Section 52
(a)
for the reduction in the value of the goods resulting from the manufacturer’s failure, namely—
(i)
the reduction below the price paid or payable by the consumer for the goods; or
(ii)
the reduction below the average retail price of the goods at the time of supply, whichever price is lower;
(b)
for any loss or damage to the consumer resulting from the manufacturer’s failure, other than loss or damage through a reduction in the value of the goods, which is proved to be a result or consequence of the failure.
(2)
Where the consumer is entitled by an express guarantee given by the manufacturer to require the manufacturer to remedy the failure by—
(a)
repairing the goods; or

(b)
replacing the goods with goods of identical type, no action shall be commenced under paragraph (1)(a) unless the consumer has required the manufacturer to remedy the failure and the manufacturer has refused or neglected to remedy, or has not succeeded in remedying, the failure within a reasonable time.
