Teo Heng Wei (OKT) di dalam kes ini telah dihadap dengan pertuduhan berikut: 30/07/2026 10:10:59 Kand. 65 Pertuduhan Bahawa kamu pada 30.12.2023 jam lebih kurang 5.10 petang bertempat di C30-3A, Bangunan Trefoil, Setia City, Jalan Setia Dagang AH U13/AH, Setia Alam, 40170 Shah Alam, dalam daerah Petaling, di dalam Negeri Selangor Darul Ehsan telah didapati mengedar dadah berbahaya sejumlah berat 500.3 gram campuran Heroin dan Monoacetylmorphine (474 gram Heroin dan 26.3 gram Monoacetylmorphine) dan dengan itu kamu telah melakukan suatu kesalahan di bawah seksyen 39B (1)(a) Akta Dadah Berbahaya 1952 [Akta 234] yang boleh dihukum di bawah seksyen 39B(2) Akta yang sama. Hukuman: Mati atau penjara seumur hidup hendaklah, jika dia tidak dihukum dengan hukuman mati, dihukum dengan sebatan yang tidak kurang daripada dua belas tahun.

Pada akhir kes pendakwaan, setelah menilai secara maksima keterangan saksi pendakwaan dan dokumen-dokumen yang dikemukakan, Mahkamah ini membuat dapatan pihak pendakwaan telah gagal membuktikan suatu kes prima facie terhadap OKT. Mahkamah ini memerintahkan untuk melepas dan membebaskan OKT daripada pertuduhan dan OKT tidak dipanggil untuk membela diri.

Tidak berpuas hati atas keputusan Mahkamah ini, pihak pendakwaan telah memfailkan rayuan ke Mahkamah Rayuan. Berikut adalah alasan penghakiman Mahkamah ini.

Pihak Pendakwaan telah memanggil seramai 6 orang saksi bagi membuktikan kes terhadap OKT iaitu seperti berikut: SP1 Thong Chee Leng (pemilik rumah ) SP2 Marcus Ng Boon Aik (Pengarah Yamada Holdings) SP3 Noor Amalina Mahpod (pekerja Yamada Holdings) SP4 Nur Ikadewi binti Sarimin (Ahli kimia) SP5 Insp Izzman bin Mohd Idrus (Pegawai serbuan) SP6 Insp Rozaimy bin Abdul Rahim (Pegawai penyiasat)

Pada 30.12.2023 jam lebih kurang 5.10 petang, pengadu (SP5) dan anggota serbuan telah pergi ke lobi bangunan Trefoil, Jalan Setia Dagang AH U13/AH, Setia Alam, Shah Alam. Sampai di lobi tersebut, SP5 telah melihat dua orang lelaki Cina dalam keadaan mencurigakan. SP5 telah menghampiri kedua-dua lelaki tersebut dan memperkenalkan diri sebagai polis. Lelaki pertama adalah tertuduh dalam kes ini manakala lelaki kedua bernama Lee Kuai Foo (B2).

SP5 telah membuat pemeriksaan badan ke atas kedua-dua lelaki tersebut namun tidak menjumpai apa-apa barang salah. Seterusnya, SP5 telah dikatakan dipandu arah oleh tertuduh dan B2 ke sebuah unit rumah apartment di C30-3A, Bangunan Trefoil dan apabila sampai di rumah tersebut, tertuduh telah menggunakan kunci untuk membuka pintu rumah tersebut.

Tertuduh telah masuk ke dalam rumah dan menunjukkan barang kes yang ditandakan sebagai M1 yang berada di atas lantai dalam rumah tersebut kepada SP5.

SP5 telah merampas kesemua barang kes dan menahan kedua-dua lelaki tersebut. Barang kes dan kesemua OKT telah dibawa balik ke Balai Polis Seksyen 6 untuk diserahkan kepada Pegawai Penyiasat untuk siasatan lanjut.

Hasil analisa dari Jabatan Kimia Malaysia mendapati bahawa barang kes merupakan dadah berbahaya sebagaimana pertuduhan.

OKT dan B2 telah direman pada 31.12.2023 dan dilanjutkan perintah reman sehingga 6.1.2024. SP6 menyatakan B2 dilepas dan hanya OKT didakwa di dalam kes ini.

Berkaitan elemen pertama pertuduhan, identiti dadah, pihak pendakwaan menghujahkan tidak ada pertikaian mengenai jenis dadah dalam kes ini. Barang rampasan telah dihantar ke Jabatan Kimia Malaysia untuk dianalisa oleh SP4 dan hasil analisa adalah sebagaimana yang terkandung dalam laporan kimia eksibit P8.

Manakala untuk elemen kedua pertuduhan, pihak pendakwaan bergantung sepenuhnya kepada keterangan SP5/pegawai serbuan yang menyatakan pada hari kejadian beliau dan anggota serbuan telah pergi ke lobi bangunan Trefoil, Jalan Setia Dagang AH U13/AH, Shah Alam dan menahan OKT dan seorang lagi lelaki Cina (B2) di lobi tersebut kerana kelihatan mencurigakan.

SP5 seterusnya menyatakan bahawa OKT dan rakannya telah membawa SP5 dan anggota serbuan ke sebuah unit rumah apartment dalam bangunan yang sama iaitu di unit C30-3A.

SP5 melihat OKT telah mengambil kunci yang diambil dari poket seluarnya dan membuka pintu kayu rumah tersebut. Kemudian, setelah mereka masuk ke rumah, OKT telah menunjukkan 1 bungkusan plastik sampah yang berwarna biru di atas lantai dan hasil pemeriksaan telah menjumpai 70 ketulan plastik berwarna hitam dan 20 ketulan plastik berwarna putih yang disyaki dadah jenis Heroin.

Selanjutnya, SP3/pekerja bangunan Trefoil menyatakan yang beliau telah dihubungi oleh pengawal keselamatan bangunan tersebut, yang bernama James pada 22.12.2023 dalam jam 11 malam yang bertanyakan bilik kosong kerana pengawal keselamatan tersebut telah mendapat permintaan daripada seorang pelanggan yang ingin menyewa sebuah unit di situ untuk beberapa hari.

Disebabkan hari yang telah lewat, SP3 telah pulang, proses penempahan yang dijalankan hanyalah melalui komunikasi whatsapp antara SP3 dan pengawal keselamatan tersebut yang mana SP3 telah meminta pengawal keselamatan itu untuk memberikan kad pengenalan (IC) pelanggan dan bayaran sewa untuk unit tersebut.

SP3 menyatakan yang pendaftaran dibuat atas nama OKT berdasarkan IC OKT dan apabila James telah membuat bayaran, SP3 telah memberikan ‘password’ bagi ‘storage box’ yang menyimpan kunci di unit tersebut.

SP3 menyatakan bahawa melalui James, OKT telah membuat tempahan pertama pada 22.12.2023 hingga 27.12.2023. Kemudian, OKT telah menambah lagi tempahan selama dua hari iaitu sehingga 29.12.2023 dan seterusnya unit tersebut didiami oleh OKT sehingga 31.12.2023.

Maka, berdasarkan keterangan saksi-saksi di atas, fakta bahawa OKT telah menempah unit tersebut dari 22.12.2023 hingga 31.12.2023 dan disokong dengan keterangan bahawa OKT memegang kunci unit tersebut menunjukkan yang hanya OKT sahaja yang mempunyai akses ekslusif ke atas rumah tersebut dan dadah yang berada dalam rumah tersebut.

Dalam kes yang dibicarakan ini, OKT mempunyai pengetahuan berkenaan barang kes tersebut berdasarkan kepada perbuatan OKT itu sendiri sebagaimana berikut: i) OKT mengambil kunci dari poket seluarnya untuk membuka pintu kayu; ii) OKT menunjukkan plastik yang berada di atas lantai yang mengandungi dadah kepada SP5;

Perbuatan OKT yang dinyatakan di atas terjumlah kepada perbuatan selepas atau subsequent conduct di bawah seksyen 8 Akta Keterangan 1950.

Bagi pembuktian elemen mengedar, OKT dikatakan mengedar dadah berbahaya bersandarkan kepada anggapan pengedaran di bawah seksyen 37(da) Akta Dadah Berbahaya 1952 (ADB 1952).

OKT menafikan mempunyai pemilikan ke atas barang kes dadah melalui kawalan, jagaan dan pengetahuan. Oleh yang demikian, peruntukan anggapan pengedaran juga tidak terpakai atas kegagalan pihak pendakwaan membuktikan elemen pemilikan.

Terdapat kelompongan terhadap kes pendakwaan akibat daripada kegagalan pihak pendakwaan memanggil 2 orang saksi material iaitu B2 dan James untuk menyokong naratif kes pendakwaan.

Melalui soal balas terhadap SP1, SP2, SP3, SP5 dan SP6, adalah dihujahkan B2 telah meminta seorang pengawal keselamatan India bernama James untuk menyewa satu unit apartment di tempat kejadian.

Bayaran sewa unit apartment dibayar oleh B2 melalui James untuk dikemukakan kepada SP3 yang telahpun pulang ketika transaksi penyewaan unit apartment tersebut.

B2 merupakan kawan OKT yang telah meminta OKT dan Ho Chia Zhe (HCZ) untuk datang ke unit apartment tersebut untuk menyambut tahun baharu. HCZ bukannya rekaan pihak pembelaan kerana passport HCZ yang dijumpai di unit tempat kejadian telah dikemukakan di Mahkamah dan ditandakan sebagai eksibit D35.

OKT dikatakan mempunyai “momentary custody” kunci dan kad akses semasa ditangkap kerana kunci dan kad akses diberikan kepada OKT oleh B2.

Dadah yang dijumpai di tempat kejadian adalah milik B2 yang merupakan pengedar sebenar dan dadah di premis berkenaan dimiliki B2.

Sekiranya B2 dan James yang merupakan saksi material dipanggil ke Mahkamah, pihak pendakwaan dapat menyangkal versi pembelaan OKT dan menjawab beberapa persoalan mengenai penglibatan James dan B2.

Pihak pembelaan juga menghujahkan walaupun B2 dan James tidak dipanggil sebagai saksi, namun pihak pendakwaan sekurang-kurangnya mengemukakan rakaman percakapan B2 dan James di bawah seksyen 112 Kanun Prosedur Jenayah (KPJ) kerana B2 dan James telahpun disiasat oleh polis. Oleh itu, kegagalan memanggil B2 dan James telah menyebabkan kelompongan ke atas kes pendakwaan.

Selain itu, pihak pendakwaan juga gagal menawarkan B2 mahupun James kepada pihak pembelaan apabila menutup kes pendakwaan.

Pihak pendakwaan gagal membuktikan OKT mempunyai pemilikan ke atas eksibit barang kes dadah kerana pendakwaan gagal mengecualikan akses oleh pihak ketiga/HCZ yang mana passport HCZ berada di premis tersebut.

Pihak pendakwaan gagal membuktikan bahawa syarat untuk menerima keterangan yang menjurus kepada discovery barang kes dadah di premis tersebut tidak dipenuhi oleh pendakwaan.

Adalah menjadi prinsip undang-undang yang mantap beban pembuktian di akhir kes pendakwaan terletak di pihak pendakwaan yang mesti membuktikan suatu kes prima facie di bawah s.180 Kanun Tatacara Jenayah sebelum tertuduh dipanggil membela diri bagi menjawab pertuduhan tersebut.

Seksyen 180(1) Kanun Prosedur Jenayah memperuntukkan bahawa di akhir kes pendakwaan, Mahkamah hendaklah membuat suatu pertimbangan sama ada pihak pendakwaan telah berjaya membuktikan kes prima facie terhadap OKT. Seksyen 180(1) Kanun Prosedur Jenayah memperuntukkan: “Procedure after conclusion of case for prosecution.

(1) When the case for the prosecution is concluded, the Court shall consider whether the prosecution has made out a prima facie case against the accused.
2
If the Court finds that the prosecution has not made out a prima facie case against the accused, the Court shall record an order of acquittal.
3
If the Court finds that a prima facie case has been made out against the accused on the offence charged the Court shall call upon the accused to enter on his defence.
4
For the purpose of this section, a prima facie case is made out against the accused where the prosecution has adduced credible evidence proving each ingredient of the offence which if unrebutted or unexplained would warrant a conviction.”

Di dalam kes Mohamad Radhi Bin Yaakob v. Public Prosecutor [1991] 1 CLJ Rep 311, Mahkamah Agong telah memutuskan: "It is a well-established principle of Malaysian criminal law that the general burden of proof lies throughout the trial on the prosecution to prove beyond reasonable doubt the guilt of the accused for the offence with which he is charged. There is no similar burden placed on the accused to prove his innocence. He is presumed innocent until proven guilty. To earn an acquittal, his duty is merely to cast a reasonable doubt in the prosecution case. In the course of the prosecution case, the prosecution may of course rely on available statutory presumptions to prove one or more of the essential ingredients of the charge. When that occurs, the particular burden of proof as opposed to the general burden, shifts to the defence to rebut such presumptions on the balance of probabilities which from the defence point of view is heavier than the burden of casting a reasonable doubt, but it is certainly lighter than the burden of the prosecution to prove beyond reasonable doubt. To earn an acquittal at the close of the case for the prosecution under s. 173(f) or s. 180 of the Criminal Procedure Code, the court must be satisfied that no case against the accused has been made out which if unrebutted would warrant his conviction ( Munusamy v. PP). If defence is called, the duty of the accused is only to cast a reasonable doubt in the prosecution case. He is not required to prove his innocence beyond reasonable doubt".

Menyentuh isu yang sama, Gopal Sri Ram HMR (pada ketika itu) di dalam kes Looi Kow Chai & Anor v. Public Prosecutor [2003] 1 CLJ 734 telah menyatakan: "It therefore follows that there is only one exercise that a judge sitting alone under s. 180 of the Code has to undertake at the close of the prosecution case. He must subject the prosecution evidence to maximum evaluation and ask himself the question: If I decide to call upon the accused to enter his defence and he elects to remain silent, am I prepared to convict him on the totality of the evidence contained in the prosecution case? If the answer is in the negative then no prima facie case has been made out and the accused would be entitled to an acquittal".

Dalam kes Balachandran v. Public Prosecutor [2005] 1 CLJ 85; [2005] 2 MLJ 301 Mahkamah Persekutuan memutuskan: "[21] Section 180(1) makes it clear that the standard of proof on the prosecution at the close of its case is to make out a prima facie case while s. 182A(1) enunciates that at the conclusion of the trial the court shall consider all the evidence adduced and decide whether the prosecution has proved its case beyond reasonable doubt. The standard of proof on the prosecution at the end of its case and at the end of the whole case has thus been statutorily spelt out in clear terms. The submission made must therefore be ratiocinated against the background of the meaning of the phrase ' prima facie case ' in s. 180. Section 180(2) provides that the court shall record an order of acquittal if a prima facie case has not been made out while s. 180(3) provides that if a prima facie case has been made out the accused shall be called upon to enter his defence. A prima facie case is therefore one that is sufficient for the accused to be called upon to answer. This in turn means that the evidence adduced must be such that it can be overthrown only by evidence in rebuttal. The phrase 'prima facie case ' is defined in similar terms in Mozley and Whiteley's Law Dictionary 11th Ed as: A litigating party is said to have a prima facie case when the evidence in his favour is sufficiently strong for his opponent to be called on to answer it. A prima facie case, then, is one which is established by sufficient evidence, and can be overthrown only by rebutting evidence adduced by the other side. [22]...Since the court, in ruling that a prima facie case has been made out, must be satisfied that the evidence adduced can be overthrown only by evidence in rebuttal it follows that if it is not rebutted it must prevail. Thus if the accused elects to remain silent he must be convicted. The test at the close of the case for the prosecution would therefore be: Is the evidence sufficient to convict the accused if he elects to remain silent? If the answer is in the affirmative then a prima facie case has been made out. This must, as of necessity, require a consideration of the existence of any reasonable doubt in the case for the prosecution. If there is any such doubt there can be no prima facie case".

Selanjutnya di dalam kes Public Prosecutor v. Mohd Radzi Bin Abu Bakar [2006] 1 CLJ 457 di mana Mahkamah memutuskan seperti berikut: "[8] For the guidance of the courts below, we summarise as follows the steps that should be taken by a trial court at the close of the prosecution's case:
i
the close of the prosecution's case, subject the evidence led by the prosecution in its totality to a maximum evaluation. Carefully scrutinise the credibility of each of the prosecution's witnesses. Take into account all reasonable inferences that may be drawn from that evidence. If the evidence admits of two or more inferences, then draw the inference that is most favourable to the accused;

(ii) ask yourself the question: If I now call upon the accused to make his defence and he elects to remain silent am I prepared to convict him on the evidence now before me? If the answer to that question is 'Yes', then a prima facie case has been made out and the defence should be called. If the answer is 'No' then, a prima facie case has not been made out and the accused should be acquitted;
III
(iii) after the defence is called, the accused elects to remain silent, then convict;
IV
(iv) after defence is called, the accused elects to give evidence, then go through the steps set out in Mat v. Public Prosecutor [1963] MLJ 263.”

Dengan berpandukan kepada prinsip undang-undang kes di atas, adalah tugas Mahkamah ini membuat penilaian maksima ke atas keterangan saksi pendakwaan, dan dokumen-dokumen yang dikemukakan bagi menentukan sama ada pihak pendakwaan berjaya membuktikan semua intipati pertuduhan melalui keterangan saksi pendakwaan yang kredible bagi membuktikan suatu kes prima facie terhadap OKT. ANALISA DAN DAPATAN MAHKAMAH – DI AKHIR KES PENDAKWAAN

Tidak ada pertikaian mengenai identiti dadah berbahaya di dalam kes ini. Akan tetapi, pihak pembelaan menghujahkan terputusnya rantaian keterangan barang kes dadah di dalam kes ini.

Cabaran pihak pembelaan ialah barang kes di Mahkamah bukanlah barang kes yang dirampas di tempat kejadian memandangkan berdasarkan Borang Pol 31 (eksibit D36), barang kes dadah dikatakan dijumpai di dalam beg kain berzip sedangkan barang kes dadah dijumpai di dalam plastik berwarna biru. Rujuk gambar eksibit P16(1-6).

Penilitian Mahkamah ke atas Borang Senarai Geledah (eksibit P17) dan Borang Serah Menyerah (eksibit P18) dan laporan kimia SP4 yang ditandakan sebagai eksibit P8, Mahkamah ini merumuskan walaupun eksibit D36 menyatakan beg kain berzip, namun saksi-saksi pendakwaan dapat mengecam barang kes yang dirampas adalah sama dengan yang dikemukakan di Mahkamah dan barang kes dadah yang sama telah dianalisa oleh saksi pakar.

Oleh itu, Mahkamah ini membuat dapatan bahawa elemen pertama mengenai identiti dadah berbahaya telah dibuktikan. KEDUA – MILIKAN – JAGAAN, KAWALAN DAN PENGETAHUAN

Apa yang lebih kritikal di dalam kes ini ialah bagi Mahkamah ini menilai berdasarkan keterangan saksi pendakwaan dan bukti dokumentar sama ada OKT mempunyai pemilikan melalui jagaan, kawalan dan pengetahuan mengenai barang kes dadah berbahaya yang dijumpai SP5 di atas lantai di unit apartment tempat kejadian dan OKT mengedar barang kes dadah tersebut menurut peruntukan anggapan pengedaran di bawah ADB 1952.

Prinsip undang-undang berkaitan pembuktian elemen pemilikan adalah jelas dan Mahkamah ini merujuk kepada kes locus classicus Chan Pean Leon v PP [1956] 1 LNS 17 yang mana Thompson J memutuskan seperti berikut: “.... “possession” itself as regards the criminal law is described as follows in Stephen's Digest (9th Editio) 'A moveable thing is said to be in the possession of a person when he is so situated with respect to it that he has the power to deal with it as owner to the exclusion of all other persons, and when the circumstances are such that he may be presumed to intend to do so in case of need'. To put it otherwise, there is a physical element and a mental element which must both be present before possession is made out. The accused must not only be so situated that he can deal with the thing as if it belonged to him, for example have it in his pocket or have it lying in front of him on a table. It must also be shown that he had the intention of dealing with it as if it belonged to him should he see any occasion to do so, in other words, that he had some animus possidendi. Intention is a matter of fact which in the nature of things cannot be proved by direct evidence. It can only be proved by inference from the surrounding circumstances. Whether these surrounding circumstances make out such intention is a question of fact in each individual case. If a watch is in my pocket, then in the absence of anything else the inference will be clear that I intend to deal with it as if it were my own and accordingly I am in possession of it. On the other hand, if it is lying on a table in a room in which I am but which is also frequently used by other people then the mere fact that I am in physical proximity to it does not give rise to the inference that I intend to deal with it as if it belonged to me. There must be some evidence that I am doing or having done something with it that shews such an intention. Or it must be clear that the circumstances in which it is found shew such an intention. It may be found in a locked room to which I hold the key or it may be found in a drawer mixed up with my own belongings or it may be found, as occurred in a recent case, in a box under my bed. The possible circumstances cannot be set out exhaustively and it is impossible to lay down any general rule on the point. But there must be something in the evidence to satisfy the Court that the person who is physically in a position to deal with the thing as his own had the intention of doing so.” (penekanan diberikan)

Dalam hal berkaitan, Mahkamah ini menekankan prinsip undang-undang di dalam kes dirujuk telah diterimapakai di dalam beberapa kes, antaranya, Mahkamah Persekutuan di dalam kes Ibrahim Mohamad & Anor v. PP [2011] 4 CLJ 113 yang memutuskan - “The law is well settled that having only custody or control over the said drugs is insufficient to establish “possession”. The physical act of custody or control must be accompanied with evidence that the accused had knowledge of the said drugs. In the absence of any statutory presumption, knowledge has to be proved either by direct evidence or circumstantial evidence. Mere knowledge alone without exclusivity of either physical custody or control or both is insufficient in law to constitute possession, let alone trafficking. (See the case of Chan Pean Leon v. PP [1956] 1 LNS 17).” (penekanan diberikan)

Susulan itu, persoalan kepada Mahkamah ini ialah berdasarkan kepada prinsip undang-undang mantap tersebut, adakah OKT mempunyai pemilikan ke atas dadah sepertimana pertuduhan terhadapnya? KEGAGALAN PIHAK PENDAKWAAN MEMANGGIL SAKSI MATERIAL B2 (LEE KUAI FOO) DAN JAMES (PENGAWAL

Tempat kejadian adalah sebuah unit apartment (Airbnb) di bangunan Trefoil yang dikatakan disewa atas nama OKT dan barang kes dadah dijumpai di atas lantai di dalam unit tersebut.

Sandaran pihak pendakwaan bahawa OKT mempunyai kawalan dan jagaan serta pengetahun ke atas barang kes dadah apabila dikatakan terdapat bukti OKT telah menempah unit tersebut dari 22.12.2023 hingga 31.12.2023.

Kemudian, pihak pendakwaan selanjutnya menghujahkan OKT memegang kunci unit tersebut dan ini menunjukkan hanya OKT sahaja yang mempunyai akses ekslusif ke atas rumah tersebut bersandarkan kepada seksyen 8 Akta Keterangan.

Dalam hal ini, persoalan pokok kepada Mahkamah ini adalah sama ada hujahan pihak pendakwaan berasas dan mencukupi untuk membuktikan OKT mempunyai pemilikan ke atas eksibit barang kes dadah hanya bersandarkan kepada keterangan saksi SP5 yang menyatakan OKT menggunakan kunci yang dipegangnya untuk membuka unit yang disewa semasa ditahan tanpa bukti kukuh OKT tahu mengenai dadah yang dijumpai di unit tersebut.

Mahkamah ini berpandangan hala tuju kes pihak pendakwaan bersandarkan kepada siasatan polis yang tidak lengkap adalah pendekatan yang terlalu simplistik (simplistic approach) kerana OKT tidak ditangkap dengan barang salah. Oleh itu, pihak pendakwaan mempunyai beban yang berat untuk membuktikan OKT tahu mengenai dadah dijumpai di premis tersebut dan boleh melupuskannya apabila OKT kehendaki (is able to dispose the drugs as and when the need arises). Dalam erti kata lain, OKT mempunyai kaitan dan memiliki dadah tersebut.

Apa yang lebih kritikal dalam kes ini ialah pihak pendakwaan gagal mengambilkira B2 ditangkap bersama OKT ketika berada di lobi Bangunan Trefoil. Tambahan pula, pihak pendakwaan gagal menyangkal peranan pengawal keselamatan bangunan Trefoil bernama James yang menempah unit tersebut atas arahan B2 serta pihak pendakwaan gagal mengecualikan akses pihak ketiga ke atas premis tersebut kerana terdapat passport HCZ yang berada di dalam unit tersebut.

Mahkamah ini berpegang kepada prinsip undang-undang, antara lainnya, diputuskan oleh Mahkamah Rayuan di dalam kes PP v Salleh bin Zakaria & Anor [2010] 4 MLJ 25, Suriyadi HMR (ketika itu) memutuskan: “[12] With the rule against double presumption militating against the prosecution, much depends on direct evidence to establish the ingredient of possession, an ingredient that requires the successful establishment of the physical and mental elements. So where is the evidence that could prove beyond reasonable doubt that ingredient? Lord Wilberforce in Warner v Metropolitan Police Commissioner [1968] 2 All ER 356 on the issue of possession had opined that ‘the starting point will be that the accused had physical control of something — a package, a bottle, a container — found to contain the substance’. Can the court arrive at a finding of fact that the prosecution had established that physical control factor? [13] Let us scrutinise the evidence first as regards this ‘physical’ element ie whether the respondent at anytime had custody and control of the drugs found in the engine section and under the rear passenger seat. For clarification purposes, the term ‘physical’ does not mean that he must physically clasp the package or container that holds the drugs, but suffice that he knows where they are and can dispose of them whenever the need arises.” (penekanan diberikan)

Manakala pihak pembelaan mencabar dengan serius mengenai kunci unit tersebut dan menghujahkan bahawa unit apartment tersebut telah disewa oleh James yang disahkan oleh SP2/pengarah Yamada Holdings Sdn Bhd sepertimana dimaklumkan oleh SP3/pekerja Yamada Holdings Sdn Bhd kepada SP2.

Mahkamah ini juga mengambil perhatian akan cabaran pihak pembelaan mengenai pentingnya peranan James, yang bertindak sebagai orang tengah untuk urusan menyewa unit tempat kejadian atas arahan daripada B2.

SP3 juga merujuk James sebagai “customer”/pelanggan yang bertanyakan mengenai bilik kosong. Malahan, bayaran untuk tempahan bilik dibuat oleh James. Ini juga telah disahkan oleh pegawai penyiasat SP6 yang telah menyiasat James dan juga mengambil rakaman percakapan James.

SP3 menyatakan resit dikeluarkan atas nama OKT kerana IC OKT diberikan James semasa membuat tempahan bilik. Resit yang dikeluarkan hanya bagi tujuan rekod sahaja. Ia hanya akan diberikan apabila diminta.

Kedua-dua penama (B2 dan James) bukan rekaan pihak pembelaan melalui keterangan secara positif oleh saksi awam/SP3 dan saksi polis/SP6 yang telah mengambil rakaman percakapan mereka. Mahkamah ini berpandangan pihak pendakwaan sewajarnya mengemukakan bukti untuk mengenepikan atau menjawab cabaran-cabaran yang dibuat oleh pihak pembelaan.

Dalam hal ini, James dan B2 adalah saksi material di dalam kes ini dan pihak pendakwaan juga gagal menyatakan sebab mengapa kedua-dua penama tersebut tidak dipanggil sebagai saksi atau sekurang-kurangnya mengemukakan rakaman percakapan penama-penama tersebut yang boleh membuktikan kedua-duanya tidak ada kaitan dengan kes di hadapan Mahkamah ini.

Bahkan pihak pendakwaan selepas menutup kesnya hanya menawarkan kepada pihak pembelaan baki anggota serbuan yang tidak dipanggil sebagai saksi di peringkat pendakwaan. Mahkamah ini juga memerhatikan bahawa pihak pendakwaan juga tidak menawarkan mahupun James atau B2 kepada pihak pembelaan.

Mahkamah ini merujuk kepada kes Mahkamah Persekutuan Rosli bin Yusof v PP [2021] 4 MLJ 479 yang dirujuk oleh peguambela yang terpelajar yang menghujahkan bahawa kes yang dirujuk mempunyai fakta yang lebih kurang sama dengan kes di hadapan Mahkamah ini.

Di dalam kes yang dirujuk, Mahkamah Persekutuan telah menegur pihak pendakwaan yang membuat pendekatan untuk tidak memanggil saksi material dan ini boleh menyebabkann ketidakadilan kepada tertuduh dan Mahkamah menyatakan seperti berikut: [7] It is pertinent to note that after closing its case, the prosecution did not offer these arrestees/witnesses to the defence. The police also did not serve their statements to the defence pursuant to section 51A of the Criminal Procedure Code (“CPC”). The names of these witnesses do not appear in the Prosecution List of Witnesses (See “Lampiran A - Senarai Saksi Pendakwaan”, at page 39, Rekod Rayuan, Jilid 3(2)). ... [38] In our view, it is settled law based on the authorities cited to us by the learned counsel for the appellant in his submission that the prosecution has discretion whether to call any particular witness, but such discretion is subject to two limitations, viz (i) the discretion must be exercised with due regard to considerations of fairness and good faith; and
II
(ii) the witnesses who had been investigated by the police and from whom the statements have been recorded must be offered to the defence. ... [40] In our view, the objective of a fair trial requires the prosecutor to call the arrestees or at the very least Kamarul Hisham and the Thai national as witnesses unless there is some good reason not to do. The prosecution did not proffer any explanation for the non- calling of these witnesses. These witnesses are persons who had been arrested contemporaneous or in proximity to the arrest of the appellant and pursuant to the same investigation. (penekanan diberikan)

Mahkamah Rayuan juga baru-baru ini di dalam kes Santoshkumar Sukumaran v PP [2026] 4 CLJ 529 telah mengambil pendekatan yang sama sepertimana di dalam kes Rosli bin Yusof v PP (supra) dan memutuskan berikut: “[35] Returning to the present appeal, this court finds no plausible reason why the respondent failed to offer the arrestees to the appellant. Not only were they not produced and offered to the appellant, but their recorded statements were also not tendered so as to close any gaps in the discharge of the prosecution’s burden of proving its case beyond a reasonable doubt. We find that the appellant’s defence was undermined by the respondent’s failure and this led to a serious miscarriage of justice. To say that the arrestees could not do better than to improve the appellant’s seemingly already confused defence at the prosecution stage is to employ a tactic that spells unfairness. This court can do no better than to reiterate what the Federal Court expressed at the conclusion of its decision in Rosli Yusof: [46] Before parting, we consider it apposite to emphasise that a person’s right to defend himself or herself against a criminal charge includes the right to obtain and adduce other evidence in support of his or her defence. It is desirable in the interest of justice for the defence to obtain the fullest possible access to the facts relevant to the issue in the case. In this regard, the prosecution has a duty to make available to the defence witnesses who had been investigated by the police and from whom the statements have been recorded. This is, as we alluded to earlier, an important or vital corollary or element of an accused’s right to a fair trial.” (penekanan diberikan)

Mengambil pendekatan yang sama dengan keputusan mahkamah atasan dan disokong dengan keterangan SP6 yang mengakui apabila disoal oleh peguambela bahawa beliau telah mengambil rakaman percakapan B2. Apa yang menghairankan Mahkamah ini ialah bukan sahaja pihak pendakwaan gagal memanggil B2 ke Mahkamah sebagai saksi, malahan rakaman percakapan B2 juga tidak dikemukakan di Mahkamah untuk menguatkan naratif kes pihak pendakwaan dan juga B2 tidak ditawarkan sebagai saksi apabila pihak pendakwaan menutup kesnya.

Sekiranya B2 dipanggil sebagai saksi, B2 boleh menafikan atau mengesahkan isu-isu yang kritikal yang telah menjejaskan kes pendakwaan seperti berikut- • bahawa B2 yang menggunakan nama OKT untuk menyewa unit tersebut. • B2 yang mengajak OKT dan Ho Che Sze (yang mana passport beliau berada di premis) untuk datang ke unit tersebut bagi menyambut Tahun Baharu. • B2 mempunyai akses kepada unit tersebut dan meletakkan dadah berbahaya berkenaan di dalam unit tersebut. • B2 yang memberikan IC OKT kepada James untuk menyewa unit berkenaan bagi pihak B2. • B2 yang membayar sewa unit tersebut melalui James. • sama ada B2 adalah pengedar dadah sebenar di dalam kes ini. • Penglibatan James dan B2 dengan pengedaran barang kes dadah dalam kes ini.

Cabaran-cabaran yang dibuat oleh pihak pembelaan adalah berasas kerana B2 telah ditangkap bersama OKT. B2 ditahan reman sepertimana eksibit D33 dan kemudiannya dilanjutkan reman sepertimana eksibit D34. B2 telah dibebaskan dan hanya OKT dihadapkan dengan pertuduhan di Mahkamah ini.

Dalam konteks kes ini, adalah terang lagi bersuluh bahawa terdapat keterangan yang melimpah ruah dari saksi polis dan saksi awam yang mana Mahkamah ini berpandangan boleh menjurus kepada kaitan kes ini dengan saksi-saksi material, iaitu James dan B2.

Mengambil pendekatan yang sama sepertimana diputuskan oleh Mahkamah Rayuan melalui Augustine Paul J (ketika itu) di dalam kes PP v Ramli bin Shafie [2002] 8 CLJ 846 yang memutuskan: “I am aware that a suggestion put to a prosecution witness is not evidence. But it is an indication of the case to be advanced by the defence. However, as I said in PP v. Chia Leong Foo [2000] 4 CLJ 649 at p. 675: ... the prosecution is expected to negative in its case in chief the explanation that the defence could be expected to advance in answer to the allegations against it (see Evidence: Proof and Practice by Graham Roberts (1st edn) p.376) It is my view that the prosecution ought to have called DSP Tan Soon Fuan as a witness to negate the suggestion made. This is necessary at this stage of the prosecution case in view of the implication arising from the first question asked by PW4. If the doubt is not resolved the implication will remain as such and thereby affect the admissibility of the information. This is compounded by the fact that PW3, who, it must be noted, is a prosecution witness, said in her evidence that she had given prior information regarding the whereabouts of the drugs to Sjn Hasnan. Sjn Hasnan does in fact exist and is not a fictitious figure. If he had been called as a witness by the prosecution his evidence, if contrary to that of PW3, would have completely demolished her evidence. With that the significance of the evidence of DSP Tan Soon Fuan will also disappear. However, Sjn Hasnan was not called as a witness by the prosecution. The implication attached to the first question asked by PW4 therefore remains. The prosecution has failed to avail itself of available resources to dispel this notion.” (penekanan diberikan)

Atas kegagalan pihak pendakwaan memanggil James dan B2 sebagai saksi telah menyebabkan timbulnya beberapa persoalan yang tidak terjawab terhadap kes pendakwaan yang menyebabkan jurang yang besar di dalam kes ini. KEGAGALAN PIHAK PENDAKWAAN MENGECUALIKAN AKSES

Memandangkan barang kes dadah tidak dijumpai pada badan OKT, sebaliknya di lantai unit berkenaan, pihak pendakwaan mempunyai beban yang berat untuk membuktikan kawalan dan jagaan atas barang kes dadah oleh OKT dengan mengecualikan akses ke atas unit berkenaan oleh orang lain.

Dalam hal ini, SP6 bersetuju dengan soalan pihak pembelaan bahawa passport atas nama Ho Chia Zhe (HCZ) telah dijumpai di dalam unit tersebut. Rujuk eksibit D35.

SP6 juga bersetuju dengan cadangan pihak pembelaan memandangkan passport HCZ berada di unit tersebut, SP6 tidak dapat mengecualikan akses HCZ kepada bilik tersebut.

Mengambil pendekatan yang sama sepertimana diputuskan di dalam kes Ibrahim Mohamad & Anor v PP (supra), Mahkamah ini memutuskan beban pembuktikan untuk mengecualikan akses HCZ pada unit tersebut tidak terletak pada bahu pihak pembelaan. Akan tetapi, pihak pendakwaan mesti membuktikan pengecualian HCZ akses pada tempat kejadian.

Mahkamah ini mendapati sewajarnya SP6 menjalankan siasatan yang lebih lengkap kerana kes melibatkan jenayah yang serius dengan hukuman yang berat. Kegagalan pegawai penyiasat menjalankan siasatan yang baik telah memprejudiskan OKT. Sepertimana di dalam kes Magendran Mohan v PP [2011] 1 CLJ 805 yang mana Alauddin Mohd Sheriff PCA telah menyebut: [42] Before parting with the case, it is necessary to state that from the facts and circumstances of this appeal it would appear to us that the investigation had been somewhat shoddy. Undoubtedly, heinous crimes are committed under great secrecy and that investigation of a crime is a difficult and tedious task. At the same time the life and personal liberty of a citizen is a precious one guaranteed by art. 5 of the Federal Constitution and its deprivation shall be only in accordance with law. [43] Thus, before accusing an innocent person of the commission of a grave crime like the one punishable under s. 302 PC, an honest, sincere and dispassionate investigation has to be made and to feel sure that the person suspected of the crime alone was responsible to commit the offence. Therefore, greater care and circumspection are needed by the investigating agency in this regard. [16] With no evidence confirming the physical element especially with the respondent never on the wheel, the prosecution thus had failed to establish custody and control of the drugs. Tidak perlu untuk Mahkamah ini menghuraikan secara terperinci isu ini kerana SP5 tidak menafikan beliau gagal mematuhi peruntukan statutori menurut seksyen 37B ADB 1952 yang mana kata-kata amaran tidak diberikan. Oleh itu, OKT telah diprejudiskan akan haknya. Mahkamah ini merujuk kepada kes Ngu Chee Wui v PP [2015] 9 CLJ 562 yang mana Mahkamah atasan telah menekankan mengenai kata-kata amaran yang mesti dipatuhi menurut s. 37A ADB 1952 dan Mahkamah menyatakan seperti berikut: “[15] PW1 was cross-examined on this part of his testimony to which PW1 agreed with the suggestion by learned counsel for the appellant that the purpose of cautionary words to be administered to the appellant (or a suspect) was to alert the appellant to his right to remain silent. Therefore, in our view it is of extreme importance that the caution must be clearly understood by a suspect (in this case the appellant). The ideal situation is of course to read to the appellant the very words of caution that are stated in proviso
b
to s. 37A(1) of the Act.”

Lanjutan itu, apa-apa keterangan berkaitan eksibit barang kes dadah tidak diterima oleh Mahkamah. Rujuk PP v Tiong Wee Kiet [2018] 7 CLJ 716.

Berdasarkan kepada analisa di atas, Mahkamah ini membuat dapatan bahawa pihak pendakwaan telah gagal membuktikan pemilikan OKT melalui kawalan, jagaan dan pengetahuan ke atas barang kes dadah.

Sehubungan itu, Mahkamah ini memutuskan bahawa pihak pendakwaan gagal untuk membuktikan OKT mengedar atas sandaran pendakwaan kepada peruntukan anggapan di bawah seksyen 37(da) ADB 1952.

Berdasarkan kepada alasan di atas, Mahkamah ini memutuskan terdapat banyak persoalan yang tidak terjawab kesan daripada kelompongan dalam kes pihak pendakwaan yang menjejaskan kes pendakwaan dan pihak pembelaan telah berjaya membangkitkan keraguan terhadap naratif kes pendakwaan.

Mengambil pendekatan yang sama sepertimana diputuskan di dalam kes Mohamad Radhi bin Yaakob (supra) yang mana Mohamed Azmi SCJ di muka surat 171 menyebut: “To earn an acquittal, the court may not be convinced of the truth of the defence story or version. Raising a reasonable doubt in the guilt of the accused will suffice. It is not, however, wrong for the court to be convinced that the defence version is true, in which case the court must order an acquittal”

Mahkamah ini setelah membuat penilaian maksima ke atas keterangan saksi pendakwaan dan dokumen-dokumen yang dikemukakan memutuskan pihak pendakwaan telah gagal membuktikan kes prima facie terhadap OKT. Mahkamah memutuskan untuk melepas dan membebaskan OKT daripada semua pertuduhan tanpa OKT dipanggil untuk membela diri.
