Dalam hal ini, sebagaimana yang dirujuk dalam hujahan oleh pihak-pihak, dalam membuat keputusan, kami berpandukan kepada keputusan Mahkamah Persekutuan di dalam kes Samat bin Yamin v. Public Prosecutor [2023] 6 CLJ 1; [2023] 4 MLJ 613 yang mana Mahkamah Persekutuan telah menerangkan mengenai tahap kesakitan atau keuzuran seseorang yang sewajarnya dipertimbangkan oleh Mahkamah semasa membenarkan permohonan pemohon untuk dilepaskan dengan jaminan menurut perenggan 13(2)(c) SOSMA sebagaimana berikut: “... Of course, the law does not specify exactly the extent and severity of the illness and infirmity which allows the granting of the said leeway, but again with the object of SOSMA in mind, it cannot be that any illness be a ground to exercise that right to bail for surely the severity of the medical conditions plays a major role in the court's consideration should an application be made on the said grounds. Thus, it is for the court to determine, based on the degree of the illness the accused person and the infirmity he suffered, backed no less by a conclusive medical evidence, that it would be just and fair for the person so charged to be freed on bail whilst awaiting the conclusion and decision of the court on the charge so preferred against him. Otherwise, it would make a mockery of the law should run of the mill illnesses, such as those specified by the applicant herein, be the justification to grant him the freedom he seeks given that the said illnesses are not even life threatening,...” (Penekanan ditambah.)
