BHD. …Defendan 24/03/2025 15:50:52 BA-24NCvC-1395-07/2024 Kand. 29 GROUNDS OF JUDGMENT Introduction [1] This is an application for an injunction by Plaintiff to restrain Defendant from proceeding further with its Adjudication against Plaintiff pursuant to the Construction Industry Payment & Adjudication Act 2012 (CIPAA). [2] After hearing both parties, I dismissed the application with cost (the Originating Summon via enclosure 1) and hence this appeal to the Court of Appeal. [3] Below are my reasons. The Parties [4] The Plaintiff is a property developer and employer of a project in Bandar Country Homes, Gombak (the project). Defendant is a company in the construction industry and the main contractor for the project appointed by Plaintiff via Letter of Award dated 29.10.2018. The contract sum was RM92,356,854.10 (RM56,115,454.10 to the Defendant and RM36,241,400.00 to the Nominated Sub-Contractors). The Adjudication Proceeding [5] On 4.8.2022, a Payment Claim was made by Defendant pursuant to section 5 of CIPAA (First Payment Claim) for an amount certified in the interim certificate for work executed. An Adjudication Claim was then served in accordance with section 9(1) of CIPAA (First Adjudication). [6] The Adjudicator in the First Adjudication delivered his Adjudication Decision on 6.1.2023 (Adjudication Decision). The Adjudicator concluded that Defendant's claim was "zerorised and dismissed". [7] Aggrieved with the Adjudication Decision, the Defendant commenced proceedings to set aside the Adjudication Decision by way of Originating Summons No.: WA-24C-5-01/2023 in the Kuala Lumpur High Court (KLHC). [8] On 18.5.2023, the KLHC allowed the Defendant's setting aside application, thereby rendering the Adjudication Decision void and without any effect. [9] The Plaintiff filed an appeal on 24.5.2023 against the entirety of the order but did not seek a stay of the order. [10] On 21.6.2024, Defendant initiated a new adjudication process pursuant to CIPAA and issued a Payment Claim dated 21.6.2024 (Second Adjudication) under Section 5 of CIPAA to Plaintiff. The Defendant claimed a sum of RM13,476,416.62 according to the Defendant's Progress Claim (Final Account). Following this, Plaintiff proceeded to serve a Payment Response dated 5.7.2024 under Section 6 of CIPAA on Defendant. [11] Plaintiff filed this application to restrain the Defendant from proceeding with the Second Adjudication on the following grounds:
