honda Accord tersebut.
f
Dadah-dadah yang dijumpai di dalam dua bungkusan teh cina GUANYINWANG (P9) dan (P11) yang dijumpai di dalam 1 bungkusan plastik pos laju (P26) yang dijumpai di dalam 1 beg kertas warna coklat (P25) berada di tempat letak kaki bahagian hadapan penumpang kereta tersebut yang mana tertuduh sahaja yang memandu ketika itu.

Tertuduh mempunyai jarak berdekatan (close proximity) dengan dadah yang dijumpai di dalam beg kertas warna coklat P25.

Isu berkenaan 'proximity' telah dirujuk di dalam kes Chong Thong v. PP [2012] 1 LNS 436 di mana Mahkamah Rayuan menyatakan: "The appellant was the only person in the Mercedes Benz motor car before he alighted from it and had its keys when he was arrested soon thereafter. The dangerous drugs were found in the boot of the Mercedes Benz motor car thus giving the appellant the requisite proximity to the dangerous drug to establish actual physical possession (See PP v. Karim Ab Jabar [2008] 5 CLJ 173).” (emphasis added) Mahkamah ini juga merujuk kepada kes Sazali Jemali v. PP [2013] 1 LNS 978, Mahkamah Rayuan juga menyatakan seperrti berikut: "In our judgment, on the factual matrix of the present case, the learned JC was entitled and correct in making such a finding. It is not disputed that the cannabis was found hidden under the driver's seat and in a box located near the handbrake. The offending exhibits were in a very close proximity to the appellant. The appellant was the driver of the car. No one else was with him at that time." [25] Daripada fakta-fakta kes yang dirujuk, 'proximity' tertuduh dengan dadah di dalam beg P25 adalah isu yang relevan untuk membuktikan jagaan dan kawalan secara fizikal. Pada ketika kejadian, tertuduh merupakan pemandu kereta Honda Accord yang mana beg P25 berada. Mahkamah mendapati bahawa keadaan 'proximity' ini menunjukkan tertuduh mempunyai jagaan dan kawalan ke atas dadah yang dijumpai di dalam beg P25 dan keadaan di mana tertuduh mempunyai kuasa untuk berurusan dengan beg P25 sebagai seorang pemilik sehingga mengenepikan orang lain dan jika terdapat keadaan yang memerlukan, tertuduh adalah berniat untuk berbuat demikian. Keterangan-keterangan ini turut menunjukkan bahawa tertuduh mempunyai jagaan dan kawalan ke atas beg P25. [26] Setelah jagaan dan kawalan berjaya dibuktikan oleh pihak pendakwaan terhadap tertuduh, Mahkamah ini menggunapakai anggapan di bawah Seksyen 37(d) Akta Dadah Berbahaya 1952 dan dengan itu pihak Pendakwaan telah berjaya membuktikan tertuduh mempunyai milikan ke atas dadah-dadah berbahaya yang dijumpai dalam beg P25 tersebut.

(iii) Tertuduh telah mengedarkan dadah tersebut [27] Bagi pertuduhan di bawah Seksyen 39B (1)(a) ADB 1952, pihak pendakwaan perlu membuktikan bahawa tertuduh telah mengedarkan dadah-dadah tersebut. Di dalam kes ini, pihak pendakwaan telah membuktikan keterangan yang menjurus kepada elemen pengedaran dadah seperti yang didefinisikan dibawah Seksyen 2 Akta Dadah Berbahaya 1952 yang mana definisi pengedaran dibawah Seksyen 2 Akta terjumlah juga kepada perbuatan "carrying, transporting'’ dadah-dadah tersebut. Mahkamah ini juga berpendapat dengan berat dadah Methamphetamine seberat 1,521.9gram dan dadah Heroin dan Monoacetylmorphine seberat 36.5gram adalah mustahil dadah-dadah tersebut adalah untuk kegunaan peribadi tertuduh kecuali melainkan ianya untuk tujuan pengedaran. [28] Mahkamah ini merujuk kepada kes Teh Geok Hock v. PP [1989] 1 CLJ Rep 160; [1989] 2 CLJ 977; [1989] 3 MLJ 162 yang menjelaskan maksud "pengedaran" seperti berikut: "True, the definition in the Act sounds artificial and not according to the ordinary meaning of the word 'trafficking' which is normally understood to mean to trade in, buy or sell, any commodity, albeit often with sinister implication. See also the Shorter Oxford English Dictionary. The definition of 'trafficking' in the Act is wide and includes not only buying and selling, but also carrying, concealing and keeping." [penekanan ditambah]. [29] Mahkamah ini setelah menilai keterangan yang dikemukakan di dalam kes ini dan mendapati tindakan tertuduh adalah tergolong di bawah takrifan "pengedaran" di bawah Seksyen 2 Akta Dadah Berbahaya 1952 bagi Methamphetamine, Heroin dan Monoacetylmorphine yang dinyatakan dalam pertuduhan-pertuduhan. Dengan merujuk kepada kes Mohamed Yazri Minhat v. PP [2003] 2 CLJ 65 di mana Gopal Sri Ram, Hakim Mahkamah Rayuan (ketika itu) telah menyatakan bahawa: "Proof of the purpose for which an act is done, where such purpose is a necessary ingredient of the offence with which an accused is charged, presents a problem with which criminal courts are very familiar. Generally, in the absence of an express admission by the accused, the purpose with which he did an act is a matter of inference from what he did. Thus, in the case of an accused caught in the act of conveying from one place to another controlled drugs in a quantity much larger than is likely to be needed for his own consumption the inference that he was transporting them for the purpose of trafficking in them would, in the absence of any plausible explanation by him, be irresistible - even if there were no statutory presumption such as is contained in section 15 of the Drugs Act. As a matter of common sense, the larger the quantity of drugs involved the stronger the inference that they were not intended for the personal consumption of the person carrying them, and the more convincing the evidence needed to rebut it..." [penekanan ditambah] Justeru, dengan jumlah dadah yang dijumpai, Mahkamah mendapati bahawa Methamphetamine berjumlah 1,521.9gram dan Heroin dan Monoacetylmorphine seberat 36.5gram tersebut bukanlah dibawa untuk kegunaan sendiri kerana tiada apa-apa keterangan yang menjuruskan kepada dadah-dadah tersebut adalah untuk kegunaan peribadi tertuduh. Isu-isu dibangkitkan Pembelaan di akhir kes Pendakwaan. [30] Pihak pembelaan telah membangkitkan beberapa isu di akhir kes pendakwaan iaitu:
a
Keterangan SP3 berkenaan maklumat yang diterima tidak boleh diterimapakai oleh Mahkamah;
b
Wujudnya keraguan material berkenaan dengan identiti dadah-dadah berbahaya yang dikaitkan dengan tertuduh;
c
Tertuduh tidak mempunyai milikan terhadap dadah-dadah berbahaya yang dijumpai oleh SP3;
d
Siasatan pegawai penyiasat SP4 adalah tidak menyeluruh dan tidak lengkap. [31] Adalah menjadi hujahan pembelaan bahawa SP3 telah menangkap tertuduh berdasarkan kepada suatu maklumat yang telah diterima yang tidak boleh diterimapakai dalam kes ini kerana ianya adalah bertentangan dengan Seksyen 40(1) Akta Dadah Berbahaya 1952 dan pihak pembelaan telah merujuk kepada keputusan Chan King Yu v Public Prosecutor [2009] 1 MLJ 457 dan Vijayaratnam v Public Prosecutor [1962] MLJ 106 untuk menyokong hujahannya. [32] Mahkamah ini melihat kepada maklumat yang diterima oleh SP3 tersebut adalah untuk membuktikan pertuduhan ataupun maklumat tersebut merupakan pendahuluan dalam naratif siasatan polis. Mahkamah ini merujuk kepada kes Majid Mohammadpour Mojtaba V. Public Prosecutor [2017] 1 LNS 263, YA Abdul Karim Jalil HMR (pada ketika itu) telah memutuskan seperti berikut: “[37] In considering this issue, we must not overlook the fact that in all those cases cited by learned counsel in support of the objection, the critical focus was on the reception or reliance of such evidence by the court to make certain findings of facts in establishing the elements of the charge. It cannot be gainsaid that if the purpose of adducing such evidence was to prove the truth of it, it would clearly become an inadmissible hearsay. This is consistent with the basic principle on the barring of hearsay evidence-See Leong Hong Khie v. Public Prosecutor And Tan Gong Wai v. Public Prosecutor [1984] 1 LNS 172; and, Subramaniam v. Public Prosecutor [1956] 1 LNS 115. This type of evidence, however, is admissible if such evidence was adduced not as a basis to establish a primary fact as alluded above, but rather merely as an information per se received by the police viz. as an introductory narrative of police's action or investigation. In other word, it is introduced for a non-hearsay purpose, i.e for the purpose other than to establish the truth of the matter asserted. It is in this perspective that the judgment of his Lordship Ahmad Maarop JCA (as he then was) in the Yusri's case, (supra), and his Lordship Abdul Aziz Mohamad FCJ (dissenting) and Zulkefli Makinudin FCJ (majority) in Chan King Yu's case, (supra), should be viewed. [38] Now, in the present case the prosecution had disclosed the said information as part of the introductory narrative of police investigation and nothing more. After reading the learned trial judge's ground of judgment, we cannot agree with learned counsel's submission that the learned judge did admit and rely on the information to arrive at his findings. We observed that the learned judge did not anywhere mention about the reception or admission of that impugned information, or if mentioned, relying upon it as his evidentiary basis, as direct or circumstantial evidence, in coming to his primary fact findings as to the elements of the charge. The learned trial judge must have been aware of the aforementioned cases. More so, we found that there was nothing in his judgment for us to infer that he must have been swayed or influenced by such evidence. In the present context, there is no issue of prejudice to the appellant. However, it would be a serious misdirection or flaw in the learned judge's judgment if he had relied upon such evidence, either directly or indirectly, as in the Chan King Yu's case, which was clearly distinguishable from our present case. It is our considered view that the ratiocination in Yusri's case on this issue was applicable and should be the correct stance to take. We also found that the learned judge had evaluated the case objectively and had rightly relied on admissible evidence to arrive at his findings. Even aliunde, there were overwhelming evidence to support his findings. Thus, we did not find any merit in the learned counsel's argument on this issue.” [33] Mahkamah ini mendapati bahawa maklumat yang diterima oleh SP3 adalah satu permulaan kepada naratif siasatan polis dan bukan keterangan yang membuktikan fakta utama (primary facts) bagi pertuduhan-pertuduhan yang dihadapi oleh tertuduh di dalam kes ini. [34] Pihak pembelaan juga berhujah bahawa terdapat keraguan material berkenaan identiti dadah-dadah berbahaya yang dijumpai oleh SP3, di mana terdapat perbezaan yang ketara di antara timbangan antara Ahli Kimia (SP2), Pegawai Serbuan (SP3) dan Pegawai Penyiasat (SP4). Adalah hujahan pembelaan bahawa berat yang timbang oleh SP3 dan SP4 adalah 2,100gram bagi Methamphetamine dan 726 gram bagi Heroin dan Monoacetylmorphines. Manakala SP2 telah menimbang dan hasil analisa adalah berat bersih barang bagi Methamphetamine adalah 2108,9gram dan berat bersih barang bagi Heroin dan Monoacetylmorphine adalah 905.2gram. Oleh itu terdapat perbezaan 9.8gram bagi Methamphetamine dan 179.2gram bagi Heroin dan Monoacetylmorphine. [35] Mahkamah ini merujuk kepada kes Lew Wai Loon v. Pubic Prosecutor [2014] 2 CLJ 649 di mana adalah diputuskan seperti berikut: “The discrepancy in the weight of the drug alone should not ipso facto cast doubt on its identity. There are other primary factors to consider such as the facts and/or events that form the foundation for its admission as a piece of evidence. One fact and/or event to consider was whether there was any break in the handling or custody which tantamount to a break in the chain of evidence which, if occurred, should cast doubt in the exhibit as a reliable and trustworthy piece of evidence. [36] Mahkamah juga merujuk kepada kes Rita Krisdianti v. Public Prosecutor [2018] 1 LNS 421, di mana adalah diputuskan seperti berikut: "[49] The issue in relation to discrepancy in weight of the drugs has been discussed in a number of decisions by both the Court of Appeal and the Federal Court. Perhaps the most notable of the two decided by the apex court are Zaiful Bin Muhammad & Anor v. Public Prosecutor [2013] 2 CLJ 383 and Hasbala Mohd Sarong v. Public Prosecutor [2013] 6 CLJ 945. In Zaiful's case there were two unexplained discrepancies which were the number of slabs of cannabis recovered and two different accounts of the weight of the drugs. No explanation was proffered by the prosecution with regard to those discrepancies. The court held that these discrepancies were fatal to the prosecution case. In Hasbala Mohd Sarong, there was also present in evidence discrepancies as to the weight of the drugs recovered. The apex court this time held that difference in weight, on its own, is no sufficient ground to hold that there are doubts with regard to identity of the drugs in question. [50] Subsequently, in the case of the Lew Wai Loon v. Public Prosecutor [2014] 2 CLJ 649, the Federal Court held that discrepancy in weight alone is insufficient to dislodge the case for the prosecution. In so doing the court opined inter alia, that the obvious explanation for the discrepancies as to the weight of the drugs was due to the use of uncalibrated weighing machines used by the police compared with the weights as derived from the use of calibrated machines by the chemists. It was also held that this fact is something that can be inferred. The lack of challenge as to the chain of exhibits during the trial was also held that the decision in Zaiful's case was peculiar to its own facts and that Hasbala Mohd Sarong and Zaiful do not conflict with each other as the facts of both cases are distinguishable. Indeed in the Court of Appeal case of Natcha Dabkaew v. PP [Court of Appeal Criminal Appeal No. K- 05-117-07-2012] took the view that both Zaiful's case and Hasbala Mohd Sarong's case were good authorities and were decided based on their own facts.” [37] Berdasarkan kepada nas-nas undang, Mahkamah ini berpendapat bahawa perbezaan penimbangan berat oleh SP2 dan SP3 adalah tidak cukup untuk menimbulkan keraguan dalam identiti dadah-dadah yang dijumpai. Mahkamah mendapati bahawa tidak terputus rantaian keterangan barang kes yang mana telah dijelaskan oleh SP2, SP3 dan SP4 di dalam Mahkamah. Penjelasan bagi kelewatan sebanyak 21 hari untuk penghantaran barang kes ke Jabatan Kimia telah diberikan oleh SP4 dan Mahkamah mendapati bahawa penjelasan yang diberikan adalah munasabah memandangkan kes ini berlaku ketika wabak Covid- 19 melanda negara ini dan prosedur-prosedur yang ketat telah dilaksanakan untuk membendung penyakit Covid-19. Sepanjang 21 hari tersebut, dadah-dadah tersebut telah disimpan oleh jurustor (SP1) ataupun dalam almari besi yang berkunci oleh SP4. [38] Pembelaan juga berhujah bahawa SP4 telah gagal menyiasat penama Affendy bin Aziz yang mengarahkan tertuduh untuk menerima dan menyerahkan beg kertas coklat (P25) tersebut dan Affendy adalah pengedar dadah sebenarnya. Malah, tertuduh diperangkap dan dijadikan kambing hitam di dalam kes ini. [39] Setelah Mahkamah ini meneliti keterangan pegawai penyiasat (SP4), Mahkamah mendapati bahawa SP4 tidak dapat menjalankan siasatan terhadap penama Affendy atas alasan bahawa Affendy telah meninggal dunia 3 hari selepas membuat laporan polis (D31), maka SP4 tidak dapat menyiasat kandungan dalam laporan polis D31. Tambahan pula, adalah penting untuk ditekankan bahawa laporan polis D31 dibuat 8 bulan selepas kejadian kes ini, di mana kandungan di dalam laporan polis D31 tidak pernah timbul semasa siasatan yang dijalankan oleh SP4. Kesimpulan di Akhir Kes Pendakwaan [40] Adalah menjadi kewajipan Mahkamah ini untuk menilai keterangan yang dikemukakan dengan penilaian maksima dan menelitinya secara terperinci, merujuk kepada PP v. Mohd Radzi Abu Bakar (supra). Setelah meneliti dan menilai kesemua keterangan yang dikemukakan oleh pihak pendakwaan dan cabaran yang dikemukakan oleh pihak pembelaan, pada tahap penilaian maksima, saya berpuas hati bahawa pihak pendakwaan telah mengemukakan keterangan yang kukuh (credible) untuk membuktikan setiap intipati pertuduhan di bawah Seksyen 39B(1)(a) ADB 1952 iaitu tertuduh mempunyai milikan terhadap dadah-dadah tersebut, dadah-dadah tersebut tersenarai di bawah Akta Dadah Berbahaya 1952 dan tertuduh telah mengedar dadah-dadah tersebut. [41] Mahkamah ini memutuskan bahawa pihak pendakwaan telah berjaya membuktikan satu kes prima facie terhadap tertuduh sepertimana diperuntukkan di bawah Seksyen 180(4) Kanun Tatacara Jenayah. [42] Tertuduh dengan ini dipanggil untuk membela diri. Sehubungan dengan kehendak Seksyen 173(ha) Kanun Tatacara Jenayah, tertuduh telah diperjelaskan tentang 3 pilihan yang terbuka kepadanya dan tertuduh telah memilih untuk memberi keterangan secara bersumpah di dalam kandang saksi. Kes Pembelaan [43] Saksi Pembelaan adalah:

Pada tahun 2015, tertuduh telah mengenali Affendy yang mengusahakan sebuah kedai burger dekat rumah tertuduh.
b
Pada 22 April 2020 jam lebih kurang 2.30 petang, tertuduh menerima panggilan telefon daripada Affendy yang meminta tertuduh mengambil barang daripada kawannya di Ampang dan menghantar ke rumah Affendy di kawasan Klang kerana Affendy tidak dapat membuat demikian atas sebab Perintah Kawalan Pergerakan yang sedang berkuatkuasa.
c
Pada jam lebih kurang 4 petang, tertuduh telah menerima satu beg kertas berwarna coklat (P25) daripada seorang lelaki Melayu yang tidak dikenali. Selepas menerima beg P25, tertuduh telah melihat kandungan P25 secara seimbas lalu dan mendapati didalamnya mengandungi satu bungkusan plastik Poslaju (P26).

Tertuduh berpuas hati kandungan dalam P25 adalah sepertimana diterangkan oleh Affendy dan tertuduh telah mengambil beg P25 daripada lelaki Melayu tersebut.

Tertuduh kemudian membawa beg (P25) dan meletak beg tersebut di atas lantai tempat letak kaki bahagian penumpang hadapan keretanya dan membawanya ke tempat kejadian di Klang.

Selepas tertuduh sampai ke kawasan deretan kedai di Lorong Unta, Taman Berkeley, Klang sepertimana diminta oleh Affendy pada jam 4.30 petang, tertuduh telah menghantar pesanan mesej kepada Affendy, memaklumkan bahawa tertuduh telah sampai.

Beberapa minit kemudian, beberapa orang yang tidak dikenali telah menghampiri kereta tertuduh dan memperkenalkan diri sebagai pegawai polis. Tertuduh diarahkan untuk keluar daripada keretanya dan pegawai polis tersebut telah menjalankan pemeriksaan tubuh tetapi tidak mendapati apa-apa barang salah.

Selepas pemeriksaan tubuh badan tertuduh, pegawai polis tersebut telah membuat pemeriksaan kereta tertuduh dan menjumpai beg P25. Hasil pemeriksaan kandungan beg P25, pegawai polis telah menjumpai 2 bungkusan teh GUANYINWANG mengandungi dadah-dadah berbahaya. Tertuduh telah maklum bahawa beg kertas coklat tersebut adalah milik Affendy. Namun, penjelasan ini tidak dihiraukan oleh SP3.

Tertuduh kemudiannya ditahan dan dibawa ke balai polis Klang Utara untuk siasatan lanjut. Semasa tertuduh ditahan di balai polis, tertuduh berjumpa dengan Affendy dan Affendy telah memohon maaf kepada tertuduh dan memaklumkan bahawa isi kandungan dalam beg kertas coklat (P25) mengandungi dadah-dadah berbahaya tersebut. Pertimbangan Mahkamah terhadap kes Pembelaan [45] Tugas Mahkamah di akhir kes pembelaan adalah untuk menentukan sama ada pembelaan telah menimbulkan keraguan yang munasabah terhadap kes pendakwaan atau sebaliknya. Sekiranya pihak pembelaan berjaya menimbulkan keraguan yang munasabah, tertuduh berhak untuk dilepaskan dan dibebaskan, walaupun versi pihak pembelaan tidak dipercayai oleh Hakim Bicara. (rujuk Mohamad Radhi Yaakob v. PP [1991] 1 CLJ Rep 311; [1991] 3 CLJ 2073; [1991] 3 MLJ 169 dan PP v. Abdul Rahman Aktif [2007] 4 CLJ 337). [46] Bagi kes terhadap tertuduh, anggapan di bawah Seksyen 37(d) telah digunapakai dan oleh itu, tertuduh perlu menyangkal anggapan ini pada tahap imbangan kebarangkalian. Sehubungan itu, Mahkamah perlu meneliti sama ada anggapan ini telah disangkal atau sebaliknya pada tahap imbangan kebarangkalian. [47] Berkaitan isu penyangkalan anggapan ini, adalah sesuai untuk dirujuk kepada kes Mohamad Radhi Bin Yaakob v. PP (supra) di mana Mohamed Azmi HMA di mukasurat 171 menyatakan: "It is a well-established principle of Malaysian criminal law that the general burden of proof lies through out the trial on the prosecution to prove beyond reasonable doubt the guilt of the accused for the offence with which he is charged. There is no similar burden placed on the accused to prove his innocence. He is presumed innocent until proven guilty. To earn an acquittal, his duty is merely to cast a reasonable doubt in the prosecution case. In the course of the prosecution case, the prosecution may of course rely on available statutory presumptions to prove one or more of the essential ingredients of the charge. When that occurs, the particular burden of proof as opposed to the general burden, shifts to the defence to rebut such presumptions on the balance of probabilities which from the defence point of view is heavier than the burden of casting a reasonable doubt, but it is certainly lighter than the burden of the prosecution to prove beyond reasonable doubt. To earn an acquittal at the close of the case for the prosecution under Section 173(f) or Section 180 of the Criminal Procedure Code, the court must be satisfied that no case against the accused has been made out which if unrebutted would warrant his conviction (Munusamy v. PP). If defence is called, the duty of the accused is only to cast a reasonable doubt in the prosecution case. He is not required to prove his innocence beyond reasonable doubt." [48] Isu beban untuk menyangkal sesuatu anggapan di bawah undang-undang ini dijelaskan juga oleh Privy Council dalam kes Public Prosecutor v. Yuvaraj [1968] 1 LNS 116; [1969] 22 MLJ 89 di mana Lord Diplock menyatakan di mukasurat 92 seperti berikut: "Generally speaking, no onus lies upon a defendant in criminal proceedings to prove or disprove any fact: it is sufficient for his acquittal if any of the facts which if they existed would constitute the offence with which he is charged are 'not proved'. But exceptionally, as in the present case, an enactment creating an offence expressly provides that if other facts are proved, a particular fact, the existence of which is a necessary factual ingredient of the offfence, shall be presumed or deemed to exist 'unless the contrary is proved.' In such a case the consequence of finding that that particular fact is 'disproved' will be an acquittal, whereas the absence of such a finding will have the consequence of a conviction. Where this is the consequence of a fact being 'disproved' there can be no grounds in public policy for requiring that exceptional degree of certainty as excludes all reasonable doubt that that fact does not exist. In their Lordships' opinion the general rule applies in such a case and it is sufficient if the court considers that upon the evidence before it it is more likely than not that the fact does not exist. The test is the same as that applies in civil proceedings: the balance of probabilities.". (Rujuk juga kepada kes Illian & Anor v. Public Prosecutor [1988] 1 LNS 139; [1988] 1 MLJ 421) [49] Pembelaan tertuduh adalah lebih kurang sama sepertimana yang digambarkan oleh pihak Pendakwaan. Namun, pihak pembelaan membentangkan satu versi di mana tertuduh adalah seorang ‘innocent carrier’ yang menurut arahan penama Affendy dengan mengambil beg P25 dari Ampang ke tempat kejadian di Klang tanpa mengetahui kandungan dalam beg P25 tersebut. [50] Penganalisaan Mahkamah ini mendapati bahawa pembelaan tidak menafikan bahawa tertuduh mempunyai kawalan dan jagaan terhadap beg P25 tersebut. Apa yang dipertikaikan adalah pengetahuan tentang dadah-dadah berbahaya tersebut yang terkandung dalam beg P25 tersebut. Adalah hujahan pembelaan bahawa tertuduh telah diperdaya oleh Affendy untuk membawa beg P25 dari Ampang ke tempat kejadian dan penjelasan ini telah diberikan kepada SP3 waktu kejadian. [51] Dari pengamatan saya, perwatakan “Affendy” memang wujud dan bukanlah satu watak yang direkacipta oleh pembelaan, kerana SP4 bersetuju bahawa Affendy wujud semasa pemeriksaan balas. Walaubagaimanapun Mahkamah ini mendapati bahawa tertuduh mempunyai banyak peluang untuk memaklumkan kepada pihak polis bahawa Affendy adalah pengedar dadah yang sebenar seawal mungkin sebelum laporan polis D31 dibuat. SP4 sebagai pegawai penyiasat hanya boleh melakukan siasatan atas apa yang beliau tahu dan diberitahu, dan tertuduh tidak boleh beranggapan segalanya sepatutnya di dalam pengetahuan pegawai siasatan jika fakta-fakta penting mengenai proses penangkapannya tidak didedahkan. [52] Di dalam kes Raman Kunjiraman v. Public Prosecutor [2014] 9 CLJ 915, Mahkamah Persekutuan memutuskan: "[51] Learned counsel submitted that it is trite law that an accused person charged under the Dangerous Drugs Act 1952 can elect to remain silent in his cautioned statement and quoted the cases of Teng Boon How v. PP [1993] 4 CLJ 545; [1993] 3 MLJ 553 SC, Alcontara Ambross Anthony v. PP [1996] 1 CLJ 705 and Mohd Hazrin Md Sari v. PP [2008] 5 CLJ 361 CA. [52] We appreciate that no adverse inference may be drawn against the appellant for remaining silent upon his arrest. The appellant does not have any duty to disclose his defence and entitled to remain silent after his arrest and when his cautioned statement was recorded. Similarly, no adverse inference is to be drawn against the appellant for remaining silent for not disclosing his defence. However, his silence would entitle the learned trial judge to give whatever weight considered appropriate. [53] Lim Beng Choon J in PP v. Badrulsham Baharom [1987] CLJU 72; [1987] 1 LNS 72; [1988] 2 MLJ 585 at p. 590 said: ... it is legitimate for the court to scrutinize the evidence as to what the accused said contemporaneously with the act or omission and also the surrounding circumstances under which the accused acted or failed to act. Such evidence is of course not conclusive by itself; it may be overborne by stronger evidence the other way. Nevertheless, it is not wrong to say the accused's state of mind may be gathered from the evidence of what he did or failed to do or what he said on the occasion in question. Putting it shortly, one may say that in order to arrive at a finding of knowledge the court will have to consider the totality of the evidence including any explanations and denials made by the accused and his conduct on the occasion in question. [54] By commenting on the failure of the appellant to provide all relevant information regarding "Noi" to the police at the time of his arrest or when his cautioned statement was recorded four days after his arrest does not mean that the learned trial judge had imposed a duty on the appellant to speak or disclose any information on "Noi". We do not perceive from the grounds of judgment of the learned trial judge that he had drawn any adverse inference against the appellant. To us his comments on the non-disclosure of "Noi's" role merely go to show to the weight that was attached to the appellant's defence, (see: Teng Howe Sing v. Public Prosecutor [2009] 3 CLJ 733). [55] Zulkefli Makinudin FCJ (as he then was) said at p. of Teng Howe Sing's case: Applying the principle in Badrulsham's case to the facts of the instant case, the learned trial judge was correct to conclude that the appellant had two opportunities to provide information about "Ho Seng", ie, at the time of his arrest and five days later during recording of his cautioned statement but he failed to do so. We are therefore of the view that in the circumstances, the appellant's failure to provide relevant information about "Ho Seng" for the police to carry out a thorough investigation into the probability of his defence, entitled the learned trial judge to disbelieve him. [56] Similarly in the instant case, the failure of the appellant to inform the police through his cautioned statement could be taken into account by the learned trial judge in attaching weight to his defence. Obviously "Noi" is a nickname and without giving any particulars of "Noi", it would be impossible for the police to conduct any investigation on her whereabout and indeed her very existence and to her role, if any, in relation to the drugs found on the lap of the appellant. Hence, the learned trial judge was entitled to disbelieve the defence story." [53] Dalam penganalisan pembelaan tertuduh sebagai “innocent carrier”, Mahkamah perlu meneliti pembelaannya secara teliti kerana pembelaan innocent carrier sekiranya berjaya dibuktikan oleh tertuduh, maka akan menimbulkan keraguan yang munasabah dalam elemen pengetahuan bagi kesalahan pengedaran dadah. [54] Mahkamah ini merujuk kepada nas Munuswamy Sundar Raj v. PP [2016] 1 CLJ 357 di mana Yang Arif Suriyadi Halim Omar HMP dalam menyampaikan penghakiman Mahkamah Persekutuan telah memutuskan seperti berikut: “The defence of innocent carrier is a valid defence that could be alluded to by an accused person, and in this case the appellant. A plethora of cases sprinkles the legal journals in Malaysia and suffice if we merely refer to a chosen few to clarify this defence without the need for comprehensive judicial activism. The Court of Appeal in Venkatesan Chinnasami v. PP [2011] 1 LNS 1736 put it aptly in the following terms: ... A defence of innocent carrier refers to a state of affairs where an accused person acknowledges carrying, for example, a bag or a box as in the case before us, containing the dangerous drugs but disputes having knowledge of the drugs. Whether it will succeed or not would very much depend on the facts of each case” [55] Mahkamah ini juga merujuk kepada nas Hoh Bon Tong v. PP [2010] 5 CLJ 240, di mana Abdul Malik JCA memutuskan seperti berikut: “[73] The defence of innocent carrier must necessarily bring into the picture the concept of willful blindness. And according to Yong Pung How CJ (Singapore) in Public Prosecutor v. Hla Win (supra) at p. 438, "the concept of wilful blindness qualifies the requirement of knowledge." And his Lordship continued further by saying (at the same page): As Professor Glanville Williams aptly remarked in his Textbook on Criminal Law, at p. 125: ... the strict requirement of knowledge is qualified by the doctrine of wilful blindness. This is meant to deal with those whose philosophy is: 'Where ignorance is bliss, 'tis folly to be wise.' To argue away inconvenient truths is a human failing. If a person deliberately 'shuts his eyes' to the obvious, because he 'doesn't want to know,' he is taken to know'. [74] Continuing at the same page, his Lordship said: In Ubaka v. PP [1995] 1 SLR 267, the principles laid down in Warner v. Metropolitan Police Commissioner [1968] 2 All ER 356; [1968] 2 WLR 1303 and modified in Tan Ah Tee v. PP [1978] 1 LNS 193; [1980] 1 MLJ 49 were applied by the trial judge. In its grounds of judgment, this court quoted the following passage by the trial judge: Ignorance is a defence when there is no reason for suspicion and no right and opportunity of examination, and ignorance simpliciter is not enough.’ [56] Berdasarkan kepada nas-nas undang, tertuduh perlu memeriksa dan menyiasat sesuatu isi kandungan barang subjek sekiranya tertuduh ada syak wasangka yang munasabah (reasonable suspicion) untuk beliau memeriksa isi kandungan beg tersebut dan tertuduh mempunyai peluang untuk memeriksa isi kandungan beg tersebut. [57] Di dalam kes ini, terdapat beberapa syak wasangka yang mewajarkan tertuduh untuk memeriksa beg P25 tersebut iaitu:

Hubungan tertuduh dan Affendy adalah tidak rapat dan hubungan mereka hanyalah antara penjual burger dan pelanggan sahaja;
b
Adalah tidak munasabah untuk tertuduh tidak menerima sebarang upah daripada Affendy untuk menghantar satu beg (P25) dari Ampang ke Klang; dan

Affendy tidak memaklumkan kepada tertuduh apakah yang terkandung dalam beg P25 yang dibaluti dengan bungkusan plastik Poslaju dengan rapi. [58] Tertuduh mempunyai peluang dan masa yang mencukupi untuk memeriksa beg P25 sebelum membawanya daripada Ampang ke Klang memandangkan perjalanan tersebut mengambil masa yang agak lama. Namun di dalam kes ini, tertuduh telah memilih untuk tidak memeriksa beg tersebut walaupun sepatutnya terdapat syak wasangka (shutting his eyes to the obvious). Maka, pembelaan ‘innnocent carrier’ tertuduh telah dipatahkan dengan prinsip ‘wilful blindness’. [59] Dengan penilaian-penilaian tersebut, Mahkamah mendapati bahawa keterangan tertuduh adalah tidak kredibel dan satu penafian semata-mata. [60] Di dalam nas Public Prosecutor v Ling Tee Huah (1980) 1 LNS 212 diputuskan: “A mere denial without other proof to reasonably dislodge the prosecution’s case is not sufficient.” [61] Mahkamah juga merujuk kepada nas PP v. Lim Chooi Huat & Anor [2011] MLJU 852 diputuskan: “I am of the view that OKT2 is an unreliable witness and his evidence is unacceptable. OKT2’s evidence was riddled with bare denials. And it is settled law that a bare denial is not a defence: see the Federal Court case of DA Duncan v. PP [1980] 2 MLJ 196.” [62] Manakala di dalam nas Thiagarajan Selvam v. PP [2014] 1 LNS 1796 dinyatakan: “[14] Kami bersetuju sebulat suara, bahawa pembelaan hanyalah merupakan penafian semata-mata, ianya tidak berupaya menimbulkan keraguan yang munasabah ke atas kes pendakwaan. Di dalam kes PP v. Ling Tee Huah (Supra): A mere denial without other proof to reasonably dislodge the prosecution’s evidence is not sufficient” [63] Adalah menjadi dapatan Mahkamah bahawa versi pembelaan tertuduh telah gagal mematahkan anggapan pemilikan tentang dadah berbahaya atas imbangan kebarangkalian di bawah Seksyen 37(d) Akta Dadah Berbahaya 1952. Mahkamah dengan ini memutuskan bahawa pihak Pendakwaan telah berjaya membuktikan kes secara melampaui keraguan yang munasabah terhadap tertuduh bagi pertuduhan-pertuduhan yang dihadapi. Hukuman [64] Mahkamah dalam menjatuhkan hukuman bukan sahaja mengambil kira kepentingan awam, kepentingan tertuduh tetapi keseriusan kesalahan juga diambil kira. Kesalahan yang dilakukan oleh tertuduh adalah satu kesalahan yang serius sepertimana ditafsirkan di bawah Seksyen 52B Kanun Keseksaan dan sekiranya dadah-dadah tersebut diedarkan kepada masyarakat, maka akan membawa kemudaratan kepada masyarakat dengan banyak masalah sosial dan jenayah lain. [65] Mahkamah ini juga mempertimbangkan dengan penggubalan Akta Pemansuhan Hukuman Mati Mandatori 2023, Seksyen 34 Akta yang sama memberikan pilihan kepada Mahkamah ini untuk memberikan hukuman berbentuk pemenjaraan seumur hidup bersama 12 kali sebatan terhadap pesalah yang disabitkan dengan pertuduhan di bawah Seksyen 39B(1) (a) ADB 2952 yang boleh dihukum dibawah Seksyen 39B(2) Akta yang sama ataupun hukuman gantung sampai mati. [66] Setelah memberi peluang bagi pihak-pihak berhujah untuk mitigasi dan pemberatan, Mahkamah menjatuhkan hukuman seperti berikut:

Untuk pertuduhan pertama (1) dibawah Seksyen 39B(1) (a) Akta Dadah Berbahaya 1952 yang boleh dihukum dibawah Seskyen 39B(2) Akta, Mahkamah menjatuhkan hukuman 30 tahun penjara dan 12 kali sebatan atas tertuduh.

Untuk pertuduhan kedua (2) dibawah Seksyen 39B(1) (a) Akta Dadah Berbahaya 1952 yang boleh dihukum dibawah Seskyen 39B(2) Akta, Mahkamah menjatuhkan hukuman 30 tahun penjara dan 12 kali sebatan atas tertuduh.
