- These Grounds of Judgment set out the Court’s reasons for dismissing the Plaintiff’s application under Order 18 rule 19 of the Rules of Court 2012 (Enclosure 58) to strike out substantial portions of the Defendant’s Defence. The Plaintiff contended that the Court of Appeal had conclusively determined liability in its favour when allowing the Defendant’s appeal in an earlier setting aside application, thereby giving rise to issue estoppel and rendering the impugned parts of the Defence unsustainable and an abuse of process. The Defendant argued that the Court of Appeal’s decision arose only in the context of interlocutory proceedings and did not amount to a final determination of liability, maintaining that the Defence raised genuine triable issues requiring a full trial. The Court considered, but found it unnecessary to determine, the Defendant’s procedural objection to the Plaintiff’s reliance on multiple limbs of Order 18 rule 19. Even assuming the application was procedurally proper, the Court held that it failed on its merits. The Court found that the Court of Appeal’s earlier decision did not create issue estoppel or res judicata and that the Defence raised substantial issues concerning privity, Stallion Empire, invoices, payment structures and computations. As these matters required full evidential examination, the Defence was not plainly unsustainable. Accordingly, Enclosure 58 was dismissed with costs of RM3,000 to the Defendant, and the matter was directed to proceed to case management
