1 DALAM MAHKAMAH RAYUAN MALAYSIA DI PUTRAJAYA RAYUAN JENAYAH NO : A-05(SH)-132-02/2018 ANTARA PRAGASAM A/L SHGER ...PERAYU DAN PENDAKWA RAYA ...RESPONDEN [Dalam Perkara Mahkamah Tinggi Malaya di Ipoh Dalam Negeri Perak Darul Ridzuan Perbicaraan Jenayah No: AA-45A-2-02/2017 Antara Pendakwa Raya Lawan Pragasam a/l Shger] _________________________________________________________ CORAM: ABDUL RAHMAN SEBLI, JCA ZABARIAH MOHD YUSOF, JCA HASNAH MOHAMMED HASHIM, JCA 2 JUDGMENT [1] The appellant was charged with an offence of trafficking in Dangerous Drugs under section 39B (1) (a) of the Dangerous Drugs Act 1952 (DDA) and an offence of possession of dangerous drugs under section 12 (2) of the DDA. The 2 charges read as follows: 1st Charge: “Bahawa kamu pada 11.5.2016 jam lebih kurang 7.30 malam di rumah No. 127, Jalan Pangkalan Barat 32, Taman Putri Lindungan Bulan, Pasir Puteh, 31650 Ipoh, di dalam Daerah Kinta, di dalam Negeri Perak telah mengedar dadah berbahaya seberat 110.1 gram (101.2 gram Heroin dan 8.9 gram Monoacetylmorphines) dan oleh yang demikian kamu telah melakukan satu kesalahan di bawah Seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah Seksyen 39B(2) Akta yang sama.” 2nd Charge: “Bahawa kamu pada 11.5.2016 jam lebih kurang 7.30 malam di rumah No. 127, Jalan Pangkalan Barat 32, Taman Putri Lindungan Bulan, Pasir Puteh, 31650 Ipoh, di dalam Daerah Kinta, telah didapati memiliki dadah berbahaya seberat 36.6 gram Methamphetamine dan oleh yang demikian kamu telah melakukan satu kesalahan di bawah Seksyen 12(2) Akta Dadah Berbahaya 1952 dan boleh dihukum dibawah Seksyen 39A(2)(r) Akta yang sama.” 3 [2] After a full trial the learned trial Judge convicted and sentenced the appellant to death under section 39B(2) of the DDA for the 1st charge. As for the 2nd charge, the appellant was convicted and sentenced to 8 years imprisonment effective from the date of arrest under section 39(A)(2) of the same. BACKGROUND FACTS: [3] On 11.5.2016 around 7.00 p.m., SP 5 led a raiding team of police officers on a house at the address as stated in the charges. The police officers had to climb over the fence to the said house as the gate was locked. However, the front door to the house was unlocked. [4] Upon entry to the said house, the appellant was seen standing inside the 1st room. The appellant was said to be in a state of shock and appeared scared. Upon a bodily search, nothing incriminating on the appellant was found. [5] The police raiding team found substance, suspected to be drugs on a table inside the room where the appellant was seen standing. The substances found were:
