Abdul Jailani] CORAM: KAMARDIN HASHIM, JCA RHODZARIAH BUJANG, JCA MOHAMAD ZABIDIN MOHD DIAH, JCA Criminal Appeal No: M-05(H)-5-01/2019 2 JUDGMENT OF THE COURT [1] Both the Respondents, a father and son who are Indonesian nationals, were jointly charged in the High Court at Malacca for an offence of smuggling of migrants, an offence under section 26A of the Anti-Trafficking In Persons and Anti-Smuggling of Migrants Act 2007 (‘the Act’). The offence punishable under the same section shall on conviction be punished with imprisonment term not exceeding fifteen years, and shall also be liable to fine, or to both. [2] The charge reads as follows: “Bahawa kamu bersama-sama pada 5/11/2018 jam lebih kurang 12.30 tengah malam di Kedudukan Laut Pulau Upeh Koordinat Latitud 2-11.3, Longitud 102-10.4, Jalan Klebang Besar Pulau Upeh, dalam daerah Melaka Tengah, di dalam Negeri Melaka telah melakukan penyeludupan migran iaitu: a) Mohd Akmat (No. Paspot: Tiada) b) Edi Saputra Bin Ismail (No. Paspot: Tiada) c) Nurhidayah (No. Paspot: B4895829) d) Samra Hutagalung (No. Paspot: B-0828408) dan dengan demikian, kamu telah melakukan suatu kesalahan yang boleh dihukum di bawah seksyen 26A Akta Antipemerdagangan Orang dan Antipenyeludupan Migran 2007 (Akta 670) dan dibacakan bersama seksyen 34 Kanun Keseksaan.” Criminal Appeal No: M-05(H)-5-01/2019 3 [3] The Respondents pleaded guilty to the charge. The learned High Court Judge (‘learned trial judge’) sentenced each of the Respondent to a five years imprisonment with effect from the date of arrest i.e. 5 November 2018. [4] The Public Prosecutor appealed to this Court against the inadequacy of sentence imposed by the learned trial judge. We heard the appeal on 12 September 2019 and unanimously dismissed the appeal. We now give our reasons. Facts [5] The facts relating to the offence as presented by the prosecution (P4) were narrated and admitted by the Respondents as follows: “1. Pada 4.11.2018 jam lebih kurang 11.00 malam, Pengadu iaitu Kpl Muhammad Asyraf Bin Rusli (No. Badan: RF176007) telah memulakan tugas rondaan OP Gelora Siri 464/2018 bersama-sama dengan Kpl 128492, Kpl 139916 dan Kpl 175926 di kawasan Perairan Melaka dengan menggunakan Bot Rigid Hull Fenders Boat 22 yang mana Pengadu dan anggota yang lain telah berlepas dari Pengkalan Polis Marin Wilayah 2, Kompleks ICQS, Melaka.

Pada 5.11.2018 jam lebih kurang 12.30 tengah malam, semasa Pengadu membuat rondaan di kawasan Perairan Pulau Upeh, Melaka, di Koordinat Latitud 2-11.3, Longitud 102-10.4, Pengadu telah ternampak sebuah bot pancung dalam keadaan mencurigakan yang mana bot pancung tersebut sedang menuju ke perairan Pulau Rapat, Indonesia. Pengadu kemudiannya telah menghampiri bot pancung tersebut dan telah mengarahkan supaya bot pancung tersebut berhenti. Apabila pemandu bot pancung tersebut Criminal Appeal No: M-05(H)-5-01/2019 4 memberhentikan bot, Pengadu dan anggota yang lain telah menaiki ke atas bot pancung tersebut dan telah membuat pemeriksaan dan mendapati terdapat empat (4) lelaki dan dua (2) perempuan warganegara Indonesia di dalam bot tersebut.

Pengadu kemudiannya telah memperkenalkan diri sebagai Anggota Polis dengan menunjukkan kad kuasa polis kepada kesemua penumpang bot tersebut. Pengadu kemudiannya telah membuat pemeriksaan di bahagian belakang bot tersebut dan mendapati terdapat dua (2) lelaki Indonesia yang mengendalikan enjin bot tersebut. Pengadu kemudiannya telah meminta pengenalan diri daripada dua (2) lelaki Indonesia tersebut namun tiada dokumen telah diberikan oleh kedua lelaki tersebut. Pengadu kemudiannya telah meminta kedua lelaki tersebut memberikan nama secara lisan yang mana lelaki pertama telah memperkenalkan dirinya sebagai Ahmad Anuar (Tertuduh Pertama) manakala lelaki kedua pula telah memperkenalkan dirinya sebagai Abdul Jailani (Tertuduh Kedua).

Seterusnya, Pengadu telah membuat pemeriksaan di bahagian penumpang bot dan mendapati terdapat dua (2) lelaki dan dua (2) perempuan yang mana kesemuanya adalah warganegara Indonesia. Pengadu kemudiannya telah meminta pengenalan diri yang mana kesemuanya telah memberikan nama secara lisan seperti berikut: a) Mohd Akmal b) Edi Saputra Bin Ismail c) Nurhidayah d) Samra Hutagalung

Pengadu kemudiannya telah membuat pemeriksaan terhadap bot pancung tersebut dan mendapati bot pancung tersebut berukuran lebih kurang panjang 20 kaki dan lebar 4 kaki. Pengadu juga Criminal Appeal No: M-05(H)-5-01/2019 5 mendapati bahawa bot pancung tersebut mempunyai dua enjin jenis Yamaha 30HP dan no chasis adalah 05X1936 dan 02X0399.

Pengadu kemudiannya telah menangkap kesemua penumpang dan pengendali bot tersebut dan telah membawa kesemua penumpang dan bot pancung tersebut balik ke pengkalan bagi tindakan lanjut. Satu laporan polis telah dibuat sepertimana BTG TIGA/002753/18.

Pada 5.11.2018 jam lebih kurang 12.00 tengahari, bertempat di Pejabat D7 Ibu Pejabat Polis Daerah Melaka Tengah, Melaka, Inspektor Mohamed Azmir Bin Mohamed Rawi (No. Badan: G22156) telah menangkap Tertuduh Pertama dan Tertuduh Kedua di bawah seksyen 4 Akta Keselamatan (Langkah-Langkah Khas) 2012. Satu laporan polis telah dibuat sepertimana MTR/010352/18.

Keterangan menunjukkan bahawa Mohd Akmal (No. paspot: tiada) berasal dari Desa Tuha Acheh Indonesia. Pada bulan Jun 2018, Mohd Akmal telah datang ke Malaysia menaiki feri dari Dumai, Indonesia ke Pasir Gudang, Johor, Malaysia. Mohd Akmal kemudiannya telah bekerja sebagai penjual sayur di Pasar Chow Kit dengan gaji harian RM50.00. Mohd Akmal bekerja dari pukul 4.00 pagi hingga pukul 4.00 petang setiap hari. Pada 3.11.2018, Mohd Akmal telah berjumpa dengan rakan sekampungnya iaitu Edi Saputra Bin Ismail (No. Paspot: tiada). Pada ketika itu, Edi sedang berbual melalui telefon dengan seorang lelaki Indonesia yang dikenali sebagai “Wak”. Edi telah memberitahu Wak bahawa beliau ingin pulang ke Indonesia. Apabila Mohd Akmal mengetahui yang Edi ingin pulang ke Indonesia, beliau telah memaklumkan kepada jam lebih kurang 12.00 tengahari, Mohd Akmal dan Edi telah pergi ke perhentian bas sebelah Masjid Kampung Baru, Kuala Lumpur. Apabila mereka sampai di perhentian bas, Mohd Akmal dan Edi telah bertemu dengan seorang lelaki bernama Iwan. Iwan telah membawa Mohd Akmal dan Edi ke sebuah rumah yang mana tidak Criminal Appeal No: M-05(H)-5-01/2019 6 pasti lokasinya. Apabila sampai di rumah tersebut, Mohd Akmal dan Edi telah nampak seorang perempuan Indonesia yang mana dikenali sebagai Samra Hutagalung yang Samra juga ingin pulang ke Indonesia. Kemudiannya, Iwan telah membawa Mohd Akmal, Edi, Samra ke kawasan Masjid Gombak, Kuala Lumpur yang mana terdapat seorang lagi perempuan Indonesia yang diambil. Perempuan tersebut dikenali sebagai Nurhidayah. Iwan kemudiannya telah membawa Mohd Akmal, Edi, Samra dan Nurhidayah ke Melaka menaiki kereta. Lebih kurang 8.00 malam, mereka telah sampai di Melaka dan telah dibawa ke sebuah rumah flat yang beralamat Blok J, 4A-10 Rumah Pangsa Taman Merdeka, Batu Berendam, Melaka. Selanjutnya, Iwan telah menyuruh Mohd Akmal, Edi, Samra dan Nurhidayah masuk ke rumah tersebut. Kesemua mereka telah disuruh untuk berehat. Selepas setengah jam, seorang lelaki telah berjumpa dengan Mohd Akmal, Edi, Samra dan Nurhidayah telah memberitahu bahawa bot sudah menghampiri pantai dan terus mengarahkan Mohd Akmal, Edi, Samra dan Nurhidayah untuk turun ke bawah menaiki kereta. Iwan sudah menunggu di dalam kereta. Apabila kesemua telah masuk ke dalam kereta, Iwan telah memandu kereta tersebut menuju ke pantai. Apabila sampai di kawasan pantai, Iwan telah memberhentikan kereta dan telah memberitahu sudah sampai di tempat yang dituju. Mohd Akmal, Edi, Samra dan Nurhidayah telah diarahkan turun dari kereta dan menyorok di sebuah batu. Tidak lama kemudian, seorang lelaki Indonesia telah menyuruh Mohd Akmal, Edi, Samra dan Nurhidayah untuk turun ke pantai melalui sebuah kawasan yang berbatu. Tidak lama kemudian, Mohd Akmal, Edi, Samra dan Nurhidayah telah nampak sebuah bot sedang menurunkan dua lelaki dan 2 perempuan yang mana mereka telah naik ke daratan. Lelaki Indonesia tersebut kemudiannya telah pergi ke arah bot dan telah bertemu dengan Wak iaitu Tertuduh Pertama. Lelaki Indonesia tersebut telah memberikan sesuatu kepada Tertuduh Pertama yang mana ianya adalah wang. Ini telah disaksikan oleh Mohd Akmal, Edi, Criminal Appeal No: M-05(H)-5-01/2019 7 Samra dan Nurhidayah. Selanjutnya, Mohd Akmal, Edi, Samra dan Nurhidayah telah diarahkan untuk menaiki bot. Di dalam bot tersebut, terdapat Tertuduh Kedua iaitu pembantu kepada Tertuduh Pertama. Tertuduh Pertama dengan pantas mengemudi bot keluar dari kawasan pantai tersebut. Semasa berdekatan dengan sebuah pulau, bot tersebut telah ditahan oleh Pengadu. Kesemua mereka termasuk Tertuduh Pertama dan Kedua telah ditangkap dan dibawa balik ke pengkalan untuk tindakan lanjut.

Keterangan juga menunjukkan bahawa Mohd Akmal dan Edi telah membayar sebanyak RM1000 kepada Iwan dan Wak yang mana Edi telah berhubung adalah Tertuduh Pertama.

Selanjutnya, Nurhidayah telah membayar sebanyak RM1500 manakala Samra Hutagalung telah membayar sebanyak RM1700 bagi tujuan menguruskan urusan kepulangan ke Indonesia.

Hasil siasatan yang telah dijalankan oleh Pegawai Penyiasat iaitu ASP Suffian Bin Mohd Jani adalah seperti berikut: a) Tertuduh Pertama merupakan bapa kepada Tertuduh Kedua. b) Tertuduh Pertama merupakan pengemudi bot pancung yang telah mengambil Mohd Akmal, Edi Saputra, Nurhidayah dan Samra Hutagalung di pantai bagi tujuan untuk membawa mereka balik ke Indonesia. Tertuduh Pertama telah dibantu oleh Tertuduh Kedua. c) Bot pancung yang digunapakai bagi tujuan membawa Mohd Akmal, Edi Saputra, Nurhidayah dan Samra Hutagalung pulang ke Indonesia merupakan milik Tertuduh Pertama. d) Mohd Akmal (no. paspot: tiada), Edi Saputra Bin Ismail (no. paspot: tiada), Nurhidayah (no. paspot: B4895829) dan Samra Criminal Appeal No: M-05(H)-5-01/2019 8 Hutagalung (no. paspot: B0828408) camkan rumah beralamat Blok J, 4A-10 Rumah Pangsa Taman Merdeka, Batu Berendam, Melaka sebagai rumah persinggahan di Melaka sebelum mereka dibawa ke pantai. e) Mohd Akmal (no paspot: tiada), Edi Saputra Bin Ismail (no. paspot: tiada), Nurhidayah (no. paspot: B4895829) dan Samra Hutagalung (no. paspot: B0828408) juga camkan Tertuduh Pertama sebagai pengemudi bot manakala Tertuduh Kedua sebagai penolong pengemudi bot yang mereka telah naik untuk pulang ke Indonesia. f) Mohd Akmal dan Edi Saputra juga mengecamkan Tertuduh Pertama sebagai Wak.

Pada tarikh 3.12.2018, Mohd Akmal dan Edi Saputra Bin Ismail telah disabitkan dan dijatuhkan hukuman di bawah seksyen 6 (1) (c) Akta Imigresen 1959/63 manakala Nurhidayah dan Samra Hutagalung pula telah disabitkan dan dijatuhkan hukuman di bawah seksyen 15

Oleh yang demikian, Tertuduh Pertama dan Tertuduh Kedua telah melakukan kesalahan di bawah seksyen 26A Akta Pemerdagangan Orang dan Antipenyeludupan Migran 2007 kerana telah melakukan penyeludupan migran iaitu Mohd Akmal (no. paspot: tiada), Edi Saputra Bin Ismail (no. paspot: tiada), Nurhidayah (no. paspot: B4895829) dan Samra Hutagalung (no. paspot: B0828408) dan dibacakan bersama seksyen 34 Kanun Keseksaan.” [6] In determining the appropriate sentence, the learned trial judge had regards to the facts and circumstances of the case, nature of the offence committed, the public interest factor and as well as the mitigating factors. Beside imposing sentence of 5 years imprisonment on each of the Criminal Appeal No: M-05(H)-5-01/2019 9 Respondent, the learned trial judge had in exercise of his discretion had ordered forfeiture of the conveyance used (the boat) under section 36(1) of the Act. [7] In his judgment, the learned trial judge had considered the offence committed by the Respondents was very serious which threatened the security of the nation, the rampancy of such offence nowadays which warranted a more deterrent sentence. We observed that the learned trial judge had balanced the public interest factor with that of the interest of both Respondents. There can be seen in his Lordship judgment at pages 24 – 27 of the Appeal Record Volume 1: “12. Adalah menjadi prinsip undang-undang yang mantap bahawa kuasa menentukan bentuk hukuman adalah kuasa budi bicara Hakim Bicara. Faktor-faktor yang perlu diambil kira antaranya adalah jenis kesalahan, kekerapan kesalahan tersebut berlaku, kepentingan awam, pengakuan salah, umur dan kesihatan tertuduh juga faktor-faktor sekeliling yang mempengaruhi berlakunya kesalahan tersebut.

Dalam situasi kes ini, Mahkamah mengambil pendekatan bahawa kepentingan awam harus diutamakan berbanding kepentingan tertuduh-tertuduh. Pada pendapat Mahkamah, kepentingan awam tidak bermakna Mahkamah tidak diberi pilihan hukuman selain hanya menjatuhkan hukuman berat sahaja. Dalam konteks ini, Mahkamah harus melihat apakah hukuman penjara maksima sahaja yang boleh menjadi satu-satu pilihan untuk memberi pengajaran kepada Tertuduh-tertuduh supaya merasai akan akibat perbuatan mereka dan memberi amaran kepada masyarakat supaya tidak melakukannya. Pada pendapat Mahkamah, tempoh pemenjaraan yang lama tidak akan mencapai matlamat hukuman itu sendiri. Ini kerana tujuan hukuman bukan untuk mendera seseorang tetapi lebih kepada memulihkan seseorang ke arah kehidupan yang lebih baik. (Rujuk PP v Loo Choon Fatt [1976] 2 MLJ 256). Dalam ertikata lain, Tertuduh Pertama sudah berumur 60 an, menjadi ketua keluarga, kehidupan keluarga miskin dan tiada pilihan pekerjaan selain mengendali bot pancung dengan mengambil upah membawa penumpang. Jika Tertuduh Pertama dikenakan hukuman penjara yang lama, keluarganya akan terkesan kerana dialah sahaja yang menanggung keluarga. Oleh itu hukuman 5 tahun penjara dari tarikh tangkap adalah memadai dan munasabah.

Bagi Tertuduh Kedua, dia tidak menyatakan umurnya tetapi pada pandangan Mahkamah dia masih muda. Dia bekerja membantu bapanya mengambil upah membawa penumpang dengan menggunakan bot pancung tersebut. Ini adalah kesalahan yang pertama. Sama seperti bapanya. Tertuduh Kedua membuat pengakuan salah sebaik sahaja kali pertama dikemukakan di Mahkamah. Mahkamah dapat melihat penjelasan yang ikhlas oleh kedua-dua Tertuduh semasa membuat mitigasi meringankan hukuman. Kedua-duanya menangis dan merayu supaya diberikan hukuman yang ringan. Justeru, Mahkamah berpendapat hukuman 5 tahun penjara dari tarikh tangkap sudah memadai sebagai pengajaran. Selain itu, mereka juga kehilangan bot pancung kerana dilucuthak kepada Kerajaan. Hal keadaan ini sudah cukup mengajar mereka supaya tidak mengulangi kesalahan yang sama lagi. Criminal Appeal No: M-05(H)-5-01/2019 11

Kesimpulan Berdasarkan alasan-alasan di atas, Mahkamah merumuskan bahawa hukuman 5 tahun penjara dari tarikh tangkap munasabah dan memadai.” [8] We agree with the views of the learned trial judge. We did not find his Lordship erred in the principle of sentencing of balancing the public interest with that of the Respondents’ interest. [9] The learned Deputy Public Prosecutor (‘learned Deputy’) urged this Court to take a serious view of the offence committed by the Respondents due to the gravity and seriousness of the offence. Learned Deputy had referred to the trend of sentencing in similar cases which shows that the sentence imposed previously was between 3 to 10 years imprisonment. [10] This bring us to the sentencing principle enunciated by Hashim Yeop A. Sani J in the often cited case of PP v. Loo Choon Fatt [1976] 632 MLJ 256; [1976] 1 LNS 102: “In respect of sentencing there can be only general guidelines. No two cases can have exactly the same facts to the minutest detail. Facts do differ from case to case and ultimately each case has to be decided on its own merits. In practice sentences do differ not only from case to case but also from court to court. All things being equal these variations are inevitable if only because of the human element involved. But, of course, there must be limits to permissible variations. The principles to be applied in imposing sentence however are the same in every case. The High Court sitting in exercise of its revisionary powers will not normally alter the sentence unless it is satisfied, that the sentence Criminal Appeal No: M-05(H)-5-01/2019 12 of the lower court is either manifestly inadequate or grossly excessive or illegal or otherwise not a proper sentence having regard to all the facts disclosed on the record or to all the facts which the court ought to take judicial notice of, that is to say, that the lower court clearly has erred in applying the correct principles in the assessment of the sentence. It is a firmly established practice that the court will not alter a sentence merely because it might have passed a different sentence.” [11] We are mindful with the words of His Royal Highness the Sultan of Perak, Raja Azlan Shah Ag. LP in Bhandulananda Jayatilake v. PP [1981] 1 LNS 139; [1982] 1 MLJ 83 at page 84 said: “Is the sentence harsh and manifestly excessive? We would paraphrase it in this way. As this is an appeal against the exercise by the learned judge of a discretion vested in him, is the sentence so far outside the normal discretionary limits as to enable this court to say that its imposition must have involved an error of law of some description? I have had occasion to say elsewhere, that the very concept of judicial discretion involves a right to choose between more than one possible course of action upon which there is room for reasonable people to hold differing opinions as to which is to be preferred. That is quite inevitable. Human nature being what it is, different judges applying the same principles at the same time in the same country to similar facts may sometimes reach different conclusions (see Jamieson v. Jamieson(1)). It is for that reason that some very conscientious judges have thought it their duty to visit particular crimes with exemplary sentences; whilst others equally conscientious have thought it their duty to view the same crimes with leniency. Therefore sentences do vary in apparently similar circumstances with the habit of mind of the particular judge. It is for that reason also that this court has said it again and again that it will not normally interfere with sentences, and the possibility or even the Criminal Appeal No: M-05(H)-5-01/2019 13 probability, that another court would have imposed a different sentence is not sufficient, per se, to warrant this court’s interference. For a discretionary judgment of this kind to be reversed by this court, it must be shown to our satisfaction that the learned judge was embarking on some unauthorised or extraneous or irrelevant exercise of discretion. We are far from convinced that any criticism of the learned judge is warranted. He took the course he did, in outweighing the plea of mitigation in favour of the public interest with a desire to uphold in favour of the public interest with a desire to uphold the dignity and authority of the law as administered in this country. We agree. That must receive the greatest weight. It is a serious offence to give false testimony, for it is in the public interest that the search for truth should, in general and always, be unfettered. The courts are the guardians of the public interest (see the Exclusive Brethren case(2)).” [12] What can be gleaned from the two often cited cases above were these: (i) variations in sentence alone is not a good ground to disturb the sentence imposed by the Court below; (ii) that the appellate court will only alter the sentence if the sentence imposed by the lower court is manifestly inadequate or excessive or illegal or improper sentence by not giving regard to facts and circumstances of the case; (iii) when the lower court erred in applying the correct principles of sentencing; (iv) the sentence of the lower court can be reversed when the learned trial judge was embarking on some unauthorised or extraneous or irrelevant exercise of discretion in imposing the impugned sentence. [13] Coming back to the instant appeal before us, we had considered whether the learned trial judge’s sentence was manifestly inadequate. As we alluded to earlier in our judgment, we did not find any error on the part of the learned trial judge on the principle of sentencing he applied in this Criminal Appeal No: M-05(H)-5-01/2019 14 case. Based on the trend of sentencing submitted by the learned Deputy before us, we did not find that the sentence of 5 years imprisonment imposed by the learned trial judge to be manifestly inadequate. Therefore, we are not persuaded by the complaint of the learned Deputy that the sentence imposed was manifestly inadequate. [14] On the above considerations, the appeal was devoid of any merits. The appeal by the prosecution against the inadequacy of the sentence was dismissed. The sentences of 5 years imprisonment on the Respondents by the High Court was affirmed.
