Section 52

Penalty for interference with marks

Any person who, without the authority of the local planning authority, wilfully destroys, damages, defaces, moves or otherwise interferes with any mark placed or set up for the purpose of indicating any level or direction necessary for the carrying out of the purposes of this Act commits an offence and on conviction—

(a)

is liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both; and

(b)

may, in addition to or in place of that penalty, be ordered to pay to the local planning authority a sum, recoverable as a fine, not exceeding three times the cost of repairing or re-emplacing the mark and of making any survey rendered necessary by the act in respect of which he is convicted.
