Section 52

(2)

The authority responsible for making appointments to any public office may appoint a person to act in that office during any period when the holder of the office is prevented from exercising his functions by sickness, absence or any other cause.

(3)

When the substantive holder of a public office is on leave of absence pending relinquishment of his office, it shall be lawful for another person to be appointed to be the substantive holder of the office.

(4)

Nothing in this section or in the other provisions of this

Division shall be construed as empowering any authority—

(a)

to make an appointment to a public office; or

(b)

to remove or suspend a public officer from office, otherwise than in accordance with the law for the time being regulating the public services.
