PENTADBIR TANAH DAERAH RAUB … DEFENDAN-DEFENDAN 29/09/2022 17:01:24 CB-22NCvC-20-12/2021 Kand. 40 ALASAN PENGHAKIMAN [1] Di dalam kes ini Defendan Pertama dan Defendan Kedua memohon untuk Encik Wai Kaw Chai (En. K.C Wai) dari Tetuan K.C. Wai & Associates dihentikan daripada bertindak sebagai peguamcara Plaintif di dalam kes ini. Alasan permohonan ini bahawa bapa kepada Defendan Pertama dan Defendan Kedua iaitu En. Leong Kah Heng yang telah mengunjungi pejabat Tetuan K.C Wai & Associates dan bertemu dengan En. K.C Wai. Ini menurut Defendan telah menyebabkan En. KC Wai mungkin akan dipanggil sebagai saksi di dalam kes ini. [2] Hal ini telah dinyatakan di dalam affidavit sokongan oleh En. Leong Pui Wah di perenggan 6, 7, 8, 9 dan 10. Penyataan bahawa En. Leong Kah Peng itu telah bertemu dengan En. K.C Wai itu dinyatakan di perenggan 7 (b) affidavit jawapan Plaintif kepada pembelaan seperti berikut: “Pertemuan ini berlaku pada 20.07.2016 di mana pindahmilik hartanah tersebut atas kasih sayang telah dilakukan.” [3] Plaintif melalui affidavit jawapan yang diikrarkan oleh En. Wong Kuan Ying menyatakan bahawa En. K.C. Wai adalah saksi material adalah tidak benar disebabkan segala urusniaga berkenaan pindahmilik itu telah selesai. Pada perenggan 9(b), Plaintif mengatakan bahawa En. K.C Wai tidak berkepentingan, persendirian dan menjalankan tugasnya sebagai peguambela dan peguamcara secara professional. [4] Plaintif menyatakan bahawa tiada keterangan yang dikemukakan untuk menunjukkan bahawa En. K.C Wai tidak boleh bertindak secara professional dalam mewakili Plaintif di dalam kes ini. [5] Defendan Pertama dan Defendan kedua di dalam affidavit balasan di para 7 (iv) menegaskan bahawa tindakan En. K.C Wai mengendalikan kes ini akan memberi tanggapan akan wujudnya ketidakadilan. Analisa [6] Berdasarkan kepada affidavit-affidavit yang difailkan, Defendan-Defendan berhujah bahawa En. K.C Wai telah terlibat secara langsung di dalam urusan yang melibatkan harta tanah ini. Penglibatan beliau itu akan menyebabkan beliau adalah saksi material di dalam kes ini. Oleh itu beliau mempunyai percanggahan kepentingan di dalam kes ini jika terus mengendalikan kes ini. [7] Sebaliknya Plaintif menafikan bahawa En. K.C Wai tidak terlibat di dalam pengurusan harta tanah ini sebagai seorang peguam yang menjalankan tindakan yang sewajarnya kepada anak guam. Ia tidak akan menjejaskan kes ini atau menimbulkan percanggahan kepentingan. [8] Permohonan untuk dihentikan atau dilucutkan seseorang peguamcara dan peguambela daripada bertindak bagi pihak anak guam adalah sesuatu yang serius. Ia akan mencalarkan nama baik seorang peguam. Oleh itu penelitian yang mendalam perlu dibuat oleh mahkamah di dalam permohonan sedemikian. Pada hemat mahkamah sebarang keputusan di dalam permohonan sebegini tidak sewajarnya dikaitkan dengan tahap profesionalisme atau kelakuan seseorang peguambela dan peguamcara. Apa yang lebih penting ialah pertimbangan kepada keadilan dan kepentingan pihak-pihak di dalam sesuatu perbicaraan. Ini bagi memastikan perbicaraan itu dijalankan dengan adil selari dengan maksim keadilan hendaklah dilaksanakan dan tampak ia dilaksanakan. [9] Kaedah 28 Legal Profession (Practice And Etiquette) Rules 1978 menyatakan seperti berikut: “28 Advocate and solicitor not to appear in a case where he is a witness
a
(a) An advocate and solicitor shall not appear in Court or in chambers in any case in which he has reason to believe that he will be a witness in respect of a material and disputed question of fact, and if while appearing in a case it becomes apparent that he will be such a witness, he shall not continue to appear if he can retire without jeopardising his client's interests.
b
(b) An advocate and solicitor shall not appear before an appellate tribunal if in the case under appeal he has been a witness on a material and disputed question of fact in the Court below.
c
(c) This rule does not prevent an advocate and solicitor from swearing or affirming an affidavit as to formal or undisputed facts in matters in which he acts or appears.” [10] Mahkamah telah meneliti Legal Profession (Practice And Etiquette) Rules 1978 dan berpandangan bahawa ianya tidak mengikat mahkamah. Ini misalnya telah dinyatakan oleh Mahkamah Persekutuan dalam kes Dato' Sri Mohd Najib Hj Abd Razak v. PP & Other Appeals (No 2) [2022] 8 CLJ 378 seperti berikut: “[18] In this regard, we find r. 6(a) of the Legal Profession (Practice and Etiquette) Rules 1978 ('1978 Rules') most relevant. It stipulates thus: Rule 6. An advocate and solicitor not to accept brief if unable to appear

(a) An advocate and solicitor shall not accept any brief unless he is reasonably certain of being able to appear and represent the client on the required day. [19] Thus, where counsel has accepted a brief, he should be deemed as 'reasonably certain of being able to appear and represent the client on the required day'. The 1978 Rules also appear to recognise the general disposition of the courts in this country to disfavour adjournments unless cogent reasons are provided. The general rule is that counsel shall make every effort to be ready for trial (and we think by extension appeals) on the day fixed. See: r. 24(a) and (b) of the 1978 Rules. [20] The 1978 Rules are not, in a sense, binding on the courts. But they are nevertheless binding on members of the Bar who are obliged to comply with them. And they are indicative of the fact that any disciplined lawyer such as the counsel for the appellant would not have accepted a brief with dates already fixed for hearing unless he was prepared.” [11] Malahan dalam konteks Kaedah 28 Legal Profession (Practice And Etiquette) Rules 1978 ini mahkamah merujuk kepada kes Wee Choo Keong v. Public Prosecutor [1990] 3 CLJ Rep 346. Di dalam kes tersebut Hakim Wan Yahya menyatakan bahawa seperti berikut: “Rule 28 explained as "advocate and solicitor not to appear in a case where he is a witness' reads:

(a) An advocate and solicitor shall not appear in Court or in chambers in any case in which he has reason to believe that he will be a witness in respect of a material and disputed question of fact, and if while appearing in a case it becomes apparent that he will be such a witness, he shall not continue to appear if he can retire without jeopardising his client's interest. This section to my mind does not envisage that an advocate and solicitor is ipso facto excluded from appearing as such in Court, the moment he believes that he will be a witness. That ethical restriction will only arise if he is likely to be a witness of any material or disputed fact. Rule 28 is a rule of ethics and the Magistrate should not have applied it totally with the stringency of the force of law. In case like this the rule of common sense and fair play in keeping with our tradition of maintaining a fair and impartial adverserial system should be observed.” [12] Penyataan ini telah dipetik oleh Mahkamah Rayuan dalam kes Mirza Mohamed Tariq Beg Mirza Hg Beg v. Margaret Low Saw Lui & Ors [2009] 4 CLJ 303 seperti berikut “[21] Wan Yahaya J (as he then was) in the case of Wee Choo Keong v. Public Prosecutor [1990] 1 CLJ 1015; [1990] 3 CLJ (Rep) 346 in interpreting r. 28 of the Practice and Etiquette Rules held that the court should not apply the Rules with the stringency of force of law but rather should instead utilise the rule of common sense and fair play in keeping with the tradition of maintaining a fair and impartial adversarial system. [22] I whole heartedly agree with the observation by learned and well respected judge. In the present case, the potential witness rule can only arise in respect of the minutes. But, MRZ has no real involvement in the content of the minutes. It was recorded by Mr. Ragumaran. Hence, there is nothing useful that MRZ could add on to the minutes should she be called as a witness.” [13] Persoalan seterusnya yang perlu diteliti oleh mahkamah ialah adakah penglibatan En. K.C Wai dalam urusan berkaitan dengan hartanah tersebut akan secara automatik menyebabkan beliau tidak berkelayakan untuk mewakli Plaintif. Adakah transaksi-tansaksi yang melibatkan En. K.C Wai menyebabkan beliau akan menjadi saksi utama dalam tindakan ini. Jika ini berlaku maka sudah pasti En. K.C Wai mempunyai percanggahan kepentingan yang menyebabkan hilang kelayakan untuk mewakili pihak Plaintif. Bagi menjawab persoalan ini mahkamah perlu meneliti berdasarkan affidavit-affidavit yang dikemukakan sejauh manakah penglibatan En. K.C Wai dalam urusan yang melibatkan hartanah dalam kes ini. Ini adalah disebabkan fakta bahawa semata-mata En. K.C Wai terlibat di dalam kes tersebut tidak secara automatik menyebabkan beliau hilang kelayakan. Fakta bahawa beliau menjadi saksi dalam satu kes juga tidak boleh menjadikan beliau tidak layak. Apa yang menyebabkan hilang kelayakan ialah sekiranya terdapat kebarangkalian bahawa beliau akan menjadi saksi terhadap mana-mana fakta yang material ataupun fakta yang dipertikaikan. [14] Adalah jelas bahawa Kaedah 28 Legal Profession (Practice And Etiquette) Rules 1978 ini adalah bertujuan untuk mengelakkan daripada peguam yang terlibat dalam satu urusan yang melibatkan pertikaian pihak-pihak menghadapi dilema di dalam penentuan berkenaan dengan fakta-fakta yang dipertikaikan di dalam sesuatu prosiding. Ini adalah disebabkan fakta bahawa beliau mewakili sesuatu pihak yang mana beliau mempunyai pengetahuan dan mengetahui sesuatu fakta ia akan menjejaskan tahap profesionalisme beliau dalam mengemukakan kes kepada mahkamah yang mungkin akan terpengaruh dengan pengetahuan beliau berkenaan dengan fakta penting tersebut. Ia tidak sekali-kali berkaitan dengan kompetensi peguambela dan peguamcara tersebut tetapi ia lebih kepada isu halangan etika dan menjaga kedudukan dan kemuliaan profesion guaman. [15] Mahkamah merujuk kepada beberapa kes yang memutuskan bahawa fakta di dalam kes tersebut memberi asas kepada seseorang peguamcara dan peguambela itu hilang kelayakan untuk mewakili anak guamnya atau sebaliknya. Misalnya, di dalam kes Newlake Development Sdn Bhd v. Zenith Delight Sdn Bhd & Ors [2019] 1 LNS 974. Fakta di dalam kes tersebut dapat dilihat di perenggan 6, 7 dan 8 seperti berikut: “[6] On 4.4.2018, the appellant filed a second application [enclosure 228] on the basis of evidence discovered recently during the taking of evidence in the on-going criminal proceedings against the 3rd respondent. The new evidence was that Dato' Vijay Kumar was a co-signatory to the 2nd respondent's client account which was opened with CIMB Bank at Solaris Mont Kiara on or around 19.3.2009. [7] The 2nd respondent's client account required both the 3rd respondent and Dato' Vijay Kumar as signatories in order to operate the client account. This means that no cheque or money can be released from the said client account without the knowledge and consent of the 3rd respondent and Dato' Vijay Kumar. This was at a time when Dato' Vijay Kumar was a consultant at the 2nd respondent. [8] Dato' Vijay Kumar must therefore be taken to have direct knowledge of the disbursement of the missing deposit sum. The appellant did not know at the material time that Dato' Vijay Kumar was also a signatory to the 2nd respondent's office account.” [16] Dan mahkamah memutuskan seperti berikut: “[12] Having heard arguments by both sides, we allowed the appellant's appeal and set aside the order of the High Court. Enclosure 228 was allowed except that prayer (2) was varied in that Dato' Vijay Kumar was disqualified from representing the 1st and 4th respondents. [13] We accepted learned counsel for the appellant's argument that it will be difficult for Dato' Vijay Kumar to maintain his professional independence and to project a course of conduct that was compatible with the best interests of the administration of justice if he were to continue to act for 1st and 4th respondents in the present suit, given the fact that he was a co-signatory to the 2nd respondent's client account at all material times when the appellant paid the deposit sum of RM9,056,124.00 to the 2nd respondent.” [17] Seterusnya di dalam kes Tetuan Kumar Jaspal Quah & Aishah v. Far Legion Sdn Bhd & Anor [2007] 3 CLJ 230. Di dalam kes tersebut isu yang timbul adalah apabila kepentingan kewangan yang dimilik oleh firma guaman adakah mewajarkan untuk seseorang itu dihilangkan kelayakan untuk mewakili anak guam. Mahkamah telah memutuskan seperti berikut: “[21] In that case the Federal Court had held that the respondent by reason of r. 27(a), was prohibited from acting for her client, in view of the personal relationship and of her pecuniary interest over the matter there. Needless to say the facts of the above case are distinguishable to the current appeal as neither is there any personal relationship nor direct pecuniary interest between Messrs Chellam Wong and the respondents. [22] As mentioned above, a solicitor may at one point of time be called upon to give the solicitor's undertaking. He might be called upon to make a distinct promise to do a particular act, or sometimes in the course of its duties, eg, in a conveyancing transaction, find himself holding on to an original title, to be released only on the terms of the undertaking. Inevitably too these undertakings have fee factors attached to them. In other words that solicitor would have a pecuniary interest over that undertaking. Following the argument of the appellant in the current case, equally applicable in every case where an undertaking had been given, in which an advocate and solicitor would invariably be construed as being pecuniarily interested, such an approach would bring about absurd results. In fact adhering to the same reasoning, as the appellant had appeared in its firm's name, and is directly pecuniarily interested in the matter it should not appear before us as an advocate and solicitor representing the very firm in the first place. To agree with its view would result in great reluctance by solicitors in future to give any undertaking, in order to avoid being disqualified from representing their clients later, let alone witness an upsurge of applications by solicitors to be discharged in court.” [18] Oleh yang demikian dalam kes ini mahkamah juga perlu melihat apakah jenis tuntutan yang difailkan oleh Plaintif kepada Defendan-Defendan. Ia dapat dilihat di dalam penyataan tuntutan bahawa pindahmilik untuk hartanah tersebut yang bertarikh 08.01.2016 yang didaftarkan pada 01.08.2016 adalah tidak sah di sisi undang-undang. Persoalannya ialah adakah En. K.C Wai terlibat di dalam urusan pindahmilik tersebut. Berdasarkan kepada penyataan pembelaan di perenggan 7(b) Defendan menyatakan bahawa bapa mereka En. Leong Kah Heng telah pergi ke pejabat Tetuan K.C Wai & Associates dan berjumpa dengan En. K.C Wai pada 20.07.2016 iaitu sebelum daripada borang pindahmilik tersebut didaftarkan pada 01.08.2016. Pada masa yang sama terdapat juga satu laporan polis yang dibuat oleh En. Leong Kah Heng pada 20.07.2016 yang menyatakan bahawa dokumen hakmilik asal hartanah tersebut telah hilang dan tidak dapat dikesan. Ini berlaku pada hari yang sama En. Leong Kah Heng dikatakan pergi ke pejabat Tetuan K.C Wai & Associates. [19] Ini bermakna berdasarkan affidavit-affidavit yang dikemukakan En. K.C Wai mempunyai penglibatan di dalam urusan yang berkaitan dengan kes ini. Ia mendedahkan kemungkinan En K.C Wai akan dipanggil untuk menjadi saksi. Oleh itu demi keadilan dan memastikan perbicaraan adil dapat dilaksanakan maka adalah wajar untuk permohonan Defendan di Lampiran 17 dibenarkan. Bertarikh: 29hb.
