(ii) For the purpose of this section the accused shall not be sworn and he shall not render himself liable to punishment by refusing to answer such questions or by giving false answers to them, but the court may draw such reference from such refusal or answers as it thinks just.” The corresponding section in the Straits Settlements Code has been repealed. It is my opinion that this section is intended to be used when an accused person elects not to give evidence on his own behalf or where he had given evidence but it is discovered subsequently that he had omitted to explain certain circumstances that appear in the evidence against him. According to the section, the questions may be put at any stage of the trial but it was contended that that did not mean that the questions could be put after the case for the defence had been closed. I cannot agree with this interpretation. In my opinion the words “at any stage of the trial” must mean at any time between the commencement of the trial and the delivery of judgment.” [23] Adalah jelas dan nyata bahawa peruntukan di bawah seksyen 256 KPJ dan seksyen 165 Akta Keterangan 1950 ialah untuk memberi peluang kepada hakim bicara mengemukakan soalan bagi mendapatkan keadilan dalam satu perbicaraan. Hal ini telah dinyatakan oleh Mahkamah Rayuan dalam kes J Ramesh & Ors v. PP [2012] 1 LNS 1453 seperti yang berikut: “[31] With all due respect to the learned counsel, we do not think it was fair to suggest that the learned trial judge had descended into the arena by asking just that single question against the third appellant. As I have stated in another matter, judges do not sit on the bench stone cold. Judges are not mere umpires but must seek to do justice according to law. They ask questions and seek clarification from witnesses and parties in any form at any time. Section 165 of the Evidence Act 1950, which we do not deem it necessary to reproduce empowers the judge to do so. Again, reference must be made to s. 256 of the Criminal Procedure Code which provides specifically on the powers of the court to put questions to an accused person. [32] Lord Greene MR has explained in Yuill v. Yuill [1945] 1 All ER 183 that justice is best done by a judge who holds the balance between the contending parties without himself taking part in their disputations. If a judge should himself conduct the examination of witnesses, said Lord Greene, "he, so to speak, descends into the arena and is liable to have his vision clouded by the dust of conflict". [33] Speaking in the same tune, Denning LJ in Jones v. National Coal Board [1957] 2 QB 55 at p. 64 said: The judge's part in all this is to hearken to the evidence, only himself asking questions of witnesses when it is necessary to clear up any point that has been overlooked or left obscure; to see that the advocates behave themselves seemly and keep to the rules laid down by law; to exclude irrelevancies and discourage repetition; to make sure by wise intervention that he follow the points that the advocates are making and can assess their worth; and at the end to make up his mind where the truth lies. If he goes beyond this, he drops the mantle of a judge and assumes the robe of an advocate; and the change does not become him well. Lord Chancellor Bacon spoke right when he said that: "Patience and gravity of hearing is an essential part of justice; and an over-speaking judge is no well-tuned cymbal. and continued at p. 65 saying: Now, it cannot, of course, be doubted that a judge is not only entitled but is, indeed, bound to intervene at any stage of a witness's evidence if he feels that, by reason of the technical nature of the evidence or otherwise, it is only by putting questions of his own that he can properly follow and appreciate what the witness is saying.” [24] Walaupun begitu, Mahkamah ini berpendapat soalan-soalan yang dikemukakan kepada pihak-pihak tidak boleh sehingga menyebabkan Mahkamah sudah berada di dalam arena pertarungan di antara pihak pendakwaan dan Tertuduh. Begitu juga soalan-soalan yang dikemukakan tidak boleh memberi gambaran pendirian Mahkamah berkenaan dengan sesuatu keterangan atau kecenderungan Mahkamah di dalam kes tersebut. Jika ini berlaku maka ia akan menjejaskan perbicaraan yang adil. Hal ini telah dinyatakan oleh Mahkamah Agong dalam kes Teng Boon How v PP [1993] 3 MLJ 553 dan turut dinyatakan oleh Mahkamah Rayuan dalam kes Lim Tan Yi lwn. PP & Satu Lagi Rayuan [2021] 9 CLJ 523. Begitu juga dalam kes Rahbar Yadollah Fathi v PP [2020] 1 LNS 99. [25] Penelitian kepada kes-kes berkenaan dengan soalan-soalan yang ditanyakan oleh Mahkamah dalam satu perbicaraan menunjukkan bahawa soalan-soalan yang dikemukakan tersebut tidak wajar menunjukkan penglibatan Mahkamah sebagai Pendakwa Raya atau peguambela dalam satu kes jenayah. Soalan-soalan boleh dikemukakan dengan tujuan untuk mendapatkan penjelasan atau pencerahan kepada keterangan-keterangan yang telah dikemukakan. Ini bagi membolehkan hakim yang membuat keputusan tersebut mempunyai keterangan yang jelas berkenaan dengan pertikaian di hadapannya. Ia bukan bertujuan untuk menguatkan kes pihak-pihak yang sedang berguam di hadapan hakim tersebut. [26] Hakim Mahkamah Sesyen dalam kes ini telah mengemukakan soalan dan meminta Responden membuat tandatangan di atas kertas di D16. Hakim Mahkamah Sesyen telah membuat perbandingan tandatangan tersebut dan membuat kesimpulan bahawa tandatangan tersebut bukannya tandatangan di eksibit pengambilan botol sampel urine tersebut bukannya dibuat oleh Responden. Dalam hal ini adalah jelas menunjukkan bahawa Hakim Mahkamah Sesyen telah memberikan pandangan berkenaan dengan tulisan Responden sedangkan ia sepatutnya diberikan keterangan oleh pakar tulisan seperti yang dinyatakan di bawah seksyen 47 Akta Keterangan 1950 yang memperuntukkan seperti yang berikut: “47 Opinion as to handwriting when relevant When the court has to form an opinion as to the person by whom any document was written or signed, the opinion of any person acquainted with the handwriting of the person by whom it is supposed to have been written or signed, that it was or was not written or signed by that person, is a relevant fact. Explanation - A person is said to be acquainted with the handwriting of another person when he has seen that person write, or when he has received documents purporting to be written by that person in answer to documents written by himself or under his authority and addressed to that person, or when, in the ordinary course of business, documents purporting to be written by that person have been habitually submitted to him. ILLUSTRATIONS The question is whether a given letter is in the handwriting of A, a merchant in London. B is a merchant in Kuala Lumpur, who has written letters addressed to A and received letters purporting to be written by him. C is B's clerk, whose duty it was to examine and file B's correspondence. D is B's broker, to whom B habitually submitted the letters purporting to be written by A for the purpose of advising him thereon. The opinion of B, C and D on the question whether the letter is in the handwriting of A are relevant, though neither B, C nor D ever saw A write.” [27] Adalah penting untuk Mahkamah bicara memastikan bahawa penentuan perbezaan tandatangan adalah tidak dilakukan dengan sewenang-wenangnya. Ini adalah disebabkan selain daripada pakar tulisan tangan, saksi yang boleh mengesahkan berkenaan dengan tulisan tangan seseorang adalah perlu ditunjukkan sebagai seseorang yang biasa dengan tulisan Tertuduh dalam kes ini. Jika itu dapat ditunjukkan maka saksi tersebut dapat mengesahkan kepada Mahkamah bahawa tulisan yang tertera pada eksibit-eksibit yang dikemukakan adalah merupakan tulisan tangan Tertuduh. Kegagalan untuk menunjukkan bahawa saksi tersebut biasa dengan tulisan tangan Tertuduh boleh menyebabkan keterangannya itu tidak dapat diterima dalam membuktikan tulisan tangan tersebut. [28] Penelitian kepada kes ini adalah didapati tiada sebarang saksi yang biasa dengan tulisan Responden dikemukakan sebagai keterangan. Apa yang ada ialah perbandingan yang dibuat sendiri oleh Hakim Mahkamah Sesyen semasa menilai tulisan tangan yang dilakukan oleh Responden. Mahkamah ini mengambil perhatian kepada kedudukan seksyen 73 Akta Keterangan 1950 yang membolehkan perbandingan dibuat oleh Mahkamah.
