Introduction [1] The appellant appealed against the decision of the learned establish a prima facie case against the respondent, in respect of a charge of causing grievous hurt by dangerous weapons or means, under section 326 of the Penal Code . [2] After considering the evidence before the court and the submissions of the parties, I dismissed the appeal. These are the reasons for my decision. S/N 3tkL0oskWEyxbuXmea3A B. Background Facts [3] PW worked with the respondent as a maid at Pandan Jaya, 55100 Kuala Lumpur . [4] The respondent lived with her mother at the Premises, and PW1 was tasked with cleaning the Premises, cooking, and tending to the aged mother. [5] PW1 was unfortunately mistreated by the respondent. She sought SAYA DISIKSA MAJIKAN TIAP HARI. SAYA MANDI DARAH TOLONG and officer, lodged a police report on the incident. [6] On 20 December house, with visible injuries. The respondent was detained on the same day, and subsequently charged with several charges, including a charge in respect of an offence under section 326 of the PC, which is the subject matter of this appeal. [7] The charge reads: Bahawa kamu di antara 11.04.2014 sehingga 20.12.2014, di alamat No. 303, Blok M10, Persiaran Pandan 7, Pandan Jaya, di dalam daerah Hulu Langat di dalam negeri Selangor Darul Ehsan S/N 3tkL0oskWEyxbuXmea3A dengan sengaja menyebabkan cedera parah terhadap Meriance Kabu (Passport No.: A7487454) dengan menggunakan playar, iaitu senjata yang mungkin menyebabkan kematian bagi mencabut empat batang gigi Meriance Kabu tersebut dan oleh yang demikian kamu telah melakukan satu kesalahan di bawah Seksyen 326 Kanun Keseksaan. [8] At the close of the p SCJ found that the prosecution had failed to establish a prima facie case against the respondent in respect of this charge. The respondent was accordingly acquitted and discharged. C. The Findings of the SCJ [9] In view of the passing of the SCJ, no grounds of judgment were prepared. The SCJ however delivered the broad grounds of his decision on 30 July 2024 , with the parts relating to the charge under section 326 of the PC reflected in lines 13396 to 13424, as follows: Bagi elemen di bawah Seksyen 326, pihak Pendakwaan perlu membuktikan bahawa OKT1 telah mendatangkan kecederaan parah pada badan mangsa sebagaimana yang ditakrifkan di bawah Seksyen 320 Kanun Keseksaan. OKT1 mempunyai niat untuk menyebabkan cedera parah atau mempunyai pengetahuan bahawa dia mungkin akan menyebabkan kecederaan parah sebagaimana yang ditakrifkan di bawah Seksyen 322. Dan OKT menyebabkan kecederaan parah dengan menggunakan apa-apa alat atau dengan cara berbahaya sebagaimana yang S/N 3tkL0oskWEyxbuXmea3A diperuntukkan di bawah Seskyen 326. Pertuduhan yang dikenakan terhadap OKT1 adalah menyebabkan kecederaan parah menggunakan senjata playar untuk mencabut empat batang gigi mangsa. Keterangan ini hanya berdasarkan keterangan SP1 iaitu mangsa sahaja dan tanpa sokongan oleh saksi-saksi lain. Malah, SP12 mengesahkan senjata yang digunakan tidak ada dalam rampasan. Namun, Mahkamah telah meneliti keterangan SP10 yang mana beliau mengesahkan bahawa wujudnya kecederaan parah yang dialami oleh SP1 dan tahap kecederaan parah adalah akibat pukulan, tendangan, dan pijakan oleh OKT1. Mahkamah merujuk kepada Seksyen 320 yang mentakrifkan cedera parah iaitu grevious hurt iaitu destruction or permanent impairing of the powers of the member joint, of any member joints, pemanent disfiguration of the head or face, fracture or dislocation of a bone. Seksyen 10 mengesahkan sejarah yang diambil oleh bahagian kecemasan menyatakan bahawa mangsa didera berdasarkan kecederaan yang dialami. Ianya adalah konsisten dengan cara yang dibuat terhadap SP1. Tambahan lagi, kecederaan yang dialami berulang kali sehingga menyebabkan kulit muka SP1 menjadi tegang, sakit dan hilang warna kulit. Selain bengkak dan lebam yang bersifat sementara, kecederaan tersebut juga telah mengubah bentuk wajah asal SP1 di beberapa bahagian. Antaranya bibir dan hidung secara kekal dan fungsi ini terjejas dan sehingga perlu dibuat pembedahan. Memandangkan senjata yang dinyatakan dalam pertuduhan tidak dapat dikemukakan dan keterangan hanya bergantung kepada keterangan SP1 sahaja, Mahkamah berpendapat bahawa S/N 3tkL0oskWEyxbuXmea3A elemen pertuduhan di bawah Seksyen 326 tidak dapat dibuktikan oleh pihak Pendakwaan (emphasis added) [10] Based on the Broad Grounds, the SCJ acknowledged PW1 s injuries. However, the SCJ found that the elements required to be proven for an offence under section 326 of the PC had not been proven, in view of the following: a. The allegation that the respondent had used a pair of pliers to cause grievous hurt was only supported by the oral evidence of PW1, without any corroborating evidence; and b. The pair of pliers allegedly used was not tendered as evidence in court. [11] Accordingly, the SCJ acquitted and discharged the respondent in respect of the charge under section 326 of the PC, without the need to call for a defence. D. Grounds of the Appeal [12] In its petition of appeal, the main ground raised by the appellant concerns the failure to appreciate that the prosecution had proven that the respondent had caused grievous hurt to the victim. In this regard, the appellant claimed the SCJ had erred in failing to call for the S/N 3tkL0oskWEyxbuXmea3A on an amended charge of causing grievous hurt under section 325 of the PC. [13] During the hearing of the appeal, the learned Deputy Public Prosecutor confirmed that the appellant no longer wished to proceed with the charge against the respondent under section 326 of the PC. Instead, the position taken by the appellant is that a prima facie case had been proven in respect of section 325 of the PC, based on the evidence tendered during the trial. As such, it is the appellant s case that the SCJ had erred in not exercising his discretion to amend the charge pursuant to section 173(h)(ii) of the P , and to call upon the respondent to enter her defence on an amended charge under section 325 of the PC. [14] The appellant also urged this court to invoke section 167 of the CPC, read with section 316 of the CPC, and convict the respondent under section 325 of the PC, as the elements of an offence under section 325 have been met. In this regard: a. Section 167 provides that where an accused is charged with one offence and it appears in evidence that he committed a different offence for which he might have been charged, he may be convicted of the offence which he is shown to have committed, although he was not charged with it; and b. Section 316 sets out the decisions available to the court at the hearing of an appeal. S/N 3tkL0oskWEyxbuXmea3A E. Issues [15] From the grounds of appeal raised by the appellant, the court considered the following issues in the final determination of this appeal: a. Whether the SCJ had committed an error in failing to exercise his discretion to amend the charge pursuant to section 173(h)(ii) of the CPC, and to call upon the respondent to enter her defence on the amended charge under section 325 of the PC; and b. Whether the court may invoke section 167 of the CPC, read with section 316 of the CPC, and convict the respondent under section 325 of the PC. F. Issue 1: Whether the SCJ Committed an Error in Failing to Amend the Charge [16] The appellant argued that the SCJ had committed an error in failing to exercise his discretion to amend the charge against the respondent under section 326 of the PC, and to call upon the respondent to enter her defence on an amended charge under section 325 of the PC. [17] As a start, I shall refer to the relevant sections of the PC. [18] The respondent was charged under section 326 of the PC, which reads: S/N 3tkL0oskWEyxbuXmea3A voluntarily causes grievous hurt by means of any instrument for shooting, stabbing or cutting, or any instrument which, used as a weapon of offence, is likely to cause death or any scheduled weapon as specified under the Corrosive and Explosive Substances and Offensive Weapons Act 1958, or by means of fire or any heated substance, or by means of any poison or any corrosive substance, or by means of any explosive substance, or by means of any substance which it is deleterious to the human body to inhale, to swallow, or to receive into the blood, or by means of any animal, shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable t (emphasis added) [19] Section 325 provides: voluntarily causes grievous hurt, shall be punished with imprisonment for a term which may extend to seven years, and shall also be lia (emphasis added) [20] The main difference between sections 326 and 325 of the PC lies in the additional requirement under section 326, that the grievous hurt offences require proof that the accused voluntarily caused grievous hurt S/N 3tkL0oskWEyxbuXmea3A within the meaning of section 320 of the PC (which will be elaborated on below), section 326 further requires the prosecution to prove the use of a dangerous weapon or dangerous means in causing such injury. [21] The in section 320 of the PC as: emasculation;
