11.15 When the award was initially granted, the consideration must have been based on the damage sustained at the time the Land Administrator acquired the Scheduled Land. LLM’s approval for the realignment of the raised U-turn ramp was granted on 30-8-2022. The compensation award was issued to the applicant on 21-3-2025. The primary aim of reorienting the elevated U-turn ramp was to address any purported concerns regarding the safety and comfort of the applicant, the occupant of the residential home. Therefore, the reorientation of the ramp will influence the cost factors to be included in the award to the applicant, making it S/N uMskRWQ40ka9S2hxKgd95g essential for EKVE to intervene. And it cannot be ignored that, in Spicon Products Sdn Bhd v Tenaga Nasional Bhd & Anor [2022] 4 CLJ 195, the Federal Court held that it is no longer the law in Malaysia that only the Land Administrator has the right to defend the paymaster's interests. Therefore, this case is deemed appropriate and suitable for EKVE to intervene in the current proceedings. Conclusion 12. This Court, having carefully examined the aforementioned reasons, hereby rules that the application submitted by EKVE shall be granted, including all associated costs.
