Kemudian pihak Jabatan Kastam Malaysia telah memfailkan permohonan untuk lu-cuthak kenderaan tersebut. Pihak Ambank (M) Bhd (Responden) memfailkan Afidavit dan membantah permohonan pihak Kastam kerana Responden merupakan Pemilik kenderaan tersebut. Bantahan awal telah dikemukakan oleh pihak Responden dan telah dibenarkan oleh Mahkamah, oleh itu pada 20 Mac 2025, Mahkamah telah me-nolak permohonan untuk melucutkan kenderaan tersebut kepada Jabatan Kastam Diraja Malaysia dan selanjutnya memerintahkan kenderaan tersebut dikembalikan kepada pihak responden. Hujahan Pemohon [5] Pengadu dengan rendah diri berhujah bahawa bantahan awal yang dikemuka-kan oleh Responden hendaklah ditolak oleh Mahkamah yang Mulia ini. Bantahan awal yang dikemukakan adalah berkenaan rujukan kepada Ketua Pengarah Kastam yang mana menurut Responden hendaklah dibuat dalam masa 30 hari selepas notis sitaan dikemukakan dan terdapatnya tuntutan daripada "pemilik" barangan, dan hendaklah dibuat kepada Ketua Pengarah Kastam sendiri. Pengadu, melalui Afidavit Jawapan yang difailkan, telah antara lain menyatakan bahawa rujukan ini telah dibuat kepada Penolong Kanan Pengarah Kastam, yang diberi kuasa melalui Seksyen 3(3) Akta Kastam 1967, untuk menjalankan kuasa Ketua Pengarah Kastam. Kuasa yang 5 | P a g e dijalankan di bawah seksyen 128(3A) ini tidak termasuk di dalam pengecualian yang dinyatakan dalam subseksyen yang sama. Hal ini tidak dinafikan oleh Responden yang mana Responden hanya menyatakan bahawa rujukan seharusnya dibuat terus kepada Ketua Pengarah Kastam, dan bukan Penolong Kanan Pengarah Kastam serta pentafsiran Pengadu hanya bertujuan mengelirukan Mahkamah yang Mulia ini. Pen-gadu dengan rendah diri memohon rujukan dibuat kepada kes FIVE SUN TRADING SON BHD v. MUHAMMAD SALLEHUDIN RAMU & ORS [2023] 2 CLJ 290: “ The Director General of Customs is empowered under s. 3(2) of the Customs Act with the '·superintendence of all matters relating to the customs" conferred on the Director General bys. 3(2) of the Customs Act. [39] Section 40 of the Interpretation Act states that where a person is conferred a power under written law to do or enforce the doing of any act or thing, the powers is understood to be also given as are reasonably necessary to enable the person to do the act or thing or to enforce the doing of the act or thing. Section 40 of the Interpretation Act reads: 40. Implied Powers (1) Where a writ-ten law confers a power on any person to do or enforce the doing of any act or thing, all such powers shall be understood to be also given as are reasonably necessary to enable the person to do or enforce the doing of the act or thing. (2) Without prejudice to the generality of subsection (]): (a) power to make sub-sidiary legislation to control or regulate any matter includes power to provide for the same by licensing and power to prohibit acts whereby the control or regulation might be evaded,· (b) power to grant a licence, permit, authority, ap-proval or exemption includes power to impose conditions subject to which the licence, permit, authority, approval or exemption is granted,· and (c) where a power is conferred on any person to direct, order or require any act or thing to 6 | P a g e be done, there shall be deemed to be imposed on any person to whom a direc-tion, order or requisition is given in pursuance of the power a duty to comply therewith. [40] Thus, readings. 40 together with s. 17A of the Interpretation Act, it is implied that the Director General '.s ··superintendence of all matters relating to the cus-toms" includes the power to issue directives that seized goods be re-exported upon payment of any compound offered by Customs under the Customs Act. [41] Section 3(3) of the Customs Act expresslv empowers Directors of Customs (and others listed therein) to exercise all the powers conferred on the Director General, except those in ss. 13B, 22 and 145 of the Act. Directors of Customs includes Directors of Customs of each State. Therefore, it follows that the State Director of Customs Selangor "superintendence of all matters relating to the customs" in the State of Selangor. This power includes the power to issue di-rectives that seized goods be re-exported upon payment of compound for t/re said goods. [42] As held by the Court of Appeal in Palm Oil Research And Development Board Malaysia v. Premium Vegetable Oils, courts in interpreting taxing stat-utes are under a duty to adopt a11 approach "that produces neither injustice nor absurdity" ie, "an approach that promotes the purpose or objectt underlying the particular statute albeit that such purpose or obiect is not expressly set out the said statute". [43] Although the Customs Act does not expressly state that the Director Gen-eral of Customs and the Directors of Customs have the power to issue direc-tives that seized goods be re-exported upon payment of any compound offered 7 | P a g e by Customs under t/re Act, in my considered iudgment, any other interpretation ofss. 3(2) and 3(3) of the Customs Act would give rise to absurdity and would not promote the purpose or obiect underlying s. 3(2) in conferring the Director General of Customs "superintendence of all matters relating to the customs" ands. 3(3) in granting t/re Directors of Customs the powers and the right to exercise all powers conferred on the Director General under the Act, save for those in ss. 10F, 13B and 22 of the Act." (emphasis added) [6] Penghakiman Mahkamah dalam kes ini jelas menunjukkan bahawa kuasa yang dijalankan oleh Penolong Kanan Pengarah Kastam bagi pihak Ketua Pengarah Kastam adalah berlandaskan undang-undang kukuh dan rujukan yang dikehendaki di bawah subsekyen (3), seksyen 128 Akta Kastam ini telah sewajarnya dipenuhi oleh Pengadu. Hakim Mahkamah Tinggi, Yang Arif Faizah Jamaludin, dalam pengha-kimannya juga merujuk kepada kes Mahkamah Rayuan iaitu PALM OIL RESEARCH AND DEVELOPMENT BOARD MALAYSIA v PREMIUM VEGETABLE OIL (2004] 2 CLJ 265, yang mana Mahkamah Rayuan memutuskan bahawa dalam mentafsirkan perundangan melibatkan percukaian Mahkamah adalah di bawah tanggungjawab un-tuk menggunapakai pendekatan "yang tidak menyebabkan ketidakadilan dan tidak munasabah ('absurdity')". [7] Pengadu berhujah sekiranya kesemua tuntutan berkenaan barangan yang dis-ita di bawah Akta ini diperlukan untuk dirujuk secara terus kepada Ketua Pengarah sendiri, ini adalah tidak munasabah dan pastinya akan menyebabkan kelewatan bagi kes-kes jenayah yang memerlukan masa untuk siasatan dan tindakan-tindakan segera. Kuasa yang diberikan melalui seskyen 3(3) Akta Kastam 1967 ini 8 | P a g e membolehkan tindakan ke atas kes-kes jenayah terutamanya siasatan oleh pegawai penyiasat dapat dijalankan dengan cepat, apabila dapat dirujuk dengan pegawai ata-san yang menjalankan kuasa Ketua Pengarah Kastam. Selain itu, Responden juga membangkitkan berkenaan isu rujukan kepada Mahkamah, yang mana menurut Re-sponden telah dibuat diluar tempoh masa yang ditetapkan di dalam seksyen 128 (3) Akta Kastam 1967. Pengadu berhujah bahawa dakwaan yang dibuat oleh Responden ini adalah tidak benar dan tiada pada mana-mana bahagian pada subseksyen (3A)(b) ini yang menetapkan satu tempoh masa untuk rujukan kepada Majistret ini dibuat. Pengadu berhujah bahawa Responden telah terkeliru dengan subseksyen (3) yang memerlukan rujukan kepada Ketua Pengarah Kastam dibuat dalam masa selepas 30 hari selepas terdapatnya tuntutan daripada mana-mana pihak, dan tiada pen-dakwaan dijalankan ke atas barang tersebut. Pengadu merujuk seksyen 128 Akta Kastam 1967 yang memperuntukkan: (1) If there be no prosecution with regard to any goods seized under this Act, such goods or the proceeds of sale of such goods which are held pursuant to paragraph l l 5(l)(c) shall be taken and deemed to be forfeited at the expiration of thirty days from the date of the notice of seizure of the goods unless, before such expiration- (a) a claim to such goods or the proceeds of sale of such goods is made under subsection (2); (b) a written application is made for the return of such goods under paragraph 115(1)(a) or (b),· or (c) such goods are returned under the said paragraph (a) or (b). (2) Any person asserting that he is the owner of such goods or the proceeds of sale of such goods, as the case may be, and that they are not liable to for-feiture may give written notice to a senior officer of customs that he claims the same. 9 | P a g e (3) If there is a claim or a written application made within the period of thirty days referred to in subsection (1) and there is no prosecution with regard to the goods, the senior officer of customs shall, on the expiration of the period of thirty days, refer the claim or the application to the Director General. (3A) Upon reference by the senior officer of customs under subsection (3), the Director General may direct such senior officer of customs- (a) to release such goods or the proceeds of sale of such goods or the se-curity furnished under paragraph 115(1)(a) or (b),· or (b) by information in the prescribed form, to refer the matter to a Magistrate of the First Class for his decision. (4) The Magistrate of the First Class shall issue a summons requiring the person asserting that he is the owner of the goods or the proceeds of sale of such goods, and the person from whom the goods were seized, to appear be-fore him, and upon their appearance or default to appear, due service of such summons being proved, the Magistrate of the First Class shall proceed to the examination of the matter, and upon proof that an offence against this Act or any regulations made thereunder has been committed and that such goods were the subject matter, or were used in the commission, of such offence, shall order such goods or the proceeds of sale of such goods or the amount secured under paragraph l 15(1)(a) or (b), as the case may be, to be forfeited, or in the absence of such proof may order the release of such goods or the proceeds of sale of such goods or the security fi1rnished under paragraph J J 5(1)(a) or (b), as the case may be. 10 | P a g e (5) In any proceedings under subsection (4), section 119 shall apply to the person asserting that he is the owner of the goods and to the personfi·om whom they were seized as if such owner or person had been the defendant in a pros-ecution under this Act [8] Pengadu juga menghujahkan peruntukan subseksyen 128(3) Akta 235 telah dipinda melalui Akta A1593, yang mula berkuatkuasa pada 1.1.2020. Lanjutan daripada pindaan tersebut, subseksyen (3A) telah dimasukkan selepas subseksyen (3), yang mana perbandingan sebelum dan selepas pindaan dapat dilihat seperti berikut: [9] Pindaan kepada subseksyen (3) dan kemasukan peruntukan (3A) yang baharu adalah terpakai dalam kes ini kerana sitaan telah dibuat pada 22.9.2022. Pindaan yang dibuat kepada Subseksyen 128(3) dengan memasukkan Subseksyen 128(3A) adalah jelas menggambarkan niat peruntukan ini untuk tidak mengikat Ketua Pengarah Kastam untuk melepaskan atau merujuk perkara (berkenaan barangan yang disita) kepada Majistret untuk keputusan dalam tempoh 1 bulan, yang Subseksyen 128(3) sebelum pindaan Subseksyen 128(3) selepas pindaan (3) On the expiration of the period mentioned in subsection (1), or, if a decision is made earlier that there be no prosecution with regard to the goods, on the making of the decision the senior officer of customs shall, if such goods or the proceeds of sale of such goods are not taken and deemed to be forfeited under that subsection, refer the claim to the Director General who may direct that such goods or or the security furnished under 115(1) (a) or (b), as the case may be, be released or may direct such senior officers or customs, by information in the precribed form to refer the matter to a Magistret of the First Class for his decision. (3) If there is a claim or a written application made within the period of thirty days referred to in subsection (1) and there is no prosecution with regard to the goods, the senior officer of customs shall, on the expiration of the period of thirty days, refer the claim or the application to the Director General. (3A) Upon reference by the Senior officer of customs under sebsection (3) the Director General may direct such senior officer of customs:- (a) To release such goods or the proceeds of sale of such goods or the security furnished under paragraph 115(1)(a) or (b); or (b) By information in the prescribed form, to refer the matter to a Magistret of the First Class for his decision. 11 | P a g e diperuntukkan di bawah Subseksyen 128(3) tersebut sebagaimana peruntukan ter-dahulu (sebelum pindaan). Satu - satunya tempoh masa yang ditetapkan di bawah Seksyen 128 ini hanyalah bagi rujukan kepada Ketua Pengarah Kastam, yang mana Pengadu berhujah disini telah dipenuhi oleh Pengadu, sesuai tuntutan statutori. Hujahan Responden [10] Hujahan Responden secara ringkas adalah bahawa Pengadu telah memung-kiri keperluan statutori serta/atau mandatori apabila Pengadu gagal mematuhi keper-luan dalam s 128 (3a) Akta Kastam untuk membuat rujukan kes kepada Ketua Pengarah sewaktu tamat tempoh notis sitaan tersebut bagi suatu kes yang tiada pen-dakwaan terhadap barangan yang disita apabila Responden telah membuat tuntutan ke atas subjek kenderaan tersebut, bagi arahan lanjut samada membuat rujukan lanjut kepada Majistret atau memulangkan kenderaan kepada penuntut, rujukan kepada majistret yang dibuat tersebut juga adalah dibuat di luar masa yang dibekal-kan/ditetapkan sepertimana dalam ss 128 Akta Kastam iaitu sejurus tamat tempoh tiga puluh (30) hari daripada notis tuntutan, pada atau sebelum 13/12/2022. Pihak Pengadu juga tidak mengemukakan sebarang apa rujukan telah dibuat dan telah menerima arahan daripada Ketua Pengarah bahawa ianya adalah dibuat menurut ara-han beliau. Dalam apa jua keadaan pun, rujukan/pengaduan oleh pengadu kepada Majistret hanya dibuat pada 7/8/2024 iaitu lampau lewat daripada tempoh masa yang dibekalkan dalam ss 128 Akta Kastam tersebut. Ketidapatuhan Pengadu kepada keperluan ss 128 Akta Kastam adalah suatu kemungkiran dan telah memprejudiskan hak Responden selaku pemilik subjek kenderaan terhadap harta di bawah Perkara 13 Lembaga Persekutuan. Responden merujuk kepada Seskyen 128 (3), (3A) dan (4) Akta Kastam 1967 yang membekalkan seperti berikut:- Goods seized in respect of which there is no prosecution, or the proceeds of sale thereof, are forfeited if not 12 | P a g e claimed within one month Seksyen 128. (3) If there is a claim or a written application made within the period of thirty days referred to in subsection (1) and there is no pros-ecution with regard to the goods, the senior officer of customs shall, on the expiration of the period of thirty days, refer the claim or the application to the Director General. (3A) Upon reference by the senior officer of customs under subsection (3), the Director General may direct such senior officer of customs— a) release such goods or the proceeds of sale of such goods or the security furnished under paragraph 115(1)(a) or (b); or b)information in the prescribed form, to refer the matter to a Magistrate of the First Class for his decision. (4) The Magistrate of the First Class shall issue a summons requiring the person asserting that he is the owner of the goods or the proceeds of sale of such goods, and the person from whom the goods were seized, to appear before him, and upon their appearance or default to appear, due service of such sum-mons being proved, the Magistrate of the First Class shall proceed to the examination of the matter, and upon proof that an offence against this Act or any regulations made thereunder has been committed and that such goods were the subject matter, or were used in the commission, of such offence, shall order such goods or the proceeds of sale of such goods or the amount secured under paragraph 115(1)(a) or (b), as the case may be, to be forfeited, or in the absence of such proof, may order the release of such goods or the proceeds of sale of such goods or the security furnished under paragraph 115(1)(a) or (b), as the case may be. [11] Perkara 13 Lembaga Persekutuan berkenaan hak terhadap harta adalah sep-erti berikut:- Hak terhadap harta 13. (1) Tiada seorang pun boleh dilucutkan hartanya kecuali mengikut undang-undang. (2) Tiada undang-undang boleh memperuntukkan pengambilan atau penggunaan harta dengan paksa tanpa pampasan yang mencukupi. Responden merujuk keputusan Mahkamah Rayuan yang diputuskan 13 | P a g e pada Januari 2025, Agm Duty Free (Tengah) Sdn Bhd v. Mohamad Hafiz Ishak & Ors1, di mana Mahkamah Rayuan telah merujuk kepada kes Modern Freight Express serta kes Sarmiina Sdn Bhd v Gerry Ho & Ors dan memutuskan bahawa selepas menerima suatu tuntutan ke atas barangan yang disita, Kastam Diraja Malaysia ha-ruslah merujuk kepada Ketua Pengarah untuk tindakan lanjut samada memulangkan barangan tersebut atau membuat rujukan pekara tersebut kepada Majistret, Kelas Pertama dalam tempoh tiga puluh (30) hari daripada notis tuntutan :- [63] It is our considered view that when there is an express provisions of law that direct the Respondents to do certain acts, the Respondents could not ig-nore their statutory duty pursuant to s 128 of Act 235 especially where there was a valid claim made by the Appellant within 30 days from the date of the seizure and when there is no prosecution done in respect of the seized goods on the expiration of the 30 days from the date of claim by the Appellant. [64] Based on the facts of the case, we find that the learned High Court Judge had erred in law and fact in holding that there is no time frame pursuant to s 128(3) and 128(3A) of Act 235 for the seized goods to be released or referred to the court in the expiration of 30 days. [12] Responden juga merujuk kepada kes Modern Freight Express v. Afzarrizal Abdul Wahab & Ors2, di mana Yang Amat Arif Tengku Maimum Tuan Mat (pada Ketika masa itu Hakim Mahkamah Rayuan) memutuskan kegagalan pihak Kastam Diraja Malaysia mengambil tindakan lanjut dalam masa tempoh tiga puluh (30) hari selepas notis tuntutan dibuat oleh penuntut adalah suatu kegagalan untuk mengaji keperluan statutory dalam ss 128, di mana petikan keputusan kes adalah seperti beri-kut:- 14 | P a g e [37] In the light of the authorities quoted earlier, we ruled that pursuant to sub-section 128(3) of the Act, where a written claim is made by the plaintiff for the said goods within one calendar month from the date of seizure and where no prosecution is commenced in respect of the said goods within the same period of time, then on the expiration of the one calendar month from the date of notice of claim, the defendants shall release the goods or refer the claim to the Mag-istrate Court. Since the defendants had failed to do either, we found that the defendants have failed to observe the statutory requirements under s 128 of the Act. [13] Responden merujuk lanjut kepada kes Agm Duty Free Sdn Bhd (supra), dan memetik keputusan kes tersebut yang memutuskan bahawa bagi sesuatu kes di bawah ss 128 Akta Kastam 1967, sekiranya tuntutan dibuat ke atas barangan sitaan, suatu pendakwaan perlu dimulakan tiga puluh (30) hari daripada notis tuntutan terse-but seperti berikut:- [54] From a clear reading of s 128 of the Act, it is our considered view that there is an express provision under the law that if there be no prosecution with regard to any goods seized within 30 days from the date of notice of seizure of the goods, the goods are deemed to be forfeited, meaning to state that if the Re-spondents intend to prosecute, it must be commenced within 30 days from the date of seizure. [55] However, if there is a claim for the said goods within 30 days, then if the Respondents intend to prosecute, a prosecution shall be commenced within 30 days from the date of the claim or on expiration of 30 days, the Senior Officer 15 | P a g e of Customs shall refer the matter to the Director General as required under subsection 128 (3) of Act 235. ….. [57] The scheme of the provision clearly does not allow the Respondents to be the persons to decide the status of the seized goods on the expiration of the 30 days from the date of the claim when there is valid claim. Instead under ss 128 (3) and 128 (4) of Customs Act 1967, IT IS FOR THE COURT TO DECIDE. [14] Responden juga berhujah bahawa undang-undang di bawah ss 128 Akta Kastam adalah ketara dan jelasnya bahawa Pengadu tidak berupaya dan tidak diberi kuasa untuk memutuskan dan melengahkan proses mahupun untuk siasatan dan/atau alasan lain. Mahkamah Majistret, Kelas Pertama merupakan pihak yang berkuasa dan diberi kuasa untuk memutuskan perkara di bawah ss 128 tersebut. Pen-gadu sepatutnya merujuk kepada Ketua Pengarah untuk arahan lanjut dalam tempoh tiga puluh (30) hari dari tarikh matang notis tuntutan, pada atau sebelum 13/12/2022 (pengiraan 30 hari daripada tarikh surat balasan Responden pada 14/11/2022) samada untuk membuat rujukan kepada Majistret atau memulangkan subjek kender-aan yang disita tersebut kepada penuntut, Responden memandangkan tiada pen-dakwaan dilakukan ke atas barangan yang disita tersebut. Memandangkan pen-gaduan dan rujukan hanya dibuat kepada Majistret dan Saman dikeluarkan pada 7/8/2024, Pengadu gagal mematuhi keperluan ss 128 Akta Kastam tersebut. Pengadu berbuat demikian menyebabkan sitaan berterusan (selepas tempoh matang 30 hari daripada notis tuntutan) atas barangan subjek kenderaan tidak sah dari segi undang-undang dan secara bersalah (wrongful). Ianya juga telah bercanggah dan memungkiri hak Responden selaku pemilik subjek kenderaan atas harta di bawah Perkara 13 16 | P a g e Lembaga Persekutuan. Keputusan dalam kes Mahkamah Persekutuan Sarmiina Sdn Bhd v. Gerry Ho & Ors3 yang memutuskan seperti berikut:- [48] In the present case, the non-compliance with s 128(3) of Act 235 is fatal as it involves a deprivation of property of a person or party which is protected under art 13(1) of the Federal Constitution that states: “No person shall be deprived of property save in accordance with law” [49] The deprivation of the consignors’ rights to the goods in this case, was not in accordance with the law as the provision of s 128(3) has not been com-plied with. In the circumstances, the continuous seizure of the goods by RMCD in the present case is unlawful and invalid. [15] Hujahan kes Responden adalah terus terang (straightforward) dan ketara ba-hawa Pengadu gagal memahami dan mematuhi keperluan dalam ss 128 Akta Kastam dan disebabkan begitu, sitaan berterusan ke atas subjek kenderaan Toyota Vellfire W5189Q tersebut adalah tidak sah dari segi undang-undang dan bersifat salah (wrongful). sedemikian, subjek kenderaan yang disita tersebut hendaklah dipulangkan kepada pemilik yang sah, AmBank (M) Berhad dengan serta merta. Pihak Responden dengan ini memohon pengaduan tindakan ini ditolakkan dan subjek kenderaan dipu-langkan kepada pemilik sewaktu Perintah dimeteraikan. [16] Responden juga menghujahkan Pendekatan/pentafsiran ss 128 (3) oleh Pen-gadu adalah tidak betul dan mengelirukan. Ianya juga tidak disokong oleh mana-mana kes-kes pendahuluan. Sebaliknya, responden telahpun memetik keputusan Mahkamah Persekutuan dan Mahkamah Rayuan yang menyokong bantahan awal Responden. Tambahan pula tiada pendakwaan telah dibuat ke atas subjek kenderaan tersebut. Pengaduan tindakan ini bagi pelucuthakan subjek harta, kenderaan W 17 | P a g e 5189Q dibuat di bawah ss 128 (3) dan (4) Akta Kastam. Segala elemen dalam seksyen tersebut patut dipatuhi dan kegagalan Pengadu berbuat demikian adalah suatu kega-galan memahami keperluan statutori dan disebabkan begitu, bantahan awal Re-sponden haruslah diterima. [17] Bantahan Awal Responden patutlah (ought to) dibenarkan memandangkan Pengadu gagal mematuhi keperluan statutori dan menyebabkan penyitaan berterusan bersifat salah dan tidak sah dari segi undang-undang. Responden turut berhujah ba-hawa hujahan/pendekatan yang dimajukan oleh rakan bijaksana bagi pentafsiran ss 128 (3), (3A) dan (4) tersebut tidak disokong oleh mana-mana kes-kes dahuluan, manakala Responden telah memetik keputusan daripada Mahkamah Agung, Mahkamah Persekutuan dan 2 lagi keputusan Mahkamah Rayuan untuk menyokong pendekatan Responden. Pendekatan Pengadu berkenaan pentafsiran ss 128 tersebut bahawa rujukan cuma bersifat “administrative” dan boleh dijalankan/dilakukan oleh Penolong Kanan Pengarah Kastam adalah tidak relevan dalam tindakan ini. Hal ini demikian kerana keperluan dalam ss 128 Akta Kastam tersebut tidak dipatuhi oleh Pengadu, yakni untuk membuat rujukan samada untuk merujuk kepada Magistrate atau memulangkan subjek harta yang disita dalam tempoh tiga puluh (30) hari selepas menerima suatu tuntutan daripada pihak berkepentingan (penuntut) sekiranya tiada pendakwaan ke atas harta tersebut, selepas membuat rujukan kepada Ketua Pengarah. Maka Menurut prinsip-prinsip teladan (settled principle) yang diputuskan dalam kes-kes yang dirujuk oleh Responden tersebut, dan menerimapakai prinsip yang sama dalam kes ini, ianya adalah ketara dan jelas bahawa Pengadu telah gagal mematuhi keperluan statutori tersebut. [18] Responden merujuk kepada kes Agm Duty Free (Tengah) Sdn Bhd v. Mo-hamad Hafiz Ishak & Ors,2 di mana Hakim Mahkamah Rayuan Bijaksana, Marina 18 | P a g e Yahya, Hashim Hamzah serta Faizah Jamaludin memutuskan bahawa dalam kes Agm tersebut ketinggalan (lack of ) pembuktian yang kukuh (cogent evidence) bahawa suatu tindakan telah diambil dalam tempoh masa ditetapkan seperti berikut:- [58] The facts of the case show that the Respondents who had admitted seizing the goods since 23/9/2022 still continued seizing the goods without referring the matter to court on the expiration of the 30 days from the date of claim made by the Appellant on 21/10/2022. In fact, the Respondents did not show any cogent evidence that they had taken any action from 21/10/2022 until the Ap-pellant through its solicitor Ms. J R Ravendran & Associates vide a letter dated 19/6/2023 (exhibit DPS-7) demanded that the Respondents release the said goods and motro lorry failing which the Appellant insisted that it shall com-mence a legal suit against the Respondents. ….. [60] It is worth highlighting that the court did not have opportunity to ascertain the actual date when the consent to prosecute was obtained from the DPP. In the letter sent by the Respondents to the Appellant, the actual date of consent was not mentioned. The parties in their submission had only relied on the date of the letter dated 26/6/2023 which in our view is not conclusive proof that the consent to prosecute was made before the expiration 30 days from the Notice to Claim by the Appellant. [19] Mahkamah Rayuan dalam kes Agm (supra), turut memutuskan pokok utama dalam permohonan kes tersebut adalah untuk menentukan status undang-un-dang penyitaan beterusan barangan oleh Responden (pihak Kastam dalam kes AGM) 19 | P a g e selepas pematangan tempoh masa tiga puluh (30) hari yang dibekalkan dalam ss 128 (3) dan (3A) Akta Kastam seperti berikut:- [65] We also find that the learned High Court Judge had misdirected himself in applying s 127 (1) of Act 235 when the main crux of the application by the Ap-pellant is to determine the legal status of the continuous seizure of the goods by the Respondents upon expiration of the 30 days period provided by s 128 (3) and (3A) of Act 235. [20] Berdasarkan petikan kes Agm (supra), Responden berhujah bahawa bantahan awal Responden berdasarkan keperluan statutori di bawah ss 128 (3), (3A) dan (4) Akta Kastam mempunyai pokok utama yang sama yakni samada status undang-un-dang penyitaan berterusan dibuat secara sah dari segi undang-undang. Responden turut berhujah bahawa Pengadu gagal mengemukakan sebarang apa dokumen ber-tulis yang menunjukkan sebarang apa rujukan telah dibuat kepada Magistrate, Kelas Pertama dalam tempoh masa tiga puluh (30) hari dari tarikh notis tuntutan Responden, yang matang pada 13/12/2022. Tindakan ini difailkan oleh pengadu di bawah ss 128 (3), (3A) dan (4) untuk pelucuthakan harta/barangan yang disita dan tiada sebarang pendakwaan ke atas barangan yang disita tersebut. Pengadu haruslah mematuhi keperluan statutori di bawah Akta 235. Memandangkan Pengadu gagal mematuhi keperluan statutori di bawah ss 128, maka penyitaan Pengadu atas subjek kenderaan W 5189Q adalah tidak sah dari segi undang-undang dan bersifat salah, Responden turut berhujah bahawa fakta-fakta dan keterangan yang dikemukakan Pengadu, tidak relevan, tidak bermerit dan tidak wajar sama sekali memandangkan penyitaan adalah tidak sah dari segi undaung-undang. Keputusan 20 | P a g e [21] Dalam memberi keputusan untuk kes ini saya membataskan diri saya untuk memberi keputusan yang adil selaras dengan undang-undang, Prinsip keadilan asasi yang menjadi asas di dalam membuat suatu keputusan yang adil dan saksama oleh mana-mana individu atau badan yang ditugaskan untuk bertindak secara kehakiman. Professor De Smith menyebut: “Peraturan keadilan asasi adalah taraf minimum dalam membuat keputusan yang saksama yang dikenakan oleh un-dang-undang terhadap orang atau badan yang bertugas yang bertindak secara kehakiman...isi kandungan keadilan asasi boleh berubah-ubah mengikut kesesuaian dan boleh berbeza-beza..., yang penting ialah kepentingan pihak yang terlibat perlu diambil kira”. Seterusnya dalam kes R lwn Sussex Justices ex parte Mc Carthyl3, Ha-kim Lord Hewart pula menyebut: “Adalah menjadi keperluan asas bahawa kead-ilan bukan sahaja dilaksanakan, tetapi perlu juga dipastikan yang ianya dil-aksanakan”. [22] Kes dihadapan mahkamah adalah permohonan pengadu untuk melu-cuthakkan kenderaan iaitu milik Responden, pertamanya Mahkamah terikat kepada undang-undang tertinggi dalam negara ini iaitu Perkara 13 Lembaga Persekutuan berkenaan hak terhadap harta adalah seperti berikut: - Hak terhadap harta 13. (1) Tiada seorang pun boleh dilucutkan hartanya kecuali mengikut undang-undang. (2) Tiada undang-undang boleh memperuntuk-kan pengambilan atau penggunaan harta dengan paksa tanpa pampasan yang mencukupi. Keduanya, ada undang-undang khas iaitu Akta Kastam yang membenarkan untuk lucuthak kenderaan Responden, namun pemakaian undang-undang ini hendaklah dilaksanakan selaras dengan keper-luan statutori dalam Akta Kastam itu, kegagalan pihak pengadu memenuhi keperluan statutori itu menyebabkan Mahkamah menolak permohonan pengadu. Mahkamah bersetuju dan menerima bantahan awal pihak responden bahawa berdasarkan 21 | P a g e keperluan statutori di bawah ss 128 (3), (3A) dan (4) Akta Kastam mempunyai pokok utama yang sama yakni samada status undang-undang penyitaan berterusan dibuat secara sah dari segi undang-undang. Mahkamah mendapati Pengadu gagal mengemukakan sebarang apa dokumen bertulis yang menunjukkan sebarang apa ru-jukan telah dibuat kepada Magistrate, Kelas Pertama dalam tempoh masa tiga puluh (30) hari dari tarikh notis tuntutan Responden, yang matang pada 13/12/2022. Tam-bahan pula bantahan awal pihak Responden disokong dengan prinsip-prinsip teladan (settled principle) yang diputuskan daripada Mahkamah Agung, Mahkamah Perseku-tuan dan 2 lagi keputusan Mahkamah Rayuan. Maka dengan ini bantahan awal Re-sponden dibenarkan dan permohonan pihak kastam ditolak.
