a network facility;

a network service; or

any other facilities and/or services which facilitate the provision of network services or applications services, including content applications services, shall be included in or removed from the access list.

The Commission shall determine that the recommended network facilities or class of network facilities or network service or class of network services be included in the access list, if it is satisfied that the access forum has consulted with persons who have an interest in the recommendation, and that not less than nine-tenths of the members of the access forum support the recommendation.

Notwithstanding Chapter 3 of Part V, the Commission is not required to conduct an inquiry before making a determination under section 55, if the determination relates to a recommendation made by the access forum under this section but nothing in this section shall prevent the Commission from conducting an inquiry if it deems it necessary.
