Eusoffe Abdoolcader (HMP) dalam kes Dato’ Mokhtar Hashim v PP [1983] 2 CLJ 10 telah merujuk kepada Seksyen 134 AK 1950 dan menyatakan seperti berikut: “On the number of witnesses called to support the defence of alibi, we pause to observe 'testes ponderantur, non numerantur' (witnesses are weighed, not numbered or counted), that is, in case of a conflict of evidence, the truth is to be sought by weighing the credibility of the respective witnesses, not by the mere numerical preponderance on one side or the other - a principle ossified and reflected in the provisions of s. 134 of the Evidence Act.”
