Rayuan Jenayah No: P-05(M)-241-04/2018 1 DALAM MAHKAMAH RAYUAN MALAYSIA DI PUTRAJAYA [BIDANG KUASA RAYUAN] RAYUAN JENAYAH NO: P-05(M)-241-04/2018 ANTARA WAN MAZRI BIN PAK WAN TEH … PERAYU DAN PENDAKWA RAYA … RESPONDEN [Dalam Perkara Mahkamah Tinggi di Pulau Pinang Perbicaraan Jenayah No. 45A-6-02/2015 Antara Pendakwa Raya Lawan Wan Mazri bin Pak Wan Teh] KORAM: KAMARDIN HASHIM, HMR RHODZARIAH BUJANG, HMR MOHAMAD ZABIDIN MOHD DIAH, HMR Rayuan Jenayah No: P-05(M)-241-04/2018 2 PENGHAKIMAN MAHKAMAH [1] Perayu telah dipertuduhkan dan dibicarakan di hadapan Pesuruhjaya Kehakiman Mahkamah Tinggi Pulau Pinang (‘hakim bicara’) dengan satu pertuduhan bagi satu kesalahan memperedarkan dadah berbahaya di bawah seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 (‘Akta’) yang membawa hukuman mati mandatori. [2] Butir-butir pertuduhan terhadap Perayu adalah seperti berikut: “Bahawa kamu pada 11.5.2014 jam lebih kurang 1.30 pagi, di alamat 1394 MK 9, Kampung Sulup, Teluk Kumbar, 11920 Bayan Lepas di dalam Daerah Barat Daya, di dalam Negeri Pulau Pinang telah mengedar dadah berbahaya jenis Cannabis seberat 1447.54 gram. Oleh itu, kamu telah melakukan kesalahan di bawah seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah seksyen 39B(2) Akta yang sama.” [3] Di akhir perbicaraan, hakim bicara telah mensabitkan kesalahan Perayu dengan pertuduhan dan telah menjatuhkan hukuman mati ke atas Perayu. Terkilan dengan sabitan dan hukuman tersebut, Perayu telah merayu ke Mahkamah ini. [4] Kami telah mendengar rayuan Perayu dan di akhir pendengaran, kami telah dengan sebulat suara menolak rayuan Perayu. Kami kemukakan alasan-alasan penolakan rayuan Perayu seperti berikut. Rayuan Jenayah No: P-05(M)-241-04/2018 3 Kes Pendakwaan [5] Secara ringkasnya, fakta kes pendakwaan adalah seperti yang berikut. Pada 11.5.2014 jam lebih kurang 1.30 pagi, bertindak atas maklumat, Inspektor Mohd Kamal bin Abdul Wahab (SP4) telah mengetuai satu pasukan serbuan dari IPD Barat Daya telah pergi ke sebuah rumah di alamat No. 1394, Kampung Sulup, Teluk Kumbar (‘rumah tersebut’). Sesampai di rumah tersebut, SP4 telah mengarahkan anggota pasukan serbuannya mengepung rumah tersebut dan telah membuat pemerhatian. Sepanjang pemerhatian, tiada pergerakan orang keluar masuk. [6] SP4 kemudian telah mengetuk pintu hadapan dan seorang lelaki yang kemudiannya dicamkan sebagai Pak Wan Teh bin Othman (SP6) telah membuka pintu. Setelah memperkenalkan diri dan menyatakan tujuan kedatangannya, SP4 dan anggota serbuan telah masuk ke dalam rumah tersebut untuk menjalankan pemeriksaan. [7] Setelah masuk, SP4 mendapati terdapat sebuah bilik di sebelah kanan pintunya dalam keadaan sedikit terbuka. SP4 dapat melihat seorang lelaki berbadan agak besar sedang berbaring di atas katil dalam bilik tersebut. SP4 terus masuk ke bilik itu dan membuat pemeriksaan fizikal terhadap lelaki itu dan tidak ada menjumpai sebarang barang salah pada badannya. Lelaki itu kemudiannya dicamkan sebagai Perayu, anak kepada SP6. SP4 dapat mencium bau ganja dalam bilik tersebut. [8] Seterusnya SP4 telah menjalankan pemeriksaan di dalam bilik di mana Perayu berada. SP4 telah menemui sebuah alat timbang (P24) terletak di atas kepala katil di mana Perayu berbaring. Di atas P24, SP4 Rayuan Jenayah No: P-05(M)-241-04/2018 4 menemui bahan-bahan tumbuhan kering disyaki ganja (P23A) yang dibungkus dengan plastik lut sinar. [9] Pemeriksaan di dalam almari pakaian yang terdapat dalam bilik yang sama, SP4 telah menemui dua (2) ketulan mampat bahan tumbuhan kering disyaki ganja (P18A dan P20A) berbalut plastik lut sinar (P18 dan P20). [10] Dalam bilik yang sama, SP4 turut menemui dan merampas satu bilah pisau (P25), satu peket plastik lut sinar mengandungi peket-peket plastik lut sinar kosong (P26), satu bil Astro atas nama Perayu (P32), satu bil dari Bank CIMB atas nama Perayu (P33), sehelai baju berwarna merah tertulis ‘Property of Southern California Trojans’ (P27) dan sehelai seluar berwarna biru bersaiz 44 (P28). [11] Perayu terus ditangkap dan dibawa balik ke IPD Barat Daya bersama dengan barang-barang kes yang dirampas. Setelah segala proses dokumentasi selesai, Perayu dan barang-barang kes telah diserahkan oleh SP4 kepada pegawai penyiasat, Inspektor Mohd Sahizal bin Ahmad Zaki (SP7) untuk tindakan lanjut. [12] Pada 14.5.2014 jam lebih kurang 3.30 petang, SP7 telah menyerahkan barang-barang kes iaitu bahan tumbuhan kering P18A, P20A dan P23A kepada ahli kimia, Kalaivaani a/p K. Balachandran (SP3) untuk dianalisis. Selepas menjalankan pemeriksaan dan analisis, SP3 mengesahkan bahan-bahan tumbuhan kering tersebut mengandungi dadah berbahaya jenis Cannabis dengan jumlah berat 1447.54 gram, hal perkara dalam pertuduhan. SP3 turut mengesahkan Cannabis seperti yang ditakrifkan dalam seksyen 2 Akta. Rayuan Jenayah No: P-05(M)-241-04/2018 5 [13] Di akhir kes pendakwaan, hakim bicara telah berpuas hati semua inti pati pertuduhan telah berjaya dibuktikan oleh pihak pendakwaan terhadap Perayu pada tahap kes prima facie. Hakim bicara menerima keterangan SP3 mengenai jenis dan berat dadah Cannabis yang dipertuduhkan. SP3 tidak dicabar terhadap kepakaran dan keterangannya oleh pihak pembelaan. [14] Hakim bicara turut menerima keterangan SP4 mengenai penemuan dan rampasan barang kes dadah dari dalam bilik yang dihuni oleh Perayu. Hakim bicara juga menerima keterangan dari ibu Perayu, Maznah binti Ariffin (SP5) bahawa bilik di mana Perayu berada dan ditahan oleh SP4 adalah didiami oleh Perayu. Perlakuan Perayu yang marah apabila barang kes dadah ditemui telah diterima di bawah seksyen 8 Akta Keterangan 1950 oleh hakim bicara. Berdasarkan kepada kelakuan Perayu, fakta Perayu seorang sahaja menghuni bilik tersebut dan fakta kedekatan barang kes terutama ganja yang dalam keadaan terdedah di atas kepala katil, serta bau ganja yang menyelubungi bilik tersebut, hakim bicara membuat dapatan melalui inferen yang munasabah bahawa Perayu memiliki dan mempunyai pengetahuan secara langsung terhadap dadah yang dipertuduhkan. [15] Untuk elemen pengedaran, hakim bicara mengguna pakai anggapan di bawah seksyen 37(da) Akta berdasarkan kepada berat dadah yang terlibat. Perayu dianggap memiliki dadah berbahaya tersebut untuk tujuan diperedarkan sehingga dibuktikan sebaliknya atas bebanan imbangan kebarangkalian. Rayuan Jenayah No: P-05(M)-241-04/2018 6 [16] Setelah berpuas hati atas penilaian maksima bahawa satu kes prima facie telah berjaya dibuktikan terhadap Perayu, hakim bicara telah memerintahkan Perayu untuk membela dirinya atas pertuduhan. Hakim bicara adalah betul dalam membuat dapatannya memerintah Perayu untuk membela diri atas pertuduhan. Pembelaan Perayu [17] Perayu memberi keterangan secara bersumpah. Hanya Perayu seorang memberi keterangan untuk kes pembelaan. Secara ringkasnya pembelaan Perayu ialah bahawa pada malam kejadian dia pergi makan tengah malam (supper). Sekitar jam 1.00 pagi dia menerima panggilan telefon daripada bapanya, SP6 yang meminta dia untuk segera pulang ke rumah tersebut. Apabila dia sampai, pasukan serbuan polis telah sedia berada di rumahnya. Pegawai polis kemudian terus menangkapnya dengan memberitahu dia ditangkap kerana memiliki dadah berbahaya. Perayu menyatakan bahawa pasukan polis langsung tidak ada memeriksa bilik dan rumahnya. [18] Perayu menyatakan terdapat 7 buah bilik dalam rumah tersebut. Perayu menyatakan dia tinggal dalam sebuah bilik di bahagian belakang rumah tersebut. Perayu menafikan dia tinggal dalam bilik seperti ditunjukkan dalam gambar P8 (16-17) di mana ganja kononnya telah ditemui. Perayu menyatakan bilik itu didiami oleh kakaknya yang bernama Wan Mazrina binti Pak Wan Teh. [19] Perayu turut menyatakan bahawa selain Wan Mazrina, ahli keluarganya yang lain turut masuk dan ‘lepak’ dalam bilik di mana dadah Rayuan Jenayah No: P-05(M)-241-04/2018 7 dirampas. Perayu juga menyatakan barang-barang kes dadah dan lain-lain barang yang dirampas bukan kepunyaannya. [20] Setelah meneliti dan memperhalusi pembelaan Perayu, hakim bicara membuat dapatan bahawa pembelaan telah gagal untuk mematahkan anggapan pengedaran atas imbangan kebarangkalian. Hakim bicara seterusnya mendapati pembelaan Perayu telah gagal untuk menimbulkan sebarang keraguan yang munasabah terhadap kes pendakwaan. Pendakwaan sebaliknya telah berjaya membuktikan pertuduhan terhadap Perayu melampaui sebarang keraguan yang munasabah. [21] Perayu telah didapati bersalah, disabitkan dengan pertuduhan dan dijatuhkan dengan hukuman mati. Oleh itu, rayuan Perayu di hadapan kami. Rayuan Perayu [22] Di hadapan kami, peguam bela terpelajar telah menghujahkan dua alasan rayuan berikut:
a
(a) satu kes prima facie telah gagal dibuktikan terhadap Perayu atas pertuduhan yang dihadapkan: dan
b
(b) telah berlaku satu kegagalan keadilan terhadap Perayu apabila hakim bicara tidak membenarkan peguam bela Perayu untuk berhujah di akhir kes pembelaan. Rayuan Jenayah No: P-05(M)-241-04/2018 8 Dapatan dan Keputusan Kami

(a) Kes prima facie [23] Bantahan peguam bela terpelajar atas isu ini ialah atas dua alasan, iaitu, pertamanya kerana kegagalan pihak pendakwaan untuk memanggil Wan Mazrina sebagai saksi, dan keduanya elemen pengetahuan Perayu terhadap dadah yang dipertuduhkan telah gagal dibuktikan. [24] Pembelaan Perayu mendakwa bilik di mana dadah dirampas dihuni oleh Wan Mazrina. Pada peringkat awal kes pembelaan, peguam bela terpelajar menyatakan kepada Mahkamah bahawa pihak pembelaan akan memanggil penama itu sebagai saksi untuk pihak pembelaan. Walau bagaimanapun, sehingga akhir kes pembelaan, penama tersebut gagal dipanggil sebagai saksi untuk pembelaan atas alasan yang mereka sendiri mengetahui. [25] Dakwaan Perayu bahawa bilik itu dihuni oleh Wan Mazrina berdasarkan kepada penemuan satu hantaran perkahwinan yang tersimpan di bawah katil dalam bilik tersebut kononnya milik Wan Mazrina. Walaupun tidak dipertikaikan oleh saksi-saksi pendakwaan terutama ibu Perayu sendiri (SP5) bahawa hantaran perkahwinan itu milik Wan Mazrina, namun hantaran perkahwinan itu telah lama ditinggalkan di situ oleh Wan Mazrina sejak selepas anaknya itu berkahwin dan berpindah dari rumah tersebut untuk tinggal bersama dengan suaminya. [26] Isu mengenai Wan Mazrina dan hantaran perkahwinannya telah dipertimbangkan dan dijawab oleh hakim bicara dalam penghakimannya seperti berikut: Rayuan Jenayah No: P-05(M)-241-04/2018 9 “[68] The accused also said that the room where the dangerous drugs were found is not his room. However, during the prosecution’s case, the accused’s mother, PW5, had earlier confirmed that the room where the dangerous drugs were found is the accused’s room. It was also not the case for the defence that Wan Mazrina has just had her wedding ceremony at any time immediately before the arrest which may suggest that she occupied in the room. Even the accused himself says that his sister had married a long time ago and stayed at Balik Pulau together with her husband. [69] The presence of the decorated basked for bridal gifts or “hantaran perkahwinan” in itself without any clothes or other personal belongings of Wan Mazrina does not show that Wan Mazrina could be the occupier of the room where the accused was arrested. During cross-examination, the accused agrees with the suggestion by the learned DPP when shown photographs exhibit P8(6) to P8(22) that the photographs show the condition of his house when the raid was conducted. Looking at the photographs, especially exhibit P8(15) to P8(19), it is illogical to conclude that the room where the dangerous drugs were found may have been his sister’s room. The unkempt and sorry state of the room immediately dispels any reasonable inference which may be drawn that the room could be occupied by the accused’s sister and her husband.” [27] Kami bersetuju dengan dapatan hakim bicara tersebut. Bukan sahaja tidak terdapat tanda-tanda bilik itu dihuni oleh wanita kerana bilik tidak terurus, tiada apa-apa barangan milik seorang wanita malahan apa yang ditemui dalam bilik adalah pakaian dan dokumen peribadi milik Perayu. Selain itu keterangan SP5 turut menyatakan bahawa bilik itu didiami oleh Perayu. [28] Dakwaan Perayu bahawa dia tiada di dalam bilik itu semasa serbuan polis dan bahawa dia tinggal di dalam sebuah bilik di bahagian belakang Rayuan Jenayah No: P-05(M)-241-04/2018 10 rumah telah disangkal melalui keterangan SP5 yang menyatakan bilik dimaksudkan oleh Perayu di bahagian belakang sebenarnya dihuni oleh SP5 dan SP6 (bapa Perayu). Dakwaan ini telah diulas oleh hakim bicara dalam penghakimannya seperti berikut: “[67] The accused in his defence said that on the date in question, he was not arrested in the room where the dangerous drugs were found. Instead, he was not at home and only came back to the house when his father called him. This is directly opposite of the evidence of PW4 who said that when the raiding party raided the house, he found the accused inside the room and the dangerous drugs too were found inside the room. …….. [73] On the same breadth, I find that the accused’s version that he did not stay at the room where the dangerous drugs were found contradicts that of his own mother, PW5, who confirmed that the room was occupied by the accused. During the visit to the house, this Court too observed that the room at the back of the house near the kitchen which the accused said was his, was in fact occupied by his parents as related by the accused’s mother, PW5, during the prosecution’s case. [74] The accused’s version that he was not at home when the raid was conducted is also contradictory and took a direct collision course with the version presented by the prosecution. In fact, during cross-examination, the accused agrees with the suggestion of the learned DPP that he was arrested inside the room during the raid. In the absence of cogent evidence to suggest that police witnesses are not telling the truth, I am of the view that their evidence must be taken as credible in depicting the events which transpired. In the present case, there was no such suggestion put by the defence and I am entitled to hold that there was none.” Rayuan Jenayah No: P-05(M)-241-04/2018 11 [29] Kami sekali lagi bersetuju dengan dapatan hakim bicara mengenai isu ini. Dalam hal keadaan wujud pertentangan antara keterangan Perayu dengan keterangan SP4, hakim bicara telah lebih mempercayai keterangan saksi pegawai polis (SP4). Hakim bicara telah membuat penilaian dan membuat satu dapatan fakta serta dapatan mengenai kredibiliti saksi. Dalam keadaan sedemikian, kami tidak sewajarnya mengubah dapatan tersebut melainkan wujud satu keadaan yang bertentangan dengan keberatan keterangan yang berada di hadapan hakim bicara itu (perverse). Keadaan itu tidak berlaku dalam kes ini. [30] Mahkamah ini dalam kes Wan Amirul Mubin bin Wan Kamaruddin v. PP [2017] 1 LNS 1478; [2017] MLJU 1253; [2017] MLRAU 351 memberikan pandangan berikut: “It is unthinkable that PW4 had fabricated evidence in view of the complete absence of any evidence or allegation by the appellant that PW4 had made up a story regarding Exhibit P30. In fact, the appellant admitted during cross-examination that PW4, PW5 as well as PW7 had absolutely no reasons to lie about him. PW4 and PW5 were police officers who were merely performing their duties and they had no reasons to lie or to frame up the appellant whom they said they did not know. [30] It is significant to bear in mind that since both PW4 dan PW5, were merely carrying of their official duties at the relevant time, in law the court is entitled to presume that their official acts were regularly performed and prima facie they did so honestly and conscientiously. Section 114 illustration (e) of the Evidence Act 1950 in this regard provides that the court many presume that judicial and official acts have been regularly performed. In the case of PP v Dato’ Seri Anwar Ibrahim [2014] 4 CLJ 162, the Court of Appeal said Rayuan Jenayah No: P-05(M)-241-04/2018 12 “It must be borne in mind that s.114 illustration (e) of the Evidence Act 1950 provides that the court may presume that judicial and official acts have been regularly performed. In State of Punjab v. Rameshwar Dass [1957] Cri LJ 1630, the Punjab & Haryana Court held at p. 1631 as follows: It is well settled that prima facie the public servants must be assumed to act honestly and conscientiously. It would, therefore, be basically wrong, without other cogent ground to consider them as untrustworthy witness in respect of their activities in performance of their official duties merely because of their official status unless the evidence is considered to be suspicious and that the conviction of the accused cannot be sustained on the statements of the official witnesses. The presumption that a person acts honestly applied as much in favour of a police officer as of other persons, and it is not a judicial approach to distrust and suspect him without good grounds? [31] Accordingly, without cogent reasons that would allow us to hold otherwise, it would be manifestly wrong to consider PW4 and PW5 as untrustworthy witnesses in handling this case. In the end what we have before us is nothing more than the bare oral testimony which was a mere denial.” [31] Begitu juga dalam satu lagi nas yang turut dirujuk oleh hakim bicara, Nenggani Asmo v. PP [2013] 1 LNS 265; [2014] 1 MLJ 501; [2013] MLRAU 122, Mahkamah ini memberikan pandangan berikut: “Although the benefit of every reasonable doubt must be given to the appellant and cannot be withheld from her, the court must not entertain it on grounds which are fanciful or in the nature of speculation; it is based upon reason and common sense and cannot be illogical or irrational. The existence of reasonable doubt is dependent upon the totality of the Rayuan Jenayah No: P-05(M)-241-04/2018 13 evidence and on an examination of all the evidence in a fair and reasonable manner and not in isolation.” [32] Alasan kedua peguam bela terpelajar menghujahkan kes prima facie gagal dibuktikan ialah dakwaan bahawa Perayu tidak mempunyai pengetahuan terhadap dadah yang dipertuduhkan. Isu ini telah diulas oleh hakim bicara dalam penghakimannya: “Knowledge [48] It is trite that knowledge is a matter to be inferred from the surrounding circumstances. In the present case, PW5 confirmed that the first room on the right where the impugned dangerous drugs were found was the accused’s room. PW5 further confirms that the accused occupies the room. The cannabis (Exhibit P23A) wrapped with a piece of transparent plastic (Exhibit P23) found on the white weighing scale branded “Constant” (Exhibit P24) was situated at a very close distance with the accused and was not concealed from sight. The other two compressed blocks of cannabis (Exhibit P18A and Exhibit P20A) in their respective packages were found on the top rack of the wardrobe marked “Y” by PW4 on photograph Exhibit P8(22) in the accused’s room which in all probability points to the inference that the accused has knowledge of the impugned dangerous drugs. [49] I am of the considered view that the close proximity of the accused with the cannabis (Exhibit P23A) wrapped with a piece of transparent plastic (Exhibit P23) found on the white weighing scale branded “Constant” (Exhibit P24) and the fact that the wardrobe where the other two compressed blocks of cannabis (Exhibit P18A and Exhibit P20A) in their respective packages were found was also in a position close to the accused suggest a strong inference that the accused has the requisite knowledge of them. It is reasonable to infer that, being the sole occupier of the room, the accused had access to the wardrobe and must, in all Rayuan Jenayah No: P-05(M)-241-04/2018 14 probability, have knowledge of the impugned dangerous drugs placed in the wardrobe.” [33] Hakim bicara turut bergantung kepada kelakuan (conduct) Perayu yang marah-marah apabila dadah yang dipertuduhkan ditemui oleh SP4 dalam bilik tidurnya. Ini dapat dilihat dalam penghakiman hakim bicara yang bersandarkan kepada hujahan Timbalan Pendakwa Raya seperti berikut: “[12] The learned DPP contends that knowledge of possession of the impugned dangerous drugs on the part of the accused may be inferred from the following facts:
a
(a) PW5 confirms that the house was only occupied by PW5 herself, her husband, PW6 and the accused;
b
(b) PW5 confirms that the first room on the right where the impugned dangerous drugs were found was occupied by the accused and the state of the room was as shown in photographs Exhibit P8(13) to P8(21);
c
(c) some personal items belonging to the accused were also found in the room;
d
(d) during the raid, the compressed block of cannabis (Exhibit P18A) wrapped with white paper and a piece of transparent plastic (Exhibit P18) was found in close proximity with the accused and it was visible;
e
(e) the compressed block of cannabis (Exhibit P20A) wrapped with a piece of transparent plastic (Exhibit P20) and the cannabis (Exhibit P23A) were found at a distance of less Rayuan Jenayah No: P-05(M)-241-04/2018 15 than 1 meter from where the accused was lounging during the raid; and

(f) the accused must be inferred to have knowledge of the impugned dangerous drugs because of their close proximity with the accused and the fact that the room was occupied by the accused. [13] In support of his submissions on the issue of knowledge, the learned DPP relies on the cases of Chan Pean Leon v. PP (supra), Wong Nam Loi v. Public Prosecutor [1998] 1 CLJ 37; [1997] 3 MLJ 795; [1997] 2 MLRA 143; [1997] 4 AMR 3603, Basil bin Omar v. Public Prosecutor [2002] 4 CLJ 418; [2003] 1 MLJ 192; [2002] 2 MLRA 117; [2002] 4 AMR 4525, PP v. Abdul Rahman bin Akif (supra), Zulfikar bin Mustaffah v. PP [2001] 1 SLR 633 and Ramis a/l Muniandy v. PP [2001] 3 SLR 534. [14] The learned DPP also seeks to invoke the application of section 8 of the Evidence Act 1950 in respect of the conduct of the accused during the raid. According to PW4, the accused appeared angry when PW4 and his raiding party found the impugned dangerous drugs in the room. The learned DPP submits that based on the authority of Parlan bin Dadeh v. PP [2009] 1 CLJ 717; [2008] 6 MLJ 19; [2008] 2 MLRA 763 and Surentharan Selvaraja v. PP [2005] 2 CLJ 264; [2005] 1 MLRA 165, the conduct of the accused who appeared angry and agitated when the impugned dangerous drugs were found in the room during the raid are relevant considerations to infer knowledge of the accused of the impugned dangerous drugs.” [34] Kami menyetujui dapatan hakim bicara mengenai elemen pemilikan dan pengetahuan dan bahawa satu kes prima facie telah berjaya dibuktikan oleh pihak pendakwaan. Oleh itu tiada merit dalam hujahan peguam terpelajar mengenai alasan pertama rayuan Perayu. Rayuan Jenayah No: P-05(M)-241-04/2018 16

(b) Kegagalan keadilan [35] Untuk alasan rayuan kedua ini, peguam bela terpelajar menghujahkan bahawa telah berlaku kegagalan keadilan (miscarriage of justice) apabila Perayu tidak dapat berhujah di akhir kes pembelaan. Peguam bela terpelajar berpegang kepada keputusan dalam kes Charles Obasi lwn. PP [2018] 4 CLJ 32; Lee Kwan Woh v. PP [2009] 5 CLJ 631 dan Diana Nelson Tanoja v. PP [2010] 3 CLJ 1. [36] Peguam bela telah merujuk kepada seksyen 181 Kanun Prosedur Jenayah (Akta 593) mengenai hak Perayu untuk membuat hujahan di akhir kes pembelaan. Seksyen 181 memperuntukkan seperti berikut: “181. (1) When the accused is called upon to enter on his defence he or his advocate may then open his case, stating the facts or law on which he intends to rely and making such comments as he thinks necessary on the evidence for the prosecution. He may then examine his witnesses, if any, and after their cross-examination and re-examination, if any, may sum up his case: Provided always that if any accused person elects to be called as a witness, his evidence shall be taken before that of other witnesses for the defence: Provided also that any accused person who elects to be called as a witness may be cross-examined on behalf of any other accused person.

(2) The accused shall be allowed to examine any witness not previously named by him under the provisions of this Code if that witness is in attendance.” Rayuan Jenayah No: P-05(M)-241-04/2018 17 [37] Kami telah berpeluang meneliti rekod rayuan. Kami mendapati bahawa pada 5.2.2018, tarikh sepatutnya pihak pembelaan memanggil Wan Mazrina sebagai saksi terakhir pembelaan, peguam bela Perayu dan saksi tidak hadir. Hakim bicara telah memaklumkan bahawa pihak-pihak hendaklah berhujah sebaik sahaja pihak pembelaan menutup kes mereka. Di muka surat 171 Rekod Rayuan Jilid 2 mencatatkan: “Mahkamah: Kes ditetapkan untuk sambung bicara peringkat pembelaan pada 27.2.2018. Hujah di akhir kes pembelaan hendaklah dibuat pada tarikh yang sama. OTP dikeluarkan. t.t. (Dato Ahmad Shahrir bin Mohd Salleh) – 5/2/2018.” [38] Pada tarikh 27.2.2018, peguam bela sekali lagi tidak hadir dan telah mengemukakan sijil cuti sakit. Saksi Wan Mazrina juga gagal hadir. Hakim bicara telah menangguhkan sambung perbicaraan kepada 7.3.2018. [39] Pada tarikh 7.3.2018, peguam bela telah memaklumkan kepada Mahkamah bahawa saksi pembelaan Wan Mazrina tidak hadir dan peguam bela telah menutup kes pembelaan dan memohon tarikh lain untuk penghujahan. Permohonan penangguhan telah ditolak oleh hakim bicara. Walau bagaimanapun, hakim bicara telah membenarkan masa selama 30 minit untuk peguam bela bersedia dengan penghujahannya. [40] Walaupun telah diberikan masa 30 minit, apabila Mahkamah bersidang semula, peguam bela masih memohon tarikh lain untuk Rayuan Jenayah No: P-05(M)-241-04/2018 18 berhujah. Hakim bicara menolak permohonan tangguhan dan terus mendengar hujahan lisan oleh Timbalan Pendakwa Raya (‘TPR’). Selepas mendengar penghujahan TPR, hakim bicara memberi peluang kepada peguam bela untuk menjawab penghujahan yang disampaikan secara lisan oleh TPR namun peguam bela masih menyatakan bahawa dia tidak bersedia untuk menjawab hujahan TPR. Perbicaraan seterusnya ditetapkan pada 18.4.2018 untuk klarifikasi dan keputusan. Pada 18.4.2018, hakim bicara terus menyampaikan keputusannya mensabitkan Perayu dan menjatuhkan hukuman mati selepas mendengar pihak-pihak mengenai mitigasi dan hujahan pemberatan hukuman berlandaskan peruntukan hukuman di bawah seksyen 39B(2A) Akta. [41] Kami telah meneliti nas-nas yang dirujuk oleh peguam bela terpelajar. Nas-nas tersebut dapat dibezakan dengan kes rayuan di hadapan kami. Dalam kes Lee Kwan Woh (supra), hakim bicara langsung tidak memberikan peluang kepada Perayu untuk berhujah. Sebaik pihak pendakwaan menutup kes, hakim bicara dalam kes itu terus membuat keputusan bahawa wujud satu kes prima facie dan memerintahkan Perayu untuk membela diri. Kes di hadapan kami melibatkan keputusan di akhir kes pembelaan dan banyak peluang telah diberikan kepada peguam bela Perayu untuk mengemukakan hujahannya. [42] Begitu juga keadaan yang sama berlaku dalam kes Charles Obasi (supra). Dalam kes itu pihak pembelaan dan juga pihak pendakwaan langsung tidak diberi peluang untuk mengemukakan hujahan sama ada secara lisan atau bertulis di akhir kes pendakwaan. Ini jelas diihat di muka surat 37 penghakiman kes itu yang kami petik seperti berikut: Rayuan Jenayah No: P-05(M)-241-04/2018 19 “[25] Peguam bela yang bijaksana telah mengutarakan alasan utama bahawa anak guamannya telah diprejudis serta dinafikan hak untuk satu perbicaraannya yang adil (fair trial) apabila hakim bicara yang bijaksana tidak membenarkan pihak-pihak pembelaan dan pendakwaan untuk membuat hujahan sama ada secara lisan atau bertulis di akhir kes pendakwaan. [26] Peguam bela yang bijaksana mengadu bahawa kedua-dua pihak pembelaan dan pendakwaan tidak dipelawa untuk memberi hujahan secara lisan di akhir kes pendakwaan. Kedua-dua pihak juga tidak diberikan masa untuk memfailkan hujahan bertulis masing-masing. Kedua-dua pihak juga tidak diberi ruang untuk memfailkan serta mengemukakan hujahan bertulis walaupun mereka telah menyediakan hujahan bertulis masing-masing. Malah, menurut peguam bela yang bijaksana, hakim bicara tidak membenarkan kedua-dua pihak untuk berhujah selepas pihak pendakwaan menutup kesnya. Sebaliknya, hakim bicara yang bijaksana terus membuat keputusan seperti dizahirkan di ms. 17, jilid 2, rekod Rayuan (RR) seperti berikut: “Mahkamah: Maximum evaluation. Kedua-dua OKT dipanggil Bela Diri Sec. 39B(1)(a) ADB. SB pada 25, 26, 27/5/2016.” [43] Manakala dalam kes Diana Nelson Tanoja (supra), Mahkamah Persekutuan telah membuat keputusan bahawa tidak mandatori bagi hakim bicara untuk mendengar penghujahan pihak-pihak di akhir kes pembelaan. Kami petik penghakiman oleh Alauddin Mohd Sheriff, PCA (pada ketika itu) di muka surat 8 dan 9 seperti berikut: Rayuan Jenayah No: P-05(M)-241-04/2018 20 “[33] The next question we ask is whether the learned trial judge is obliged to hear submissions from counsel and DPP before he gives his decision? [34] In other words, is it mandatory for the learned trial judge to hear submissions before giving his decision? [35] In our judgment it is not mandatory for the learned trial judge to hear submission from learned counsel before giving his decision. [36] Section 181(1) of the Criminal Procedure Code provides: When the accused is called upon to enter his defence he or his advocate may then open his case, stating the facts or law on which he intends to rely and making such comments as he thinks necessary on the evidence for the prosecution. He may then examine his witnesses (if any) and after their cross-examination and re-examination (if any) may sum up his case …. (emphasis added). [37] The word ‘may’ indicates a discretion. Therefore it could be seen that submission at the end of the defence case is discretionary and not mandatory. Therefore the learned trial judge could if he wanted to, decide without having the need to hear submission from defence counsel. Submission is not evidence and hence the judgment is not defective. If the law categorically states that it is not mandatory for counsel to make submission, we can see no reason why it is mandatory for the learned trial judge to hear submission. What, if learned counsel chooses not to make submission? Is the learned trial judge still obliged to call upon learned counsel to make submission? If indeed the law intends that the learned trial judge should hear submission that it would say so in no uncertain terms. Rayuan Jenayah No: P-05(M)-241-04/2018 21 [38] Having perused the notes of evidence of the learned trial judge we observed that the learned trial judge did consider the submission of learned counsel (See pp. 140 – 144 of the Appeal Record Vol. 1). Thus, this fact lends credence to the date 18 January being a typographical error. [39] We therefore say that there is no basis for learned counsel for the appellant to allege that the learned trial judge has prejudge the matter even before submission is heard and that this has prejudice the rights of the appellant.” [44] Kami sebuat suara mendapati bahawa alasan rayuan kedua Perayu juga tidak bermerit. Kesimpulan [45] Atas alasan-alasan yang kami huraikan di atas, kami mendapati tiada sebarang merit dalam rayuan Perayu terhadap sabitan dan hukuman. Kami mendapati sabitan adalah selamat dan disokong oleh keterangan yang kukuh dan mencukupi. Rayuan Perayu ditolak. Sabitan dan hukuman Mahkamah Tinggi disahkan dan dikekalkan.
