Lampiran 4 adalah permohonan Perayu untuk lanjutan masa memfailkan rayuan terhadap keputusan Ketua Pengarah Tenaga Kerja bertarikh 8.5.2025. 2. Perayu telah memfailkan notis rayuan (Lampiran 1) terhadap keputusan tersebut pada 26.5.2025 3. Setelah meneliti suratcara dan hujahan kedua pihak, Mahkamah menolak Lampiran 4. Berikut adalah alasan untuk keputusan tersebut. Latar belakang 3. Responden telah memfailkan suatu tuntutan terhadap Perayu di Pejabat Tenaga Kerja di Cyberjaya. Tuntutannya telah dibicarakan pada 8.5.2025 tanpa kehadiran Responden. 4. KPTR telah memutuskan untuk membenarkan tuntutan Responden dan mengarahkan Perayu membayar Responden RM7,819.53 untuk baki gaji dan gaji ganti notis. Lampiran 4 5. Perayu menyatakan mereka melantik peguam pada 21.5.2025 untuk merayu keputusan tersebut. Peguam itu keliru berkenaan di mana notis rayuan itu perlu difailkan dan ini menyebabkan notis rayuan mereka difailkan 4 hari di luar masa. 6. Perayu menyatakan mereka akan diprejudiskan jika tidak dibenarkan merayu keputusan tersebut dan kelewatan itu tidak terlampau. Perayu memohon Mahkamah menggunakan budibicaranya demi keadilan untuk mengatasi kelewatan tersebut agar mengutamakan merit rayuan mereka. 7. Responden membantah kepada Lampiran 4 kerana alasan kelewatan Perayu tidak munasabah. Dengan merujuk kepada A.55A Kaedah-Kaedah Mahkamah Tinggi 2012 (KM), Responden mempertikaikan cara Perayu membawa rayuannya ke Mahkamah Tinggi. Dapatan Mahkamah Mod rayuan 8. Ada 2 peruntukan dalam KM yang menetapkan prosidur untuk membawa sesuatu rayuan ke Mahkamah Tinggi yakni (i) A.55 berhubung rayuan dari Mahkamah Rendah; dan (ii) A.55A berhubung rayuan di bawah undang-undang bertulis. 9. Untuk rayuan dari Mahkamah Rendah, A.55 k.3(1) KM memperuntukkan perbicaraan hendaklah sebahagian besarnya dalam Borang 111 dan hendaklah difailkan di Mahkamah yang daripadanya 10. Untuk rayuan di bawah undang-undang bertulis, A.55A k.1(1) KM memperuntukkan -mana undang-undang bertulis, suatu rayuan dibuat daripada apa-apa keputusan mana-mana orang atau kumpulan orang kepada Mahkamah Tinggi, rayuan itu hendaklah dibuat ke Mahkamah Tinggi di Negeri yang keputusan itu diberikan melalui saman pemula yang menyatakan alasan rayuan dan disokong dengan suatu 11. Mahkamah ini mengambil maklum (i) keputusan Mahkamah Rayuan dalam kes Austral Amalgamated Tin Bhd v. Abdul Wahab Kopon & Ors & Anor Appeal [2004] 2 CLJ 316, di mana Nik Hashim HMR (pada ketika itu) memutuskan di 320 With regard to the second issue, we hold that the labour office is not a under the CJA. Section 28 of the CJA which deals with civil appeals from subordinate courts reads as follows: 28. Civil appeals from subordinate courts. (1) Subject to any other written law, no appeal shall lie to the High Court from a decision of a subordinate court in any civil cause or matter where the amount in dispute or the value of the subject-matter is ten thousand ringgit or less except on a question of law. Under s. 3(2) of the Subordinate Courts Act 1948 (Act 92), it is clearly specified that only the following courts are termed as subordinate courts, namely: (a) Sessions Courts; (b) Courts; and (c) in West Malaysia only, Courts. Labour office is not included in the said list. Thus, the labour office is not a court. The inquiry that was conducted by the senior labour officer in the present case is the inquiry by virtue of the powers under s. 69 of the EA given to the Director General of Labour to inquire into any dispute between an employee and his employer. It is only an inquiry and not a court proceeding. It is therefore erroneous to classify the labour office as an in the definition of under s. 3 of the CJA or a Labour Court as it is normally called, simply because the Labour Office is not a court in the first place ... ; dan (ii) hak merayu terhadap keputusan KPTR adalah di bawah seksyen 77 Akta Kerja 1955 (Akta 265); yakni suatu undang-undang bertulis. 12. Pada pandangan pertama, berdasarkan kedua perkara ini sahaja, nampaknya prosidur untuk sesuatu rayuan dari keputusan KPTR hendaklah menepati peruntukan A.55A KM. 13. Seksyen 77 Akta 265 memperuntukkan dissatisfied with the decision or order of the Director General under section 69, 69F or 73, or subsection 81D(4) such person may appeal to the High Court. (2) Subject to any rules made under section 4 of the Subordinate Court Rules Act 1955 [Act 55], the procedure in an appeal to the High Court shall be the procedure in a civil appeal from a Sessions Court with such modifications as the 14. Ini kerana seksyen 77 Akta 265 adalah peruntukan statutori sebstantif berbanding KM yang hanya berupa peraturan yang menetapkan prosidur. Seksyen 77 Akta 265 harus diberikan keutamaan. 16. Pandangan ini berdasarkan penghakiman Mahkamah Persekutuan dalam kes Yong Teng Hing v. Walton International Ltd; Pendaftar Cap Dagang, Malaysia (Interested Party) [2011] 7 CLJ 401, di mana Richard Malajum KHN memutuskan di 419 Meanwhile, there may be cases of appeals from tribunals considered by the High Court as appeals from the Subordinate Courts. In our view this is the exception to the general rule. Such approach was taken due to the clear provision in the legislations. An illustration for this can be found under the old s. 21(2) of the Accountants Act 1967 (since amended vide Act A1099). The old s. 21(2) of the Accountants Act 1967 stipulates that "the procedure governing such appeals to the High Court shall be the same as for appeals to the High Court from decisions of a Subordinate Court in civil matters." Thus in Abdul Halim Mohyiddin v. Malaysian Institute of Accountants (MIA) [2001] 5 CLJ 541 it was held that the appeal must be treated as if it were an appeal from the Subordinate Court under O. 49 of the SCR. In such instance we are of the view that the High Court is exercising its appellate jurisdiction and applying the exception rule. Similarly, in Lee Soo Chuan v. Lai Ah Yan & Anor [1972] CLJU 69; [1972] 1 LNS 69. Gill FJ in delivering the judgment of the former Federal Court held that "an appeal from the decision of a senior inspector of mines must be brought in the same way as a civil appeal from a sessions court or a magistrate's court, that is, in accordance with the procedure laid down in Order XXXIX of the Subordinate Courts Rules 1950 followed by the procedure contained in O. 59 rr. 1 and 2 of the Rules of the Supreme Court 1957." Again we would opine that in hearing the appeal the court there was exercising its appellate jurisdiction as the relevant legislation brought the matter within the exception rule. Clearly therefore that our courts in considering matters as the present case recognise that the provisions of the governing legislations dictate whether the general or the exception rule apply (penekanan saya) 17. Seksyen 77 Akta 265 adalah suatu pengecualian kepada peraturan umum. 18. Berdasarkan alasan ini, mahkamah tidak menerima hujahan Responden yang Perayu terkhilaf dalam mod memulakan rayuannya di Mahkamah Tinggi. Kelewatan memfailkan rayuan 19. Sesuatu rayuan ke Mahkamah Tinggi di bawah A.55 KM hendaklah dibawa dalam tempoh 14 hari dari tarikh keputusan. 20. Dalam konteks rayuan ini, tempoh 14 hari itu bermula pada 9.5.2025 dan berakhir pada 22.5.2025. Lampiran 1 yang difailkan pada 26.5.2025, 4 hari di luar tempoh tersebut. 21. Alasan Perayu untuk kelewatan ini adalah kerana mereka perlu melantik peguam, peguam menghadapi masalah memfailkan notis rayuan di pejabat KPTR dan kesuntukan masa. 22. Adalah menjadi undang-undang mantap bahawa dalam melaksanakan budibicara Mahkamah untuk sesuatu permohonan lanjutan masa, Mahkamah hendaklah menimbang tempoh kelewatan, alasan untuk kelewatan, merit rayuan dan prejudis kepada pihak yang lain. 23. Walaupun tempoh 4 hari bukan kelewatan yang melampau, namun hak Responden untuk mendapatkan penghakiman yang memihak kepadanya terjejas kelewatan ini. Kelewatan ini juga akan membawa kepada kelewatan proses pendengaran rayuan ini kelak. 24. Tiada apa-apa peruntukan yang mewajibkan notis rayuan perlu difailkan dengan menggunakan khidmat seorang peguam. Perayu mempunyai tempoh yang mencukupi untuk memfailkan rayuan dan kemudiannya melantik peguam jika perlu. 25. Mahkamah tidak dapat membuat apa-apa penilaian berkenaan merit rayuan Perayu kerana Perayu belum memfailkan rekod rayuan untuk rayuannya. 26. Secara keseluruhan, Mahkamah mendapati alasan-alasan lain Perayu juga tidak munasabah.
