A person who is required to undergo supervision by a Rehabilitation Officer under subsection (1), shall be deemed to have been placed under such supervision by virtue of an order made by a Magistrate under paragraph 6(1)(b) of the Drug Dependants (Treatment and Rehabilitation) Act 1983, and the provisions of that Act shall apply accordingly in relation to such supervision. (emphasis added) 14 [42] Thus, s. 31 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 must be read conjointly with ss. 38A and 38B of the Dangerous Drugs Act 1952. Therefore, the KKM Guidelines Bilangan 6/2002 which is formulated in line with both of the aforesaid Acts and therefore it has the force of law. [43] Similarly, the IGSO F103 was also formulated with its objective “bertujuan untuk memastikan segala tindakan ke atas orang-orang kenaan dilakukan mengikut peruntukan-peruntukan yang ditetapkan di bawah Akta ini.” This Act (Akta ini) refers to the Drug Dependants (Treatment and Rehabilitation) Act 1983. Therefore, arguably the IGSO F103, like KKM Guidelines Bilangan 6/2002, is also has the force of law, quite apart from acquiring its statutory power under s. of the Police Act 1967. [22] Di para 48, Mahkamah Rayuan mengingatkan bahawa Tertuduh telah hilang peluang mengenai ujian pengesahan penganalisaan kerana satu botol sahaja digunakan. Mahkamah Rayuan berkata: “[48] We were, however, in agreement with learned counsel that the appellant had lost the opportunity for a confirmation test as only one bottle of urine sample was collected from the appellant, whilst the IGSO F103 and KKM Guidelines Bilangan 6/2002 require two bottles of urine sample be taken. In the field of sports at international level, the taking of two bottles of urine sample from athlete or sportsman/sportswoman is consistent with the World Anti-Doping 15 Code. According to an article entitled “International Convention Against Doping In Sport” (http://www.unesco.org/new/en/ social-and-human-sciences/themes/anti-doping/international-conventionagainst-doping-in-sport/), it was written inter alia: Taking the sample The sample is then split between two bottles labelled A and B with a unique sample code number. The Doping Control Officer provides the athlete with instructions on how to inspect the sample collection kit, distribute the sample between the A and B bottles, secure the samples and complete the paperwork. The sample shipping All samples are sent to a WADA accredited laboratories.” [23] Mahkamah Rayuan juga memberi ingatan bahawa didalam kes ini Tertuduh telah juga dinafikan haknya dari segi undang-undang prosedur dengan kegagalan pihak berkuasa menggunakan 2 botol sampel. Mahkamah Rayuan menegaskan di para 50: “[50] The appellant was deprived of the procedural law which gives him of the right of a second test – confirmation test. The Magistrate and learned JC, by ruling that one bottle of the appellant’s urine sample was sufficient, was contrary to the IGSO F103 and the KKM Guidelines Bilangan 6/2002. The appellant, accordingly, did not have 16 a fair trial and arts. 5(1) and 8(1) were violated. The appellant did not get what the procedural law said he should get. He had lost a chance of being acquitted which was reasonably opened to him. Thus justice has been miscarried - commonly called “miscarriage of justice”. Justice is justice in accordance with law as enshrined in arts. 5(1) and 8(1) of the Federal Constitution. The High Court case of Australia in Mraz v. The Queen [1955] 93 CLR 493 was referred to by Gopal Sri Ram FCJ in Lee Kwan Woh, supra, where Fullagar J said at p. 514 in the following terms: … every accused person is entitled to a trial in which the relevant law is correctly explained to the jury and the rules of procedures and evidence are strictly followed. If there is any failure in any of these respects, and the appellant may thereby have lost a chance which was fairly opened to him of being acquitted, there is, in the eye of the law, a miscarriage of justice. Justice has miscarried in such cases, because the appellant has not had what the law says that he shall have, and justice is justice according to law. (emphasis added).” [24] Mahkamah ini telah mendengar rayuan ini dan membuat keputusan pada 5/4/2018. Keputusan kes Noor Shariful Rizal telah diputuskan pada 22 Februari 2017. Justeru itu ketika keputusan kes ini dibuat, Mahkamah ini terikat dengan keputusan Noor Shariful Rizal, dan telah melepas dan membebaskan Tertuduh memandangkan tidak ada undang-undang lain atau keputusan kes Mahkamah atasan lain yang memutuskan sebaliknya, atau mengatasi keputusan tersebut. 17 E. KESIMPULAN [24] Berdasarkan alasan-alasan di atas yang bersandarkan kepada keputusan kes Noor Shariful Rizal (supra), Tertuduh telah dilepas dan dibebaskan oleh Mahkamah ini. [25] Mengenai soalan undang-undang yang dikemukakan, ianya telah terjawab dengan keputusan kes Noor Shariful Rizal ini.
